The Associated Press’ Ben Nuckols takes a look at how a GOP-controlled Congress could usher in college athletics reform, noting that Senator Ted Cruz (R-TX), who is set to take over as chair of the Commerce Committee, remarked recently that a college sports bill will be a top priority. Cruz, who has accused Democrats of dragging their feet on a college sports bill, has publicly opposed student-athletes becoming employees. “For example, the historically Black colleges and universities came together and said, ‘If you force us to treat student-athletes as employees, it’s going to cause us to cancel most of our athletic programs.’ That would be a disastrous outcome.” Former LEAD1 CEO Tom McMillen reiterated his position that the situation is “much more doable with Republicans in control,” adding: “From the standpoint of the NCAA’s perspective, this is sort of an ideal scenario for them.” However, Nuckols notes that any legislation coming from the Senate would need bipartisan support to reach the 60 votes needed to bypass a filibuster. On that score, there may be room for compromise, as Senator Maria Cantwell (D-WA), the outgoing Commerce Committee chair, agrees with Cruz that the gap between the haves and have-nots is only growing. “Right now, big schools and their boosters are pitted against smaller schools. We need a predictable national NIL standard that will ensure a level playing field for college athletes and schools.” (link)

CollegeAD digs in on UCLA’s 11-year partnership with JMI, which runs through June 30, 2035. JMI will pay the Bruins an annual rights fee based on a percentage of revenue generated from the exercise of the licensed rights. In the first year, UCLA will receive 100% of net revenue after JMI recoups its deductible expenses. In Year 2, the Bruins will receive $8M. That figure will increase by $1M in the next two years before settling on $11M in Years 5-7 and $12M in Years’ 8-10. The deal also stipulates a minimum annual value of NIL sponsorships JMI must facilitate. The company will hold exclusive rights to monetize the NIL of student-athletes who have those rights to the university. (link)

Mississippi State last week received the okay to begin construction on a new indoor football practice facility. The project, approved by the states’ Institutions of Higher Learning board, also includes weight room upgrades, locker room renovations, additional offices, nutrition areas and hydrotherapy areas. A budget has yet to be determined, but MSU anticipates costs to exceed $3M and has already earmarked $500K for architectural and engineering fees. Also undetermined is a timeline for the project, but MSU expects there to be phases over multiple years. (link)

Washington Football HC Jedd Fisch explains why he’s optimistic about college football moving forward: “I hope there are some guardrails to allow players to continue to build their resiliency and not feel as if every time there's a hiccup they might look somewhere else. But on the same token, I'm really excited about trying to even the playing field and for us to be able to fully invest in our revenue-share program like we're going to here at Washington. Hopefully the guardrails [are] up [and] some program’s not spending an inordinate amount of money versus others would be able to continue to not allow the discrepancies at times of personnel. But I also believe now you can see why so many games go so many different directions is because guys that were backups don’t want to be backups. They want to go start somewhere else. So college football Saturdays are amazing. Our fans – and I don't just mean Washington, I mean fans of college football – have to understand that it's not just about the logo anymore. It’s about the players and you're going to see a lot of logos that have losses that they used to not have.” (link)

NJ Advance Media’s Brian Fonseca profiles how Rutgers men’s basketball student-athletes Dylan Harper and Ace Bailey are balancing NIL endeavors with playing hoops and observes: “Dylan Harper and Ace Bailey, probably the most talented pair to suit up in scarlet in 118 years of Rutgers hoops, have turned a program that’s long lived in obscurity into one of the hottest brands in the sport. In an era when college athletes have more power than ever, they are budding conglomerates in what has always been a mom-and-pop shop in Piscataway. The dichotomy, fascinating as it is impactful, is a constant hum in the background of the program’s most important season.” Fonseca notes that Fanatics became the first company to sign both stars to multi-year deals with Nike following months later, and “the corporations are now part of Rutgers lore. Moments after he put on a black hat with a block ‘R’ and told the world he was staying home during a commitment ceremony at Fanatics’ headquarters in Manhattan, Harper sat next to [Fanatics CEO Michael] Rubin and head of athlete partnerships Omar Wilkes in a conference room to sign a lucrative NIL deal.” Rubin: “They’re two incredible players, future of the NBA. When we started in the memorabilia business, it was all about the stars who are. Now it’s about who the young, next generation stars are, and those guys — that’s a lot of the future there.” While the duo continues to make names for themselves, they’re also putting Rutgers in the spotlight, as Kennyhertz Perry attorney Mit Winter points out. “Let’s face it: Guys like Dylan Harper and Ace Bailey have a lot of value as college athletes — to Rutgers especially and to businesses as well. Richmond is redshirting men’s basketball student-athletes Jaylen Robinson and Bryson McGlothin, two highly regarded freshmen that Spiders HC Chris Mooney believes have “incredibly high ceilings,” and The Richmond Times-Dispatch’s John O’Connor observes: “The strategy seems risky in the transfer-portal era, especially for players who could be tempted at some point to play closer to home. Wait for freshmen to develop and for the window to open for playing time, and they may make their greatest impacts at schools other than the one at which they started. UR, in this case, could end up being no more than a training ground.” However, Mooney believes this is “such a unique time, and I do think that there’s going to be somewhat of a shift back where guys stay at their school for four or five years. And we feel like we’ve done well in the transfer portal, but we also feel like the best part of us is helping guys develop into better and better players. … It’s only me reading into it. I don’t have any evidence for that, but that’s what I feel like might happen. … Like there’s a difference in polling numbers than there are in what people are actually saying and thinking.” (link)

Octagon Analyst for Media Rights Consulting Sam Marks shares some thoughts on this weekend’s Michigan-Ohio State and Auburn-Alabama games: “While Ohio State and Michigan viewership was on the rise in recent years and broke records last year, its lowest viewership was the last time UMich was unranked in 2017. Since UMich is unranked again, this year might see an end to the rise in viewership. On the other hand, Iron Bowl viewership was less affected by the rankings. However, viewership has been on a downward trend since 2017 and Alabama has not been ranked lower than 10th before an Iron Bowl since 2012. But they are still in contention for a [College Football Playoff] spot. With the Iron Bowl moving to ABC, this downward trend could change. The Iron Bowl used to carry CBS’s Thanksgiving Saturday. On #ABC, it will now be bumped by a good lead in (Tennessee-Vanderbilt) and lead out (Texas-Texas A&M).” (link)

DraftKings must pay the state of Ohio $425K as part of a settlement with the Ohio Casino Control Commission over the company’s acceptance of prop bets on college athletes. The bets were accepted in March despite a ban that had gone into effect weeks prior. Also as part of the settlement, DraftKings has stopped allowing third-party deposits and prop bets on specific players. (link)

English professors across the country say college students are struggling to finish books, according to The Atlantic’s Rose Horowitch, noting that this is in part because middle and high school teachers, having noted kids’ attention problems, have started assigning poems, short stories or excerpts of books instead of full works.” Meanwhile, Axios’ Erica Pandey notes kids shows are getting shorter. For example, episodes of Bluey, one of the most popular kids shows, are about seven minutes long on average. Furthermore, pop songs are simpler, shorter and more repetitive to give them a better chance of going viral on TikTok and Instagram in snippet form. Oregon Health & Science University behavioral neuroscientist Bonnie Nagel: “Boredom comes much easier now. … There’s an adaptation of our attention to require rapid content change or really exciting content.” Pandey points out that this doesn’t mean kids aren’t learning; in fact, they are “arguably processing more information on a wider variety of topics than older generations did at the same age. But absorbing all that information in bite-sized pieces can prevent them from sharpening their focus.” The good news, Virginia psychologist Daniel Willingham explains, is that kids and teens’ willingness to pay attention for long periods of time is dwindling, but the research doesn’t show – nor is it likely – that kids are any less able to focus than their parents or grandparents. TCU AD Jeremiah Donati joined AthleticDirectorU’s Tai M. Brown to offer insight into the changing landscape and the longtail impacts on hiring, resource allocation, NIL strategies and more. Donati discusses current challenges through the lens of his experience as a sports agent and says that most decisions today are basic in terms of business but challenging in terms of relaying information and having conversations with staff and coaches. Donati and Brown also discuss momentum and revenue-generating opportunities for women’s sports, with Donati noting that “the next big land grab” will be in-house marketing agencies and relationships with corporate sponsors: “How can you show value in those spaces for your student-athletes? Because there’s a lot of money to be made and who can do that well will demonstrate a lot of value to membership.” As far as whether coaches in revenue-generating sports are generally willing to part with resources to help sports that don’t generate revenue, Donati says: “Generally no. And I don't mean that as a negative; I just mean that they've never been really asked to. Very few have been asked to sacrifice at the hands of another sport – I mean not so intentionally. It’s happened organically, there's been changes that happened across departments, but literally the conversations a lot of athletic directors are having with non-revenue sports are, ‘In order for me to save your job or your sport or your staff, I need to reallocate resources that I can protect the revenue.” Lots more on ADU. San Jose State Women’s Volleyball advances to the Mountain West Conference Championship finals by virtue of Boise State forfeiting its semi final matchup against the Spartans. The Broncos twice boycotted regular-season matches with SJSU and says of this third opt-out: “The decision to not continue to play in the 2024 Mountain West Volleyball Championship tournament was not an easy one. Our team overcame forfeitures to earn a spot in the tournament field and fought for the win over Utah State in the first round on Wednesday. They should not have to forgo this opportunity while waiting for a more thoughtful and better system that serves all athletes.” (link, link)

Rutgers Board of Governors Chair Amy L. Towers and School of Engineering Dean Alberto Cuitiño will co-chair the 20-member committee tasked with selecting the final candidates to become the university’s next president. The board’s goal is to complete the search, interview candidates, select and have the successor ready to start by July 1, 2025. (link)

The Marquette Academic Senate has passed a no-confidence vote in President Kimo Ah Yun and COO Joel Pogodzinski just days after Ah Yun was named the permanent president. The vote passed by a tally of 18-17 with two abstentions. The MU Board of Trustees in a statement: "The no confidence vote does not deter our belief that the Executive Leadership Team is leading with our Catholic, Jesuit tradition at heart. That said, we are committed to continued, respectful dialogue and collaboration to address our complex challenges and create solutions. Those solutions cannot begin and end with tuition increases; we must also look inward at ourselves and how we operate." Senate Chair Paul Gasser responds: "We are not asking to stand still. We are asking for a stronger voice in decisions that affect the quality of a Marquette education, because we deliver that education every day." (link)

Rolling Stone’s David Hill pens an in-depth examination of the state of sports betting in America and posits that regulation on gambling “hasn’t panned out the way anyone hoped.” He notes that some sportsbooks have pulled up stakes altogether while others, in search of higher profits, “have started limiting gamblers whose bets win while accepting bets of any amount from those who stand to mostly lose, including problem gamblers, sending the winners back into the arms of the offshore sportsbooks and barroom bookies the regulated industry had promised to replace.” The pseudonymous legendary bettor “Captain Jack” Andrews estimates that less than 1% of U.S. sports bettors win over $100K annually, which Hill notes is how the sportsbooks want it. DraftKings CEO Jason Robins recently said as much, calling sports betting “an entertainment activity. People who are doing this for profit are not the people we want.” In fact, Andrews says DK limited him less than 30 days after going live in New Jersey because he was betting second-inning baseball lines. “I was down $600. I wasn’t even betting a whole lot.” Meanwhile, sportsbooks often tap sharps to help flag unusual activity. Amid suspicion of point-shaving during Temple men’s hoops games last season, consultant Elihu Feustel was asked to look at three Owls games where the first halves seemed off. Feustel tells Hill: “If Temple is an eight-point favorite but they are one and a half in the first half, when they should be four or four and a half, that’s a giant aberration that’s so large there’s no way to explain it other than match-fixing.” Lots more from Hill, who concludes with this: “The repeal of PASPA made it possible for people in America to make money taking bets, but they turned around and made it nearly impossible for anyone to make money placing bets. If anything, they made it easier than ever to lose. … The government, the shareholders, the CEOs, they all want their money guaranteed. The rest of us, the real risk takers, we’re just looking for a fair bet at a good price.” (link)

In the face of an $11M budget deficit, Denver has eliminated eight administrative staff positions this fall and will replace 15 staff positions in the College of Arts, Humanities and Social Sciences with higher-paid roles that will serve all 20 departments. DU has also eliminated an undisclosed number of vacant positions. The belt-tightening led to a vote of no confidence on Friday against Chancellor Jeremy Haefner by faculty leaders in the College of Arts, Humanities and Social Sciences, DU’s biggest academic unit. From a 2022 peak of 13,815 students, DU’s enrollment has been on the decline and is projected to fall to 12,043 for FY25, a 10% drop from the fall 2023 semester. Haefner believes several factors have led to the enrollment dip, including the so-called enrollment cliff, trust issues with higher education and problems with FAFSA. International studies professor Aaron Schneider argues: “DU’s response to an enrollment shortfall has been to cut services to students and raise the price. I don’t know in what universe raising the price and worsening the product will fix an enrollment problem, but that’s the direction the university is going.” (link)

Tennessee State is facing a $46M budget deficit by the end of the year without financial help, according to a report submitted to the TSU Board of Trustees by auditors. Inside Higher Ed’s Sara Weissman notes that university officials two weeks ago told the state comptroller the university couldn’t make its November payroll and received a $43M emergency cash infusion as a result. TSU Interim CFO Daarel Burnette: “It's going to be two to three years before we build an adequate reserve. Most colleges try to put 90 days of cash in reserve for the summer. We didn’t have anything. We have to build reserves to get us through the summer cycle. The issues and problems we are seeing today—this has been a wave building since COVID ended and maybe going on before that.” Enrollment fell from 8,198 students last fall to 6,310 this fall, and 3,542 students have enrolled for the spring, fewer than expected. Weissman also reports the university has “taken a number of belt-tightening measures, including cutting staff, ending band trips to away football games and slashing 117 contracts that duplicated services, which reportedly saved the university $3.5M.” The board also voted Friday to urge Interim President Ronald Johnson to end the contract of former President Glenda Glover, who was slated for an $850K transition agreement and $212,500 annually for four years in an advisory role. (link); Since retiring on June 30, Glover has received $511K, according to The Tennessean’s Rachel Wegner, who reports: “Glover was set to receive two $425K payments in an $850K transition agreement with the university. Additionally, she was set to draw $212,500 a year for four years in an advisory role for the school. TSU Board Chair Dakasha Winton said that, as of Nov. 23, Glover had been paid $425K as part of the transition payment, along with $85,746.11 from her advisory salary – or roughly five months of pay. Glover told The Tennessean she postponed the second $425,000 transition payment because the university was pressed for cash. … It's not clear if the school will make any additional payments to Glover, or if her contracts are still active.” Winton during Friday’s meeting also noted that the board “has not approved any agreements with the immediate past president. Full transparency on these matters is essential for restoring trust." (link)
