Sportico’s Michael McCann further unpacks Vanderbilt QB Diego Pavia’s preliminary injunction against the NCAA and spells out that litigation in the future “could include athletes eyeing seven-year collegiate careers, where they play the first two years in JUCO and then five years in DI. Some could sue to gain even longer collegiate careers, with athletes using university graduate programs to play college sports well into their 20s or even beyond. At the other end of the spectrum, younger players could challenge the NCAA’s initial eligibility guidelines. … College athletes can now credibly argue the denial of playing eligibility and accompanying NIL deals deprives them of market-based opportunities ordinarily protected by antitrust law. NCAA eligibility rules are vulnerable to antitrust scrutiny because they reflect agreements by competing businesses (i.e., NCAA member institutions) to restrain opportunities for a labor market that increasingly resembles pro athletes.” Complicating matters further, NCAA rules require it to treat all members and student-athletes equally. “Yet now the NCAA is compelled to treat Pavia better than other former JUCO players. That problematic dynamic could lead the NCAA to announce other players sharing the same eligibility situation as Pavia can keep playing too. … Lastly, there’s the possibility of athletes denied NCAA eligibility due to rules set by the NCAA Eligibility Center…challenging rules on account of lost NIL opportunities and denial of play in a commercialized college sports landscape. Former George Mason Deputy AD Kevin McNamee suggested this to me on X and it’s a great point. An attorney could adapt Pavia’s arguments to fit a challenge to initial eligibility rules, which include assorted academic requirements.” More from McCann. (link)

The Pac-12 earlier this month filed applications with the U.S. Patent and Trademark Office for the word marks for “Pac-9,” “Pac-10,” “Pac-11,” “Pac-13,” “Pac-14,” according to Sportico’s Daniel Libit, who adds the conference also officially pursued the marks to the numberless “Pacific Athletic Conference” and “The PAC Conference.” The applications, per Libit, “relate to publications, clothing, association services and broadcast or television programming. The league is using law firm Cooley, which has previously handled the Pac-12’s intellectual property work. On average, a successful trademark takes a little over a year to be registered, but trademark protection is retroactive to the date its application was filed.” (link)

Michigan AD Warde Manuel sits down with The Michigan Insider’s Sam Webb and among a handful of items commented on his recent contract extension: “Extremely happy to be here. I love Michigan. I have three degrees and played two sports here." He adds he’s having "too much fun to stop now” and says he’s excited to face the challenges in the industry, particularly with President Santa Ono. “It’s good to have a president who is engaged with athletics and loves it the way he loves it.” Manuel notes Ono “doesn't give me everything I want" but says he understands the problems that athletics can face and helps them overcome those challenges. “I’ve had a lot of great bosses. He’s the best one I’ve ever had.” Manuel anticipates players will sign contracts post-House and explains: "I'm not trying to stop student-athletes from moving. But it can't be free movement every year. It's one of the biggest complaints we have from our fan base that they don't know who's on the team year to year." From a ticket price standpoint, Manuel says the Wolverines are behind Texas, Ohio State and Penn State and adds: “I played here. I believe toe should meet leather at 12 o'clock. Creighton Volleyball HC Kirsten Bernthal Booth joins D1.ticker’s Matt Roberts from the AVCA Convention. As the sport continues to grow in popularity, Bernthal Booth points out one unique component on the women’s side that “we’re not having any other male counterpart hold us up. We’re doing it because people love women’s volleyball. I think we need to continue to storytell. And we need runway for that. Even when we go into the national tournament, do viewers know the athletes? Do they know the coaches? I think we need to continue to lean into that throughout the season. I also think one of the things that they're doing really well on the international level is how do we make the fan experience great? How do we make the television experience great? I've been to some meetings [in which people say] there's too much down time, so do we need to be on a serve clock? If you go to International games they've got 15 seconds.” Is it possible for volleyball to have a Caitlin Clark-type figure to lead even more substantial growth? Bernthal Booth notes the sport doesn’t necessarily allow for a player to score “from Point A to Point B,” but says “I do think there’s stories to be told. I think we can lean into coaches some. The story going on at Penn State with [HC] Katie [Schumacher-Cawley] battling cancer, people connect with that. That’s real life, she’s got young children. So are we telling those stories? USA Lacrosse Magazine’s Justin Feil breaks down how the House settlement could impact college lacrosse and Duke Women’s Lacrosse HC Kerstin Kimel puts it like this: “Business as we've known it in the world of college athletics is going to change. And anybody who thinks they know what this is going to look like in real time, they're kidding themselves.” The settlement would allow men’s teams to increase their scholarship allotment from 12.6 to 48 and women’s teams to increase from 12 to 38; however, Maryland Men’s HC John Tillman “just [doesn’t] see that happening,” and IWLCA President/Tampa (DII) Women’s Lacrosse HC Kelly Gallagher notes: “Nobody has a money tree in their backyard. So if schools are definitely adding the 20 additional scholarships to football, where is the money going to come from to get to whatever that number is for their women's lacrosse team?” Saint Joseph’s Men’s HC Taylor Wray, meanwhile, is less worried about funding more scholarships than about losing the existing ones. “If anything, schools are getting less money, and now you think you're going to get more scholarships? It ain't happening. If anything, scholarships are going to be taken away from sports that are deemed not as big of a priority at certain institutions. This is not going to add scholarships across the board. If anything, I think it’s going to crush certain sports.” Duke Men’s HC John Danowski adds: “That's the fear I have. If basketball gets two more scholarships and if football gets 20 more scholarships, where does that come from? Does that come from the male side? Because you need to be aware of your Title IX balance. Or is there going to be an increase from the universities?” Ultimately, Kimel hopes that whatever the decision is, it’s clearly communicated and “there's not a lot of room for interpretation and loopholes for people to work around things, which has been the world of college athletics.” (link)

Louisville professor Meg Hancock and doctoral student Nicholas Kopka and Tulane professor Ehren R. Green share some insights and analysis from The Pipeline Project: 2024 Employment Overview, NCAA Football Bowl Subdivisions which found that in 2023, “only 36% of sport supervisors in FBS athletic departments were women. Of that group, only 16% of football and men’s basketball programs in Power 4 conferences had a woman sport supervisor. … This data suggests women are systematically underrepresented and continue to encounter barriers in the pipeline for advancement in intercollegiate athletic departments. Athletic departments have experienced exponential growth over the last decade with more than 1,000 new assistant and associate AD positions across FBS athletic departments with an 80% increase in assistant AD roles and an 43% in associate AD positions. Yet, women’s representation remained stagnant. In 2015, women held 29.7% of assistant AD roles and 25% of associate AD roles. By 2024, those numbers have risen to 35% and 31%, respectively. While this shows progress— women have gained around 6% in both categories— these increases are still modest compared to the overall growth of the positions. Moreover, only 11.7% of FBS athletic departments are led by women.” As for using this and other data from the report to take action, Hancock, et al. write: “For athletic administrators, we recommend identifying leaks in the pipeline and paying attention to turnover within their department. We also recommend building and repairing the pipeline by offering and encouraging professional development for supervisors, clarifying roles, defining job expectations, and succession planning. Entry and middle level professionals may use this data to provide insight into their own career development. It also showcases how these professionals can balance their career aspirations, and the realities faced within their work environment.” Lots more. (link)

Garcia reflects on her journey from aquatics and recreation to intercollegiate athletics, including how she persevered when her first job application was rejected. Garcia and Garcia Cichosz also discuss gender equity within facilities, how to use your voice when you're at the table with leaders, and the various ways Garcia stays organized. Garcia: "We're making sure the lights are on and the toilets are flushing, which is not the glamorous part, but we’ve really been part of bigger projects. … I think also the branding part that is huge now in every team and every location, so that’s been different. SBJ’s Jason Wilson asks if the success of EA Sports’ College Football 25 is repeatable for College Football 26 and notes: “It stormed a market starved for 11 years for a college football game, and as noted earlier, it’s the bestselling sports game ever. The sport’s viewership is up. All this led to a dream scenario for EA. But will EA Sports College Football 26 live up to the expectations set by this year’s edition? Expect the development team at the EA Tiburon studio to pay close attention to how well the 12-game CFP performs on TV and with fans and see if there are any takeaways from it for building a bigger, better CFP in the game for 2025.” Wilson also notes that EA found a new way to position its Madden NFL franchise: namely, by packaging it with College Football. “The EA Sports MVP Bundle was a top-10 seller for a couple of months. Game bundles aren’t new in the wider industry, but it’s usually a tactic to move older games. This is the first time I can recall two top-flight sports games getting sold together. It’ll be interesting to watch how this first-ever football bundle works for EA going forward. [Circana Executive Director of Video Games Mat] Piscatella is also keeping an eye on it: ‘This one doesn't have a lot of comparable benchmarks to look at. Auburn Executive Deputy AD Jared Benko, who recently served as AD at Georgia Southern, sits down with D1.ticker’s Kristen Eargle on The Career Hustle. The two discuss why the time was right for Benko’s career move, as well as dive into recent AD hiring trends. Benko provides insights into how he approached making decisions during his time as an AD, including who he puts in the room as advisors and why. Benko: “There’s a saying about ‘not taking criticism from those you don’t take counsel from.’ There is a Winston Churchill quote, ‘If you stop and throw a rock at every dog that barks, you will never get where you are going.’ These leadership roles are not easy. You’re always going to have feedback. The feedback that I really and truly care about have invested interest and are in the fox hole with you. At the end of the day, I want to work alongside people that have mutual respect both as a professional and as a person. I just don’t believe you have to sacrifice either one just to make the popular hire or just the hire that you think is going to win the most. That’s a short-term lens.” When it comes to deciding who to consult during coaching searches, Benko explains that first and foremost you want individuals who add value and bring thoughtfulness. “Ultimately I wanted everyone to feel like they had a role in the process because what you also do during those searches is you build equity with people…and so I kind of look at it as an opportunity for people to get off to a fast start, too.” Lots more on Collegiate Sports Connect. CougFan.com’s Barry Bolton indicates Washington State will reduce its Football scholarship allotment from 85 to 79 with the aim of realizing an annualized savings of over $300K. Cougars radio analyst & former standout quarterback Alex Brink passed along the news to Bolton, adds: “They can't compete like that, there is just no way. It doesn't work … You have schools that can go to 105 if they want … and we're at 79? There is literally just no way that you can compete. I was just stunned.” An unnamed “prominent booster” tells Bolton: “If you want to know why he (former HC Jake Dickert) left, it's the pennywise and pound foolish nonsense, like dropping to 79, that Kirk Schulz and the Board of Regents are cramming down throats. [...] the Board of Regents has no idea the football program is one of the single-greatest assets at our university so they’re going to starve it rather than make bold decisions that require critical thinking skills.” (link)

The Notre Dame-affiliated Friends of Notre Dame (FUND) collective, which has announced plans to shut down as the Fighting Irish transitions to the new for-profit RALLY collective & lifestyle agency, generated $20.5M in revenue last year, according to Sportico’s Daniel Libit. More context: “Any leftover funds, that are not otherwise dispersed, could be transferred to another nonprofit, including the university, which operates under the same tax-exempt status. [...] FUND Foundation reported distributing $5.12 million to Notre Dame athletes in 2023, while paying its former executive director Kevin Klau $66,667 and COO Megan Whitt $67,083. The organization ended last year with $14.88 million in net revenue and $21.1 million in net assets, according to its IRS disclosures.” (link)

Ahead of today’s Women’s Volleyball National Championship match between Louisville & Penn State, Wisconsin HC Kelly Sheffield sat down with Coaches.wire’s Daniel Gillman at the AVCA Convention to cover a number of trend lines for the sport. Sheffield: “People have gotten out of their comfort zones. Getting into bigger arenas - bigger basketball and football stadiums - has been really important. TV has responded and come along. Coaches tend to get a bit fearful at times to do things new, getting into a routine a little bit, but getting into new venues has been big. [...] It’ll continue to grow because fans are responding to it, administration is getting behind it and television is intrigued by it.” Sheffield on student-athlete compensation challenges & opportunities: “You can see where we’re headed and you better be out in front of it and have a plan. [...] But now we’re about to transition into revenue sharing and that’s a totally different beast. [...] It’s been a challenge for a lot of athletic departments. You’ve got the athletic department who is out there trying to raise money for facilities. You have coaches out there trying to raise money for their programs. It’s felt a little like everyone is competing against each other, which I don’t think is necessarily a really healthy thing. As we’re getting into revenue sharing, hopefully we don’t have to be fighting over donors, so I think it will be a lot healthier.” As for the coming roster cap: “How do you manage all this? The revenue sharing and roster limits with Title IX? There’s still a lot of court decisions that have to be made. Georgia Southern announced plans to renovate Baseball’s J.I. Clements Stadium with a $10M new facility in time for the 2026 season. The Wiggins Building will give way to a new 16K+ square-foot facility that will include a new locker room, meeting room, players' lounge, nutrition center, display lobby, coaching offices, training room, as well as indoor batting cages and pitching tunnels with state-of-the-art technology for year-round use. Demolition of the Wiggins Building is set for early January with construction beginning subsequently afterwards. (link)

The Athletic’s Bruce Feldman checks in with several coaches and staffers to discuss issues with the football calendar within the context of Penn State backup QB Beau Pribula’s decision to transfer amid the Nittany Lions’ CFP push. While some, like PSU HC James Franklin and UTSA Jeff Traylor, contend the NCAA puts players in a no-win situation, one personnel staffer says: “We always want a villain in a story, but at this moment, I don’t know if the villain here is the NCAA. A lot of people want to think there is an easy fix to this but there actually is no easy solution.” A Big 12 HC adds: “The problem is that football has long operated as a one-semester sport. But now, because of the Playoff, it is a two-semester sport. The cleanest answer is to move up the season: Take away conference championship games, roll right into the Playoff after the regular season, and finish by the end of December or the first week of January. Then, you have a two-week portal window post-national championship game. But I’m doubtful of that happening. There are obvious issues with finals, school.” Another option is to reexamine the unlimited transfer rule, and a Mountain West HC tells Feldman: “The bigger issue is the unlimited transfer rule because it creates such a high volume of transfers. The Power 4 schools don’t really have to do the same work that Group of 5 schools do because they can outbid us at any point in the process. … The system works really well for like 200 or so kids and the top 20-30 schools, and it is a disaster for everyone else.” More. In order to fix the problem with the transfer portal calendar, On3’s Andy Staples suggests: “Instead of holding 15 spring practices in either February, March or April, adopt an OTA (organized team activities) schedule similar to what NFL teams use – but that schedule doesn’t begin until the second week of May. This is the key, because it allows for an adjustment to the transfer portal window timing that would take pressure off of players and coaches. … Semester-system schools wrap their spring semesters in early May and start their summer sessions in late May. This would allow incoming transfers to practice with their teammates and learn their new schemes. It also would allow those transfers to wrap up any academic needs at their previous school.” Staples also suggests consolidating the transfer windows into one that opens the day after the national championship. “It’s time to take that step back. Some things — the semester system, for example — aren’t going to change. But that doesn’t mean there are no workable solutions. Some things — when schools hold their offseason practices — are easily changed. Start there and work outward.” (link)

President Joe Biden and the White House are expected to “pull back unfinished rules across several agencies if there isn’t enough time to finalize them before Trump takes office,” according to ESPN News Services. Among those could be Biden’s efforts to provide protections for transgender student-athletes and cancel student loans. “For the regulation on transgender students, the Education Department said it was withdrawing the proposal because of ongoing litigation over how Title IX, the landmark law preventing sex discrimination, should handle issues of gender identity. In addition, the department said there were 150,000 public comments with a range of feedback, including suggestions for modifications that needed to be considered. At this point, the department wrote, ‘We do not intend for a final rule to be issued.’” (link)

ESPN’s forthcoming “Flagship” streaming service may be the “goldilocks product offering that many are hoping for in Bristol,” according to a note from MoffettNathanson Senior Research Analyst Robert Fishman. Via Puck’s John Ourand: “Fishman predicts that Flagship will amass 1M paid subscribers by the end of 2026 and as many as 3M by 2030, all paying around $25 a month, or $300 per year…at least at first. In particular, he estimated the service would bring in $200M+ in subscriber revenue the year after next (remember, those 1M subscribers will accumulate over the course of 12 months) and around $20M in advertising revenue. … Projecting these numbers out, the service could likely do well over a billion dollars in annual revenue by the end of the decade—a nice number, but pretty small in the grand scheme of things, and less than the network pays for any of its major sports packages. (As a reminder, ESPN made $16B in 2022 and amassed about $2.9B in profit.)” ESPN Chairman Jimmy Pitaro “desperately needs to move ESPN toward the future, but he cannot yank the cord on cable too quickly.” Meanwhile, Puck’s Bill Cohan notes that Warner Bros. Discovery CEO David Zaslav hired three investment banks (J.P. Morgan, Evercore, and Guggenheim Securities) and two high-powered law firms (Kirkland & Ellis and Wachtell Lipton) to aid in the company’s reorg. Cohan: “You don’t need three M&A advisors and two legal advisors just to reorganize the divisions of your company. Instead, you pay their considerable fees so they can meticulously analyze what a spinoff, sale, or some other strategic separation of the [WBD cable networks] would look like, including when and how to announce it, how much debt to pile on to it, and whether that business should try to bring in a private equity partner. The NFL has no plans to scale back its commitment to DEI initiatives, according to Commissioner Roger Goodell, who said during last week’s league meeting: “We didn’t get into this because it was a trend, and we’re not getting out of it because it’s a trend. We’re in it because it makes the NFL better.” NFL SVP/Chief Inclusion and Diversity Officer Jonathan Beane acknowledges the league’s response to issues in the past, such as peaceful protests led by former San Francisco 49ers QB Colin Kaepernick, resulted in backlash from fans who view DEI unfavorably today, but adds: “That is something that we see as a part of our history. It’s not something where we try to step away from and act like it didn’t happen.” Beane also contends the “perception of the NFL has gone up…because of a lot of the really hard work done as it relates to inclusion.” Front Office Sports’ A.J. Perez points out that “the uproar over the kneeling and the rhetoric from Donald Trump during his first presidential run didn’t actually impact viewership much in 2016. TV ratings recovered and have been on an upward trajectory since. Plus, the social-media-fueled furor over DEI is about 10 decibels lower than what the league dealt with eight years ago.” Beane goes on to explain that “we’re looking for reach and growth as a league. We’re looking to grow flag football. We’re looking to grow internationally and be a true global brand. In order to do that, we’re going to continue to focus on developing our people, whether it’s having marketing that is welcoming and inclusive, using the league as a unifier – a platform to welcome all of us to the game of football.” (link)
