As the post-House world slowly comes into focus, Kelleigh Irwin Fagan, partner at Church Church Hittle and Antrim, tells SBJ’s Ben Portnoy: “Any time you’re making payments to a student-athlete that has some affiliation with your school, how much can it get into the employment question? How much can you control, through payments, their activities without crossing that line? Maybe you can’t do that much without crossing that line, but all of these issues are so intertwined. Pulling one lever in one direction may impact something else on the employment side.” Smith College economist Andrew Zimbalist earlier this year noted that if Dartmouth men’s basketball student-athletes “are declared to be employees and they’re eligible to unionize, what it means is that every private school in the country will also qualify to unionize. That means Division II schools; it means Division III schools; it means my school, Smith College, because the basketball players at Dartmouth basically have the same existence as a DIII school.” Meanwhile, Athletes.org Co-Founder Brandon Copeland says: “Being an employee gives athletes certain protections and rights that they don’t have today, and that’s the minimum, that’s the standard, that’s the floor. I also think that, listening to our advisers and our legal counsel, there are certain things that being an employee would detract from the current college athlete experience. For some athletes, some of the revenue-generating ones, it would be probably perfect. It would operate much like it does at the pro level. For other athletes, it may end up hurting them in the long run.” (link)

CBS’ Dennis Dodd observes that “clarity on how and whether” to distribute revenue-sharing “is slowly coming into focus: if fully funded, football would get the overwhelming share of that $20.5M at a particular school – between $10-15M annually for the next 10 years; men's basketball would get between $2-4M; the remainder – a fraction, really – would go to women's basketball” and other sports. Therefore, it wouldn’t make sense to offer a men’s basketball player $4M, the reported offer BYU was willing to make to top 2025 recruit AJ Dybantsa. Kennyhertz Perry attorney Mit Winter: "Coaches who have been talking to [NIL] agents don't even understand. The agents don't even understand the House settlement at all, that it's going to have a cap. They're going to have to temper some expectations on how much guys are going to be paid. Definitely [in] basketball but maybe overall, too." Dodd submits that as revenue-sharing plays out, “it will be hard to argue against the SEC and Big Ten consolidating their power. The implications of the overwhelming majority – if not all – of those 34 schools being able to afford an extra $20.5M annually are more than about monopolizing recruiting. The two super leagues no doubt will use revenue sharing to make the case for increased influence, be it policy making in everything from NCAA rules to the size of the College Football Playoff.” One Power 4 AD tells Dodd: "This will be a separator. Maybe a national separation that we need. I don't know." To that point, one ACC administrator says: "Why are we going to spend $20M that we didn't spend last year? It really doesn't make sense that we're doing that. Spending [millions] on an average football player just because the SEC's going to do it? I don't pay our coaches the same that SEC coaches get." While questions remain regarding the departure of Hawaii AD Craig Angelos, the Honolulu Star-Advertiser’s Dave Reardon wonders whether the next UH AD “will be expected to work without a contract and, like Angelos, as an at-will employee – meaning that they can be fired at will of the employer, without specific cause.” While such arrangements are good for taxpayers insofar as they forestall buyouts, Reardon notes they can make it difficult to attract quality candidates.” As far as specific candidates, Reardon points out that veteran NBA agent/former NBA AC Jarinn Akana has expressed interest in the role, adding: “Keith Amemiya was at Friday’s game, too. Gov. Josh Green’s sports task force chief was noncommittal about whether he would apply for the job in a text message response Saturday. And noncommittal is smart until you get a feel for what kind of job security, if any, UH will offer its next athletic director.” Amemiya tells Reardon: “If there’s a limit on the number of times a person can be considered and passed over for the position, I might’ve already exceeded it. But seriously, I’m grateful for my current opportunities at Central Pacific Bank (where he is a senior vice president) and with the Governor, so let’s see how the process evolves.” In addition to Interim AD Lois Manin, one person who won’t be interested in the position is former Football HC June Jones, who responded with a simple “yes” when asked by Reardon if it was safe to say he would not be interested. Illinois State has opted to play its FCS Playoff opener on the road against Southeast Missouri State in order to host the state’s high school playoffs at their Hancock Stadium home. Redbirds HC Brock Spack: "I thought it was more important that we get the state high school football championships back on campus. They needed to hear it from me that we would go on the road if we had to that first week. This is where the state championships belong. They were here when I was in high school, and this is where everyone wanted to end up. You can't pay for this kind of advertisement for our community, for our university, and for our athletic and our football program." (link)

The NCAA Men’s Water Polo Tournament field is set with UCLA as the top seed followed by USC, Fordham and Stanford. The other four teams are Salem (WV), Princeton, California Baptist and Long Beach State. Competition begins on December 6. (link)

Georgia Tech has named Chicago Bears Manager of Football Administration/Pro Scout J.J. Cosh as Executive Assoc. AD for Player Management. In the newly formed role, Cosh will work directly with coaches and student-athletes to develop and implement Georgia Tech’s revenue-sharing strategy. Yahoo’s Ross Dellenger: “Expect to continue to see schools hire for such positions as the industry evolves into a more professionalized entity. These hires will do much more than just manage the new rev-share cap as ‘capologists.’ They will oversee new scouting departments and negotiate contracts.” (link, link)

NC State is partnering with Independent Sports and Entertainment to identify a new naming rights partner for Carter-Finley Stadium. Northwestern’s reconstructed Ryan Field “is intended to be not only college football’s most expensive venue, but its most reflective of the modern, live sports fan experience,” according to SBJ’s Bret McCormick, who cites the multiple premium offerings, sightlines and canopy covering every fan as examples. Ryan Sports Development Co-CEO Pat Ryan Jr. says there is still one pressing question which involves paying for the majority of the stadium project before turning it over to university ownership once completed. “Can this move us from a place where our season-ticket base is just Northwestern fans or will we also be able to add some part of the Chicago business community to support a premium program?” He adds: “Chicago is a pro sports town. The good news is people are willing to pay pro sports prices. The problem is you have to deliver something different than you do when you’re in a college town. The expectation of the Chicago fan, the Chicago corporate community, is for a professional-like experience, so that’s where a lot of these products came from.” If the corporate community does buy in – both figuratively and literally and literally – Ryan says the project will be” very financially viable, very financially dynamic. But that’s a theory right now, and we have to see if we can prove it out. We have every confidence that we will, but it’s never happened before; there has never been a premium collegiate experience in Chicago.” (link)

+ The Indianapolis Star’s Zach Osterman shares details from Indiana Football HC Curt Cignetti’s MOU and notes that it includes $11M for staffing, which is up roughly $3.5-4M. The buyout is 85% of remaining income but increases to 100% if IU makes the College Football Playoff or Big Ten Championship. Cignetti will earn $8.3M in Year 1, including a retention bonus. Should Cignetti leave before the contract is up he’ll owe the Hoosiers $13M in Year 1. That figure decreases to $10M, $9M, $8M, $6M, $3M, $3M and $1M in subsequent years, respectively. Cignetti can pick up a $1M bonus for making the Big Ten Championship, $1M for finishing as the CFP runner-up and $2M for winning the CFP. He will also earn $100K for winning five Big Ten games and $150K for winning six. His base salary starts at $6.8M and increases incrementally to $8.2M by the final year. (link)

Legal Matters…
+ In a filing with the Northern District of California today, the Mountain West asked the court to dismiss the Pac-12’s case regarding the legality of the MW’s poaching penalty, claiming the Pac-12 failed “to allege any harm to competition or to itself.” The Mountain West’s motion rejects the Pac-12’s claims that the poaching penalties are anticompetitive by arguing the Pac-12 “does not allege the existence of any defined market. The Pac-12 has not alleged that the MWC exerts any power over any market”. And the Pac-12 admits that Section 7.01 of the Scheduling Agreement is ancillary to a legitimate, pro-competitive purpose.” The Pac-12 maintains that “schools have departed from the MWC for other conferences in recent years. In none of those instances did the new conference pay the MWC ‘poaching penalties.’” (link)
+ A purportedly transgender San Jose State women’s volleyball student-athlete can continue competing, pursuant to a ruling by U.S. District Court Judge Judge S. Kato Crews, who wrote in his decision: “The movants have failed to meet their burden to show irreparable harm, a likelihood of success on the merits, or that the balance of harms or equities is in their favor.” Crews did acknowledge in the ruling that “no Defendant disputed that SJSU rosters a trans woman volleyball player” but added: "The movants’ Title IX theory raised in this case directly conflicts with Title IX’s prohibition on discrimination against trans individuals. … The threatened injury to the movants if an injunction issues is outweighed by the [Mountain West’s] interest in holding the upcoming MWC Tournament without an eleventh-hour shake-up to its currently planned structure. The relief requested with the Emergency Motion would risk confusion and upend months of planning and would prejudice, at a minimum, Defendants and other teams participating in the tournament depending on the results of any reseeding." Crews also denied Utah State’s claim to join the lawsuit. (link, link)

+ Sportico’s Daniel Libit reports that “BPS Foundation, the nonprofit partner of NIL collective operator Blueprint Sports, took in $14M in contributions last year – more than quadrupling its previous annual haul – despite mounting questions about the charitable purpose of it and similar organizations that pay NCAA athletes.” According to a copy of the organization’s 2023 federal tax return, BPS Foundation distributed $9.4M to athletes, and Libit notes the foundation has a shared services contract with Blueprint Sports, through which it paid the company $1.05M in management fees in 2023. Libit adds: “The two entities’ relationship, as Sportico previously reported, has drawn scrutiny from nonprofit experts, who question the public benefit of paying college athletes—even if, as BPS Foundation asserts, it facilitates their engagement with other public charities. In effect, the foundation serves as a tax-deductible passthrough enabling donors to receive a write-off for moneys that ultimately go to Blueprint’s for-profit collectives.” While Executive Director Andrew Beisel maintains the “BPS Foundation continues to operate within the rules and regulations of the IRS as a 501c(3) approved organization,” Libit points out IRS Deputy Associate Chief Counsel Lynne Camillo penned a memo in June arguing that the direct benefits for athletes provided by booster-funded NIL collectives likely undermined their claims of operating for an exempt purpose. “In response, a number of collectives that were seeking tax-exempt status decided to ditch that course of action.” (link)
+ USC women’s hoops standout JuJu Watkins has inked a new NIL with State Farm. SBJ’s Austin Karp notes that “as part of this new deal, Watkins is expected to appear in ads across TV and social media, and she’ll also rep State Farm at select events. Her first TV spot (alongside Jake from State Farm) will air Friday on Big Ten Network.” This is State Farm’s second college NIL deal after signing Iowa star Caitlin Clark last fall while she was starting her final season at Iowa. In the first year of a two-year pilot program, individual tennis championships occurred in the fall rather than the spring season. Competition wrapped up yesterday with Michael Zheng of Columbia and Dasha Vidmanova of Georgia capturing the men's and women's singles championship, respectively. TCU's Pedro Vives Marcos and Lui Maxted earned the men's doubles championship while Virginia's Elaine Chervinsky and Melodie Collard won women's doubles. Team championships will take place in the spring. (link)

JohnCanzano.com’s eponymous publisher sits down with Pac-12 Commissioner Teresa Gould to discuss a number of topics, including the media rights negotiations. Gould “declined to put a firm timeline” on the negotiations, but Canzano notes that “industry insiders tell me a reasonable target for an announcement would be sometime around basketball’s March Madness. Gould wants to manage expectations, but I didn’t hear anything on Saturday that shifted that estimate.” The league’s next expansion move will be driven by feedback from media partners, per Gould, who adds: “I don’t think we need to get all the way to the end of the media-rights process” before expanding. The process so far is in the “introductory stage” with the “who’s bidding?” stage not far off. Gould: “We’re not just looking for whoever is willing to pay the most dollars for our rights. We’re looking for partnership. We need a media partner who wants to be part of our growth and what we’re doing to recreate the Pac-12.” As for whether the league will indeed sell football and basketball rights separately, Canzano writes: “I got the impression from Gould that the conference will shop the rights, at least initially, as a bundle. That could change if a media partner expresses an appetite for a basketball-only offering.” Also from Canzano: “Remove Sacramento State from the expansion board, despite the geography. Gould lives in Northern California, within an hour of the school. She knows the campus well and admires its recent ambition, but I didn’t get the impression that the Pac-12 has an interest in adding an FCS school.” Lots more. (link)

Missouri AD Laird Veatch joins the Mizzou Storytellers podcast with Tigers Director of Letterwinner Engagement Loretta Jones and Assoc. AD for Strategic Communications Dave Matter to talk about MU’s “Will to Win” gameplan to address the major changes coming to college athletics. He also shares insights on closing Mizzou’s revenue gap in the SEC and discusses plans to modernize the fundraising model. Jones points out Mizzou’s revenue is third from the bottom in the SEC and $35M below the league average, and Veatch explains that underscores the need to be aggressive. “The reality is our university is helping us bridge that gap, and that is not a sustainable model long-term, so we have to do what is necessary and can't really expect to take the next step and really to win those championships unless we're at least on a similarly resourced playing field.” Mizzou’s ticket/donation average cost is less than half of the SEC average, and Veatch notes it’s been 12 years since the Tigers have increased ticket prices. “And if you look at the cumulative impact of inflation over that period, that means our potential buying power associated with what we can generate from football is about 40% less than what it was 12 years ago. So, it has a cumulative effect that's really dramatic and we're just going to have to find a way to start to eat into that.” In addition to further monetizing venues through concerts and events and securing more corporate sponsorships, Veatch acknowledges the Tigers will be asking more of fans moving forward. “That is a reality. As we’ve talked about, we’re going to be significantly increasing football prices. That’s going to be something that we really need to push forward. … We need to modernize our fundraising approach so that it really motivates and recognizes philanthropic giving beyond those seat purchases and it also really helps recognize and motivate long-term, lifetime-type giving and recognizes those that have been true leaders for us. Appalachian State AD Doug Gillin discusses several topics on the David Glenn Show, including how the athletic department responded in the aftermath of Hurricane Helene. The football team, for instance, had to cancel its September 28 matchup with Liberty, and Gillin credits Mountaineers Deputy AD/CFO Jonathan Reeder for approaching him over the summer and recommending the department add disaster insurance. “And while I was a little skeptical spending the money, we did it and certainly thankful that we did. When you look at a football game here, it's significant. It’s multiple millions of dollars of revenue that are lost when we don't play football here, so we're going through that process right now with the insurance company and thankful that we had it and looking forward to hopefully being able to recuperate as much as possible from a lost-revenue standpoint.” In regards to the House settlement, Gillin says it’s about “how can we continue to be competitive but stay in our lane? We can’t spend money we don’t have. So for us it's going to be continuing to find different revenue streams as we can, but also continuing to be judicious with how we spend our money. What I'm talking to all of our coaches about is… within the framework of your budget, can you do some things differently to allow for increased scholarships? Baseball scholarships, as an example, [are] going from 11.6 to 34. We can’t do that, we can’t make that jump, but could we be something better than 11.6 if we readjusted our money?” Full interview. The NCAA on Friday filed a 37-page opposition to an injunction filed by Vanderbilt QB Diego Pavia in which it argues Pavia “hasn’t established the requisite necessity for a preliminary injunction,” per Sportico’s Michael McCann, who adds: “The association says he knew of the challenged rules years ago and could have contested them at that time but instead waited until the second half of the 2024-25 season to bring a case. ‘The law does not allow him to manufacture an emergency by waiting to sue,’ the NCAA charges. … The NCAA also contends that Pavia hasn’t established he’s at risk of irreparable harm, a crucial factor for obtaining an injunction. Irreparable harm ordinarily means a kind of harm that money damages can’t remedy.” In fact, the NCAA argues that Pavia’s “desire to continue earning compensation for his NIL” would constitute an injury money could remedy should Pavia be denied an injunction. As such, if Pavia later proves in a trial that he should have been eligible for 2025-26, his lost NIL deals could be calculated and the NCAA could remunerate Pavia for what he would have earned. McCann: “In forthcoming court filings, expect Pavia to counter the NCAA’s use of [former OTE players Matt and Ryan Bewley] and [North Carolina women’s tennis student-athlete Reese Brantmeier]. Pavia could argue Bewley is inapplicable since while the Bewley brothers were paid to play in OTE, there is no comparable point for Pavia. He has not played in a quasi-professional league and, by all accounts, has complied with NIL and other NCAA rules. As to Brantmeier, it concerns prize money restrictions for athletes in individual sports (tennis, golf, fencing, equestrian etc.), not a football player’s continued access to NIL deals.” (link)

Dan Furman, president of the Louisville-focused 502 Circle, explains that “we’re over a $10M collective,” and credits the fans for coming through. “I’m going to be the first to tell you this is really expensive to do. We’re a startup. We are trying to figure it out…we’re trying to build out processes and find ways to keep being competitive and build what we’re doing. It is not easy, by any stretch and there are a lot of people putting a lot of sacrifices forward to try and figure this out.” (link)

Front Office Sports’ Alex Schiffer examines how Santa Clara’s decision to cut football in the ‘90s impacts the women’s soccer NIL infrastructure. Broncos HC Jerry Smith, who was six years into his now-38-year tenure at the time, predicted it would be a problem, telling reporters at the time: “My job just got a lot harder.” The program did not immediately suffer and has, in fact, won two national titles since 2020 and remains a perennial contender. But the way the program recruits has changed, as Smith explains: “We kind of stay away from a five-star kid. Because I think I can win without them. And I’m going to lose out to a Power 4 conference. They’re going to outbid you on NIL. There’s such a low return on that kid for Santa Clara that we really don’t spend time recruiting them.” Smith has yet to offer NIL money to a high school recruit yet, but it’s on the list of calls he knows he’ll be making in the near future. He remains close with both alumna/long time USWNT stalwart Julie Ertz and alumnus/NBA hall of famer Steve Nash but has not asked them for money but says: “It’s coming. I haven’t called Julie. But it’s coming. It’s a big wave that’s coming.” Smith also tells Schiffer there’s a correlation between the athletes he loses to NIL and the schools they choose: those with football programs that can easily outbid them. He says most of those players are landing five-figure deals. But the problem isn’t the money as much as those schools’ ability to spread it further down the roster. Looking ahead, Smith says: “I think Santa Clara is a place where we can last longer if there’s going to continue to be chaos. What’s happening with the money that’s being spent by the Power 4, it’s only a matter of time before the rest of us won’t be able to keep up.” (link)

The SEC has fined Auburn $100K and Oklahoma $200K for violations of the league’s access to competition area policy. It was a first offense for both schools; however, OU was fined an additional $100K for fans entering the field before the game was over. (link)
