As the post-House world slowly comes into focus, Kelleigh Irwin Fagan, partner at Church Church Hittle and Antrim, tells SBJ’s Ben Portnoy: “Any time you’re making payments to a student-athlete that has some affiliation with your school, how much can it get into the employment question? How much can you control, through payments, their activities without crossing that line? Maybe you can’t do that much without crossing that line, but all of these issues are so intertwined. Pulling one lever in one direction may impact something else on the employment side.” Smith College economist Andrew Zimbalist earlier this year noted that if Dartmouth men’s basketball student-athletes “are declared to be employees and they’re eligible to unionize, what it means is that every private school in the country will also qualify to unionize. That means Division II schools; it means Division III schools; it means my school, Smith College, because the basketball players at Dartmouth basically have the same existence as a DIII school.” Meanwhile, Athletes.org Co-Founder Brandon Copeland says: “Being an employee gives athletes certain protections and rights that they don’t have today, and that’s the minimum, that’s the standard, that’s the floor. I also think that, listening to our advisers and our legal counsel, there are certain things that being an employee would detract from the current college athlete experience. For some athletes, some of the revenue-generating ones, it would be probably perfect. It would operate much like it does at the pro level. For other athletes, it may end up hurting them in the long run.” (link)

N4A has rolled out its new strategic plan, which is expected to provide a roadmap for the organization through 2029. Four key priorities: 1) Student-Athlete Support and Success (“At the core of N4A is our commitment to student-athletes. Through innovative professional development opportunities, networking, and mentoring, we will continue to elevate our community's experience and expertise.”; 3) External Relations (“Advocacy and outreach are critical to our mission. We will strengthen our voice and influence with institutional leaders, conferences, and national organizations, ensuring that the perspectives of N4A and its members are integral to shaping the future of intercollegiate athletics.”; and, 4) Internal Operations (“To sustain our mission, we will invest in the infrastructure and processes that enable N4A to operate effectively. Extra Points author Matt Brown writes on his experience as the title sponsor for one game of the Opendorse Bowl Series which saw Westminster (PA) beat Marietta at Tom Benson Hall of Fame Stadium. Brown’s topline takeaways: “Where you play the game matters a lot. Who you partner with also matters a lot. I gotta be honest. There are some legitimate challenges in trying to put on an event in the D-III space, especially with novices like us. But working in D-III also brings some very special opportunities.” On the game’s location and the Hall of Fame Stadium, as all four teams participating got a tour of the Pro Football Hall of Fame: “there’s something unique about being able to offer not just another game, but a game in a new, exciting and different place that adds to the entire athlete and fan experience. This would have still been a great game if we had played it in, say, the Steubenville High School Stadium or something. But playing it at the Hall of Fame changed the experience completely into something even more. […] This was not a bowl game that players needed extra motivation to get up for. Nobody cared that the stands were mostly empty, or that the weather was cold and wet. Matthew Howard, a senior offensive lineman for Westminster, might have said it best in the postgame press conference, when he said ‘a lot of teammates told me their football careers would end in Canton.’ Playing there mattered…but these guys mostly just wanted another chance to play with their brothers. One more bus ride. One more team meal. One more memory.” More. (link)

NCAA Director of Inclusion Niya Blair Hackworth and Institute For Sport & Social Justice VP for Strategic Partnerships and Development Whitney Tarver sit down with AthleticDirectorU’s Tai M. Brown to discuss their organizations’ efforts to develop the structures for a safer, more equitable world via leadership development and education. Tarver dives into the Institute’s founding, including its role in the globalization of sport and justice and its goal to engage, empower and support constituents, while Hackworth shares insight into the development of programming for NCAA student-athletes, coaches and administrators. Both Tarver and Hackworth agree that conversations about equity, justice, diversity and empowerment are essential for today’s leaders. Hackworth: “It’s really hard to measure DEI in terms of success because it’s really a long-term game. So, we think about success as not only how many people we can get to our programs or initiatives or touchpoints that we have, but how we’re able to change mindsets.” Tarver explains that in addition to education, “leadership is also the primary focus of a lot of what we do. So everything is kind of tied into leadership and tied into personal accountability because, like I said, that change that we want to see has to start with the individual has to start with me.
