USA Today’s Steve Berkowitz reports that “members of U.S. House Democratic Women's Caucus sent [a] letter to Secretary of Education Miguel Cardona asking for clarity about how Title IX should be applied to NIL pay schools would be able to provide college athletes under proposed settlement of House and related cases. Letter to Cardona asks for reply by Dec. 5 re: To what extent would Title IX apply to direct athlete compensation?; Does Ed Dept agree that settlement’s damages distribution model should not be considered as compliant with Title IX for purposes of additional payments to current and future athletes?; What constitutes enough interaction btwn schools/athletes and collectives that would require Title IX to be applied and enforced?” (link); Yahoo’s Ross Dellenger adds: “The Caucus asks of the Department of Education many questions that college leaders have been asking the department for months. Georgia AD Josh Brooks takes issue with the College Football Playoff ranking process: “We have to be humble in this process but I will say this, I know the committee made a statement that they had questions about the inconsistency of our team. I would question the inconsistency of their ranking process, quite frankly. But if you want to talk about consistency, what has been consistent has been the strength of our schedule and I would challenge any of them to think about any other team in that Top 12, what their schedule would look like had they gone on the road and played the games that we played. Even a neutral site at Clemson, a Top 20 team. A neutral site against your rival Florida. Doesn’t matter what the record of either team is in those games. And then going on the road, Kentucky, Alabama, Texas, Ole Miss. So that’s all I’ll say about that.” (link)

ESPN’s Pete Thamel writes on Tulane’s continued football success under first-year head coach Jon Sumrall as university SVP/COO Patrick Norton comments: “[Athletics is] really important to our brand. Now, how do we capitalize on that? That's still, I think, in some ways to be determined. I mean, this is fairly recent for us, success from the Cotton Bowl, which was really an amazing experience for the university. One that we hadn't gone through in a very, very long time.” The Green Wave has hired Huron Consulting to assist with a “basic diagnosis” of the athletic department. Norton continues on why the university turned down overtures from the Pac-12: “We were leaving something that is more certain to less certain and frankly, it's not the Pac-12 that we always knew, that we grew up with that John Wooden and UCLA and USC. It just wasn't the same. I'm not saying that these schools aren't solid, very good schools, but it's not the same. And it was different than what we wanted, and so I think the decision wasn't that hard, but we listened.” Green Wave AD David Harris: “As you look at the next several years, and the changing landscape of college athletics, people feel that there's really a place for Tulane within the college football landscape and just overall being a stronger athletics brand. And so to be in this position is incredibly exciting. Kentucky Football HC Mark Stoops says for SEC head coaches “to be on the number at 85 (scholarship players) when the spring semester starts, to say that it’s going to be complicated is a severe understatement. … We would love our concentration to be on coaching and spending time with our players and being around that. That’s where all of us are still putting most of our time, but we have to – I have to – look at roster management.” Stoops went on to say to reporters that “due to the fact that you just asked the question, we need to have some conversation about this because it’s extremely hard. Knowing who’s leaving, knowing what you want to bring in the portal, that’s one thing, but then also high school. We’ve been thinking and talking about 105 and then 95 and then down to 85. I think if we all play by the same rules, we’re all good with it, but to say that we need to hit it, you know, right on the number at 85 starting the first day of spring semester will be a challenge. That’s a severe understatement.” Also from Stoops: “I took great pride in building the program on taking those two-, three-star guys, guys that we could get in the surrounding areas, and developing them into very good football players. But those days are over, and you better have a good team now. And you have to have the resources to get those players.” (link)

Oakland Men’s Basketball HC Greg Kampe talks to the Detroit News’ Carlos Monarrez about the changing landscape of college hoops: “I have ideas and thoughts, but I don't know where it's going. But I know this: I want to be a player in it. I want to have a say in it. I want to voice opinions and help create policy, because it's that important. [...] I spent my whole summer trying to raise money to buy players next year, and you can print that. I mean, think about that. The basketball coach at Oakland just told you I spent my WHOLE summer trying to raise money to buy players and I raised over $200,000 to buy players. Do I think I can do that again? No, I don't think I can do it again. I think what the Kentucky win did was gave us the clout to do that this year. [...] Our actions have all proven that it's about money. Nobody's saying it. Our actions have proven it's about money. So let's accept what it is. You're not going to change it. The toothpaste is out of the tube. You are not going to change it. With several football officiating decisions ranging from questionable to controversial to incorrect this season, The Mercury News’ Jon Wilner asked former Colorado/Washington/UCLA Football HC Rick Neuheisel about his opinion, particularly in relation to the BYU-Utah game. Neuheisel: “BYU’s still the undefeated team. You get a call like that…whether it’s the field judge or the side judge, throws the flag and bails them out with a holding call. You have to really want to call that. You have to really want to. I’m not calling anybody’s integrity into question. What I’m saying is you can’t have Big 12 officials doing that because Big 12 officials are trying to protect the Big 12 league. It’s creating a conflict. … What we need to go forward here… is we need a one-house, all-united officiating group run by the CFP. There’s plenty of money to handle it.” Neuheisel also proposes having all replays handled by one centralized office to avoid conflict of interest. “All these replays (would) go back to a mission control, much like they do in the NFL so you aren’t sitting there saying, ‘This is an ACC crew making an ACC-beneficial call. ‘This is a Big 12 crew making a Big 12-beneficial call.’ We can’t have that. Netflix’s continued foray into live sports streaming was last night’s boxing match between Mike Tyson and Jake Paul that had more than its fair share of buffering hiccups. More than 100K+ users reported network issues on the Downdetector website throughout the livestreaming, noting the slow buffering and network issues. Paul: “We crashed the site. This is the biggest event. Over 120 million people on Netflix.” Netflix declined to comment on the overall outcome of the event. The next big marker for the global streamer is a Christmas Day NFL matchup between the Kansas City Chiefs & Pittsburgh Steelers. (link)

Through the first nine days of the men’s basketball season, teams are averaging 104.6 points per 100 possessions, according to KenPom’s Ken Pomeroy, who adds: “Comparing the first nine days of the season to the first nine days of past years, this season’s start is easily the best, edging out the 2014 season which was at 103.8.” When predicting whether this will be a record-breaking offensive season, Pomeroy crunches the early numbers and explains that “in a normal year, a lot of the improvement in offense over the course of the season is due to shooting and turnovers. And given that shooting and turnovers are at their best numbers ever to this point in the season, there may not be that much improvement in offensive rating coming. In addition, we know that the change in the charge rules for secondary defenders has fundamentally improved offenses as well and that’s a change that’s already baked into the early season numbers.” That said, Pomeroy would “still bet that this season finishes at a record level, although it’s far from a given. A slightly more sophisticated model, assuming a non-linear relationship between early offensive rating and season offensive rating, and using some turnover and shooting information, indicates that it’s more likely than not that this season’s offense beats last season’s record. Furthermore, last season still had a decent increase despite starting out hot. I mean, there’s really no reason to explain why offense would get worse in coming weeks, other than officials deciding to call the charge rule from the 2010 rulebook.” (link)

Ōura last week acquired Sparta Science to “fuel the fastest-growing segment of its business: its enterprise customers using the Oura Teams dashboard,” according to SBJ’s Joe Lemire, who explains that “Sparta’s Trinsic software, which collects and analyzes health and fitness data from third-party sources, will be incorporated into Oura Teams.” Ōura Chief Commercial Officer Dorothy Kilroy tells Lemire: “We really see enterprise in our future, definitely sports teams, government, Department of Defense, but we also have huge ambitions in healthcare.” Kilroy describes Trinsic as “the meat of the acquisition” that will “give all of our enterprise customers access to this enhanced enterprise experience with data that we've not been able to do yet at a level that Trinsic has done.” Kilroy goes on to explain that Ōura sees the need to continue supporting athletes holistically: “We've continued to have a huge amount of inbound demand from different sports teams at a global level. We definitely see the opportunity to continue to expand that and integrate into their athlete management system. There's been an emphasis in sports about what was on the pitch for a long time, and I think now there's much more emphasis on what's off the pitch.” (link)

U.S. Senator Ted Cruz (R-TX) reiterates that NCAA reform will be a priority: “Right now, the current world of college sports is the Wild West [with] name, image and likeness, open transfer portals. It is, I think, endangering the future and viability of college athletics. I think Congress needs to step in and legislate. When the Democrats were in the majority, it just wasn’t a priority for them. It will be a priority. We are going to address it. As chairman [of the Commerce Committee], I can convene hearings. I’m in charge of every hearing the Commerce Committee has. I invite the witnesses for the hearings. I can call up markups. I can decide what bills get marked up and what bills don’t, and it gives you the ability to drive an agenda that is just qualitatively different.” (link, link)

More from SEC Commissioner Greg Sankey on yesterday’s The Paul Finebaum Show, where he discussed the impact of last week’s general election and says once committee leadership assignments are finalized, that “helps us to direct conversations to members of both parties because we do need what I'll call a nonpartisan solution. I think typically we talk about bipartisan[ship], so we need both Republicans and Democrats to share in a common direction. I think the elements that I've spoken of so frequently remain. We need national standards for college athletics competition. … Our student athletes deserve to know when they line up across from each other at the line of scrimmage there's similar standards in place. I think the young people on our teams deserve a level of consumer protection around these deals that are being struck. Who’s making these offers? Who’s in these representation roles? I'm concerned that there's not been enough scrutiny, enough transparency around these agreements and some of these things not being fulfilled. Those stories are out there and they're not a limited number. I think we can work together in this country and across the varying levels of college sports with both Republican and Democrat leaders to come to a conclusion that can support the kind of uniquely American tradition that is college sports, provide opportunities, and protect our Olympic effort.” (link)

The Athletic’s Pete Sampson examines how Notre Dame’s ACC affiliation continues to be beneficial for both parties and points out that “some inside the league argue [it’s] more critical today than when first signed. … ACC membership gave Notre Dame a conference ally when it needed the support. And Notre Dame maintaining its relationship with the league helps keep a pin in that grenade the Big Ten and SEC sometimes toss back and forth. Notre Dame joining one or the other would be devastating to the conference. And the ACC letting Notre Dame walk would cripple the school’s independence, which is sacrosanct at a place that does religious imagery at a high level. Together, Notre Dame and the ACC create stability in an industry desperate for it.” Fighting Irish AD Pete Bevacqua: “We want and hope for a very strong ACC. I think that’s good for college sports in general. It’s certainly good for all the universities that are part of the ACC. And quite frankly, I won’t hesitate to say it’s incredibly good for us.” ACC Commissioner Jim Phillips adds: “We want to maximize what’s best for the ACC and Notre Dame wants to maximize what’s best for them. It’s healthy for us on an annual basis to have those conversations and see if what we’re doing is best for both parties.” Also from Phillips: [Bevacqua] hasn’t missed a beat in terms of taking off where Jack left it. Pete is not just about what’s good for Notre Dame. It’s what’s good for the ACC and college sports, too. I don’t know if anyone necessarily thinks about it that way in our industry.” (link)

Action Network’s Brett McMurphy joins Inforum’s Dom Izzo to discuss the potential of North Dakota State joining the Mountain West and says the conference would prefer to add a new member from the FBS ranks, but the options are limited. “They don't have any interest in New Mexico State. They’re not going to get anybody to leave obviously a power conference or the American. The Sun Belt doesn't make sense. Conference USA there's a few teams there. I don't think those are sought after by the Mountain West. So, the best option would then come from the FCS, and I talked to a number of people that, quite frankly, thought North Dakota State would be a better option than a lot of the FBS teams that they could go after or maybe even better than Northern Illinois or Toledo.” McMurphy also says the pressure from FBS leaders like SEC Commissioner Greg Sankey and Big Ten Commissioner Tony Petitti on conferences not to add FCS teams “is real enough that I've heard that from multiple people from within the Mountain West and from other conferences. … And I still don’t understand the reason why. Ultimately, you could add 10 more teams to the FBS and it’s not going to impact the SEC or the Big Ten. … Can the SEC and the Big Ten keep other leagues from adding FBS members? Absolutely not. But somewhere down the road, would they hold that against those leagues? Florida State and Clemson both filed briefs with the North Carolina Supreme Court yesterday regarding their ongoing ACC lawsuits. The Athletic’s Matt Baker notes there is “nothing earth-shattering at first glance. Both used a lot of words to say that as state schools, they can't be sued in another state because of sovereign immunity.” (link)

Kansas approves an ongoing FY25 budget of $122M that’s expected to fall short of expenses by $16M per KUSports.com’s Henry Greenstein. That comes after nearly breaking even in FY24 by posting a surplus of $438K on a $127M budget. Several factors helped contribute to the budget shortfall including the relocation of football games off campus (to Children’s Mercy Park and GEHA Field at Arrowhead Stadium), a new stadium operations partnership with Oak View Group and recently completed renovations to Allen Fieldhouse. Jayhawks CFO Pat Kaufman: “We knew this would be a year where we would have to dip into some of our liquidity sources to kind of make it through the year, knowing that when the (renovated David Booth Kansas Memorial Stadium) comes on next year and the year after that and starts generating some serious revenues, we’d kind of catch up and move ahead in a great way.” The department is expected to cover the $16M shortfall from a line of credit it established during the COVID-19 pandemic. In other KU news, AD Travis Goff reiterated that the Memorial Stadium project remains on time and budget for the 2025 season opener against Fresno State on August 23, 2025. (link)

Hawaii AD Craig Angelos joins The Sports Nutz podcast and says the Rainbow Warriors are closing in on a deal to make Nike its new apparel partner. “Our teams will be really happy with that if we can bring that in for a landing, but it’s always sticky because the apparel companies want to hold onto you. They’re very competitive, they try to match each other's bids, etc., but if we did end up making it to Nike, that would be I think a big accomplishment for our program. I know our coaches and student-athletes would probably really appreciate it, too.” Regarding the new Aloha Stadium project, Angelos explains the state has allocated upwards of $400M for the stadium itself, and a developer would be responsible for funding the rest of the mixed-use entertainment area. “So, the question I think will come down to, can they fund the rest of the surrounding area? If they can, then it'll all come together and we’ll be playing out there in the fall of 2028.” Angelos also talks about having leadership roles in various athletic departments and explains that every place has its own identity. “So you kind of have to unlock the code for each particular place you go. … So when I go to different places, depending what responsibility I have, I try to look to see what's going really well. Where are we and where do we need to be? If we're already doing a good job, then we move on to the next one, but just surgically try to go in there and try to ascertain how we can make it better.” Full podcast. (link)

Ole Miss Football HC Lane Kiffin blames the tampering that occurs within the sport on the timing of the fall transfer portal window, which forces players to inform their programs whether they plan on transferring before the season ends. “I don’t really worry about what we can’t control. I mean that happens a lot. So just try to keep our guys focused. Again, it’s a really poorly thought-out system of the windows, when they are and people tamper all the time. So we just try to maximize the really poor system that’s been set up and try to avoid the distractions. And part of it — to finish that — part of the problem of the really poor system is creating these free agency windows and they happen before a season’s not even over. So, you’re just basically inviting kids to wander mentally and to get tampered with because when the windows are, people are still playing. Can you imagine the NBA or NFL, if free agency were to start in the playoffs? It would never happen. I don’t know that it’s very talked about but just think about that for a little bit.” The NIL component further complicates the process, as Kiffin notes: “You’ve got young kids going ‘Wait, I can go and make that much money somewhere else if I go in the portal and leave?’ So, that’s just really — we don’t have enough time on this call for all the problems with the system and how not-thought out it was.” (link)

UCLA is not expected to bring in a single men’s basketball recruit from high school during the early signing period that began this week, according to the Los Angeles Times’ Ben Bolch, who notes it would be the first time the Bruins have done so in “at least a quarter of a century.” Bolch adds: “It’s possible they might not land a high school player in the spring or summer either, largely because of their roster construction. The team has just two seniors in addition to three players who plan to redshirt in hopes of a larger role next season. Bruins HC Mick Cronin: “There’s really only one rule: You can transfer every year. So who the hell knows [what will happen] next spring? Who knows? And then you sign early now, it used to be binding, now it’s just an aid thing. If a guy wants to change, he can sign with you and if he decides to change his mind, they’re going to let him out [of his scholarship]. There are no rules, let’s just be honest about it. … In this era, you have to build a team one year at a time and obviously you’re hoping that you’re not going to have to totally start over every year. So there are some prospects that we could have a team…but if we could have a multitude of guys back that would be great, that would be awesome for a lot of reasons — less craziness for me in the spring with some continuity for 2025-26, but you just don’t know.” (link)
