The NCAA in a statement to Front Office Sports in connection to the trans athlete participation lawsuit filed yesterday by Texas Attorney General Ken Paxton: “College sports are the premier stage for women’s sports in America and while the NCAA does not comment on pending litigation, the Association and its members will continue to promote Title IX, make unprecedented investments in women’s sports and ensure fair competition in all NCAA championships.” (link)

Texas Tech AD Kirby Hocutt explains how the Red Raiders will approach revenue-sharing agreements with student-athletes: "We've worked on NIL contracts that we will award to the designated student-athletes, so a football player that is on our roster next year more than likely will have an NIL contract with us that is inclusive of tuition, room, board and then whatever NIL amount that is determined appropriate. So we will administer those contracts internally, administratively and work with our coaches on managing the amount of revenue share that they have to award, helping them monitor that." Red Raiders Deputy AD Jonathan Botros adds: "It'll be similar to our financial-aid process as it relates to coaches making decisions on financial aid for student-athletes. They can also make decisions as it relates to an NIL licensing and endorsement agreement value, and then we just take over as far as the administration as it relates to executing the contract for the student-athletes — storing it, making sure payments are made, things like that." As far as The Matador Club collective is concerned, Botros explains: "If The Matador Club does cease to exist as it stands currently, there'll be that fork in the road where it's critically important for us to continue to receive the support from fans and donors to the Red Raider Club now to support revenue sharing. And then the other piece of it will be to create opportunities for our student-athletes for true NIL." Hocutt goes on to say that the department is “still talking about options for us to help engagement in [the NIL] space — if it's building out something internally or if it's an outside agency that we partner with. We have not finalized any decision there, but would anticipate there would be opportunities that present themselves to certain athletes." (link)

Florida State AD Michael Alford provides an update on renovations to Doak Campbell Stadium and the Dunlap Football Performance Center and notes that everything will be ready in time for the football season. “Sales are going great, people are really excited. We're pacing ahead with the new products that we’re able to go out and offer our season ticket holders. I think the fan experience next year…is going to be really special.” Regarding the performance center, Alford notes when he first arrived in Tallahassee, “we were dead last in the conference in dedicated football space – dead last, and that's the ACC. We're not talking [about] who we compare as peers across the country. So, that facility is really going to assist us, especially, once again, coming out of the House case when everything gets settled and we have a cap. Now it's going to come back to education – which we’re a top 20 public institution in America.” A bit more. (link)

Colorado AD Rick George indicates star Football student-athletes Travis Hunter & Shedeur Sanders, as well as others on the Buffs roster, will be covered by disability insurance as CU has no opt-outs for the Alamo Bowl game against BYU this weekend. George: “It was his (HC Deion Sanders) idea we should get disability insurance for our athletes for this game to ensure that they played and if there was some kind of injury that they would be well taken care of. So, we worked together on that. We’re excited about it, we think it’s great that all our players are playing in the game. That’s what all bowl games should be like.” Sanders adds more context: “We happen to have two players that are probably going to be the first two picks of the NFL Draft. We all know who those two are and they have received, I think, the highest number of coverage that has ever been covered in college football. It far exceeds anyone that has ever played this game of college football.” (link)

Notre Dame-Indiana, also on ESPN, averaged 13.4M. Clemson-Texas on TNT averaged 8.6M & Penn State-SMU on TNT averaged 6.4M. The Athletic’s Stewart Mandel with some context: “Putting that in perspective, the Ohio State-Tennessee game did about the same TV audience as last year's UConn-Purdue men's basketball championship game (14.8M).” (link)

CBS Sports’ John Talty and Chris Hummer on Tulane QB Darian Mensah’s transfer portal process, which the duo says “speaks to a situation where money has flooded in from all corners and players hitting the market have never benefited more. According to sources around college football, Mensah received a deal from Duke that is believed to pay him $8 million over two years. A $4 million annual average would make him the highest-paid player in college football history, unofficially. A year ago, the going rate for a top-of-the-market quarterback like Cam Ward, who went from Washington State to Miami (FL), or Riley Leonard, who left Duke for Notre Dame, was a little less than half that.” Additional context: “Mensah was repped by Young Money APAA Sports agents Noah Reisenfeld and Adie von Gontard on the deal. Darren Heitner, a well-known sports law attorney, assisted as legal counsel and called it ‘groundbreaking’ with Duke and the NIL collective Durham Devils Club in a post on social media.” Macro-environment wise, per an SEC Director of Player Personnel: “I'm looking at the books from last year to this year and it's not even close. You take a contract and you multiply it by two, and that's what you're paying. Everybody thinks they have money now, and they'll figure it out on the backend. So everybody is trying to play fast."(link)

Coaches.wire’s Daniel Gillman sits down with Oregon Volleyball HC Matt Ulmer from the 2024 AVCA Convention. Ulmer says It remains to be seen whether UO will allot the full 18 scholarships as allowed by the House settlement, and explains Ducks AD Rob Mullens “doesn’t really deal in hypotheticals. I’m sure he has all of these plans, and I'm sure he has a Scenario A, B, C, D for whatever happens, but I think it's smart from leadership that you don't just throw things out there. So from my perspective it's business as usual, you know, here's what we're trying to do and then, again, I'm sure leadership is planning for all the different contingencies.” Ulmer believes women’s volleyball is just scratching the surface of how popular it can become, noting that “you’re just starting to see the networks really put women's volleyball at the front and center. Just give us an opportunity, give our women and our sport the opportunity to show what we can do and let the public decide on if they like it or not.” Ulmer adds: “I think our sport is a really interesting one because it's one where the men aren't leading the way. … I think that the world is starting to understand that we can give women more of an opportunity and it's okay it's not a threat to the men.” With increasing professional opportunities within the U.S., Ulmer says: “What you’re seeing more of is players from outside the country are now wanting to come here to play, which is what we've been doing to other countries for forever. … I think so many of our student-athletes are thrilled by the idea that they’re going to be home, their parents [are] going to watch them play…and this is just starting.” Lots more. TCU Senior Deputy AD for External Affairs and Revenue Generation Ryan Peck sits down with AthleticDirectorU’s Tai M. Brown to discuss his piece “The Sports Biz Career Plan” and reflect on his own journey to a senior leadership role. Peck and Brown go through the main recommendations from the “Career Plan,” including the importance of defining your core values and assessing the landscape of opportunities with that lens; the necessity of having advocates and mentors along the journey; and how getting clear with your story, including the weaknesses or gaps in your knowledge and experience, is a key to getting ahead. Peck on the Career Plan’s meeting the metrics set forth in the plan: “It allows you to kind of challenge yourself in the job. For me personally, I wanted to get published in the NACDA magazine or secure the biggest gift previously or you do I help a teammate get a promotion – I mean there are so many different aspects to it, but part of it was a deadline that I would think about it in segments of one year, three or five years, up to 10 years. And I remember doing it many, many years ago and I was sitting next to a buddy and he's like, ‘Man, you've accomplished a lot.’ And it wasn't something that I put on my bathroom mirror and looked at daily, but it allowed me to think we're getting some things done around here. … I think sometimes in our day-to-day, employees get so locked in we forget what we've done, so I'll start out a meeting [and ask] what are two things you accomplished last month and then what are two things you want to do this month? I try to keep it very simple and very high-level so we can pat ourselves on the back a little bit and be sure that we’re moving and getting things done.” More on ADU. (link)

The NCAA Board of Directors has voted to appeal the Diego Pavia court ruling but is also granting a waiver for junior college players in a similar position as Pavia, paving the way for the extension of the careers of hundreds of former junior college players. A statement from the board adds that DI leaders are “committed to advancing [player eligibility] discussions during January governance meetings.” (link)

U.S. District Judge Claudia Wilken has approved a version of the Q&A document about the House settlement for current and prospective athletes that “does *not* include changes requested by lawyers representing athletes who had objected to preliminary approval of settlement,” according to USA Today’s Steve Berkowitz. (link); Attorneys Douglas DePeppe and Brandon Leopoldus submit that the House settlement could jeopardize up to 25K Olympic sport roster spots across DI, roughly 13% of the 190K student-athletes currently competing at this level. “The Complaint emphasized that many student-athletes come ‘from socio-economically disadvantaged backgrounds’ and were being ‘deprived of the educational opportunities and economic benefits that the market would pay.’ However, the proposed settlement creates harm to these exact same student-athletes in a manner that is likely antithetical to antitrust law. The proposed settlement would implement roster caps that could eliminate opportunities for thousands of DI athletes, particularly in Olympic sports. Because of this, the proposed settlement does not adequately represent the interests of all class members given that the preliminary settlement defines multiple settlement classes including an ‘Additional Sports Class’ covering all Division I athletes outside of football and basketball. … Further, the settlement's structure may effectively create a new form of anticompetitive restraint by forcing schools to reduce athletic opportunities in order to fund payments to a small subset of athletes. This appears to conflict with the NCAA's stated goal of creating ‘a safe, and equitable environment that allows student-athletes to reach their full potential in academics, athletics and life.’” They conclude: “While many complain about the pay for play influences and demise of college sport, more sunlight needs to fall upon the NCAA and athletic directors with their knives out priming to cut nonrevenue sports rosters.” (link)

More NCAA Legal Matters…
+ Texas Attorney General Ken Paxton is suing the NCAA over its transgender policy and says in a statement that his office is attempting to prevent the NCAA from “engaging in false, deceptive, and misleading practices” by marketing sporting events as competitions only for women but then allowing “biological males to compete against biological females.” Paxton argues the NCAA violated the Texas Deceptive Trade Practices Act by “false marketing” competitions as women’s only but offering a “mixed sex” event. “The NCAA is intentionally and knowingly jeopardizing the safety and wellbeing of women by deceptively changing women’s competitions into co-ed competitions. When people watch a women’s volleyball game, for example, they expect to see women playing against other women – not biological males pretending to be something they are not. Radical ‘gender theory’ has no place in college sports.” Paxton has asked the court to grant a permanent injunction to prohibit the NCAA from allowing biological males to compete in women’s sporting events involving Texas or to stop marketing the events as women’s sports. Eastern Washington AD Tim Collins reports football ticketing revenue increased by over 40% “due to new outbound sales efforts, new fan amenities like the Bud Light Endzone Suites and food trucks, and new giveaways and promotions at Roos Field throughout the season.” Collins also notes EWU has raised $68M as part of its $100M capital campaign. “One of the prongs of the Strategic Plan is to invest in our people and places and, with that in mind, we’ve reaffirmed the athletic department's commitment to level-up Roos Field with over $6M raised thanks to philanthropy toward our $13M goal to begin construction.” Moving forward, Collins notes the Eagles are getting ready to launch a new membership campaign to add 509 new donors to support scholarships, operations, and opportunities to benefit student-athletes. Indiana’s College Football Playoff berth provided the company a “return to its roots and a massive chance to capitalize on interest from a fanbase that annually helps Indiana rank as Homefield’s top-selling school partner,” according to SBJ’s Ben Portnoy, and Homefield Co-Founder/CEO Connor Hitchcock says: “We have every Power 4 school you could want [from a licensing perspective]. It shakes out like you'd think, Big Ten and SEC schools plus Notre Dame all constitute the top 10 [in sales]. Indiana isn't seen as a top 10 brand [by some], but, for us, it is.” As the company continues to grow, Homefield Director of Partnerships and Events Josh Johns tells Portnoy: “Ecommerce is our bread and butter. But, at some point in time, if you want to carry the authenticity and the thoughtfulness and care that we think defines Homefield, you’ve got to be on campus, baby. You’ve just got to.” Homefield, Portnoy notes, has “leaned into the energy that comes from college campuses and alumni associations. It advertises with a handful of media outfits (podcasts, newsletters, etc.) geared toward the college space and has hosted events at bars and restaurants in and around schools from around the country. Johns: “I’ve found that the heart grows fonder the further you are away from campus. These [events] become like little campuses themselves.” (link)

We are excited to bring this event to Lincoln, a city with a rich volleyball tradition and a passionate fan base. ESPN has debuted a new ad that invites fans to “tap in” to the network's "breadth of digital offerings, including highlights, breaking news, documentaries, sports betting, fantasy games, social feeds and other on-demand content" that will be offered on its upcoming standalone streaming service. The campaign from BSSP is the first step toward Flagship’s fall 2025 launch, according to Ad Age’s Jon Springer. The ad features NBA Countdown host Malika Andrews, who says: "You could just watch ESPN, but why not tap in?" Future phases of BSSP's campaign are "planned for March, when ESPN will demonstrate its leadership in women’s sports coverage,” per Springer, who adds that ESPN will "give the campaign a push on Christmas Day" during its NBA coverage and will "continue to put the creative in front of large audiences" (link)
