The NCAA Board of Directors has voted to appeal the Diego Pavia court ruling but is also granting a waiver for junior college players in a similar position as Pavia, paving the way for the extension of the careers of hundreds of former junior college players. A statement from the board adds that DI leaders are “committed to advancing [player eligibility] discussions during January governance meetings.” (link)

U.S. District Judge Claudia Wilken has approved a version of the Q&A document about the House settlement for current and prospective athletes that “does *not* include changes requested by lawyers representing athletes who had objected to preliminary approval of settlement,” according to USA Today’s Steve Berkowitz. (link); Attorneys Douglas DePeppe and Brandon Leopoldus submit that the House settlement could jeopardize up to 25K Olympic sport roster spots across DI, roughly 13% of the 190K student-athletes currently competing at this level. “The Complaint emphasized that many student-athletes come ‘from socio-economically disadvantaged backgrounds’ and were being ‘deprived of the educational opportunities and economic benefits that the market would pay.’ However, the proposed settlement creates harm to these exact same student-athletes in a manner that is likely antithetical to antitrust law. The proposed settlement would implement roster caps that could eliminate opportunities for thousands of DI athletes, particularly in Olympic sports. Because of this, the proposed settlement does not adequately represent the interests of all class members given that the preliminary settlement defines multiple settlement classes including an ‘Additional Sports Class’ covering all Division I athletes outside of football and basketball. … Further, the settlement's structure may effectively create a new form of anticompetitive restraint by forcing schools to reduce athletic opportunities in order to fund payments to a small subset of athletes. This appears to conflict with the NCAA's stated goal of creating ‘a safe, and equitable environment that allows student-athletes to reach their full potential in academics, athletics and life.’” They conclude: “While many complain about the pay for play influences and demise of college sport, more sunlight needs to fall upon the NCAA and athletic directors with their knives out priming to cut nonrevenue sports rosters.” (link)

+ Texas Attorney General Ken Paxton is suing the NCAA over its transgender policy and says in a statement that his office is attempting to prevent the NCAA from “engaging in false, deceptive, and misleading practices” by marketing sporting events as competitions only for women but then allowing “biological males to compete against biological females.” Paxton argues the NCAA violated the Texas Deceptive Trade Practices Act by “false marketing” competitions as women’s only but offering a “mixed sex” event. “The NCAA is intentionally and knowingly jeopardizing the safety and wellbeing of women by deceptively changing women’s competitions into co-ed competitions. When people watch a women’s volleyball game, for example, they expect to see women playing against other women – not biological males pretending to be something they are not. Radical ‘gender theory’ has no place in college sports.” Paxton has asked the court to grant a permanent injunction to prohibit the NCAA from allowing biological males to compete in women’s sporting events involving Texas or to stop marketing the events as women’s sports. Eastern Washington AD Tim Collins reports football ticketing revenue increased by over 40% “due to new outbound sales efforts, new fan amenities like the Bud Light Endzone Suites and food trucks, and new giveaways and promotions at Roos Field throughout the season.” Collins also notes EWU has raised $68M as part of its $100M capital campaign. “One of the prongs of the Strategic Plan is to invest in our people and places and, with that in mind, we’ve reaffirmed the athletic department's commitment to level-up Roos Field with over $6M raised thanks to philanthropy toward our $13M goal to begin construction.” Moving forward, Collins notes the Eagles are getting ready to launch a new membership campaign to add 509 new donors to support scholarships, operations, and opportunities to benefit student-athletes. Indiana’s College Football Playoff berth provided the company a “return to its roots and a massive chance to capitalize on interest from a fanbase that annually helps Indiana rank as Homefield’s top-selling school partner,” according to SBJ’s Ben Portnoy, and Homefield Co-Founder/CEO Connor Hitchcock says: “We have every Power 4 school you could want [from a licensing perspective]. It shakes out like you'd think, Big Ten and SEC schools plus Notre Dame all constitute the top 10 [in sales]. Indiana isn't seen as a top 10 brand [by some], but, for us, it is.” As the company continues to grow, Homefield Director of Partnerships and Events Josh Johns tells Portnoy: “Ecommerce is our bread and butter. But, at some point in time, if you want to carry the authenticity and the thoughtfulness and care that we think defines Homefield, you’ve got to be on campus, baby. You’ve just got to.” Homefield, Portnoy notes, has “leaned into the energy that comes from college campuses and alumni associations. It advertises with a handful of media outfits (podcasts, newsletters, etc.) geared toward the college space and has hosted events at bars and restaurants in and around schools from around the country. Johns: “I’ve found that the heart grows fonder the further you are away from campus. These [events] become like little campuses themselves.” (link)

The second annual AVCA First Serve event will take place at Pinnacle Bank Arena in Lincoln, Nebraska, over August 22-24, 2025. AVCA First Serve will mark the official start of the 2025 women’s volleyball season and feature eight of the nation’s top teams. AVCA CEO Jamie Gordon: “The 2025 AVCA First Serve promises to be an unforgettable experience for players and fans alike. We are excited to bring this event to Lincoln, a city with a rich volleyball tradition and a passionate fan base. The collaboration with Pinnacle Bank Arena and Visit Lincoln on the event will be a great way to start the 2025 Division I women’s volleyball season.” The participating teams have yet to be announced. ESPN has debuted a new ad that invites fans to “tap in” to the network's "breadth of digital offerings, including highlights, breaking news, documentaries, sports betting, fantasy games, social feeds and other on-demand content" that will be offered on its upcoming standalone streaming service. The campaign from BSSP is the first step toward Flagship’s fall 2025 launch, according to Ad Age’s Jon Springer. The ad features NBA Countdown host Malika Andrews, who says: "You could just watch ESPN, but why not tap in?" Future phases of BSSP's campaign are "planned for March, when ESPN will demonstrate its leadership in women’s sports coverage,” per Springer, who adds that ESPN will "give the campaign a push on Christmas Day" during its NBA coverage and will "continue to put the creative in front of large audiences" (link)

Sportico’s Michael McCann further unpacks Vanderbilt QB Diego Pavia’s preliminary injunction against the NCAA and spells out that litigation in the future “could include athletes eyeing seven-year collegiate careers, where they play the first two years in JUCO and then five years in DI. Some could sue to gain even longer collegiate careers, with athletes using university graduate programs to play college sports well into their 20s or even beyond. At the other end of the spectrum, younger players could challenge the NCAA’s initial eligibility guidelines. … College athletes can now credibly argue the denial of playing eligibility and accompanying NIL deals deprives them of market-based opportunities ordinarily protected by antitrust law. NCAA eligibility rules are vulnerable to antitrust scrutiny because they reflect agreements by competing businesses (i.e., NCAA member institutions) to restrain opportunities for a labor market that increasingly resembles pro athletes.” Complicating matters further, NCAA rules require it to treat all members and student-athletes equally. “Yet now the NCAA is compelled to treat Pavia better than other former JUCO players. That problematic dynamic could lead the NCAA to announce other players sharing the same eligibility situation as Pavia can keep playing too. … Lastly, there’s the possibility of athletes denied NCAA eligibility due to rules set by the NCAA Eligibility Center…challenging rules on account of lost NIL opportunities and denial of play in a commercialized college sports landscape. Former George Mason Deputy AD Kevin McNamee suggested this to me on X and it’s a great point. An attorney could adapt Pavia’s arguments to fit a challenge to initial eligibility rules, which include assorted academic requirements.” More from McCann. (link)

The Pac-12 earlier this month filed applications with the U.S. Patent and Trademark Office for the word marks for “Pac-9,” “Pac-10,” “Pac-11,” “Pac-13,” “Pac-14,” according to Sportico’s Daniel Libit, who adds the conference also officially pursued the marks to the numberless “Pacific Athletic Conference” and “The PAC Conference.” The applications, per Libit, “relate to publications, clothing, association services and broadcast or television programming. The league is using law firm Cooley, which has previously handled the Pac-12’s intellectual property work. On average, a successful trademark takes a little over a year to be registered, but trademark protection is retroactive to the date its application was filed.” (link)

Michigan AD Warde Manuel sits down with The Michigan Insider’s Sam Webb and among a handful of items commented on his recent contract extension: “Extremely happy to be here. I love Michigan. I have three degrees and played two sports here." He adds he’s having "too much fun to stop now” and says he’s excited to face the challenges in the industry, particularly with President Santa Ono. “It’s good to have a president who is engaged with athletics and loves it the way he loves it.” Manuel notes Ono “doesn't give me everything I want" but says he understands the problems that athletics can face and helps them overcome those challenges. “I’ve had a lot of great bosses. He’s the best one I’ve ever had.” Manuel anticipates players will sign contracts post-House and explains: "I'm not trying to stop student-athletes from moving. But it can't be free movement every year. It's one of the biggest complaints we have from our fan base that they don't know who's on the team year to year." From a ticket price standpoint, Manuel says the Wolverines are behind Texas, Ohio State and Penn State and adds: “I played here. I believe toe should meet leather at 12 o'clock. I don't believe there should be advertising in Michigan Stadium. But my job is to explore all opportunities.” Lots more. (link)

Creighton Volleyball HC Kirsten Bernthal Booth joins D1.ticker’s Matt Roberts from the AVCA Convention. As the sport continues to grow in popularity, Bernthal Booth points out one unique component on the women’s side that “we’re not having any other male counterpart hold us up. We’re doing it because people love women’s volleyball. I think we need to continue to storytell. And we need runway for that. Even when we go into the national tournament, do viewers know the athletes? Do they know the coaches? I think we need to continue to lean into that throughout the season. I also think one of the things that they're doing really well on the international level is how do we make the fan experience great? How do we make the television experience great? I've been to some meetings [in which people say] there's too much down time, so do we need to be on a serve clock? If you go to International games they've got 15 seconds.” Is it possible for volleyball to have a Caitlin Clark-type figure to lead even more substantial growth? Bernthal Booth notes the sport doesn’t necessarily allow for a player to score “from Point A to Point B,” but says “I do think there’s stories to be told. I think we can lean into coaches some. The story going on at Penn State with [HC] Katie [Schumacher-Cawley] battling cancer, people connect with that. That’s real life, she’s got young children. So are we telling those stories? USA Lacrosse Magazine’s Justin Feil breaks down how the House settlement could impact college lacrosse and Duke Women’s Lacrosse HC Kerstin Kimel puts it like this: “Business as we've known it in the world of college athletics is going to change. And anybody who thinks they know what this is going to look like in real time, they're kidding themselves.” The settlement would allow men’s teams to increase their scholarship allotment from 12.6 to 48 and women’s teams to increase from 12 to 38; however, Maryland Men’s HC John Tillman “just [doesn’t] see that happening,” and IWLCA President/Tampa (DII) Women’s Lacrosse HC Kelly Gallagher notes: “Nobody has a money tree in their backyard. So if schools are definitely adding the 20 additional scholarships to football, where is the money going to come from to get to whatever that number is for their women's lacrosse team?” Saint Joseph’s Men’s HC Taylor Wray, meanwhile, is less worried about funding more scholarships than about losing the existing ones. “If anything, schools are getting less money, and now you think you're going to get more scholarships? It ain't happening. If anything, scholarships are going to be taken away from sports that are deemed not as big of a priority at certain institutions. This is not going to add scholarships across the board. If anything, I think it’s going to crush certain sports.” Duke Men’s HC John Danowski adds: “That's the fear I have. If basketball gets two more scholarships and if football gets 20 more scholarships, where does that come from? Does that come from the male side? Because you need to be aware of your Title IX balance. Or is there going to be an increase from the universities?” Ultimately, Kimel hopes that whatever the decision is, it’s clearly communicated and “there's not a lot of room for interpretation and loopholes for people to work around things, which has been the world of college athletics.” (link)

Louisville professor Meg Hancock and doctoral student Nicholas Kopka and Temple professor Ehren R. Green share some insights and analysis from The Pipeline Project: 2024 Employment Overview, NCAA Football Bowl Subdivisions which found that in 2023, “only 36% of sport supervisors in FBS athletic departments were women. Of that group, only 16% of football and men’s basketball programs in Power 4 conferences had a woman sport supervisor. … This data suggests women are systematically underrepresented and continue to encounter barriers in the pipeline for advancement in intercollegiate athletic departments. Athletic departments have experienced exponential growth over the last decade with more than 1,000 new assistant and associate AD positions across FBS athletic departments with an 80% increase in assistant AD roles and an 43% in associate AD positions. Yet, women’s representation remained stagnant. In 2015, women held 29.7% of assistant AD roles and 25% of associate AD roles. By 2024, those numbers have risen to 35% and 31%, respectively. While this shows progress— women have gained around 6% in both categories— these increases are still modest compared to the overall growth of the positions. Moreover, only 11.7% of FBS athletic departments are led by women.” As for using this and other data from the report to take action, Hancock, et al. write: “For athletic administrators, we recommend identifying leaks in the pipeline and paying attention to turnover within their department. We also recommend building and repairing the pipeline by offering and encouraging professional development for supervisors, clarifying roles, defining job expectations, and succession planning. Entry and middle level professionals may use this data to provide insight into their own career development. It also showcases how these professionals can balance their career aspirations, and the realities faced within their work environment.” Lots more. (link)

Garcia reflects on her journey from aquatics and recreation to intercollegiate athletics, including how she persevered when her first job application was rejected. Garcia and Garcia Cichosz also discuss gender equity within facilities, how to use your voice when you're at the table with leaders, and the various ways Garcia stays organized. Garcia: "We're making sure the lights are on and the toilets are flushing, which is not the glamorous part, but we’ve really been part of bigger projects. … I think also the branding part that is huge now in every team and every location, so that’s been different. SBJ’s Jason Wilson asks if the success of EA Sports’ College Football 25 is repeatable for College Football 26 and notes: “It stormed a market starved for 11 years for a college football game, and as noted earlier, it’s the bestselling sports game ever. The sport’s viewership is up. All this led to a dream scenario for EA. But will EA Sports College Football 26 live up to the expectations set by this year’s edition? Expect the development team at the EA Tiburon studio to pay close attention to how well the 12-game CFP performs on TV and with fans and see if there are any takeaways from it for building a bigger, better CFP in the game for 2025.” Wilson also notes that EA found a new way to position its Madden NFL franchise: namely, by packaging it with College Football. “The EA Sports MVP Bundle was a top-10 seller for a couple of months. Game bundles aren’t new in the wider industry, but it’s usually a tactic to move older games. This is the first time I can recall two top-flight sports games getting sold together. It’ll be interesting to watch how this first-ever football bundle works for EA going forward. [Circana Executive Director of Video Games Mat] Piscatella is also keeping an eye on it: ‘This one doesn't have a lot of comparable benchmarks to look at. I'm assuming it will stick around on the charts through at minimum January, but we'll see!’” (link)
