Grant House, Sedona Prince and Nya Harrison – the named plaintiffs in the House case – have sent a letter to U.S. District Court Judge Claudia Wilken asking for her to address the need for a players' association, citing "a critical need for structural changes to protect athletes and to prevent the failures of the past." The plaintiffs are calling for Athletes.org to serve as the players' association, writing: "Without independent, formal representation, separate from schools or their affiliates, athletes will inevitably remain in a vulnerable position, perpetuating the cycle of inequity and paving the way for continued litigation. AO provides the infrastructure to offer the collective voice, legal guidance, and resources we need to address these challenges, constructively, ensuring a fair and sustainable future for college athletics." (link); Front Office Sports’ Amanda Christovich notes that it’s unclear how “Wilken could create a players’ organization on her own, besides requiring it as part of the terms of the settlement. It’s also unclear whether this organization could be considered a formal union, given that athletes aren’t currently classified as employees. That’s likely part of the reason the letter doesn’t call for a formal union, opting for the word ‘association’ instead.” (link); Plaintiffs’ attorney Jeffrey Kessler tells ESPN’s Dan Murphy he doesn’t believe the letter will derail the settlement process. He also says the athletes advised him of the letter to Wilken and he did not have an issue with it. "I think the settlement is incredible for college sports, but it does not solve every issue in the world. The fact they might also need a players' association is a valid point. I have no problem with it." Murphy posits Judge Wilken is “unlikely to play any role in forming or blessing a players' association, but the athletes' letter could have an impact on how she views the long-term success of the settlement.” (link)

Florida State ended its investment talks with Sixth Street “about a year ago,” according to Sportico’s Eben Novy-Williams, who explains: “The talks, which began in 2022, were among the earliest known conversations about how institutional capital might break into modern college athletics, and they advanced quite far, with one source saying the two sides had the structure of a deal in place before things drifted apart. Two main points of uncertainty—FSU’s legal battle to leave the ACC, and ongoing settlement talks in House v. NCAA—proved too hard to overcome, said the people, who were granted anonymity because the details are private. The school currently isn’t in serious talks with other firms, though that could change in the future.” (link)

+ College Football Playoff Executive Director Richard Clark remarked today that “projecting how this team would play against that team is not what we do. When that type of discussion began, I would step in and remind everyone of the protocols.” Clark also explained the selection committee valued conference championships. “I think we should all value conference championships. In addition: “We need to give the committee the ability to have candid discussions. Allow the voting to continue to be anonymous. … We have to have enough (playoff shows) for transparency. If we go just the last week, there's too much mystery to that. If we take it away and put one ranking out there, I think that's a big mistake." (link)
+ During a panel discussion with Ohio State AD Ross Bjork, Learfield President/CEO Cole Gahagan, and Wasserman Chair/CEO Casey Wasserman, Bjork made the point that perhaps the most salient message to send to Congress involves saving the Olympic model. Wasserman, who is serving as the LA28 CEO, added: "If football leaves the system, Team USA is over." Wasserman was referencing how revenue-sharing increases the challenges for Olympic sports and suggests schools will sponsor fewer sports in the future. "If we want to preserve the value of our Olympic team (with $0 in federal funding)...it's a really scary thing...unless we figure out how to solve these problems. … The untapped monetization of college football is in the multiple billions of dollars of year...(scheduling and media, organizing the best ~ 64 teams). If you monetize that in a more efficient way to capitalize on the value, either football is going to leave the system or that incremental money is going to fix all of the other problems in the athletic departments." Meanwhile, Bjork also commented that once the media deals are up there will be economic consolidation; however, he maintained it will still be important for conferences to stand on their own. Gahagan noted that “what we do a bad job of (in the US) is we don't have an omni-channel model in our business. … When you talk about and, not an or, model...how do we together have a comprehensive conversation with (a brand) about activating together?” More. UCLA AD Martin Jarmond is starting a five-year deal with $1.55M in basic annual pay plus a $511,500 signing bonus for the year ending June 30, 2025, according to USA Today’s Steve Berkowitz, who adds: “Under prior terms for 24-25, he had been set to make just over $1.55M, including $300K retention. Future years' pay for Jarmond, including scheduled $300K annual retention payment: 25-26: $1.9M, 26-27: $2.1M, 27-28: $2.3M, 28-29: $2.4M.” (link)

After several key contributors from this year’s team entered the transfer portal, North Texas AD Jared Mosley called for college football reform on Monday. “Postseason opportunities and championship-level experiences are still at the heart of what we want to provide our student-athletes every year. But change is needed! Open portal windows and free agent movement before games are played no longer deliver the value for student-athletes, universities or fan bases. While institutions will always strive to maximize the postseason bowl experience for all, there is a lot of work left to fix or improve what many bowl-eligible institutions have already experienced with the wide-open free agency before games are even played. Let’s get to work!” (link)

The Texas One Fund raised almost $10.5M in revenue last year to support NIL opportunities for Texas student-athletes while spending more than $13.3M, according to Sportico’s Daniel Libit, who notes the collective distributed about $11.7M to UT student-athletes. Libit also reports that Texas One Fund Athlete Director Charity Grady received $138,461 in compensation last year, while Austin-based JHL Company was paid $230,998 for management and fundraising services. Nearly $9M of Texas One Fund’s distributions was paid through Opendorse, which received a fee of $621,548 for this work. Also from Libit: “Aside from donations, which constituted the lion’s share of its earnings, the collective reported generating $595,486 in sponsorship fees. It spent $221,901 on advertising and promotion expenditures, $333,503 on conferences and meetings, and $130,419 to rent event space at UT’s Clark Field.” (link)

Colorado State Football HC Jay Norvell explains that independent outside agents are working the transfer portal on spec, calling schools themselves to see how much NIL money they’d offer players who have expressed no interest in transferring. The agents then contact the players and tell them they can secure a certain amount of money if the player goes through them. “These kids are not thinking about getting in the portal, but when they have these people call them and say, ‘If you get in the portal, I’ll give you $200K. And, by the way, I’m going to take 15, 20% of that. So these guys are just stealing from these kids. An NFLPA agent gets 3%. A lot of these agents that are talking to all of our players, they're taking 10, 15, 20% and that's really criminal. … As much as we try to tell our players that and educate them, when somebody's offering you that kind of money, it's still hard for these kids. So, that just kind of gives you an idea of what's happening, and it's unfortunate and, like I said, we talked to our top 26 kids. They all have been offered a lot of money.” (link)

Former New England Patriots HC Bill Belichick is considering an offer to become North Carolina’s next HC, according to The Athletic’s Ralph Russo, Brendan Marks and Diana Russini, who report: “A deal has not been agreed to and terms are still being negotiated, the sources said. While a deal may still come together quickly, sources cautioned that nothing is imminent and the sides remain apart on multiple key terms.” In his appearance on the Pat McAfee Show yesterday, Belichick remarked that “if I was in a college program, the college program would be a pipeline to the NFL for the players that had the ability to play in the NFL. It would be a professional program – training, nutrition, scheme, coaching techniques ‒ that would transfer to the NFL. It would be an NFL program at a college level and an education that would get the players ready for their career after football, whether that was at the end of their college career or their pro career. But it would be geared towards developing the players, time management, discipline, structure, and all that. There would be life skills regardless of whether they were in the NFL or somewhere in business. I feel very confident I have the contacts in the National Football League to pave the way for those players ... to have the opportunity to compete in the NFL.” (link, link)

The NCAA yesterday sent out a second Q&A related to the House settlement. Yahoo’s Ross Dellenger notes the eight-page document is intended to be a starting document with more information to come at a later date. On when schools must be compliant with new roster limits, the NCAA explains: “Beginning in the 2025-26 academic year, for fall sports, schools must be at or below the roster limits prior to the first date of competition that counts for championships selection in the relevant sport. For winter and spring sports, schools must be at or below the roster limits not later than December 1 or the first contest that counts for championships selection in the relevant sport (whichever is earlier).” The document also notes that access to DI championships will not be impacted by a school’s decision to opt into revenue-sharing. Additionally, schools must determine and notify the NCAA by March 1 of each year if they plan to opt in for the following year. Also from the Q&A: “All [NIL] agreements with associated entities and associated individuals with payments occurring after July 1, 2025, will be subject to the fair-market-value assessment contemplated by the settlement. Also, all new agreements with associated entities and associated individuals executed after settlement approval (which could occur any time after April 7, 2025) will be subject to a fair-market-value review. In addition, if there is a challenge to determinations related to fair-market-value, third-party arbitrators approved by the plaintiffs, the defendant conferences and the NCAA will render a decision.” The document also recaps how the initial rev-share pool will be calculated: “The Pool will be set by totaling up eight of the Membership Financial Reporting System Reports (MFRS) revenue categories for each institution from the five defendant conferences and Notre Dame, then dividing the total by the number of institutions from the five defendant conferences plus Notre Dame, then taking 22% of the resulting dollar figure. The defendant conferences’ defendants estimated the 2025-26 cap to be approximately $20.5 MM. The actual cap number will be determined in Q1 of 2025.” (link, link – full document)

New on Connect: Ivy League Executive Director Robin Harris joins Connect's Steph Garcia Cichosz to discuss the issues impacting the conference, the league’s top priorities and the prominence of women leaders in the Ivy League. Harris also talks about positioning the Ivy League brand and says she believes the conference provides the best all-around student-athlete experience in DI. “All eight schools are focused on the entire student-athlete experience, allowing them to succeed academically, of course, have time to be students and be involved in other activities on campus and, of course, have an amazing athletic experience as much as they want it to be. And we have student-athletes that go on to professional careers in sports in the NFL, in Major League Baseball, in women's sports, in the WNBA, Olympians – but they also know they have a degree where they can have a career and be successful.” Full Q&A. Big East Deputy Commissioner/COO Vince Nicastro joins the On the Fly podcast and shares his thoughts on expanding March Madness: “I think it’s probably prudent for us as an industry to take a look at the tournament format and [consider] if there is a case to be made for expansion – a very small expansion. … There was some discussion years ago about going to 96, and I certainly would not support that, but if we went from 68 to 72 or even to 76 and created some First Fours to start the tournament, I think that’s worth evaluating. And I think for a conference like ours, it probably would benefit us on balance because I do think we'll have strong enough teams that are getting left out of the tournament or just shy of the tournament that may have access to March Madness. And, as you know, such an inordinate amount of attention is placed on whether you make the tournament or not as a program. You can be a superb basketball coach, have a superb basketball program, and if somehow you don’t get in for a year or two, people look at you differently like you haven’t succeeded. It’s not fair, but I do think expanding a little bit may provide some additional opportunities for schools to enjoy the benefits of being in that great event.” Nicastro also says the Big East has emphasized maintaining the double round robin hoops schedule, something that is increasingly difficult to do as other conferences continue to expand. “We think that’s really important so that those rivalries are either perpetuated or, with the Midwest schools, we’ve started a lot of rivalries between the East and the Midwest. … So, we’re going to hang on to that double round robin as long as we can because we do think it’s unique.” More from Nicastro, who notes Big East schools will be “very proactive and aggressive” when it comes to sharing revenue. As part of a restructuring of its fundraising enterprise, Missouri is “reimagining the Tiger Scholarship Fund as the Mizzou Athletics Fund beginning Jan. 1, 2025.” The Mizzou Athletics Fund will be built on three pillars: Game Day Priority, which provides fans priority access to the seating and parking options they desire; The Mizzou Leadership Circle, which will recognize and steward top donors who give above and beyond seat-related donations, and joining will unlock additional stewardship opportunities such as VIP events, team travel and special access; and The Mizzou Legacy Societies, which will recognize lifetime philanthropic support of Mizzou Athletics. Tigers AD Laird Veatch: "As college athletics prepares to enter the revenue-sharing era, we have been laser-focused on finding ways to elevate Mizzou's position and capitalize on the opportunities in front of us. As part of our fundraising restructuring efforts, renaming the Tiger Scholarship Fund the Mizzou Athletics Fund will more accurately reflect how donors already contribute to much more than scholarships. At the same time, we will simplify our giving programs to more clearly align our donor benefits with the contributions that will be so vital to our sustained competitive success." (link)

ESPN Chairman Jimmy Pitaro talks about adding an ESPN+ tile to Disney+: “The idea is to remove a lot of the friction that exists today. We want to be everywhere. We want ESPN+ to be within Hulu like it is today, and we want ESPN+ to be within Disney+ if you’re a subscriber, so it’s actually spot-on connected to our mission, which is to serve the sports fan anytime, anywhere.” In addition to around 100 ESPN+ live events – including college football and basketball games – Disney+ subscribers who aren’t subscribed to ESPN+ will be able to access some studio shows like Pardon the Interruption, College GameDay and ESPN Originals; however, ESPN+ SVP John Lasker says the content available to broader Disney+ subscribers is a “small fraction” of ESPN+ content. “It’s not creating an alternative to ESPN or ESPN+, [but] more an extended reach opportunity.” (link)

MoffettNathanson Co-Founder/Analyst Michael Nathanson joins Puck’s John Ourand on The Varsity podcast to discuss the challenges facing legacy media outlets, how sports leagues and college conferences can thrive post-TV and lots more. Nathanson explains that his firm has set the cable subscription floor to somewhere between 50-60M homes and the question today is whether that floor holds. As such, MoffettNathanson reminds companies who continue to push into streaming to be “more mindful of killing the golden goose. The golden goose is being killed because non-sports fans have realized rightly that it’s more efficient and cheaper to find entertainment choices outside the bundle. Case closed. Simple. So, you’ve gone from 100M to 68M homes simply because people who are not sports fans or people who are younger have chosen to stream. If you’re a sports fan, you stay in the bundle. … In the bundle we have today, sports have never been stronger. If you were a sports rights holder, your position in that bundle is only getting stronger. Look at Fox's results relative to AMC, which has no sports rights. Fox has been able to grow ad share, grow affiliate fees, they're pushing sports all the time. If you’re AMC networks and you have no sports, you're screwed.” As for what this all means for leagues and college conferences, Nathanson explains they may look to “pull their rights from weaker hands” in the next few years if media companies don’t get stronger. However, that likely only applies to the leagues with the strongest national appeal, which, in college, Nathanson explains, means the SEC and Big Ten. “They’re national professional football leagues. … It’s going to be interesting to see – you’ve had RSNs die, the Pac-12 die…again, canary in the coal mine.” Full podcast.
