Plaintiffs’ lawyers in the House and related cases say in court filing that "a number of third parties have sought to profit from the Settlement by offering claims-filing services,” according to USA Today’s Steve Berkowitz. The attorneys add that “some entities have made various misleading statements to solicit" clients, and they are asking U.S. District Court Judge Claudia Wilken to issue an order making it clear that class members do not need to enlist third-party services to participate in monetary relief, the use of such services will not increase the amount of monetary relief, and no-cost assistance is available from the Claims Administrator and Class Counsel during the filing period. Hawaii has released a statement concerning the departure of AD Craig Angelos which reads, in part: “This is a confidential personnel matter. The University of Hawaii confirms that Mr. Angelos' final day as the UH Mānoa athletic director is December 1. Effective December 2, Associate Athletic Director Lois Manin will serve as the acting athletic director. An announcement about a future search will be made by incoming UH President Wendy Hensel after the new year. President David Lassner met regularly with AD Angelos since he was hired, as he does with all his direct reports. Lassner made the decision to part ways with Angelos based on performance. This action is taking place now following the completion of the search for the new UH president.” (link); Angelos has also issued a statement explaining he was “completely blindsided when I learned of the outgoing President’s decision to part ways. When I asked for the reason, he cited my performance – a response that absolutely shocked me because I thought things had been going pretty well for our athletics department. In a short amount of time, I believe we accomplished so much like creating new revenue streams, hiring a ticket sales team, revamping fundraising efforts, focusing on NIL initiatives, navigating the effects of the NCAA House settlement, securing a place in the Mountain West Conference while eliminating travel subsidies, arranging charter flights for the football team, negotiating a record-breaking apparel deal, developing a facilities master plan, collaborating with the stadium authority on the new Aloha Stadium project, and balancing the budget for the past two years. … I want to assure everyone that there is no ‘smoking gun’ here – no hint of impropriety or malfeasance, either personally or professionally. Michigan AD/CFP Selection Committee Chair Warde Manuel was asked about the seven-spot gap between Texas and Georgia despite the Bulldogs’ win over the Longhorns in Austin and said: “Well, obviously Georgia has a very good win at Texas, but as the committee analyzed the body of work of Texas versus where Georgia is at the present time with two losses, even to top-25 teams, we came out that Texas was still a very strong team deserving of a 3 seed. They have a top-5 defense. Quinn Ewers is leading one of the top passing offenses in the country. … It's nothing against Georgia. Georgia is a great team, but they did struggle against Ole Miss at Ole Miss but had a great win this past week against Tennessee. We will continue to monitor both teams and see how it goes in the next few weeks.” Manuel also says the committee “had a long debate” about Georgia and Ole Miss, Miami (FL), Alabama in particular. “It was very, very thorough. We're dealing with very small margins in terms of the different things that we're looking at and comparing, so I can assure you the committee went through it intensely in the last couple of days.” Asked about how the committee views strength of schedule – particularly in Georgia’s case, as the Bulldogs have wins over three teams ranked in the top 16 – Manuel explained: “We take a look at it holistically. Strength of schedule is a component. It's an important data point to us and for us. But it is not the only assessment that we make. Priority Sports agent Rick Smith joins Tulane Sports Law Director Gabe Feldman to take a look inside college coaches’ contracts, the trends in college coaching, where the money is, where it’s going and more. Smith emphasizes the fact that universities don’t have endless supplies of money and are therefore “scrambling” to find ways to share revenue with student-athletes. For instance, one of Smith’s clients, a “mid-major coach,” was told he needed to take a pay cut by his AD. Smith also cites Florida’s decision to retain Football HC Billy Napier. What Gators AD Scott Stricklin didn’t say in announcing that decision is that letting Napier go comes with a $26M buyout. “They’re looking at the buyout with the loss of revenue and saying we can't make these numbers work, so we'll just let it roll.” Given the “exponential increases” in coaches’ salaries, Smith wonders “what's going to happen there. Are we going to stop in our tracks? Are we going to see these increases? Because if one school does it, then everybody needs to follow. So, are we going to have unicorns and outliers and then everybody else? Or how's that going to work?” Smith also wonders if, moving forward, athletic departments are going to set “different parameters for without-cause terminations. I think that 100% guarantees are going to be tougher probably to negotiate.” (link)

The Atlantic 10 Presidents Council concluded its Fall Business Meeting by affirming the league’s long-standing, deep commitment to basketball success within the current national climate. From the A-10’s release: “As a basketball-centric Division I Conference, the council and [athletic] directors discussed the changing future environment of NCAA Division I as it will be impacted by the court rulings on the House, Hubbard, and Carter cases. The consensus was that the Atlantic 10 Conference will continue to support and fund its flagship programs at the highest possible level as permitted by NCAA rules, with the permissive opportunities going forward directly benefiting student-athletes and their success through NIL opportunities. The council and the directors emphasized the importance of staying united as members of the A-10 during the changing times.” Also: “Although there will be a diverse approach to institutional management, a unanimous vote approved a recommendation to provide a $1.4M supplemental distribution from the Atlantic 10 sustainability fund. The equal distribution to eligible member institutions is designated for use to enhance basketball and/or offset the potential lost revenue from the NCAA due to the House settlement back damages payment model assessment assigned to every Division I institution.” More. Clemson Football HC Dabo Swinney voices his frustration with the House settlement: “Obviously we have to cut a lot of guys this year. It’s terrible. It’s the worst thing in my whole coaching career and what’s going on. But we’ve gotta cut a bunch of kids that have been in our program.” Several players who will not be allowed to return to Clemson for the 2025 season will be honored at Senior Day on Saturday, and Swinney says: “I’ve given all of them an option, if they are in their fourth year, then they have the option to be honored as a senior. They’ve earned that. Some of these kids would be back for their fifth year next year and they’re not going to have the opportunity to do that. And that’s sad, but that’s the way it is. So we’ve given them an opportunity. Those kids that if you’re graduating in December or May, you can be honored as a senior if you want to. … We’ve got a lot of walk-on guys that know that this is going to be their last opportunity and they deserve it.” (link)

+ The ACC has signed a deal to make Geico the presenting sponsor of this year's football championship game. SBJ’s Ben Portnoy notes financial details have yet to be made available, but it's “expected to be an investment in line with similar collegiate events for presenting sponsors via media and sponsorship. + Comcast will spin off its NBCUniversal cable TV networks, including MSNBC, CNBC, USA, Oxygen, E!, Syfy and Golf Channel, leaving only Bravo as the only network to remain with the NBC TV business. The assets being spun off generated roughly $7B in revenue in the 12 months ended September 30. Mark Lazarus, who is currently the chairman of NBCUniversal’s media group, will be named CEO of the new venture, per the Wall Street Journal’s Amol Sharma. Variety’s Brian Steinberg adds some context: “The split will undo a massive media deal. Comcast spent more than $13B in cash and asset contributions to buy 51% of NBCU in 2011, and then another $16.7B in 2013 to acquire the remaining interest in the company. Since that time, Comcast has acquired the kid-media assets in DreamWorks Animation, invested heavily in U.S. rights for the Olympics, and even dabbled in digital media by investing in BuzzFeed. But the spinoff is indicative of the growing weakness of cable as a medium. Standalone cable networks have become complex but toxic assets in the modern media lineup. They continue to generate millions in advertising and distribution revenue. … Still, they require millions in content spend to keep up their ratings at the exact moment that many of their viewers are moving to streaming services.” (link, link)

Hawaii AD Craig Angelos has been dismissed by outgoing President David Lassner, effective December 1, according to Action Network’s Brett McMurphy, who notes that “no reasons were provided by Lassner.” The Honolulu Star-Advertiser’s Billy Hull points out Angelos has been working without a contract under an “at-will” agreement and was informed of the news prior to leaving for last week’s football game at Utah State. Attorney Jeff Portnoy, a former member of the UH Board of Regents: "What's interesting is he's making this termination, Lassner, within weeks of his retirement. I find that fascinating that he's not leaving that decision to the new president. So is there something really serious that happened internally? Or is it a matter of dissatisfaction with his management style? I don't know that, but whatever the reason is, I don't think anybody can see this as a positive at all for the program. It puts it in limbo. The decisions athletic directors make, you have coaches coming up for extensions. Who's going to do that? These are imminent things." The Pac-12 has officially announced its choice of Octagon as its agency of record to advise the conference on its media rights strategy through its rebuild. The news was first reported by JohnCanzano.com’s eponymous proprietor last month. Commissioner Teresa Gould: “Going into the marketplace to identify and secure some strategic media partners is a really, really important part of our future. I’ve been pretty transparent all along that once we secured our six target institutions, then we were going to pause and pivot and focus on this media rights strategy. We’re really hoping to be a forward-thinking, open-minded kind of modern-day conference, and we are looking for the right media rights partners to help us create that.” Octagon EVP of Global Media Rights Consulting Dan Cohen says all media bundles are on the table, adding: “It's really important that we build that storyline, and we build that brand, and we tell the story of these eight schools and potentially more, and you do that best with free-to-air exposure.” Gould would prefer a variety of different platforms across linear and digital to grow audiences, something she said is a priority for coaches and administrators at member schools. “We have a blank slate. These presidents and these athletic directors are forward-thinking and are willing to do things that other conferences may or may not have considered doing. Playing on nontraditional days, looking at the format of our championships, doing things that help elevate and support our national brand and continue to keep these programs relevant is important.” SBJ’s Mollie Cahillane notes: “Ideally, a final round of partners will be locked in by the spring, depending on how quarterly earnings go.” (link); Official release. DePaul AD DeWayne Peevy in a letter to fans explains how the House settlement will impact the Blue Demons and writes: “While these anticipated changes bring new opportunities and increased resources for former, current and future student-athletes, they also create significant financial challenges for our program. We are incredibly fortunate within the Big East Conference that our new broadcast television deal, announced earlier this summer, will help mitigate this lost revenue. In anticipation of these changes, we have been working diligently to identify multiple opportunities to reduce our department's operating expenses and maximize revenue. As the college athletics system modernizes, our approach must modernize as well. You will undoubtedly begin to see these changes in the coming months.” (link)

Nebraska AD Troy Dannen hopes NU will be able to unveil plans for the renovation of Memorial Stadium sometime in early 2025 and says ticket prices won’t increase until construction is finished. Undertaking such a big endeavor, Dannen acknowledges, means the on-field product has to improve. "We’ll have to raise a lot of money. Why do we want to win six (games)? I know as a business man, I'd like to win six to get that momentum going into a year where we're going to start asking people for gifts to lay the cornerstones and get the foundation work of the new stadium done." Dannen also says he spoke with Big Ten Commissioner Tony Petitti about the officiating during last week’s loss to USC, particularly on the Huskers’ last offensive play where it appeared wide receiver Jahmal Banks was held. "In this game, the foul wasn't thrown. Our concern has been why? It's a judgment call, but it seemed kind of egregious. I'm not trying to take the official to the middle of town square, but how do we make things better? How does it not happen again?" As for whether a Terrence Crawford boxing match could take place in Memorial Stadium, Dannen says it’s up to the WBA light middleweight champion. “It's really in his corner, but I haven't talked to him since [he expressed a desire to fight in Memorial], but we'd like to get him in there.” Regarding reports that the Huskers’ season opener against Cincinnati next football season could move from Indianapolis’ Lucas Oil Stadium to Kansas City’s Arrowhead Stadium, Dannen explains: "I would guess we'll see something in the next week – where that will take place, not sure when, but there may be some changes on that.” (link)

Ohio Governor Mike DeWine signed an executive order yesterday that allows colleges and universities in the state to directly pay student-athletes for their NIL. The order is set to expire when the House settlement goes into “full operational effect.” A spokesperson for Ohio State tells Cleveland.com: “We appreciate the governor’s support as the college athletics landscape continues to evolve.” (link); Full EO. U.S. Senator Tommy Tuberville (R-AL) has some ideas about NIL that weren’t included in the PASS Act he co-sponsored with outgoing Senator Joe Manchin (I-WV). In remarks at the Monday Morning Quarterback Club in Birmingham this week, Tuberville remarked: “I’m not against players making money, but we got to have some kind of penalty for players breaking contracts. So it’s got to go both ways. … So we’ll continue to look at it once we get a new administration in. I’m going to get a couple of people on the Democratic side.” As for precisely what penalties players should face, Tuberville says: “Well, going back. Well, there’s going ... There’s going to have to be some exceptions. But my thoughts are, you know, you sign a contract on NIL, I mean you can’t just up and break it. I mean you gotta…you wanna sign a year, two-year, three-year, you got a three-year contract. If you break it, there’s gotta be some kind of penalty. We’ll have to go through all the rules and regulations when it comes to the commerce committee on this.” Tuberville went on to say that players breaking NIL contracts is the complaint he hears most from his old colleagues in the coaching world. “I don’t think that it’s right to go out and start offering a half-million-dollar contract to a 10th grader in high school. I don’t think that…I don’t think you should be able to recruit with money. I think you recruit with your school and your salesmanship, but then you get there and then you give them the opportunity to make money.” More from Tuberville. (link)

+ Now is not the time to push back on Ohio State’s frequent Big Noon appearances, according to Buckeyes AD Ross Bjork, who says: “I think that’s an offseason conversation honestly, but here’s what I’ll say: Fox has the first pick. We’re the biggest brand within the Big Ten. We have the most fans who watch our games. The ratings are really high, and I’ll just kind of leave it at that, but that’s really an offseason conversation.” Bjork also noted that Oregon being on the West Coast, where they’d be kicking off at 9 AM is likely a major factor in OSU’s noon kickoffs. “If Oregon’s playing on the West Coast, they really can’t play a 12 noon Eastern Time game. You have us, Penn State, Indiana. We’re the most successful programs this year. If you just look at that piece of it from a time zone standpoint, it kind of makes sense where it’s landed. That’s more of an offseason analysis, more of an offseason conversation.” (link)
