The U.S. Senate voted to not extend Lauren McFerran as NLRB chairman for another five years. Had she been confirmed, Democrats would have controlled a majority of NLRB for the first two years of Donald Trump’s term. The Washington Post’s Jesse Dougherty: “But Joe Manchin + Krysten Sinema voted no on McFerran, meaning Trump will nominate someone to fill the vacancy created at the end of the year. That will flip the NLRB to R control. In turn, progress toward college athlete employment w/ the NLRB could really, really slow down.” (link)

The National College Players Association clarified a previous statement that parts of the House settlement contravened multiple state NIL laws, according to Sportico’s Daniel Libit. NCPA Executive Director Ramogi Huma explained in an email that the group was amending its previous position “after receiving information” from the plaintiff’s law firm Hagens Berman, which serves as class co-counsel. The NCPA now says the settlement “has not been deemed illegal in any way” and notes that “any NCAA rule that violates a state law would still be subject to such state laws and enforcement by the states.” House plaintiffs’ attorney Steve Berman: “We are pleased that they are correcting the information. It’s important, and the judge has acknowledged that the class get completely accurate information about the case.” (link)

+ USA Today’s Matt Hayes disagrees with Florida State AD Michael Alford’s assertion that “we never said we wanted to leave the league,” writing: “In Florida State’s August 2023 lawsuit against the ACC, on page 32 of the 38-page complaint, item 151 states: ‘Florida State be deemed to have issued its formal notice of withdrawal from the ACC under Section 1.4.5 of the ACC Constitution, effective August 14, 2023.’” Furthermore, Hayes notes the FSU Board of Trustees said it wanted an exit plan from the ACC by August of 2024. During that meeting, board member/former FSU QB Drew Weatherford remarked: “It’s not a matter of if we leave. But when and how.” When asked at yesterday’s SBJ IAF whether FSU was still positioned to leave the ACC, Weatherford said: “We just have to solve for [the financial disadvantage]. If we can do that where we are [with the ACC], that’s great. If we can’t, I’m still open to the option that we need to find another conference.” Alford added: “We’ve always questioned the revenue distribution. Go back in history, you will never see the president or myself say we want out of the league. We have great peer institutions, we’re a lot alike. We’ve always had great communication. [ACC Commissioner] Jim [Phillips] and I from day 1. We’re trying to solve the problems.” (link)
+ Texas AD Chris Del Conte, Oklahoma AD Joe Castiglione, Cal AD Jim Knowlton and UCLA AD Martin Jarmond talked about their respective conference realignment experiences on a panel yesterday, during which Del Conte explained: “We had this plan that was so eloquent, it's kind of like breaking up with your girlfriend back in high school. You rehearse this thing a thousand times, then you get in there and you just wet the bed. Then she hates you forever. Then the old adage, ‘Can we still be friends?’ There ain't no friends. That was not happening.” Castiglione remarked: “We loved the Big 12, [were] very loyal to the Big 12 in many ways, but if you looked at the way the media agreements were going to be renegotiated, the Big 12 was last to the table, and that's after all the pro sports contracts were redone, too. So, it was really questioning whether the Big 12 was going to be in a position to have the right amount of growth that we all needed for the future.” As the clock wound down on the Pac-12, Knowlton says former Chancellor Carol Christ was convinced the schools would each “sign the grant of rights that Friday morning at 7. And when that didn't happen, that really changed for Cal ... There’s the five stages of realignment, and it was ‘horror,’ ‘terror,’ ‘chaos,’ ‘begging’ and then finally ‘relief.’” Jarmond on what has been unexpected so far in the Big Ten: “Iowa came to play in the Rose Bowl this year, and Delta created two flights just for Iowa fans. They came strong. But we've also seen when some of the Big Ten schools that have come for a game, a basketball game or football game, they might come to another game. We've had some repeat customers also come and just watch a UCLA match. So that's been positive. I didn't really anticipate that, but that's been a boon.” (link)
+ Ole Miss-focused Grove Collective Executive Director Walker Jones commented on the future of collectives: “The answer will vary based off where you sit. So the answer for us at Ole Miss may be different than South Carolina or Georgia or Oregon or Ohio State, just kind of depends. I think one of the few things I would say is we will definitely be charged with turning in from collectives to agencies, boutique agencies that are content driven, activation driven, brand marketing driven. I don't want to sit in front of a room with 200 donors and beg for money to go buy a five-star quarterback. That's not my highest and best use. And I don't think that's what we should be doing. We should be providing opportunities for our student-athletes that demand market value for who they are on the field or on the court and serving as that agency of record for the universities.” Guaranteed commercial NIL opportunities will crystallize as the next arms race in the industry, Jones went on to say. “They're going to tell the student-athlete you're going to make $500K to be the quarterback at our university on student athlete compensation, and you can anticipate $200K on top of that with…student-athlete influencer marketing opportunities with brand agreements. Those are the headwinds and the conversations that universities are starting to have on how to separate themselves from their peers.” (link)

North Carolina has officially announced former New England Patriots HC Bill Belichick as its next Football HC. According to The Athletic’s Brendan Marks, Michael Silver, Jeff Howe and Dianna Russini, Belichick and UNC have agreed to a five-year, $50M deal. They also report UNC’s staff will include Washington DC Steve Belichick and former Cleveland Browns GM/Patriots Asst. to the Coaching Staff Michael Lombardi, who will serve as the team’s GM. Along with Belichick, other finalists for the position were Cleveland Browns AC Tommy Rees, Georgia DC Glenn Schumann, and Army West Point HC Jeff Monken, according to The Athletic. North Carolina also announces a $13.5M gift that was made in 2023 by the Joan H. Gillings Foundation, which was established with Gillings’ passing in 2021. In her memory, Joan's family endowed a student-athlete scholarship and the women's lacrosse head coach position, supported three facility renovations (women's golf, women's tennis and women's basketball), established the Nutrition, Wellness & Mental Health Endowment, endowed the FORevHER Tar Heels mentorship program and ensured every women's team would have at least $1M in their operating endowments. Because of additional funding, the Mental Health and Performance Psychology (MHPP) program served 301 athletes in the 2023-24 academic year and improved the wait time by a week. Wyoming is requesting a one-time allocation of $1.5M from the state legislature in its supplemental budget to help with the House settlement. Cowboys AD Tom Burman addressed the Joint Appropriations Committee this week and said: “The world of college athletics is changing dramatically. We just feel like this is an opportunity for us to grow our program and keep up, and we’re hoping that between the university, the state and the private sector, we can cover all these costs.” Asked what it would mean if the school did not receive the allocation, Burman responded: “We would probably be looking at sport elimination and making some very draconian cuts.” Burman also said the Cowboys plan to add three scholarships for football and one for men’s basketball next year along with three for volleyball, two for women’s soccer and three more for other women’s sports. As part of its annual survey of Football AC compensation, USA Today’s Tom Schad and Steve Berkowitz found that average pay for OC and DC positions has increased by nearly 25% in just four years to $1.1M annually. “And this year, for perhaps the first time, Power 4 coordinators are making even more than Group of 5 head coaches, whose average pay is $1.05M. At the same time, coaches and athletics directors say it’s also never been more difficult – or more complicated – to be a head coach. This is especially true in the Group of 5, where the rules changes empowering players to more easily transfer and profit off their name, image and likeness have had a more jarring impact than in the Power 4.” Former Minnesota/New Mexico State HC Jerry Kill: “It’s a lot different [in the Group of Five], I can tell you that. I think people just say, ‘Hey, I’ll just go be a coordinator and make good money.’ You see older guys doing that more than anybody, I think.” Schad and Berkowitz note there are 78 ACs at FBS public schools this season making at least $1M, “including 18 position coaches and a whopping six assistants from the same school: Ohio State. When USA Today Sports first started tracking assistant coach pay in 2009, there was just one (when not adjusting for inflation).” The math works in the other direction as well, as NMSU AD Mario Moccia says hiring a “current Power 4 coordinator just seems like it’s not realistic” given the salary differences that now exist between the two levels. Buffalo AD Mark Alnutt adds: “You have to look at a different candidate pool. One that, again, is a good fit, a good match for a particular institution. But then one that also maybe is not the highest level coordinator, that you know you can’t get.” More. (link)

Florida State has selected PBK as the architect for its new lacrosse-only stadium. FSU lacrosse will play its inaugural season in the spring of 2026 as the 13th women's lacrosse program in the ACC. The stadium is slated to include a turf field, press box and multiple seating options for fans as well as a team building with locker rooms, meeting rooms, team lounge and other student-athlete spaces. Here are the latest get-in prices for the first-round College Football Playoff games, according to Front Office Sports’ Margaret Fleming: $911 for Notre Dame–Indiana, $142 for Penn State–SMU, $314 for Texas-Clemson, and $336 for Ohio State–Tennessee. All prices are as of yesterday. Travel prices are also soaring in some places, as Fleming notes: “As of Tuesday, State College hotels that usually cost about $100 per night jumped to roughly $1,200 to $1,500 per night during the CFP, or sold out of rooms completely. Airbnbs in the town have jumped from a couple of hundred dollars per night to roughly between $1,000 and $2,500. … Many of South Bend’s hotels sold out of their inventory, and several Airbnbs are higher than $3,500 per night. South Bend, Indiana, and State College, Pennsylvania, are the two smallest cities—at roughly 100,000 residents—hosting games and therefore more vulnerable to price-gouging. Columbus has nearly a million residents, but still, a number of hotels near OSU have shot up to more than $400 for Saturday night. Travel prices in Austin—one of the largest markets in the country—appear to be largely unchanged.” Mike Patel, who owns a Holiday Inn Express about 25 miles from Penn State: “It’s given a little bit of extra boost in winter months. We really slow down in winter months. So this gives extra help to pay the bills and take care of other stuff for the property.” (link)

NCAA President Charlie Baker is confident the House settlement will ultimately be approved and tells Sports Illustrated’s Bryan Fischer he would invite increased government oversight of college athletics to ensure a more stable landscape beyond what is covered in the settlement’s 10-year window. “If the settlement gets approved—and I’m certainly hoping it will be given the preliminary approval—starting in July, this stuff has to actually work. Skip the issue of what it means in the long term, it’s got to work. People need to understand the decisions they’re making, kids need to understand the decisions they’re making.” Baker declined to indicate whether the NCAA would engage directly with Athletes.org or other advocacy groups but says he has encouraged schools to stay flexible and hopes athletes are educating themselves on the settlement and other pressing issues facing college athletics. “This is a fairly complicated exercise to implement. It doesn’t have a lot of ‘thou shalts.’ … We are all aware that you have 365 schools in DI, all of whom are going to have to make some decisions about how and where they want to play in the space. That’s one of the reasons why it’s an opt-in, opt-out model. I think you’re going to see far more kids on scholarship than you see today. And far more kids engaged in a school-based approach to NIL that, I think in the long run, will be much better for them and for the schools.” House plaintiffs’ attorney Jeffrey Kessler has emphasized that the settlement doesn’t solve every problem facing college athletics, and Baker says: “We’re still going to have to figure out some way to deal with the employment question. We have 36, 37 states with different NIL laws. … I’d be willing to do this in some way where we have to go through a checkpoint of some kind in the federal government to get approval for a rule that involves something that is a nationwide standard. To determine, if in fact, there are any antitrust issues there. … I sort of feel like, O.K., you gave us a mission, Congress. We’ve done a pretty decent job of following through on your mission.” (link)

U.S. District Court judge Claudia Wilken has “no authority” to create a union or a players’ association, according to Sportico’s Michael McCann, who explains: “Her authority is limited to addressing the specific antitrust issues raised in the three cases and to review the settlement to ensure it meets the requirements of Federal Rule of Civil Procedure 23 that it is fair, reasonable and adequate. That’s it.” McCann also notes that it’s possible Athletes.org or other advocacy groups could one day be recognized by the NLRB as unions. “But as of now, those organizations are not unions. They can’t collectively bargain on behalf of athletes. … That’s not to say the letter is irrelevant. During a hearing or as part of a written order, Wilken might opine she believes college athletes need a more organized voice to protect their interests. It’s less likely that she’ll opine, without review of facts and legal arguments, that college athletes are or are not employees and should or should not unionize. Wilken might also ask in a settlement approval hearing if the settlement is the right vehicle to accomplish the goals House, Prince and Harrison express in their letter. That would serve as another way of checking to make sure the settlement isn’t just an agreement by the lawyers without meaningful input by the client. The letter praises the settlement, but what the players seek—a collective voice—is well beyond the settlement and might make Wilken pause to ask whether the players understand the limitations of the settlement and the framework it prescribes.” (link)

+ More from Baker, where he acknowledged the House settlement will likely require a rewriting of several NCAA bylaws. “The creation of that institutional NIL model and some of the other pieces that are associated with that are completely different than anything that’s ever been in place. For us, that’s job number one. I also think we’re all hoping that the preliminary approval by the judge will sort of signal that we should go ahead and do the contingent work required to implement this.” In regards to getting an assist from Congress, Baker said: “We’ve already dealt with many of the issues we were told people wanted us to deal with and I think that’s enhanced the conversation we’ve had with Congress. [But] I don’t know exactly what it will be. Anybody who says they do is not telling you the truth. Politics and legislative writing is very messy.” Baker also commented on the construction of a fan database, which is an example of the kind of system Baker believes demonstrates the NCAA’s value to power conferences. “It would be hard to have a national championship and March Madness without us. It’s an ecosystem for all the people who work in it and it’s one that has been incredibly powerful and successful over a long period of time. This database, for example, would be really hard for anybody else to do.” Baker on sports betting: “My interest with sports betting is to get prop betting out of sports. Anyone who saw our data should know why we feel that way. The stuff that shows up online is appalling and disgraceful. Until the platforms and sports books want to have a serious conversation, it’s unlikely we’ll be that interested.” (link)
+ In a panel discussion about private equity in college sports, Weatherford Capital and Collegiate Athletic Solutions Founding Partner Drew Weatherford insisted the goal isn’t to buy a stake in athletic departments. “When you think about private equity being invested at the university or conference level today, it is not going to be structured in a traditional equity-like manner.” AAC Commissioner Tim Pernetti, meanwhile, warned that the industry is "at a very dangerous tipping point,” and if it doesn't "organize and protect the product," then "we could be headed for rough waters in the future. This is not an if, it's a when. It's essential to bring partnerships in to help us achieve these goals. But everybody has got to get a grip that it's changing under our feet. So we can keep tap dancing and hoping that it stops or we could actually move with it, but we're behind it." Arizona President Emeritus Robert Robbins maintains that many athletic departments need cash infusions and are therefore open to having discussions with private investors. “There's land around our campuses, certainly at University of Arizona, we have some land approximate to our athletic facilities, and there could be some joint venture between private infusion and money and you have to have a return for them, but it also has to be a win for the university.” Pernetti added: "The real value you get out of a private capital partner is you get access to expertise in strategy, leadership, cost control. … You get access to expertise our industry has not yet seen. … This is about building an enterprise that has long-term sustainability.” (link, link)

SBJ’s Irving Mejia-Hilario: “The CSFL’s plan is contingent on congressional action, like lumping college sports into the Sports Broadcasting Act and a special designation which would permit student-athletes to not be labeled as employees. Still, even with support from lawmakers, the CSFL has a long way to go if it has any hopes of finding a viable path to victory. It will need big players like school presidents, chancellors and athletic directors to work together and outright support the CSFL.” As such, Perna said: “We’ve got the unique opportunity in 2025 to get something done in college sports. So the type of capital we need is political capital, not cash capital. We’re looking for congressional votes. We’re focused on being independent, impartial, neutral and putting a broad coalition together to tell the story in DC of what we need and we think we can be successful doing that.” (link)

USA Today’s Steve Berkowitz and Mark Giannotto examine the growing trend of college football teams hiring GMs and other front office-type personnel in anticipation of the House settlement. “The pool of candidates athletics departments are beginning to hire, consider and consult with include NFL personnel from legal and business backgrounds, as well as CEOs from companies outside football, now that it appears contract negotiations with players and their agents and salary cap management have become instrumental to a team's success. There is no consensus yet on what the best model will be to navigate this new frontier of college sports. Only that the football infrastructure most schools relied upon for years wasn't built to handle what's about to happen.” As Texas A&M HC Mike Elko puts it: “It used to take a village. Now it takes an army.” Huron Consulting Group Managing Director of Strategy and Operations Tim Walsh adds: “The schools that were hesitant about building out this infrastructure have quickly come to realize that their slowness in moving this direction is costly because their coaches are stressed. There’s a mad scramble to get these structures in place and these people in place. … It’s going to be a little inconsistent across the country at first, as institutions try to find that sweet spot, what the coach is willing to accept in terms of delegation of authority to those GMs, but over time I think the GMs are going to become more sophisticated, have better financial people working for them to manage all these contracts and commitments in a way that’s sustainable, and then the coaches will be free to coach.” (link)

The WCC has filed a breach of contract lawsuit against Grand Canyon over “GCU’s refusal to satisfy and then deny its financial obligation with regards to substantial amounts owed to the Conference in both entrance and withdrawal fees, each were due within 30 days of its withdrawal notice.” The WCC claims that as part of the terms of the agreement signed by GCU, the school was “required to pay the remaining balance of its entrance fee (GCU made the first payment), and the membership withdrawal fee outlined in the Conference’s Constitution, each within 30 days of its written notification of membership withdrawal. Grand Canyon University has indicated to the West Coast Conference that it does not intend to pay the remainder of its entrance fee or the withdrawal fee.” WCC Commissioner Stu Jackson: “The purpose of a legal contract is to put the force of law behind agreements between parties. We have a fully executed legally binding agreement between the West Coast Conference and Grand Canyon University that outlines its financial terms and obligations. By redefining their position, Grand Canyon University attempts to avoid their obligations in the contract.” (link)

The Mountain West is asking the U.S. Tenth Circuit Court to toss out a bid to obtain a restraining order preventing a San Jose State transgender player from participating in the conference’s volleyball championship. The league argues that since the tournament has now concluded the point is moot. (link)

Sportico’s Daniel Libit examines the VII Group, who is hosting this weekend’s Holiday Hoopsgiving event featuring men’s hoops matchups between Auburn and Ohio State, Florida and Arizona State, and Georgia and Grand Canyon. The VII Group was scrutinized over the summer for its failure to secure airline and hotel accommodations for George Mason’s Bahamas trip, and asked whether this year’s Hoopsgiving offers a chance at redemption, VII Group CEO Chris Williams tells Libit: “There is no reputation to redeem, being that we are in good standing as a business.” Williams declined to participate in a full interview, saying he was too busy with tournament preparations. Libit, meanwhile, reports that Memphis in April sued the company for breach of contract relating to the Tigers’ participation in the 2022 Hoopsgiving event. “According to the school’s lawsuit, which has not been previously reported, the VII Group had failed to refund Memphis more than $57K despite the school making 15 requests for the money in the 16 months since the game took place. The amount included a $50K guarantee the school had paid to the VII Group, as well as transportation and accommodation expenses that were supposed to be reimbursed.” The VII Group denied that the Tigers had fulfilled their end of the agreement, and Libit writes: “Williams declined to comment about the case when asked about it last week. Instead, he offered to do an interview after this weekend’s Hoopsgiving games, saying, ‘It is going to take (many) more minutes to clean up’ Sportico’s previous reporting. Williams subsequently sent a cease-and-desist letter, threatening potential legal action if a reporter continued contacting the company or if a story was published ‘without our prior consent.’” Lots more. The Buffalo Bills and Miami Dolphins each have agreed to sell 10% ownership stakes to private equity firms. Axios’ Dan Primack and Tim Baysinger report that Ares Management led the Miami deal, while Arctos Partners led the Buffalo deal. The Ares investment also includes stakes in Hard Rock Stadium and the Formula 1 Crypto.com Miami Grand Prix. Joining Ares is Brooklyn Nets owner Joe Tsai and investor Oliver Weisberg. Arctos is being joined by a group of individuals that includes former pro athletes Vince Carter, Tracy McGrady, and Jozy Altidore. (link)
