Fordham began interviewing AD candidates late last month, according to CollegeAD, which reports the Rams have trimmed the list down to four finalists. The group, which reportedly interviewed in person last week, includes sitting ADs and Power 4 senior staffers. A decision could come by the end of the week. (link)

The appointment of U.S. Senator John Thune (R-SD) as Senate Majority Leader is “arguably [the NCAA’s] best-case scenario,” according to Sportico’s Daniel Libit, who points out: “Although Thune is not known to have explicitly endorsed [opposition to student-athletes being classified as employees], he seemed to signal support for it in an opinion piece…titled ‘The Opportunity to Play,’ in which he wrote of the importance in ‘safeguard(ing) the things that make college sports uniquely great.’” Libit also notes Thune and Senator Ben Cardin (D-MD) introduced legislation in 2022 that would “prohibit collectives and other outside organizations from offering tax write-offs to those who contributed money that ultimately went to pay college athletes. Thune framed the bill as an effort to ‘protect athletes’ and ‘strengthen NIL,’ although a logical consequence of such a measure would be to disincentivize donations to collectives.” Libit goes on to point out that Thune in 2021 voiced concerns about Congress’ involvement in solving the NCAA’s problems. “This is a complicated subject and one I really wish the NCAA would be able to figure out. There are some things the federal government does well and some things the federal government doesn’t do well, and this strikes me as something we may not do well.” (link)

The State of South Dakota in a new court filing has voiced its displeasure with House settlement, arguing that parties to the deal have not provided proper notice of it to state attorneys general, as required by federal law. USA Today’s Steve Berkowitz: “The specific point South Dakota is making is fairly technical, but keep in mind: The state, through its AG Marty Jackley, has filed a lawsuit in state court against the NCAA over the settlement. The NCAA has moved that suit to federal court, but the state is currently seeking remand back to state court.” (link)

The Pac-12 is “focused on media rights and then adding at least one more ‘all sports’ member,” according to JohnCanzano’s eponymous webmaster, who adds: “Beyond that, I wonder if Teresa Gould’s conference might kick the tires on Saint Mary’s as a possible basketball addition. Or maybe partner with the WCC on a scheduling alliance. That feels like it depends on feedback from potential media partners. The Pac-12 beefed up on basketball via expansion; is there a growing TV appetite for it? Saint Mary’s compares favorably with the stable of programs the Pac-12 recently added. The school casts a small footprint and doesn’t play football, but the Gaels have proof of performance on the basketball court relative to new-world Pac-12 members. … If potential Pac-12 media partners demonstrate more interest in basketball, the Gaels may make sense. Or maybe the Pac-12 gets Saint Mary’s in their basketball arenas via a scheduling partnership? Given that the Pac-12 was only lukewarm on adding Grand Canyon University, which eventually landed in the Mountain West, I’m curious to see how this unfolds.” (link)

Florida State AD Michael Alford during a booster town hall meeting presented slides about the Seminoles’ brand value and viewership ratings. According to Alford, FSU’s “viewership strength index” is tops in the ACC and would be third and fourth in the Big Ten and SEC, respectively. According to the presentation, FSU would average what appears to be 20% better viewership than Florida when playing the same opponents on the same TV channel. According to The Athletic’s Matt Baker, Alford also remarked that when the House settlement provides more of a level playing field in terms of player compensation, facilities will be something that matters more. Also from Alford: "In head-to-head competitions with common opponents, we actually have a better brand value than our counterparts in the middle of the state. It's something that we take a lot of pride in that we own the state of Florida when it comes to our brand, and the attention our brand receives when we play nationally and we play opponents from outside our region, there's a lot of interest." (link, link); Alford also noted during the meeting that despite the difficult football season, donor support continues to be strong. “We’ve had some very large gifts just this week.” Alford also noted the largest suites and luxury boxes in the renovated Doak Campbell Stadium will be sold out as soon as they became available and that ticket sales have exceeded projections throughout the process. “The people we have walked through the preview center with, sat down with, showed the options, shown why we’re doing this, shown comparisons to the marketplace, they understand. They understand the commitment to get this program back, and they understand that they’re part of the commitment to provide the resources for now and the future.” Alford declined to discuss the ongoing lawsuits with the ACC, including whether FSU is considering staying in the league for a larger portion of the revenue share, but told Warchant’s Ira Schoffel: “The brand is still the brand. Everybody I talk to in the country in this profession, whether it’s administratively or coaching-wise, all know we’re going to get this back. And they know it will be very quick. That is the sentiment across the country. Does it hurt us in our negotiations? Those are still ongoing. People understand Florida State. They understand this is a strange year. This is not the norm. People also anticipate us getting back very quickly.” (link)

UAB AD Mark Ingram Q&As with The Banner’s Steve Irvine and says when it comes to the House settlement the “best information that I've gotten on this, frankly, is from my peers in the SEC and the Big Ten because they seem to know a lot more than we know. How is that? Why is that? I'm not sure. But they seem to know a lot more about where this is and where it's headed than anybody else. Listening to them talk about their cost-containment things and hearing them with their budget figures versus ours, it’s an astonishing difference. … Hearing that from them, now we have to go and formulate a plan on how we could do that. The best way I can describe it is that it's like Good Will Hunting. They've already got it on the board and are sketching it out. And we don't even know what the math problem is yet. And by we, I don't mean UAB, I mean our conference and Group of 5.” Regarding the potential revenue-share floor discussed by AAC Commissioner Tim Pernetti, Ingram says he’s “not opposed to the concept of having a minimum investment, but I don't have any idea what that is.” He points out the distribution within the AAC league is not the same, with the incumbent members bringing in twice the distribution of new members. “So when we start talking about a minimum spend within the league and the framework of the league, I think that that has to be taken into consideration that there is a competitive disadvantage prior to this by virtue that they have more dollars to operate than we do. If that translates into how much they can turn around and spend on talent on the field or court, we've created an inequity within the framework of our own conference. The NEC will eliminate its self-imposed 45-person roster limit in football in light of the anticipated House settlement. According to CollegeAD, NEC members can now issue as many scholarships as they’d like up to the limit of 105. One source says teams can offer as many or as few scholarships as they want, and one AD predicts schools will go up to 40 or 50, “but they’re not going to 63 (the current FCS max).” (link)

A dozen volleyball student-athletes along with San Jose State AC Melissa Batie-Smoose have filed a lawsuit against the Mountain West, Commissioner Gloria Nevarez, the Cal State Board of Trustees and SJSU President Cynthia Teniente-Matson, among others. The suit also requests emergency injunctive relief in advance of the conference tournament, which starts November 27, and alleges violations of Title IX and First and 14th Amendment rights stemming from SJSU allegedly having a transgender player on its roster. From the suit: "Recently, the MWC, SJSU, and the other Defendants have collectively manipulated MWC rules, diminished sport opportunities for women, spread inaccurate information, used their positions to chill and suppress speech with which they disagree, and punished dozens of female collegiate volleyball student-athletes for taking a public stand for their right to compete in a separate sports category, all in a concerted effort to stamp out debate over women’s rights in sport.” The suit goes on to argue the SJSU player in question should be ineligible to play in the tournament and the Spartans transporting that player to the conference tournament is a violation of Title IX. “Review of the existing MWC policies, which do not set forth a clear policy or practice of imposing losses upon teams which choose not to play for safety reasons, also supports the conclusion the MWC TPP (Transgender Participation Policy) was specifically adopted to chill protests and other expressive conduct, including boycotts, on a women’s rights issue.” More. Oregon will increase football season-ticket prices next season, Ducks AD Rob Mullens tells JohnCanzano.com’s eponymous publisher. Mullens: "If you look at this year, the season-ticket value was tremendous.” Mullens also says a "talent fee" or tax is not in the works, nor are there any plans to cut sports. "That is not on the table for us today. Obviously, we're still learning about things." Mullens did acknowledge there will be "tough decisions" regarding how to fund scholarships and operations in some sports. "We don't have unlimited resources. … We have one sport that generates revenue for the other 19 sports." UO is trying to generate an additional $20.5M to reach the projected NIL cap in 2025, and Mullens tells Canzano: "Can we raise $20.5M? How do we allocate $20.5M? … We're spending a lot of days planning for what's about to take place on July 1." (link)

Penn State football season ticket holders will have the opportunity to purchase their same seats should the Nittany Lions host a first-round College Football Playoff game. The Athletic’s Audrey Snyder explains that student tickets are not available yet, but Penn State does plan to have the same number of student tickets available (21K) as during the regular season. Snyder adds: “How all campuses pull off hosting has been years in the making. Penn State’s Beaver Stadium had to have priority maintenance completed last winter in hopes of hosting. The biggest hurdle for Penn State remains what to do if there is a significant snowstorm in the days leading up to the game. Penn State uses several grass fields for parking and overnight RVs, which are often in jeopardy late in the season with weather concerns.” (link)

Texas A&M has agreed to spend $160K to be the primary sponsor of Stewart-Haas cars at two NASCAR races, according to Sportico’s Eben Novy-Williams, who reports Stewart-Haas agreed to “race twice with Texas A&M-branded liveries, plus a handful of other marketing, promotional and ticket deliverables. Chase Briscoe raced his No. 14 car with a maroon Texas A&M wrap in Las Vegas on Oct. 20, and his teammate Josh Berry drove his No. 4 car with a maroon and camouflage wrap at this past weekend’s season-ending race in Phoenix. Both races were televised on NBC. Berry also wore a Texas A&M-branded firesuit. … In addition to the marketing on the cars and drivers, Stewart-Haas agreed to provide the university with a handful of other benefits, according to the contract. They include a minimum of four ‘Texas A&M-specific’ social media posts during race weekends, and a promise to tag the school’s socials in all race-related posts.” (link)

NCAA President Charlie Baker joins The Dan Patrick Show and says his goal as far as keeping member institutions together is “I want to keep the unhappy family unhappy and together, but happier than they were before.” He calls the House settlement a “pretty good example of an opportunity to create what I would describe as a framework that works for the power schools and works for the others as well.” Baker answers a question about the impact of Donald Trump’s return to the White House by noting that “I do think the president-elect has demonstrated he's a huge college sports fan. He doesn't just talk about it, he actually goes to the events. He went to the wrestling championship last year, he’s been to a bunch of the football bowl games, he's gone to the basketball stuff. I mean, this is somebody who clearly appreciates what college sports is about and I think that will help too.” Moving forward, Baker believes that “our ability to succeed is going to be driven to some extent by our ability to make it possible for the big schools to be what they are and who they are and to make sure that the other schools have the ability to be what they are – instead of trying to think about all of them as being the same because they’re not.” Baker says of a potential football super league breakaway that he’s concerned teams like Indiana, who no one thought would start the season 10-0, would be left out. “If you carved it down to a smaller number, Indiana might not be in your 50. … To me, what’s happening in college football, in particular, is a sense that there are a lot more games that matter week-to-week than mattered two or three years ago. I don't know if that's a function of the transfer portal or the quality of the coaching or what, but it feels to me like there's a lot more competitive opportunity there than there was a few years back.” More from Baker. Republicans have named U.S. Senator John Thune (R-SD) as the chamber’s next majority leader. Thune beat out fellow Republicans John Cornyn from Texas and Rick Scott from Florida. (link); Yahoo’s Ross Dellenger notes this “paves the way for Ted Cruz to assume the chair of the Senate Commerce Committee. Cruz has said publicly that he will make college sports legislation a priority.” (link); Meanwhile, NBC News is projecting the GOP to win a majority in the House of Representatives, giving the party full control of Congress and the Oval Office. Arizona has distributed revenue-sharing contracts to recruits this week ahead of the start of the early signing period, and Wildcats AD Desiree Reed-Francois tells Yahoo’s Ross Dellenger: “We met two weeks ago with each one of our head coaches. We walked them through the revenue share, scholarship models and their P&L. This is the gap year. This year could be bumpy, but we have a pathway forward. There is light at the end of the tunnel.” Dellenger, however, points out that “uncertainty looms,” as student-athletes are expected to “sign agreements with both NIL collectives and the schools under a promise of compensation as part of a settlement that has not even been formally approved. Many coaches are building rosters without knowing their revenue-share amounts and, in some cases, their scholarship allotment and roster spots. In the meantime, collectives are planning to ‘frontload’ deals with athletes as a way to create more dollars for their affiliated schools next year in the settlement-related revenue-share pool.” Athletes.org Co-Founder Jim Cavale believes these revenue-sharing contracts are essentially pay-for-play deals that “cause problems for everyone involved.” He adds: “We all know the performance of an athlete is unpredictable at any age, let alone when they are first starting to play college sports. … All of this is creating a paper trail that will make employment a reality.” Dellenger goes on to note that the NCAA is targeting Deloitte to run the clearinghouse, which “presumably will use an algorithm or formula for calculating fair market value, though much of this remains unclear.” Lots more. College hockey commissioners are asking the NCAA to be mindful of the sport’s unique deferred enrollment rule, which allows players a grace period until their 21st birthday. NCHA Commissioner Heather Weems tells the Grand Forks Herald’s Brad Elliott Schlossman: "Right now, it's more of a 'could be,' but in the environment we're in, the NCAA is looking at anything that's a bit of an outlier. While there's been no specific conversation or action, it's an area we're tracking, because it's an outlier like professionalization. We're trying to make sure that our folks in the NCAA are aware, because so often, hockey is an outlier." CCHA Commissioner Don Lucia adds: "We want to make sure they're educated on why hockey is different as they look to standardize rules. We're an outlier. We think it's in the best interest of our sport and the student-athletes that we keep the runway as it is to enter college." Multiple commissioners tell Schlossman they believe changing the rule would result in more players leaving home earlier to play junior hockey at younger ages, and Lucia explains: "Many areas around the country don't have established high school hockey like Minnesota. Minnesota is unique in that regard. We don't want to see kids being forced to leave home any earlier than they already do. We think that could be a negative impact on academics.” (link)

NBC Sports’ Brentley Romine takes a look at how roster limits will impact college golf specifically and notes the sport “figures to lose hundreds of current roster spots once those sports’ programs begin operating with roster maximums of nine players – or, at least in some instances, fewer. The Southeastern Conference recently told its golf coaches that it will cap their rosters at eight players, while there are serious rumblings of other schools going below that to satisfy Title IX requirements.” One Power 4 Women’s Golf HC tells Romine: “Was told an hour ago that I can only sign one kid, and I committed to two over a year ago. Imagine making this phone call. Heartbreaking. The situation we have been put in unfortunately.” A P4 men’s coach who had to make the same cut calls this the “worst week of my coaching career.” Romine goes on to note that while some coaches “aren’t planning to break any bad news to their new signings right now, language being written into some aid agreements – which have replaced the recently eliminated national letter of intent (NLI) – would allow schools to terminate those contracts to comply with any settlement-related mandates (i.e. roster limits).” Meanwhile, a mid-major coach tells Romine: “These top schools have been plucking guys from our rosters for years. It’s funny how the tables have turned now.” (link)

Temple Football HC Stan Drayton, after losing 52-6 to Tulane last week, noted the Green Wave team is an example of what’s possible with NIL: “This is a very good football team. I mean, they've invested in some players. So, yeah. You could just tell. They're physically very, very strong. Functionally, very, very strong. We had a hard time tackling them. We had our guys around the football at times, and we’ve got to make plays. I'm not going to sit here and sound like I'm making excuses here, but we were outmatched in a lot of spots, and we’ve just got to find a way to play better to equalize that.” Drayton says the construction of the roster began with then-HC Willie Fritz, who’s now the HC at Houston, “but Tulane has made the commitment to invest in bringing in good players into the program, and it's definitely showing on the football field. … There's definitely a gap there if we don't catch up in terms of the investment piece of it. There’s no doubt about it. And they are setting the standard, the type of body type, the type of football player that is coming into this conference, and we absolutely need to level up to be competitive with those types of teams, for sure. … And if NIL got that program looking the way it is from two years ago, only winning [two games], if that can do that to that program, it can do that to this program. But people have to be real about it.” (link)

Ksenia Maiorova, the immigration attorney who is representing LSU women’s basketball student-athlete Last-Tear Poa, tells NOLA.com’s Reed Darcey that Poa’s intention in filing a lawsuit against U.S. Citizenship and Immigration Services was not to set a legal precedent. “The purpose here is just to get a fair adjudication of her petition. This is a case that is seeking a review by an impartial body of a denial that we feel is unjust.” Poa is seeking a P-1A athlete visa rather than the F-1 student visa. The former is typically reserved for professional athletes who move to the US solely to compete in their respective sports or amateur athletes who play at an “internationally recognized level of performance.” Maiorova argues that NIL deals fall into the category of work permitted by the P-1A visa – namely, promotional activities related to athletic competitions. USCIS director Tracy Tarango disagreed, arguing that Poa failed to prove not only that she was living in the U.S. solely to play basketball, but also that her desire to capitalize off her NIL is related to her athletic career – not just to her individual financial gain. Maiorova called the reasoning "divorced from reality,” adding: "While everyone has a common-law right to their name, image and likeness, the ability to capitalize commercially on that common-law right depends on whether you're famous. And in (Poa’s) case, her ability to commercially benefit from her [NIL] is tied primarily to her status as an athlete on LSU's basketball roster.” Creighton law professor David Weber believes the lawsuit is the first of its kind, and says when it comes to student-athletes, “the reality is they're a hybrid. They're a combination. And our immigration laws haven't adapted yet since that NCAA decision in 2021 to allow NIL rights.” More. (link)
