Hawaii President David Lassner speaks publicly for the first time since parting ways with AD Craig Angelos and reiterates the dismissal was due to performance. Lassner acknowledges Angelos’ achievements during his tenure but points to private performance reviews as the basis for his decision. Lassner agrees the timing of Angelos’ dismissal is “awkward” but says he didn’t believe it would be prudent to take this action while the presidential search is underway. “It would have become a major distraction and might have overwhelmed that absolutely critical search. At the same time I did not believe that I could or should leave the next president to solve a problem that I believe existed, particularly when it was a result of my own decision.” Lassner goes on to refute what he calls “outright lies,” including “accusations of a coup by individuals in the department or my rewarding my friends.” More from Lassner. Mountain West Commissioner Gloria Nevarez joins the Now It’s Legal podcast with Athletes.org Co-Founder Jim Cavale and says the league has been in discussions about how it will approach revenue-sharing. “I would start by saying all the Mountain West schools are in. They’re going to be participating in some way. What that means yet we don't know. And we've been exploring minimums, facilitation through the conference office, but frankly there are just right now so many unknowns about what that means, how dollars will count and flow toward the cap. We are not a named defendant, so we're really not in the room right now as they are hammering out the details and what the settlement actually means when the rubber hits the road. But we're ready and have been doing the background. I don't know that we have any decisions that we’d announce at this point.” Nevarez believes it’s important for student-athletes from each sport to be represented in a representative government structure. Currently at the conference level, student-athletes are represented by one player from each school, and Nevarez explains: “If you're talking about a basketball issue, you might not have any basketball players in the room. And each student-athlete, if they've not been prepped to go ask their basketball colleagues on their campus, are trying to bring their own perspective and not really representing that sport.” In discussing the possibility of having all of FBS work together in a centralized manner, Nevarez points out that the opportunity for increased revenue across the board is there but points out a similar system used to be in place in which the centralized media rights were handled by the NCAA. “And there was a lawsuit and we lost that lawsuit and the media rights had to trickle out to the conferences. So, the more consolidation we have, the higher our antitrust risk is, which is one of the things I think they're working at the highest levels to try to solve because this fracturing…makes the entire system inefficient.” Full podcast. Ohio State will add 91 scholarships following the House settlement’s implementation, according to Buckeyes AD Ross Bjork, who writes in an open letter to fans: “We firmly believe this new investment will allow our programs to continue to compete for and win championships and keep excellence at the forefront of our mission.” Bjork also notes OSU is committed to maintaining and supporting scholarships for 36 sports. “We will also continue to work diligently to further reduce operating expenses while uncovering many of the new revenue sources that fit Ohio State traditional values. We are committed to being extremely innovative and creative amid these changes to the collegiate sports model. During these times of immense change, we have an opportunity to show the world what it means to be a Buckeye and lead the way into the future.” (link)

The Athletic’s Matt Baker reports Florida State AD Michael Alford today reiterated to the FSU Board of Trustees that with the House settlement soon putting a rev-share cap on things, he thinks facilities, coaches and culture will be more important. “Context: FSU is doing a lot of facilities upgrades, including a major stadium renovation and the construction of a football operations center. Concrete and steel work being done now on that.” Also from Baker: “[Alford] says the GM will generally be negotiating for the school. There will be a capologist and checks and balances. Looking at multi-year contract possibilities. Multiyear contracts would help curtail the transfer portal, FSU's AD says. There'd be a buyout clause if Player X left early. I'm finding this conversation interesting. Evaluation will be even more important, FSU's AD says. If you miss on a first-round pick (or in this case, a 5-star ATH), that counts against your cap. How many times can you afford to miss with a cap?” (link)

Wake Forest AD John Currie outlines the Deacs’ three-pronged approach to the House settlement: “First, like any of you when faced with new expenses in your home or business, we have been drilling down on careful examination and tough decisions about expense reductions and reallocations of existing resources, while still protecting our ability to provide a World Class Student-Athlete Experience. Second, with the support and encouragement from leadership donors, we will once again call on additional investments from all of Demon Deacon Nation, in the form of Deacon Club gifts, ticket purchases, and sport-specific fundraising. And, continued institutional investments in Wake Forest Athletics both solidifies the foundation and amplifies the importance of competitive and academic success. Thanks to President Wente and the Board, we have the confidence to charge forward with this ambitious plan, as some of our competition vacillates and falters.” (link)

Georgia Tech officials are discussing an increase in student fees, according to the Atlanta Journal-Constitution’s Chad Bishop, who reports that “starting in the 2026 fiscal year, the current fee of $127 per semester would increase by $25. The early stages of that proposal for the increase were presented Wednesday to Tech’s Mandatory Student Fee Allocation committee, which consists of four undergraduate students, four graduate students, two faculty members and two members of the administration.” (link)

Learfield has launched EDGE, a marketing agency that will “deliver customized digital marketing strategies to help brands engage consumers, increase purchase consideration, and drive revenue.” Digital industry veteran Scott Meldrum has been appointed EVP of Digital Solutions to oversee the agency and Learfield’s digital strategy. President/CEO Cole Gahagan: “The genesis of Edge was this demand that our brand partners have come to us and said, ‘Can you help me with my programmatic, my performance marketing?’ The other genesis of this was as ‘Fanbase’ was growing. We heard more and more from the campus side of our school relationships saying, ‘Can you help us build our university's brand, reach more prospective students, more parents through performance marketing.’ ... + North Carolina's Rams Club announces two new excellence initiatives in The Carolina Athletics Excellence Fund and the Carolina Athletics Excellence Endowment. The Carolina Athletics Excellence Fund “seeks to provide flexible funding in support of Tar Heel student-athletes through gifts that are unrestricted in use and immediately available, allowing Carolina to respond swiftly to current challenges as well as to seize emerging opportunities. The Carolina Athletics Excellence Endowment takes a longer-term approach with gifts being invested to produce an annual yield that will be used to meet any scholarship needs beyond what The Rams Club's Scholarship Endowment Trust provides – and to meet the variety of funding challenges and opportunities Carolina Athletics will face in the years to come.” Rams Club Executive Director John Montgomery: “It's essential that we answer the challenges with adaptable solutions. Carolina is – and always has been – focused on excellence and the complete student-athlete experience. This dynamic environment holds a lot of uncertainty, but also promise. + Boise State has received an anonymous $1M donation to support the Enhancement Fund for women’s basketball. Broncos AD Jeramiah Dickey: "We continue to see growth in donor and fan support around our women's sports programs, and this gift further shows how much Bronco Nation values women's basketball. + Bowling Green announces the Campaign for Our Future to support enhancements to Steller Field, home of the Falcons’ baseball team. Planned upgrades include the installation of a new synthetic turf playing surface and perimeter fencing. The estimated cost of the first phase of this project is $2.3M and the goal is to meet fundraising benchmarks to start the project after the 2025 baseball season. Alumnus and BGSU Board of Trustees member Paul J. Hooker has agreed to match gifts up to $500K between now and January 31, 2025, to support the endeavor. Falcons AD Derek van der Merwe: "This project has been a critical mission to our baseball team, supporters, alumni, and fans the last couple of years. BGSU Baseball Head Coach Kyle Hallock has taken steps to comprehensively improve all aspects of our program and to position it for success. Legal Matters…
+ Penn State won its trademark infringement lawsuit against Vintage Brand, and Sportico’s Michael McCann explains: “Penn State proved that Vintage Brand, which sells vintage T-shirts, throwback hats, retro tees, socks, magnets, koozies, mugs, cutting boards and similar products associated with sports teams, infringed PSU’s trademarks by selling products bearing the school’s imagery without permission. The jury awarded Penn State $28K in damages, but the verdict’s real value is in a judicial finding that infringement occurred. That finding upholds a longstanding relationship between trademark law and college sports merchandise.” (link)
+ Federal authorities are investigating whether former Temple men's basketball student-athlete Hysier Miller bet on his own games and manipulated the outcome of games he played in, according to ESPN’s Pete Thamel and David Purdum, who note Miller’s dismissal from Virginia Tech was due to federal investigation and NCAA inquiry. Asked for comment on the allegations, Miller’s attorney replied: “Hysier Miller has overcome more adversity in his 22 years than most people face in their lifetime. He will meet and overcome whatever obstacles lay ahead." Temple Director of Communications Steve Orbanek says the school is "aware of the deeply concerning allegations of sports wagering last season,” adding the school has not "received any requests for information" from state or federal law enforcement but "will cooperate fully should we be contacted." Hawaii Assoc. AD for Internal Operations/SWA Lois Manin has released a statement concerning the dismissal of AD Craig Angelos which reads, in part: “There has been a lot of chatter regarding my employment at UH Athletics. I would like to set the record straight with facts and not conjecture. First of all, let me be very clear. I will not be applying for the permanent position. I applied for the UH Athletics Director job when David Matlin retired. I was a finalist. When David Lassner called to tell me that I did not get the job, I thanked him for the opportunity. I was disappointed that I was not chosen, but not surprised. Later that day the announcement was made that Craig Angelos was hired. I called every person on the search advisory committee to thank them for their service. Within the first 30 seconds of meeting Craig, I told him that I wanted him to hear from me and not anyone else that I had applied for the job and that I was prepared to support him fully. I remained in my current job… and supported Craig as best I could with what knowledge I gained in my 25 years in collegiate athletics administration at UH. … I have been both a union employee and an at-will employee. My effort does not change in any capacity or for any leader. It has always been my best effort. I have worked countless hours of nights, weekends and holidays for the department alongside so many others who love the program, our student-athletes, our coaches and our fans.” Full statement. Syracuse Chancellor Kent Syverud talked with the Faculty Senate about the current state of athletics and said: “What’s undecided and what’s really up for grabs is where [revenue-sharing] money is coming from, who it’s spent on and how it’s going to be spent. Those are issues that if this was just a professional sport league would be decided by the owners and the managers and the commissioners. That’s largely where this discussion has been occurring at colleges so far. But there are stakeholders that need to be at the table in that discussion, and those are the students themselves, and not just the student-athletes, but the students who come to college partly for this as part of the experience. It has to be the faculty that are responsible for teaching and curriculum related to these students. And a little more, it has to be the presidents owning up to responsibility for these decisions. I’ve been trying to get that to happen, to get Syracuse to be at the table nationally for these discussions and here, to get all the University stakeholders at the table. I’m thrilled about this discussion and the involvement of this committee and these issues going forward. I have strong views on a lot of the questions that have been raised, including the role of collective bargaining going forward, including Title IX, including other things. But it’s not just my decision; it’s not the athletic director’s decision; it’s not athletics’ decision—on whether to impose a student fee, for example. It’s a more general discussion, and this is just the beginning of that discussion, but it’s going to be fairly active all year. That’s pretty much all I can say at the moment about the uncertainty.” (link)

Wichita State AD Kevin Saal explains in a letter to fans that the Shockers must generate $7M in new recurring annual funding to “compete at the level of our collective expectations” post-House. That figure includes $2.5M additional roster expenses and a minimum of $2.6M in anticipated revenue-sharing. Saal: “We intend to continue comprehensively evaluating our efforts and making adjustments that will allow for high-fan and -donor engagement across all of Shocker Nation while positioning us for excellence. Regardless of all the changes in our industry, as our staff walks through the halls of our Student-Athlete Center, practice facilities and team spaces, our mission remains clear: We develop a tremendous group of young people, in a formative time of their lives. Student-athletes are better prepared for the next 40 years of their lives because of their developmental experiences within our program. Changes to college athletics, such as revenue-sharing and additional scholarships, offer athletic departments new opportunities to impact students and support their pursuit of education.” (link)

South Dakota Attorney General Marty Jackley provides an update on the state’s lawsuit regarding the House settlement: “At the end of the day, my belief is they’re going to have to answer to a South Dakota jury about why they’re not taking proper care of our athletes and why they’re making our taxpayers (foot) the bill for mistakes they’ve made elsewhere.” In its current form, Jackley says the settlement would cost the state about $700K to $1M every year for 10 years, and “the negative impact could come one of two ways. Either the Legislature would have to step in and use taxpayer dollars to fill that void, or, those dollars just simply won’t go to our athletes and our programs. Both of which we are trying to prevent.” Also from Jackley: “At this point, the litigation is a class action. There is what’s called the fairness act which requires the NCAA to give all 50 Attorneys General notice and notice of how it affects their athletes. Jackley says the NCAA is refusing to give that information; therefore, “we simply asked the federal judge to compel or require them to give that information.” (link)

Texas AD Chris Del Conte Q&As with KVUE’s Bryan Mays and says when pitching coaches on coming to Austin it’s about “how do I harness Texas? My job is to go harness what we have. When Bob Bowman took Arizona State to win a national championship on that Friday, I said, ‘Bob I'm going to talk to you,’ and he goes, ‘Hey, I'll talk to you on Monday. Let me go in win a national championship. I was like yeah baby, but that just tells you what [former Longhorns Swimming and Diving HC] Eddie [Reese] built – an incredible swim program. We feel we’re the very best swim program in the country. It’s been established. Eddie won 15 national championships. Bob just won his first at Arizona State and he says, ‘I want that job.’ The resources, the facilities we have, the recruiting base that we have, and swimming's really important. He chose to come. [Baseball HC] Jim [Schlossnagle] I worked with at TCU for 10 years. I knew him. But Texas has been to Omaha 38 times, won six national championships. There is only one Texas.” When it comes to the fan experience, Del Conte says he’s a “big fan of R&D. Rip off and duplicate. I’ll go to another stadium. Say we’re playing LSU at six o’clock. We’ll get there four or five hours before the game and we’ll walk the parking lots, I’ll send a staff member to look at food, send a staff to go look at their music, go look at their in-game, what can we incorporate here?” Facilities, Del Conte continues, have to match the Longhorns’ expectations. “Our football practice facility, we know that’s really antiquated. We don’t have an indoor, we have a bubble. There’s many high schools in the state of Texas that have a full indoor. … At the end of the day, we just can’t wait another 20 years. We’re going to always have to constantly invest if we want to attract the very best.” More. (link)

Georgia Southern AD Chris Davis says during an interview with WTOC’s Jeff Roberts that his relationship with former AD Jared Benko was collaborative but “at the end of the day, Jared was sitting in the chair. There was a lot of respect I gave and made sure that people knew Jared Benko was our athletic director. And it was very important for him to impact those moments and it was my job to carry out not only our decisions, but our vision of our strategic plan and continue to push forward whatever it was, whether it's a facility project or whether it was presenting to our boards or whether it was helping with a coaching search.” Due to his time with the department, Davis says he understands who he can seek out for information and help when needed, as he will have to transition from someone who carries out the decisions to someone who makes them “because if I do both, it’s like a head coach trying to be the head coach and the assistant coach. Or, in football terms, it’s like the head coach trying to be the defensive coordinator or offensive coordinator. It typically doesn’t work because there’s a lot going on there.” He also has a leg up because he doesn’t need to spend the first month on the job meeting the staff. “I know everybody here. My 30-60–90[-day] plan is to make sure I fill my old spot with a great person and then from there making sure that we set the tone as an organization. Like I said, we’ve already been running fast. To do that, you’ve got to win games or you can't stay. Everybody knows that. That’s the modern business, but my job right now, more importantly, is to make sure that these young people are okay and that they're growing mentally, they're growing emotionally, they've got confidence, and they're going to leave our program better than they came in. And that was the promise I made their parents. I also promised…there’ll be a day I wake up and say, ‘You know what? Somebody else needs to be doing this. I'm not excited about going recruiting.’ And I haven't gotten to that yet.” (link)

Legal Matters…
+ Utah State has asked a judge for permission to join a federal lawsuit against the Mountain West regarding its transgender participation policy. The motion to intervene was filed the same day that GOP legislators in the state called on USU to join the suit. (link)
+ Meanwhile, according to Law360, the Mountain West says the motion for an emergency injunction that would force it to ban a transgender athlete from competition ahead of its upcoming conference volleyball tournament comes too late and is a “manufactured” emergency. (link)
+ Vintage Brand was found to have willfully infringed on Penn State’s trademarks and as such must pay $28K in compensatory damages to the school. (link)
+ Former Utah State Football HC Blake Anderson has filed a $15M wrongful termination lawsuit against the school. The suit reads, in part: “The entirety of USU’s purported basis for terminating Coach Anderson ‘for cause’ can be boiled down to one, single incident involving a football player’s arrest on April 5, 2023, for an incident that was alleged to have occurred off campus at the player’s apartment. The alleged incident involved the player and the mother of the player’s child who, at the time of the incident, was not even a student at USU.” The suit also argues Anderson was unaware the player in question was arrested, saying he believed the player’s baby had a medical emergency. Once Anderson did learn of the arrest, the suit states he relayed that information to former Interim AD Jerry Bovee, who allegedly said he would file the report to USU’s Office of Equity. The suit asserts that the Office of Equity started its investigation only when USU began “searching for a reason to fire Coach Anderson at the insistence of [USU Vice President of Legal Affairs] Mica McKinney.” (link)
+ Former Virginia student Christopher Darnell Jones Jr., the gunman accused of fatally shooting former UVA football student-athletes Devin Chandler, Lavel Davis Jr. and D'Sean Perry in November 2022, has pleaded guilty to three counts of first-degree murder, two counts of aggravated malicious wounding and five counts of using a firearm in the commission of a felony. Jones faces a maximum punishment of five life terms plus 23 years. A sentencing hearing is scheduled to begin February 4. A statement provided to ESPN’s Andrea Adelson from the Perry family asks the public to join them at the sentencing hearing “so we can send the message to the defendant and the judge on the impact of the actions the defendant took and what each life meant.” (link, link)
+ An Ohio bank is suing Kent State Football HC Kenni Burns for unpaid credit card debt totaling $23,852.09 plus interest, according to CBS’ Richard Johnson, who reports: “In a complaint filed on September 13, Kent-based Hometown Bank alleges Burns applied for and was issued a credit card and failed to make minimum monthly payments on the card as well as exceeding the credit limit of $20K. Burns is in his second year as head coach of the Golden Flashes, with a starting base salary of $475K, according to his contract.” Burns in a statement says: "My wife and I are aware of a legal matter involving debt related to paying off a recent remodel and move. We are working swiftly to address this matter." (link)

+ The College of Charleston has launched 231-GoClyde, a RealResponse anonymous texting tool to report misconduct (e.g. alleged Title IX or hazing violations) or to seek help and resources. The RealResponse platform will be rolled out via soft launch to the fraternity and sorority community and athletics this fall. A full, campus-wide launch is scheduled for early 2025. (link)

+ The Fiesta Sports Foundation has signed a multiyear partnership with the Arizona Interscholastic Association (AIA) to elevate the experience for Arizona's high school student-athletes, schools, families, fans and partners. Starting immediately, the Fiesta Bowl will be the presenting partner of the AIA Flag Football Championship. In addition to on-field promotional elements, the Fiesta Sports Foundation will be the presenting partner of the annual AIA Student-Athlete Leadership Summit, which brings together students from every AIA member high school to learn and practice leadership skills.
