The Big 12 has fined Utah AD Mark Harlan $40K and publicly reprimanded him for his comments following Saturday’s Holy War matchup with BYU. Commissioner Brett Yormark: “Mark’s comments irresponsibly challenged the professionalism of our officials and the integrity of the Big 12 Conference. There is a right way and a wrong way to voice concerns. Unfortunately, Mark chose the wrong way. Accordingly, this violation warrants a public reprimand and financial penalty. The Big 12 Conference prioritizes professionalism, integrity, and fairness, and will continue to do so.” Harlan: “Last night following our game against BYU, I made clear my feelings related to the game officiating. However, I recognize that there are more appropriate times and avenues to express those concerns, and I accept the consequences of my decision. My comments came after having just left our team locker room where our student-athletes were hurting and upset. The University of Utah is proud to be a member of the Big 12 Conference and we look forward to working with our peers to continue to enhance the league. Florida Men’s Basketball HC Todd Golden will continue coaching the team while the school investigates allegations of sexual harassment and other misconduct, per The Athletic’s Matt Baker, who notes a “spokesperson for the athletic department released a statement Sunday saying Golden’s status is unchanged and that he’ll coach the team Monday night at home against Grambling State.” (link)

Kennyhertz Perry attorney Mit Winter says of Vanderbilt QB Diego Pavia’s lawsuit against the NCAA: “It’s always hard to predict how litigation will turn out, but Pavia’s lawsuit has a better chance of success than it would have had just a few years ago, based on courts’ recent willingness to find that NCAA rules violate antitrust law and with college athletes now able to argue they’re economically harmed by not being able to play (because of NIL compensation that comes along with playing).” Winter adds that “the big question will likely be whether the NCAA can show there are procompetitive justifications for limiting the number of years someone can be a college athlete. … Based on recent court decisions, and the evidence that’s been developed in those cases, that may be hard to do. If he’s given those two additional years, he’d presumably make a significant amount of NIL compensation during those two years.” (link, link)

Obviously, we would like to have someone with some marketing experience, to have someone who has a little bit of ticketing or sponsorship experience, someone who can really be creative. There’s a lot of new technology out there specifically in these types of roles, so being able to use technology in a creative way. But honestly, at the end of the day, having a good human who knows how to work with others and knows how to communicate and be reflective on their own work, but also others’ and also be able to lead people in a positive, effective way are really the intangibles I look for first. New Oral Roberts Deputy AD SJ Tuohy Q&As with the Daytona Beach News-Journal’s Chris Boyle about his extensive work in NIL, the challenges mid-major programs face in modern college athletics, how his work overseeing the UCF-focused Kingdom Collective has prepared him for his new role and more. On his decision to accept the post at ORU: “To me, it lines up with what I believe in. … I like the mission there. You want to be somewhere where they have won before and have shown that winning matters. They've gone to the Sweet 16 (in men's basketball) in the last couple years, and they went to the College World Series last year. It's a place that wins, but I also wanted to go somewhere I could make an impact. One of the biggest things about UCF is I felt like we were building something and stacking something in the Big 12 and trying to compete. I think Oral Roberts is the same way. You can make a pretty tangible impact and grow it; it's not just plug and play.” Tuohy also explains how overseeing a collective has prepared him for his Deputy AD role: “You're doing a lot of stuff, right? You're doing media outreach, you're doing fundraising, you're doing marketing, you're doing budgeting. It's very similar; it's obviously a smaller scale than what [UCF AD] Terry [Mohajir] does, or someone in the athletic department does. If you do one thing for a long time, you get good at that one thing. I think The Kingdom piece, you have to do a lot of different roles, which is good.” The biggest misconception regarding NIL’s role in recruiting, Tuohy explains, is that “negotiations are a super small piece of it. If you're trying to hit on what's wrong about the preconceived (notions) of negotiations, it's that the contracts aren't structured, or that it's the Wild West. Collectives are trying to clean things up with providing structure in those contracts. I think some of the transfer rules in the NCAA are the ones that really aren't.” Full interview. (link)

Indiana Football HC Curt Cignetti earned a $250K bonus for assuring the Hoosiers finish in the top six of the Big Ten standings. USA Today’s Steve Berkowitz notes Cignetti has now brought in $600K in bonuses to go with the automatic one-year contract extension and $250K raise, beginning next season. At present, the added season is scheduled to be worth $5.1M with at least $3.3M guaranteed. If the Hoosiers keep winning, he could pick up another $2.7M in bonuses. The next step would be $250K more if the team finishes second in the Big Ten. Oregon HC Dan Lanning also picked up a bonus for winning at least 10 games this season. Berkowitz: “This is the second consecutive season in which he has added a year to his contract, which calls for a $200K pay increase annually. Under the agreement, he can get this automatic extension three times. He and Oregon are now set to be together through Jan. 31, 2031. If the school fired him without cause, it would owe him all of the pay remaining under the deal (currently about $55M). If Lanning decides to terminate the agreement between now and the scheduled expiration date, he would owe the school $20M. Lanning would get a $250K bonus if the Ducks reach 11 regular-season wins and $250K more if they reach 12. He has additional amounts available for playing in, and winning, the Big Ten championship game and/or the College Football Playoff. He also can get a bonus based on team academics.” (link)

With a few exceptions, ESPN on-air talent has largely remained apolitical during Chairman Jimmy Pitaro’s tenure, and Puck’s John Ourand explains there are a couple reasons for this: “First, some of the more opinionated talent—including [Jemele] Hill, [Dan] Le Batard, and [Pablo] Torre—have all left the network. And after six years in charge, there’s no gray area surrounding Pitaro’s political philosophy. Everyone knows exactly what he expects of them. It’s a marked departure from the era of John Skipper, Pitaro’s beloved predecessor, who was professionally weaned at Rolling Stone and was much more comfortable with talent sharing their opinions. Skipper encouraged an environment where people could speak their minds, and hired people like Hill and Le Batard to do just that. Others point to the changing face of sports media, and a new era in which talent like [Pat] McAfee and Stephen A. [Smith] have YouTube shows or podcasts to share their extracurricular opinions. Furthermore, Skipper reigned during the peak talent era, when ESPN was in 100M homes. In those days, anchors were larger-than-life stars and often had the latitude to behave that way. Now, the company is regularly culling its rolls and the surviving denizens in Bristol are too world-weary or chilled by the broader industrial environment to dare speak their minds—and subsequently contemplate a future calling a Rutgers-Northwestern game on the Big Ten Network.” (link)

By the end of September, Nevada sportsbooks were up $80.9M, the most ever in a single month, and Westgate SuperBook EVP for Race & Sports Operations Jay Kornegay tells ESPN’s David Purdum that "between Weeks 2 and 3, we won almost every single game. I can't remember saying that ever." The NFL and college football accounted for $55.8M of the record, and bookmakers explain that while they had a good start to the college football season, the NFL’s 26 upsets were the catalyst for the record month. Kornegay: "When you start seeing the favorites losing outright, it compounds the recreational players' losses because not only do they love to play the perceived better team, but they also love to tease them and parlay them. And when you knock them out straight-up, it's beneficial to the bookmaker." Through September, Nevada sportsbooks were up $370.7M, on pace for the state's most lucrative year ever, but Circa owner Derek Stevens says: "When you have these big, big wins, if you're a bookmaker, you can't take that stuff too seriously and when you take these big losses, you got to continue to run the process. I just think that it was disproportional how it fell at the beginning of the year. October's been a pretty good players' month. November, I guess we'll see how things are going to play out." (link)

The Akron Beacon Journal’s Michael Beaven writes on the departure of Akron AD Charles Guthrie, points to an email sent by the university that includes, “The University of Akron and Director of Athletics Charles Guthrie have mutually agreed to part ways, effective immediately, to allow Guthrie to pursue another opportunity.” Beaven does not go on to detail the other “opportunity,” but does indicate Akron Chief Strategy Officer Matt Juravich is involved in assisting the athletic department with its leadership transition. Sportico’s Michael McCann dives into Vanderbilt Quarterback Diego Pavia’s lawsuit against the NCAA: as he pushes for another year of eligibility after spending the first two years of his college career at junior college New Mexico Military Institute. McCann: “Pavia is represented by attorneys Ryan Downton and Salvador M. Hernandez. U.S. District Chief Judge William L. Campbell, Jr and U.S. Magistrate Judge Alistair Newbern will preside over Pavia v. NCAA. The NCAA will have the chance to try to rebut Pavi’s arguments. The association could contend these rules facilitate important academic objectives in that they move college athletes toward graduation. The NCAA could also assert the rules promote competitive balance in that they help the NCAA oversee fair competition between member colleges. Further, the NCAA could insist that Pavia’s alleged harm is not imminent, since his case concerns his eligibility for 2025-26, and that the controversy does not yet warrant judicial intervention. [...] It’s become increasingly difficult for the NCAA to depict college sports as a product unique from pro sports and worthy of deference when faced with antitrust scrutiny. Judges have taken notice and ruled accordingly.” (link)

Big 12 Commissioner Brett Yormark on BYU’s ninth-place ranking in the first edition of the College Football Playoff polls this year: “I was a little surprised. I just want to make sure that people aren’t focused on the logo on the helmet, and they’re instead focused on the resume and how the team is performing. When you think about BYU specifically, I would say that they should have been a little higher (than No. 9 in the CFP rankings). BYU has two great wins against top-25 schools, and a really impressive one against SMU on the road that I was there for. But they have to continue to win and earn their way in, which I think they will. I have a lot of trust in the selection committee that (BYU will get the consideration it deserves). This was only the first week of rankings. I’m bullish on our conference and where our schools will land at the end of the regular season.” Yormark also believes it’s possible for the conference to still get two teams in the Playoffs. More. BYU went on to eke out a win in last night’s Holy War matchup against Utah, but a controversial penalty called against the Utes with less than two minutes left had Utah AD Mark Harlan none too pleased: “This game was absolutely stolen from us. We were excited about being in the Big 12, but tonight I am not. We won this game. Someone else stole it from us. I’m very disappointed. I will talk to the commissioner. This is not fair to our team. Embattled Florida Men’s Basketball HC Todd Golden says he is participating with the school's investigation while maintaining its confidentiality: “My family and I appreciate the support we have received and remain confident the university will continue its efforts to finish its review promptly.” Golden also said he has retained Turkel Cuva Barrios attorney Ken Turkel about a potential defamation case. San Diego State Women’s Volleyball defeated San Jose State last night 3-1 to move to 17-7 (9-5) as the third set included a group of fans chanting “No men in women’s sports.” More from the San Diego Union-Tribune’s Mark Zeigler: “The chanting increased in frequency and volume, particularly when (SJSU student-athlete Blair) Fleming was serving, until Dave Noll, SDSU’s associate athletic director for operations and events, climbed into the stands and spoke with them. It was preceded by the public address announcer reading the Mountain West’s fan conduct policy asking ‘all persons to please show respect for the opposing team, game officials and each other’ while warning that any acts ‘in conflict with good sportsmanship, safety and fair play are subject to ejection and prosecution.’ The interaction between Noll and Patrick Higuera, a fan from Oceanside wearing a white T-shirt with two pink Xs, grew heated and drew the presence of four police officers in the aisles. An SDSU fan briefly intervened in defense of Noll before police stepped between them. Noll left after several minutes, and the group stopped chanting.” (link)

CBS Sports’ Matt Norlander has more information on the in-air scuffle between Auburn men’s basketball student-athletes that had the pilot turn the plane around: “Auburn freshman Jahki Howard and senior Ja'Heim Hudson were the players involved in Friday physical altercation on the team plane. Both players did not travel for tonight's game against No. 4 Houston. Their status beyond this weekend is TBD.” Auburn prevailed 74-69 for the win. (link)

Texas Tech Football HC Joey McGuire sounds off on the officiating in the Red Raiders matchup against Colorado yesterday: “You know, the frustrating thing is we're sitting here, it's 41-27. It could have been a little bit closer, we give up that one right at the end on the turnover. We don't get in the end zone, fourth-and-1. But, I'll tell you this: It's 17-13, and we bring, it's third-and-seven, and we bring pressure. It's an incomplete pass. And when you watch that play, somebody tell me how you can call roughing the passer. … How you can no-call five obvious facemasks, one that was reviewed for targeting that wasn't called and then four others on the running back … It's tough for me to say too much, because it's 41-27 and I'll sound like I'm saying that ... In a game like this, we have to be better and I guarantee you Deion's going to sit there and say he has to be better, but the officiating has to be better at this level. I'm, I'm just frustrated and I hate it.” (link)

Former West Virginia Football Defensive Coordinator Jordan Lesley was arrested in Monongalia County early Saturday morning and booked in the North Central Regional Jail on a misdemeanor charge of domestic battery. Lesley was let go from the Mountaineers staff on October 29. His bail has been set at $5K. (link)

While the NCAA’s decision to lift its ban on CHL players playing college hockey “obviates the need for a court-ordered injunction, litigation over the ban could continue since money damages for economic harms already inflicted on players are also at stake.” Sportico’s Michael McCann is referring to a lawsuit filed by prospective student-athlete Rylan Masterson against the NCAA and 10 universities in a putative class action. The defenseman is ineligible to play DI hockey because he previously played in exhibition games for the OHL’s Windsor Spitfires. As reported previously, Masterson argues the NCAA and member schools violated antitrust law by conspiring to “boycott” him and similarly situated players. McCann: “Masterson’s lawsuit frames the ban as a relic from a bygone era. While the ban is predicated on the idea that CHL players are pro athletes and thus not amateurs, the NCAA has recently moved away from the amateurism model. … Meanwhile, the NCAA allows DI schools to play former pro hockey players from European teams even though they were pro athletes.” McCann adds: “The NCAA could reach a settlement with Masterson to address the alleged economic harm, but in the meantime will continue to defend itself in the litigation. On Nov. 1, the parties filed a joint status report in a New York federal district court saying they ‘are still in the process of attempting to resolve the issues’ at stake in the litigation and expressed they intend to file another joint status report by Nov. 15.” (link)

ESPN College GameDay personality Pat McAfee knows he’s not for everyone. A poll done last year by The Athletic revealed that nearly 50% of viewers didn’t like McAfee’s presence on College GameDay. This year, however, perceptions are shifting. Another Athletic survey shows McAfee’s appeal is growing among fans, even if opinions remain mixed. While 42.5% of viewers still aren’t on board, the number in support of McAfee has climbed to 37.7%, up from 30.1% last year. This survey drew over 3,700 participants, compared to 3,100 in 2023. The Washington Post’s Ben Strauss joins The Varsity podcast with Puck’s John Ourand to discuss Fox’s sports media strategy, the “rising drama surrounding beat reporters’ locker room access” and more. Regarding Fox’s decision to abstain from streaming, Strauss recalls seeing a college football promo touting that games on Fox were “easy to find, sort of a nod to where are you going to find the game on Peacock or ESPN+ or whatever? Come find the game on Fox, you know where it is, which is a pretty good ad campaign in 2024 where everybody's got six streaming services and can't bounce between channels. And just on the consumer side, we were sold the utopia of cutting the cord and I think if you talk to sports fans, people who still have their cable subscriptions are probably happier than people who don’t.” Strauss goes on to point out that there “does seem to be sort of a cruel irony here in that everybody went to streaming not worried about profits, sort of chasing Wall Street's approval however many years ago – go to streaming, that's where the future is, it doesn't matter how much money you lose. And then all of a sudden, a couple years ago Wall Street said, ‘Oh, wait a minute, why are you guys losing so much money?’ … All of a sudden, the whole trajectory of the industry changed…and now to see Wall Street sort of say, ‘Kudos, Fox, for your strategy’ is…remarkable to me.” Strauss observes that advertisers are particularly interested in sports given the stark political divide in the country. “To get to people outside of that is not the easiest, and I think sports is becoming a bigger part of culture. The fracture of media in Los Angeles and Hollywood has made athletes in some ways bigger celebrities than movie stars. … They’re not minting movie stars in the same way that they were when all the movies came out in theaters, so I do think sports has grown in its impact on culture, which gives its bigger platform to advertise to more people.” (link)
