NCAA President Charlie Baker joins the Pat McAfee Show and says he believes there “will be a market that goes alongside the rev-share, and that’s going to be important” once the House settlement is implemented. The question currently being discussed, he adds, is “how do you figure out what information is available to who when? But the most important thing here is there’s a general acceptance and understanding across DI…that there’s going to be a mechanism you have to submit your contract into and get it approved.” As for how long those contracts’ terms will be, Baker says it’ll be up to the schools and the student-athletes, but “then when it gets approved, there’s no more debate about what it is or what it says or what it does. And I think part of what the biggest problem we have now is so much of this is happening through multiple parties. When people talk about third parties, you have a lot of situations that I've been made aware of where there are multiple people who are involved. There are family members, there are friends, there are agents – sometimes real agents, sometimes people who–“watched Entourage” McAfee says. Baker says of U.S. District Court Judge Claudia Wilken: “This judge has been involved in these cases for a decade. This is her issue. To some extent, having her as the final arbiter here is, from the point of view of a lot of people, a really good thing.” Asked whether it’s possible Wilken decides in April that she doesn’t agree with some of the finer points of the settlement, Baker says it’s "theoretically possible, but I kind of hope she wouldn’t have given us the approval if she wasn’t planning to [see it through].” On the Diego Pavia decision: “My big worry about it is there’s a rhythm to college sports and the rules associated with this four years of eligibility…has been with us forever and it’s been how we make it possible to sort of line up academic performance with athletic performance and opportunity and to make sure the next generation of kids have a place to go. If you writ large this decision across the JUCOs – and then maybe somebody says well if JUCOs get two years of eligibility plus four, why shouldn’t anybody who goes to college get six? – [where do high school athletes figure in]? Northwest Missouri State President Lance Tatum sits down with MIAA Commissioner Mike Racy and KQ2's Chris Roush to discuss the state of the NCAA and DII and changes he would like to see, starting with what he hopes is a topic of conversation at the NCAA Convention: “I think it's really imperative on the NCAA to open up this conversation about what a new structure would look like. Could we combine parts of Division II and parts of Division I to create a new classification because even within Division II there's a broad separation between those schools that invest heavily at the upper tier of Division II and those that are not really interested in competing in football, so to speak? So I think the time is coming. I'm really interested in January's NCAA convention to hear what the Division II leadership is open to. Are they willing to open up a conversation about a total restructure? I think it goes back to is there a conference or a convention of conference schools to come in and to really rebuild the constitution of the NCAA and figure out is amateurism something that we're going to be able to hang on to or do we go to a model where perhaps we play outside of the NCAA structure in certain sports even all the way down into the Division II level?” Continuing: “You're going to have two polarizing groups: those that want no change and those that want to totally blow up what is currently in place, but I think the real work is going to be done in the middle. It's going to be the levelheaded CEOs and conference commissioners who come together and say what are we trying to achieve, what is the true experience that we're trying to build for students, and if it involves pulling pieces out in order to preserve another core segment of that then I think I’m certainly willing to have that conversation. I don't personally want the NCAA to be disbanded. […] I think the danger though is if we don't evolve then we're going to have to deal with the consequences that come from not wanting to engage in that side of the conversation.” Asked what the NCAA looks like in three to five years, Tatum hopes: “It looks like an association that really does support this idea of amateurism and student-athlete experience and that that's going to be different today than it was 25 years ago. […] The situation is not going to be rectified at the state level right because the states that are deeply invested in the success of their flagship universities are never going to let another state get the advantage on them and so I think a lot of this is going to be driven to a more federal level. […] My hope is that we can find the right mixture of state and federal legislation and guidelines that give us a platform where student athletes can compete.” (link)

NCAA Legal Matters:

+ Vanderbilt (DI) QB Diego Pavia’s request for a preliminary injunction allowing him another year of eligibility has been granted. From Chief U.S. District Court Judge William L. Campbell, Jr.’s 25-page memorandum opinion: “The eligibility bylaws induce potential football players to attend NCAA institutions rather than non-NCAA institutions even when non-NCAA institutions, such as junior colleges, might be in their best interest. Therefore, the rule harms student-athletes when they are making decisions on whether to attend a junior college or an NCAA institution. The effects on the labor market also cause downstream effects for consumers of collegiate athletics because the restriction on the eligibility of former junior college student-athletes…harms the competitiveness of the teams by limiting the number of years these players can compete at the Division I level. + Yahoo’s Ross Dellenger notes that for now, the “NCAA does not plan to offer further clarity or a change to eligibility rules that may affect other athletes. The court order applies to Pavia. The NCAA eventually changed its transfer rules to adhere to a West Virginia court ruling last year. It's worth monitoring.” The NCAA in a statement contends that “altering the enforcement of rules overwhelmingly supported by NCAA member schools makes a shifting environment even more unsettled. The NCAA is making changes to deliver more benefits to student-athletes, but a patchwork of state laws and court opinions make clear that partnering with Congress is essential to provide stability for the future of all college athletes.” (link)

+ To that end, Tulane Sports Law Director Gabe Feldman tells Dellenger: “On the bright side for the NCAA, this may strengthen their case for congressional intervention.” Meanwhile, one administrator says: “It’s not going to end until we collectively bargain.” (link)

+ Sportico’s Michael McCann is asked for his thoughts on “the likelihood of a non-JUCO athlete taking the next step and fighting the four-year eligibility limit, leading to theoretical unlimited eligibility” and responds: “I think we'll see this happen. The more college sports resembles pro sports, the harder it will be to restrain how long college athletes can play. So long as their school puts them in a full time degree program, there's now a good legal argument they should remain NCAA eligible.” (link)

+ Headlining attorney Tom Mars chimes in on the Diego Pavia court decision: “Although the federal court injunction in favor of Diego Pavia is limited to his specific case, it only took 24 hours for me to hear from a former JUCO football player (now a senior) whose head coach gave him my number. I’m sure other sports lawyers are getting similar calls. [...] The ‘roadmap’ for other former JUCO players: Player’s lawyer (paid by school as allowed in eligibility cases per NCAA rule) use Pavia pleadings as template with adjustments showing irreparable harm, citing Pavia ruling. After 3-4 consecutive losses, the NCAA surrenders.” (link)

NFL Flag Executive Director/RCX Sports CEO Izell Reese writes an SBJ op-ed about the rise of girls’ and women’s flag football and notes that 42,955 high school girls participated in the 2023-24 season, a 105% YoY increase. Meanwhile, nearly half a million girls aged six to 17 played flag football nationwide in 2023, and the number continues to rise. “The message is clear – girls want to play flag football. As this pathway expands, one crucial gap remains: NCAA membership sponsorship. That’s why, on behalf of the NFL, RCX Sports Foundation, USA Football and NFL Flag, we’ve applied to make women’s flag football an NCAA Emerging Sport for Women.” Reese points out the sport is already thriving on the NAIA and NJCAA levels while Conference Carolinas and Alabama State (DI) have also introduced the sport to their respective campuses. Further NCAA support, Reese continues, “would not only help cement its place on the national stage, but also enhance gender equity in athletics. It reinforces a powerful message — that young girls’ dreams are attainable, and their talent will be recognized and rewarded.” (link)

The Federal Reserve cut interest rates by 25 basis points but forecast two fewer rate cuts in 2025 than previously expected. Originally, the central bank projected it would cut rates four times in 2025. (link)
