U.S. District Court Judge Sean Jordan of Sherman, Texas, on Friday permanently blocked the Biden administration U.S. Department of Labor rule that took effect in July, saying it improperly bases eligibility for overtime pay on workers’ wages rather than their job duties. In June, Jordan said the rule was likely invalid and temporarily blocked it from being applied to Texas state employees. The state of Texas and business groups representing a range of industries had filed lawsuits challenging the rule, which had been consolidated. Jordan, in part: “The Department may impose some limitations on the scope of the EAP Exemption’s operative terms, but it cannot enact rules that replace or swallow the meaning those terms have.” Most importantly: “The rule would have required employers to pay overtime premiums to salaried workers who earn less than $1,128 per week, or about $58,600 per year, when they work more than 40 hours in a week, beginning Jan. 1, 2025, and it had temporarily raised the threshold to about $44,000 per year on July 1. The previous threshold of about $35,500, which was set in 2019, will now be back in effect.” (link)

San Diego State AD JD Wicker sat down with AthleticDirectorU’s Steph Garcia Cichosz to reflect on the values of “patience and persistence” when guiding an athletics department through times of change. Wicker and Garcia Cichosz discuss recent success for the Aztecs, how to stay on top once a high level of athletic and academic success has been achieved and the strategy behind building a program into a national brand. Wicker also offers insight on communication strategies with student-athletes, campus partners and staff; discusses how he redefined the “Aztec way” when hiring a Football HC; and shares his “fill your battery” moments and habits that help him maintain momentum. When hiring new staff members, Wicker explains that “culture is very important to us. We have a very distinct culture. I feel like in our department it's a family style of culture. The great thing about San Diego State is we’re all in one building, all of our sports, all of our functional areas, so they're going to have to come in and want to be a part of this larger group and not just be someone who’s siloed. We also have a pretty rigorous interview process. … We just hired a new deputy for kind of external areas – marketing, media relations, those areas – they had to do a presentation and all staff got to come in and participate in that and ask questions. So, we really try to put them in front of as many people as we can and help them understand that you're not just coming in and I'm just in my area. UCF Deputy Athletics Director of Strategy and Competitive Success Chris McFarlane joins Connect's Kristen Eargle on this week's edition of The Career Hustle. They discuss McFarlane’s transition from Deputy AD for External Relations and Business Development, moments that have shaped him throughout his career, how he adapts to various leadership styles, what he looks for when hiring new staff members and coaches and more. McFarlane explains that “when I’m at a game, whether it’s home or on the road, part of what I’m paying attention to is the coach on the opposite sideline – how they handle themselves on the sideline, how much do I think they're actually doing because it may not always be the head coach that I'm paying attention to. It may be an associate head coach or an assistant coach, and usually it's with no job and no thought of a job coming open anytime soon. But it's my responsibility to always be prepared. It’s a constant evaluation and I like to see how people are acting and responding to certain things when they're not expecting me to be paying attention to that.” McFarlane also talks about his role as the “Chief Connector,” noting he may not always be the subject matter expert, but “I do have an ability to try to connect dots and bring people together to break down barriers and to solve problems. Missouri Executive AD/CFO Andrew Roberts joins the News & Brews Sports Biz podcast with James Moore & Co. and says the biggest change he’s seen over the past 12 years is the compliance team used to be able to take several decisions off his plate. “Over time, the rulebook has really gotten ripped up and things have continued to just move to program autonomy. You know, ‘You guys make the decisions,’ which really means that resources define what we can and cannot do. So, more and more the pressure to make decisions has shifted over to the business office. I kind of saw that happening before I was really the decision-maker but certainly around 2018-2019, and then as I became a CFO in 2020, it just felt like everybody was looking to me to say, ‘Can we do this? Can we do that?’ Because compliance was no longer saying, ‘Yeah, they were saying, ‘Hey, it's possible, you have to ask Andrew if we have the money for it.’” Roberts says Tigers AD Laird Veatch has outlined his vision for how MU will move forward, which has “teased some changes that are probably coming and, frankly, are long overdue here at Missouri. And a lot of that's going to be around ticket pricing and how we manage our donations and fundraising efforts. So, [we’re] really focused on the revenue generation side. I know he's touched on expense management as well and we've certainly made commitments to our leadership here to do that, and we've got some thoughts around how we might tackle that. … I’ll kind of steal Laird’s words: we’re not necessarily talking about cutting back and doing less, it’s just trying to really identify what matters. … We’re not going to out-money everybody in our league.” Full podcast. Princeton Women’s Lacrosse HC Jenn Cook points out the ripple effect of conference realignment can be felt in the Ivy League most notably through the difficulty of scheduling high-quality opponents. “It was probably the most challenging scheduling-out-of-conference year that I’ve had in my 17 years as a coach. It definitely has to do with conference realignment and conference expansion, primarily.” The Daily Princetonian’s Doug Schwartz notes scheduling for lacrosse normally starts around November and ends around June; however, the schedule this time around wasn’t finalized until September. Cook: “For us, there are always historical matchups that we like to play. You know, that’s your UVAs, Loyolas, Penn States, and Maryland. Unfortunately, this year, a date to play Maryland just did not mesh for us.” Cook also explains that league coaches work together to help schedule quality opponents. “For us, like our coaching group within the Ivy League, we meet and we’re constantly communicating. You want your league to be strong … You get your league strong by everybody within the league playing really quality opponents outside of conference.” (link)

The 57-year-old University of Colorado coach and Pro Football Hall of Fame cornerback has said publicly he wants to stay in college football despite some theories that Jerry Jones is targeting his former star. Sanders holds an 11-10 record over two seasons with the Buffaloes, and as of now, I have not spoken to a team decision-maker interested in bringing Sanders in as an NFL head coach.” (link)

When it comes to setting up a super league, Crakes Media Principal Patrick Crakes asks: Is there any strategy out there that doesn’t suggest getting rid of “middle men?” Crakes’ question comes in response to CBS’ Dennis Dodd noting last week that ACC and Big 12 presidents and chancellors were expected to hear Project Rudy proposals directly from proponents. Former Fox Sports President Bob Thompson indicates he’s “not sure I understand the ESPN sublicense of Big 12 games to TNT at this point. Guess it depends on the windows. I assume ESPN will keep the Saturday night window. One thing that is for sure…there can be no doubt that ESPN is all in on the SEC. … TNT wanting Big 12 is easy. They need to replace NBA events and Inside the NBA. Don't understand the ESPN angle. Maybe they wanted the NBA show from TNT more than they wanted those Big 12 games. If I was launching an ESPN DTC service in August of 2025 I would be looking to make the event lineup as strong as possible along with keeping ESPN+ strong.” (link)

TBS and Warner Bros. Discovery have settled their breach of contract lawsuit against the NBA. Sportico’s Michael McCann notes the settlement will “preserve WBD’s 35-year relationship with the league for at least the next 11 years. A person familiar with the settlement told Sportico that the new arrangement contains many features, some of which are governed by an 11-year-agreement with other features contemplated within a five-year agreement. Of greatest interest to NBA fans, the famed Inside the NBA will continue. The show will be produced by TNT Sports, which will also hire the on-air talent and make programming and editorial decisions, and air on ESPN/ABC. The new arrangement also includes a continuation and enhancement of the digital partnership between NBA and TNT TV, sales partners and other parties. In addition, WBD will acquire the rights for NBA games outside the U.S., including in Nordic countries and parts of Latin America. The deal also includes new methods of using NBA intellectual property content, expanded rights for Bleacher Reports’ House of Highlights rights and over a five-year term, $350M for services, promotion, programming and marketing WBD is providing the NBA, as it does now, and in advertising inventory that the NBA can use across WBD networks and digital platforms globally. Meanwhile, the NBA can now move to implement its new TV arrangement without the cloud of a legal battle.” (link)

Puck’s John Ourand points out the leverage the NFL enjoys with networks won’t translate to streamers, telling The Athletic’s Andrew Marchand: “If Fox didn’t have the NFL, FS1…goes under almost. One of the reasons that Skydance paid so much for Paramount is because they have an NFL deal that extends out another decade. Traditional media companies, their whole existence relies on these sports leagues. Because of that, these leagues have an incredible amount of leverage over them and they can go and get the kind of prices that the NBA got, they can get the kind of prices that the NFL got. … Having the leagues go after [streaming], they’re going to find that the whole leverage aspect of what they’ve enjoyed for the past several decades is gonna be turned on its head, and that’s where I think that they should be weary.” Ourand goes on to say: “What the NFL did recently, and it paid off well for them. … Every single one of the TV networks has a package, Amazon has a package, now Netflix has the Christmas Day games, Google/YouTube has the Sunday Ticket. So all of a sudden, there are just enough packages for just enough people that are interested. But it’s like buying a house. The more bidders that you get, the higher the price goes up. And kind of culling that and just creating more of a fervent bidding market could potentially get more money out, I think.” (link)

More context: “Thirty-one teams were selected to participate in each championship. The top two, seven-person teams automatically qualified from each of the nine regions, for a total of 18 teams. Thirteen additional teams were selected at-large. Thirty-eight individuals were selected to participate in each championship through an automatic qualifier and at-large selection process. JohnCanzano.com’s namesake releases his in-depth interview with Oregon AD Rob Mullens, which covers thoughts on a number of high-profile industry items. On how Mullens & his team are considering roster caps & scholarships: “We’re probably at a point here where, to your question, we’re going to have to be much more strategic in how we do that because we don’t have unlimited resources. It will be important for us to invest in the areas where we do generate revenue. We have one sport that makes money here that funds the other 19. We’ll need to continue to compete at the highest level in football in order to help fund those other 19 sports.” How about innovative revenue opportunities? “Everything’s on the table, and that’s what we were trying to communicate. Obviously, the lifeblood of an athletic program is ticket sales and donations. So those things are always going to be extremely important. The media contracts are set. The local sponsorships are somewhat set. But we are going to look at things differently. You referenced field logos, maybe even jersey patches. Where there are opportunities that we’ve been somewhat hesitant to do in the past, we will now look to because as we see college athletics change to remain at the highest level, you're going to need to be able to generate this $20.5 million to get to the full cap.” Mullens goes on to say that a “talent fee” - like Tennessee has announced plans to implement - is not on the table for the Ducks, nor is the full-out cutting of sport programs. Seattle U. announces it will discontinue Men’s & Women’s Indoor Track & Field, as well as Men’s Tennis, at the end of the current academic year. Key context: “Along with the discontinuation of the three sport programs, sprints, jumps and throws in outdoor track will be phased out as student athletes who compete in these events exhaust their eligibility. The men's and women's cross country and outdoor track programs will continue, as will women's tennis.” University President Eduardo Peñalver & AD Shaney Fink “This year of transition has been marked by thoughtful reflection and difficult choices. Washington Senior Assoc. AD for Sport Administration Charles Small joins Connect's Kristen Eargle for a look inside his career path and perspective. Small, the former Valparaiso AD who has also led DEI initiatives at multiple universities, discusses how he approaches adapting to leadership styles, choosing opportunities and his focus on earning trust and measuring success. When evaluating his next career steps, Small says he thinks long-term and looks at the big picture. “I zoom out and zoom in. What’s the best version of me in the next X period? Is that five, 10 years? And then what am I going to do on a daily basis to get better? And I feel like if you're true to that process, you will be prepared when opportunities come to you. So, when that opportunity presented itself, I felt confident I felt like I was ready. I was looking for alignment, I was looking for a pathway to success. And I know once I saw that I thought I had a pathway to success, I felt like there would be alignment in terms of values. I talked to [Iowa State AD] Jamie Pollard at the time when I was at Iowa State, and I talked to some other mentors and felt like this is an opportunity for me to make this move and it felt in line with goals I have for my family. It felt in line with goals I had professionally.” When it comes to adapting to new leadership styles, Small says he uses the 1-3-1 mode. “I think about an issue. I think about three possible solutions, and I come with my strongest recommendation. Indiana and Football HC Curt Cignetti have agreed to a new contract that will make him the highest paid employee in university history. Officially, Cignetti will sign a new contract through November 30, 2032, worth an average annual compensation of $8M. He will also receive an annual $1M retention bonus. His current agreement, which ran through 2029, guaranteed him $4.5M annually. (link)

USA Today’s Steve Berkowitz with the biggest bonus winners of the weekend: Iowa State HC Matt Campbell adds another $250K to his tally on the year; Oregon’s Dan Lanning gets $200K for the Ducks’ 11th win of the regular season, which also triggers a 1-year contract extension worth $9.4M, all guaranteed; Rutgers’ HC Greg Schiano leads the Scarlet Knights to bowl eligibility and gets a $100K bonus for doing so; Colorado HC Deion Sanders snags $100K for the Buffs 8th regular season win; North Carolina HC Mack Brown picks up a $75K payday for bowl eligibility; add $75K for Clemson’s Dabo Swinney, as well; Memphis HC Ryan Silverfield picks up automatic 1-year contract extension and $25K bonus as the Tigers get their 9th win. This takes his deal through 2029 and the extra year is currently set to be worth $2.8M ($1.68M guaranteed). Silverfield at $125K in bonuses this season. Several others at the $25K mark or below. With USC President Carol Folt announcing her decision to retire, the Los Angeles Times’ Ryan Kartje reflects on her impact on athletics and points out that “when Folt first took over, in July 2019, the department had not only been rocked by scandal, but also plagued by a decade of insularity and stagnation. … And Folt stepped in, determined to make waves immediately. Those sweeping efforts to reshape USC’s image didn’t always land among longtime employees in athletics, who felt she balked too often at USC’s deep traditions. Two former university administrators told me that, upon taking the job, Folt voiced her disapproval of the famed university slogan, ‘Fight on!’ She went so far as to have staffers engage university officials about phasing it out because it was ‘contentious’ — a request that, one official explained, ‘went over like a lead balloon.’” Still, Folt pressed forward with changes, parting ways with AD Lynn Swann and bringing in Mike Bohn before eventually signing off on the hire of Football HC Lincoln Riley. Kartje: “Folt made a more shrewd calculus at the conference level soon after hiring Riley as coach. As part of a committee exploring expansion with the Pac-12, Folt had already stood up against the idea of expanding the conference. The following summer, she would turn around and help engineer USC’s move to the Big Ten, a move that would usher in the end of the Pac-12 as we knew it.” Regarding the circumstances of Bohn’s departure, Kartje notes: “When Times columnist Dylan Hernández approached her after a news conference and tried to pose [questions about Bohn’s conduct], her office ended the interview and accused The Times of being ‘sexist.’ She is poised to ride that silence into retirement.” More. ESPN’s top college football broadcast team of Chris Fowler & Kirk Herbstreit had an interesting suggestion on how to handle fake injuries after a related questionable stop in play during last night’s Tennessee-Georgia game. Fowler: “Simple solution is, you come off like that, you’re done for the series. However long the drive lasts, you’re out. If you’re seriously hurt, you wouldn’t be able to come back anyway. If you’re not, you’re just done.” (link)

Ivy League endowments, many of which allocate outsized portions of their portfolios to private equity and venture capital, have underperformed the university average for the second straight year, according to Financial Times’ Sun Yu, who notes that some, including Yale and Princeton, are “lagging far behind their smaller peers, as the once-lucrative asset class suffers from a plunge in dealmaking and stock listings.” Yu points out that “six of the eight Ivy League universities reported returns in the 12 months ended June that stood below the higher education average of 10.3%, according to Cambridge Associates. … Yale and Princeton fared the worst by respectively yielding 5.7% and 3.9%. The underperformance follows an even weaker 2023 when no Ivy League school was able to match the 6.8% industry average. Yale gained 1.8% while Princeton lost 1.7% last year.” At issue, Yu explains, is that “most Ivy League endowments had earmarked more than 30%, and in the case of Yale and Princeton at least 40%, of their assets to PE and VC by the first half of this year. … In contrast, a survey of 121 university endowments by Cambridge Associates found their allocation to PE and VC had averaged 22% over the same period.” Former Texas/Texas A&M Investment Management Company CIO Britt Harris says it was “a huge anomaly” for most Ivy League endowments to generate negative or low single-digit returns last year when the risk-free 10-year US treasury yielded more than 4%. “People underestimate how volatile some of these private investments can be.” More.
