Virginia President Jim Ryan talked about the future of athletics at a Faculty Senate meeting last week and noted UVA will look to strategies such as utilizing philanthropy and fundraising campaigns to help navigate financial challenges while preserving the University’s academic mission. He added: “Right now, it's so cloudy that it doesn't make sense to me to just throw in the towel and say we're going to no longer try to compete at the highest level in all the sports that we compete in. But there may come a time where we have no other choice than to make hard decisions about what we're going to do in college athletics.” (link)

Indiana AD Scott Dolson shares some background information on how Football HC Curt Cignetti’s contract extension came to fruition: “In my catch-up meeting with President [Pam] Whitten, I made a recommendation to her that we be proactive, that he's doing such a great job, certainly we're in it for the long haul, why don't we get ahead of this? And she wholeheartedly accepted that recommendation. And I should say this – and I'm not saying this because she's my boss, I promise you this – she's been incredibly supportive, back to when we made the change last year, just in the whole process. We wouldn't be here today. She probably hasn't gotten the attention she deserves, in terms of just her support for the program and for our vision for Indiana football. But based on that, after letting her know my recommendation, she accepted, and I had my meeting with Coach Cig. I said to him, ‘I know the last thing you want to think about right now is your contract.’ He's worried about our next opponent. But I said I want to get out in front of it because I don't want you to worry, does your agent have to shop you around? How are we gonna do this? I said it's really important to us that we're not just being reactive to someone coming after you. We know your value, and we know where you are in the Big Ten, and we want you to feel that. UC Santa Barbara AD Kelly Barsky joins AthleticDirectorU’s Steph Garcia Cichosz to discuss her first year in the chair, the value of having deep institutional knowledge as a leader and her commitment to lifelong learning. Barsky and Garcia Cichosz also reflect on the nonlinear path to success, strategic thinking from the big chair and values-based alignment before diving into routines and habits, favorite podcasts and books every leader should read. Barsky explains she’s an “organized and structured person” but understands that an AD must be agile enough to pivot multiple times throughout a given day: “Having, I think, schedule and structure and communication and set time frames for check-ins are all great, but also be ready to change and adjust and recognize that priorities may need to shift any day, any week, any month based on the need and how to best serve the the department and the campus.” Barsky adds she’s “still leaning in and learning how to best use technology to help serve and support. [It’s] very granular, but as an example there are some really regular things that need to be communicated, need to go out, so it's schedule those all. North Carolina Football HC Mack Brown opens up about how much the recruiting process has changed during his career: “It’s interesting that there’s a lot more talk about portal now than there is recruiting. It’s changed that much. You’re looking at guys now that are transferring, like the quarterback at Wake, this is his third school, and we fought our guts out to get Tez [Walker] to play at a third school. He didn’t even play at the first one. Now, here we are. We got guys that are at their fifth school. So it’s just changed so much, and it continues to change daily. We tell our coaches to stay off social media and don’t worry about what’s happening in the lawsuits and revenue sharing.” Post-House, Brown says schools are “going to have to start deciding who gets paid more because it’s going to be salary caps, and you can’t pay them all the same. You’re actually going to have to say, ‘This safety is going to get this much money, so this safety is going to get less.’ And I’m sorry, but if you don’t like it, transfer, because that’s just the way we feel. Not only are you going to have to do a better job of evaluating before they get here, you’re going to have to do a great job of evaluating who you’ve got, and then you’re going to have to develop who you’ve got.” (link)

Ole Miss Football HC Lane Kiffin says of the SEC Championship: “I’ve talked to other coaches, so I’ll just kind of give you the feeling from some other coaches that they don’t want to be in it. You know, the reward to get a bye [in the College Football Playoff] versus the risk to get knocked out completely. I mean, that’s a really big risk. I think it has ended up being a very unique situation of all postseason sports, the way that system is set up there. How could you go to [the SEC Championship] and get knocked out [of the CFP race]? And if you don’t go [to the SEC Championship game], you’re in. … There’s great benefits to this playoff system and so many people being excited and fans and programs and more games, and then there’s cost, too. The conference championships don’t mean as much. And it’s not just, do you potentially get knocked out by losing that? Do you [have] more injuries? So you’re going to get more injuries, play another game to get a bye, but then the other people are having their bye while you’re playing [in the conference championship game.] So I think that’s why, and I’ll go on record saying it, why a lot of coaches – or some coaches I’ve talked to – don’t want to go.” (link)

The MEAC has suspended a total of 36 football student-athletes – 17 from Howard and 19 from North Carolina Central — as well as an NCCU AC for their roles in a postgame fracas on Friday night. Commissioner Sonja Stills: “The Mid-Eastern Athletic Conference has a zero-tolerance policy for fighting, as it directly violates the values of sportsmanship, respect, and integrity that define our Conference. We are committed to maintaining a safe and respectful environment for all student-athletes, coaches, and fans. Any actions that compromise these principles will result in serious consequences. We expect all participants in MEAC athletic events to conduct themselves with dignity and uphold the high standards that reflect the spirit of the MEAC.” The names of those suspended were not released. HBCU enrollment is recovering from the pandemic at a “faster rate than much of the rest of higher education,” according to the Washington Post’s Danielle Douglas-Gabriel, who notes some HBCUs have reported as much as a 30% increase in this year’s freshman class compared with prior years. HBCU leaders attribute the gains largely to years of strategic planning that are now paying off. For instance, Livingstone (DII) President Anthony Davis helped raise the school’s freshman retention rate from 50% to 78% by connecting students with academic support centers and engaging them before they could consider leaving. Davis: “Our strategy is working. We’ve been looking at how we recruit and retain students, being very intentional and we’ve seen great results." United Negro College Fund Frederick D. Patterson Research Institute Asst. VP Nadrea R. Njoku adds: “All of our HBCUs are thinking critically about their business models and how they create different streams of revenue and target different populations. … They are in the public eye and taking the opportunity to tell their story." Meanwhile, opinions are mixed on whether the Supreme Court decision ending race-conscious admissions is a driving force behind the enrollment growth, as Douglas-Gabriel points out that applications did increase nearly 30% this year for the 39 HBCUs that use the Common App, including Howard and North Carolina A&T, but “those schools have reported steady growth for several years.” Benedict (DII) VP for Enrollment Management Yohannis A. Job says the SCOTUS decision “has given HBCUs an opportunity to really tell our story and highlight ourselves as an institution of choice. It has allowed young people to ask the question: Is this the place where I will be celebrated…where my identity will not just be a diversity checkbox?” More. (link)

ESPN is working on a plan to add generative AI to its SEC football coverage. FACTS, an AI avatar, is being trialed for “pregame convos, promoting education and fun with sports analytics,” SEC Network/ESPN Coordinating Producer Baron Miller: “FACTS is designed to test innovations out in the market and create an outlet for ESPN Analytics’ data to be accessible to fans in an engaging and enjoyable segment. It complements our journalists and on-air talent, providing additional insights." ESPN debuted FACTS at its Edge conference in New York last week, during which Chairman Jimmy Pitaro noted: “There are ways for us as an enterprise to really benefit from AI. And don’t get me wrong, AI is disruptive, but I see it as disruptive in a good way and kind of pushing the sports fan experience forward. I do not see this as displacing jobs.” (link, link)

The Buffalo Bills and Miami Dolphins are the first two NFL teams to sell stakes in their franchises to private equity firms, according to SBJ’s Ben Fischer, who reports: “Both the Bills’ proposed transaction and the Dolphins’ plans to sell 10% to Ares Management… are on the agenda for Tuesday’s NFL finance committee meeting, indicating a high probability of winning final approval from owners in December.” Financial terms are unknown, but CNBC recently valued the Bills at $5.35B and the Dolphins at $7.1B. Bloomberg, which first reported the talks between the Bills and Arctos and the Dolphins and Ares, said the Dolphins and other assets held by owner Stephen Ross were being valued at $8.1B. Bills buyers previously unknown include Rob Palumbo (5.6%), co-managing partner of the private equity firm Accel-KKR; a group led by Theresia Gouw (2%), co-founder and managing partner of the venture firm Acrew Capital; Sue McCollum (1.7%), CEO/owner of alcohol distributors Eagle Brand Sales and Double Eagle Distributing; and a group led by Tom Burger (1.4%), the co-founder and managing partner of Gridiron Capital. In addition to Ares, Dolphins buyers reportedly include Nets co-owner Joe Tsai, who will buy 2.9% of the team, and Nets minority owner Oliver Weisberg, who will buy 0.1% of the team. (link)

Northwestern has released more details for the $850M reconstruction of Ryan Field, which could “launch a new type of [college football] stadium design, focused on enhancing fan experiences and incorporating elements from recent NFL stadium builds,” per ESPN’s Adam Rittenberg. A video tour of the stadium shows off the amenities, including a European soccer-style canopy that protects fans from weather and amplifies noise, several premium options, restaurants, street fairs and lots more. (link - article, link - video renderings & overview); Sportico’s Eben Novy-Williams observes Ryan Field will boast two “notable and almost contradictory superlatives. Upon its completion in 2026, it will be the most expensive college football stadium ever built. It will also have the fewest seats among the 34 Power Two teams. Specifically, there will be 35K seats, down 12K from its previous capacity and 42K seats smaller than the average SEC or Big Ten venue. What was Northwestern’s rationale for the design? “First, there are some practical considerations. Geometrically, without a 40K-seat upper bowl, the entire stadium can be closer to the action, allowing for better sightlines. Financially, upper bowl seats are the most expensive to build and typically produce the least revenue. More broadly, however, attendance across college football is down about 13% since 2010, and many schools with bigger venues struggle to fill the upper reaches of their stadiums. The bulk of the ticket money is generated from premium seating—suites, box seats and other hospitality areas—and the new Ryan Field will have four different tiers of those pricier options.” Wildcats benefactor Patrick Ryan Jr.: “So the question is: How do you invest in something that’s not just putting more people in the rafters? As part of Warner Bros. Discovery’s settlement with the NBA, 13 Big 12 football games and 15 men’s basketball games per year will move from ESPN’s streaming platform to the linear channels of TNT and TBS. The sublicensing deal starts in the fall of 2025 and runs for six seasons. Yahoo’s Ross Dellenger: “Weekly kickoff times are still unclear, but 10 of the 13 games will be Big 12 conference matchups. The Big 12 games will be simulcast on the streaming service Max. … Perhaps overshadowed in the NBA’s announcement, the Big 12 piece is a significant boon for the conference. The deal shifts football games scheduled to air on ESPN+ streaming to more visible linear channels, gives the league a fourth network partner and positions the conference well in its next television contract negotiations, [Big 12 Commissioner Brett] Yormark said.” Yormark adds: “This is additive to what ESPN and Fox bring us. That’s why this is a great deal. Any addition to both is complementary and will lead to more promotion and marketing around the Big 12 and conference brands.” (link)

Partner Katie Davis notes the IRS released its statistics on excise taxes paid for 2023 and explains: “The number of entities & total tax paid on the Compensation Excise Tax decreased compared to 2022. Although some public colleges & universities shed their 501c3 status, it seems unlikely to account for this decline. Stats on the section 4960 excise tax on excess compensation per The Tax Law of Colleges and Universities: 2023: 1,274 organizations paid $569,745,191; 2022: 1,710 organizations paid $670,899,001; 2021: 516 organizations paid $210,061,282; 2020: 302 organizations paid $96,168,764. Once referred to as the ‘Nick Saban rule,’ the tax law that went into effect left some loopholes and inconsistency in how this has been treated. … It will be interesting to see whether the TCJA gets renewed or sunsets under the next presidential administration. It's possible this rule could eventually go away. Schools have used techniques to reduce their tax liability, including royalty payments for the license of a coach's NIL and loans for split dollar life insurance. Some public universities have also considered whether to give up their 501c3 status entirely (a complex heavy lift.)” (link)

Absolutely we’re going to have to walk that path. But I don’t want to weave through the guys recruiting-wise that just want to go somewhere because they’re making more money than the next place. Because it is my job to take care of this team, and that’s what I tell my staff and our administration. It is my job number-one at the end of the season to keep our best players right here in Boise, Idaho. … Then, second to that, is recruiting. And that will never get gray for me. That will never become any different, because I believe in that. You come here and perform the way we want you to and do it for this team, we take care of those guys first. In regards to some of the stuff coming out, it’s exciting. Jeramiah has done a phenomenal job, we have a ton of support. So it’s there, but I have not been involved in those conversations with our recruits. I tell them that’s there, but I don’t promise anything to these young men. Legal Matters…
+ Utah lawmakers are asking Utah State to join a lawsuit filed by several Mountain West volleyball student-athletes against the conference which alleges the league, San Jose State, and the NCAA violate federal law by diminishing sports opportunities for women. Utah Governor Spencer Cox, Senate President J. Stuart Adams and House Speaker Mike Schultz say USU joining the suit would send “a clear message.” A joint statement from the trio reads, in part: “Female athletes deserve the right to a safe playing field, fair competition, and equal opportunities. The NCAA Mountain West Conference and other institutions across the nation have failed to take action, thereby undermining vital protections and putting female athletes at risk. We will continue to defend our female athletes.” (link)

It’s one of the best days of the year: Army West Point has revealed its football uniforms for next month’s Army-Navy game: “Inspired by the 101st Airborne Division, we will honor the relentless fighting force of the #ScreamingEagles.” The jerseys include a patch that reads “Bastogne” in honor of the role the Screaming Eagles played in turning the tide of the Battle of the Bulge. The nameplate on the back reads “ARMY!” in an homage to General Anthony McAullife’s response of “NUTS!” to the German commander’s demand of surrender of the town. Awesome. (link)

The North Texas Board of Regents has approved the completion of design work for Phase 1 of the Athletics Center expansion. Phase 1 will include a 50-yard plyometric turf area, 16 high performance dual-sided combo racks, 4K square feet of open floor, a 1K-sq-ft mezzanine cardio space, and a 1,250-sq-ft nutrition site. This year’s Pop-Tarts Bowl will feature three edible mascots with the MVP getting the honor of choosing which gets eaten. The choices are frosted hot fudge sundae, frosted wild berry and a third mystery flavor. Pop-Tarts Director of Marketing Heidi Ray: “The first Pop-Tarts Bowl became one of the year’s biggest memes, and since then, our edible mascot has popped up on red carpets, TV commercials, sold-out Halloween costumes and it continues to get brought up during big cultural moments. The SWAC has suspended seven players from Jackson State and nine from Alabama State for their roles in a postgame brouhaha on Saturday. Commissioner Charles McClelland: “Acts of unsportsmanlike conduct have zero place in the sports of intercollegiate athletics and within the Southwestern Athletic Conference. We will continue to enforce a zero-tolerance policy for all acts deemed unsportsmanlike and contrary to the high standard of good sportsmanship we expect.” Both schools have also been fined $25K.
