Heitner Legal Founder Darren Heitner reacts to Florida State’s press release indicating it supports Men’s Basketball HC Leonard Hamilton’s right to defend himself: “The players aren’t suing the school or the collective. They’re suing Leonard Hamilton in his individual capacity for unfulfilled promises. Notable that FSU only says it supports Hamilton’s right to defend himself and not that it will defend him. Carefully crafted statement.” Sportico’s Michael McCann subsequently asks: “When was Hamilton's right to defend himself at issue? He, and no one else, is the defendant. In America, if you're sued, you can defend yourself. Not sure what this statement does.” (link); Also from Heitner: “To be clear, there are currently six named plaintiffs. That number may increase. Headlining sports attorney Tom Mars observes that Deloitte, which was selected by the NCAA to serve as an NIL clearinghouse, has published a study acknowledging that return on invested talent (ROIT) metrics are not a “silver bullet” and do “not mean that the value proposition of people can simply be reduced to numbers.” The study adds that “ROIT represents a lens through which the complexities of the financial impact of talent can be analytically viewed retrospectively and converted into the more financially nuanced perspective of the boardroom and wider investment communities. … Getting the right balance between the analytical and artistic craft of executing decisions is where both the greatest opportunities – and challenges – in releasing talent’s latent value lie.” (link, link – full study)

Utah has instructed all departments to run a “planning exercise” for anticipated budget cuts, and the Salt Lake Tribune’s Courtney Tanner reports President Taylor Randall wrote in an email to faculty and staff: “We all hear the narratives regarding higher education from those who challenge its purpose and value, and are acutely aware of the heightened political interest in our own state.” Randall also noted the exercise “will apply to all areas” but added: “Please be mindful that this is a planning exercise. We remain optimistic that any state funding reductions will be minimal, but must prepare for multiple scenarios.” Utah House Speaker Mike Schultz (R-12) earlier this year spoke publicly about his desire to cut higher education funding by around 10%. Penn State Football HC James Franklin “can’t really get into” the Nittany Lions’ player payroll, explaining that it’s “not that I wouldn't want to, it's just hard [because] the way this system is set up right now, there's no real way to track that. The information that you see out there or if an athletic director or somebody is willing to report it, there's no real way to track it. I think Boise’s situation is probably a little bit different and I think you guys know our situation has been a little bit different in those areas, so I can't really speak on that. I'm not one of these guys that feel like you should have a strong opinion if you don't have all the information or most of the information, and I don't. I don't have enough true, valuable, credible information to make that type of statement. I think there's things that we see out there on social media – how credible that information is, I'm not sure.” (link)

The Athletic’s Pete Sampson notes that “Notre Dame – the administration, the president, the athletic director, the trustees – is as committed as I’ve seen in 24 years on the beat. It was just nine years ago in the New York Times that former president Rev. John Jenkins was quoted that Notre Dame wouldn’t participate in the semi-pro future of college athletics. Just two weeks ago, athletic director Pete Bevacqua promised Notre Dame would share more than $20M with athletes when the House Settlement passes. That’s a sea change with more power than the personality of the head coach. … A better way to understand Notre Dame’s commitment to winning is (Football HC Marcus) Freeman’s contract extension, which puts him on a six-year deal believed to push $10 million annually. When that kind of contract comes down at other schools, how often do you see it happen with strings about assistant salary pool and facility upgrades? Well, Notre Dame did those financial commitments before extending Freeman, not after. The ‘100% buy-in’ came from Notre Dame in Freeman as much as it came from Freeman to Notre Dame.” (link)

The Athletic's Doug Haller profiles Arizona State Football HC Kenny Dillingham, who has used AI to write multiple songs about the Sun Devils. ASU center Leif Fautanu recalls watching Dillingham make the request from an AI platform and tells Haller: “AI wrote this whole song. He saved it and sent it to the leadership council. We’re all like, ‘Dude, do you not have anything else to do?’” Dillingham’s dabbling in AI is symbolic of his approach to coaching, as Haller observes the “34-year-old is not afraid to be himself. Players describe Dillingham as fun, energetic and a little goofy. … Music has a role in this, although as far as anyone knows, Dillingham has no talent in this area. He sets the vibe before team meetings.” WR Melquan Stovall: “He’ll get on YouTube and type, ‘The happiest or best songs’ of a certain era.” Fautanu adds: “Like even today [after a recent practice]. The search was, ‘Most iconic songs from the 1970s.’ He played the song and nobody knew what the song was. We were like, ‘START THE MEETING.’” Backup QB Trenton Bourguet notes: “That’s one thing about coach Dillingham. ESPN men’s hoops analyst Dick Vitale confirms to HoopsHQ’s Seth Davis that he is cancer-free and says he hopes to return to the sidelines this season, perhaps as early as next month. “It…all depends on what happens during my exam with Dr Zeitels. [Praying] for good news!” While he’d prefer to be in the arena, Vitale says calling games remotely is an option “if Dr. Zeitels is pleased after scoping me. He was very happy with my voice in the video. Remember I have had cancer of vocal cords plus 35 radiation treatments on them plus in the last two years at least three operations plus numerous scopes.” (link)

Puck’s John Ourand sits down with ESPN headliners Scott Van Pelt and Mike Greenberg to discuss several topics, including ESPN’s deals with Pat McAfee and Stephen A. Smith, about which SVP says: “First of all, Pat exists in a completely different ecosystem where he had an established relationship with an audience and was able to clearly demonstrate the value to ESPN. ESPN needs to get younger, and Pat has this massive, passionate following; so he’s able to dictate the terms to them. Then Stephen A. looks at that and says, I’d like to do the same thing. I’m a very interested party in what Stephen A. does. All of you who cover it are going to mention the numbers. But the numbers aren’t as interesting to me as what the buffet is. What I mean is: he’s going to do First Take and do something with the NBA. But what else is he doing, and is it under the ESPN umbrella? It’s a very different time now. Daytime talk and being the CEO of your brand and parceling it out to however many different bidders—it could be like the NFL, where you give pieces to Netflix, Amazon, NBC, Fox, ESPN, CBS. If he’s allowed to do that, then I would be a very interested party. I root for Stephen A. the same way I rooted for Pat, the same way I root for everybody in our business to get the absolute most you can.” Greenberg adds: “Stephen A. has so many diverse interests—there are so many things he wants to do and so many conversations he wants to be a part of. ESPN isn’t the right place for all of those. It’s the right place for some of them. … I think it’s fabulous that he can go and do that in other places. There was a time when that would have been completely verboten.” Greenberg again: “Stephen A. is an incredibly important presence on ESPN, and I don’t think the fact that he’s on Fox News at night talking about politics has any impact on the overwhelming success of his daily talk show on ESPN. Netflix’s pair of Christmas Day NFL games demonstrated the streamer can handle major live sporting events without the technical hiccups which plagued the Tyson-Paul fight, according to Puck’s John Ourand, who writes: “The streaming company’s next step in live event programming comes next week, when it kicks off its 10-year, $5B rights deal with TKO by carrying WWE Raw for the first time. The looming question is whether Netflix’s association with weekly live programming will turbocharge its interest in acquiring more rights. Every sports league and conference certainly hopes so. It should be noted that the first WWE show on Netflix will be broadcast from the Intuit Dome in L.A. and is expected to be attended by top executives from both TKO and Netflix. You can bet that those TKO executives will be pitching UFC rights. Their ESPN deal ends next year.” (link)

Six former Florida State men’s basketball student-athletes – Darin Green Jr., Josh Nickelberry, Primo Spears, Cam’Ron Fletcher, De’Ante Green and Jalen Warley – have filed a lawsuit against FSU HC Leonard Hamilton in which they allege Hamilton promised each of them $250K in NIL payments from the coach’s “business partners.” Yahoo’s Ross Dellenger: “As evidence of the NIL promises, the complaint includes multiple text-message exchanges among players, between players and Hamilton, and between players and Will Cowen, an executive with one of Florida State's NIL collectives. In one of the more striking revelations, FSU players say they boycotted a practice before a Feb. 17 game against Duke. They ‘walked out of the gym’ during practice to show their frustration over the unpaid NIL promises and they intended to boycott the game as well, the claim says. Hamilton discovered the plan and, in a meeting in the team’s film room, re-emphasized that the money would be in the players’ accounts the very next week. Players competed in the game, losing to the Blue Devils, 76-67.” Heitner Legal Founder Darren Heitner is representing the student-athletes and notes: “My primary goal with this lawsuit is to obtain relief for several FSU basketball players who relied on promises from their Head Coach. Additionally, I hope this action causes everyone in the NIL space to think twice before taking advantage of athletes. … It is vitally important to hold people accountable to the promises they make. This is a situation where the entire roster relied on Coach Hamilton’s promise and he failed to deliver. This is about holding him accountable and hopefully this prevents this from happening again at FSU or elsewhere.” (link, link)

Florida State in a statement explains that “upon learning recently of the allegations made by former men’s basketball student-athletes, the university has worked diligently to determine what transpired last season. Though our inquiry is not yet complete, at this point we know of no unfulfilled commitments by FSU in terms of scholarships or other appropriate benefits or the Rising Spear Collective relative to NIL payments owed to the athletes. We support Coach Hamilton’s right to defend himself against these allegations and look forward to an expeditious resolution of this matter.” (link)

Sportico’s Michael McCann & Eben Novy-Williams point out the complaint against Hamilton indicates he was “smart” in that he “avoided responding in writing” to address the unpaid promises. He instead said he’d call a family member. McCann & Novy Williams subsequently explain: “One hurdle for proving breach of contract is the apparent absence of a written agreement. Like other states, Florida has a ‘Statute of Frauds,’ which holds that contracts generally must be in writing to be enforceable. However, there are exceptions that can make an oral agreement enforceable. One is if the contract can be performed within a year. The complaint stresses that Hamilton’s promises ‘could have been completed within one year’ and that payment was in exchange for the players to play at FSU in the 2023-24 season. The complaint also includes claims for promissory estoppel, which asserts that the players relied to their detriment on a $250K promise, and Hamilton should not be left off the hook. They could have enrolled at other colleges or transferred to them but pledged to FSU in anticipation of $250K.” Hamilton, the writers continue, could argue that “players are misconstruing ordinary recruiting into enforceable contracts. Hamilton might also argue the promised arrangements were only conditional, and not every condition was met. Mindful of the statute of frauds, he might also dispute that they were intended to be performed in only one year.” (link)

Former Arizona State men’s swimming student-athlete Grant House talks with Yahoo’s Ross Dellenger about the landmark court case that bears his name. Dellenger reports that over the last several months, some individuals against the settlement have aired their grievances with House. He’s received dozens of messages, and even a phone call, from people threatening to violently harm him. He labels a few of them as “death threats” and says: “It was quite shocking and it’s been emotionally challenging to work through. Never imagined it would escalate to that level.” House also tells Dellenger he did not agree to the roster limitations that could cost his own sport hundreds of positions and says he was “shocked” earlier this month at the attorneys’ requests for more than $700M in fees. “It’s interesting how the finances are allocated for people (attorneys) who have already been very successful in the biggest class-action lawsuits and who have been some of the most successful lawyers in sports. It’s interesting that they needed more money after all that.” Meanwhile, House is “seeking adjustments to the settlement from the judge herself. He recently helped author a letter that, while praising the settlement, urged U.S. District Court Judge Claudia Wilken to create more ability for athletes to hold a voice within college athletics’ new model.” House: “It is about us, the athletes, and we need to be involved in these discussions and have thoughts heard. It was quite shocking that there wasn’t more communication [from the attorneys]. People say ‘What else do we need? We’ve got NIL.’ We need regulation, protections, clauses put in place to protect programs and athletes.” Overall, House believes the settlement is a “huge positive step” but adds: “This isn’t the end-all be-all. It’s not the answer we should stick with for the rest of time. It’s a starting point and a leverage point to go forward and develop this over time.” (link)

Action Network’s Brett McMurphy cites multiple sources who say there will be “in-depth discussions” about changing the College Football Playoff seeding process for the 2025 season when the conference commissioners meet later this month. This would provide first-round byes to the top four teams in the final rankings regardless of whether it won a conference title, sources said. … The most popular concept for 2025 is to still give automatic bids to the five highest-ranked conference champions but award the top four seeds to the selection committee’s four-highest ranked teams.” One commissioner says: “We should be open to getting (the seeding) right regardless of what that means. But protecting conference champions and securing a spot in the playoff is a must.” McMurphy points out that “what makes this tricky to pull off is there must be unanimous agreement by all parties: conference commissioners, the College Football Playoff management committee and, of course, ESPN has to give its blessing. That’s the only way the final year of the contract could change.” (link)

UNC Wilmington AD Michael Oblinger says the $800K the athletic department received from the state in sports betting tax revenue is “a wonderful thing for us. Anytime you can have additional revenue streams – whether you’re enhancing revenue streams or developing new ones – it’s obviously very important to what we’re trying to do here.” Oblinger was able to approach Chancellor Aswani K. Volety about expediting an overhaul of Brooks Field, where the Seahawks play baseball, two years early because of the new revenue. New turf, dugouts and outfield walls are being installed, and upgrades to the school’s tennis courts and sports medicine facility are now possible as well, and Oblinger notes: “Those are things that we need to do. We’re putting that money to good use.” The Seahawks are not including the revenue figures in the budget due to its sporadic nature, as Oblinger points out: “It’s one of those situations where it’s difficult to forecast what this year will look like, what next year will look like down the road.” (link)

Illinois experienced “record-breaking ticket revenue” for the third consecutive men’s basketball season last year, according to Illini AD Josh Whitman, who notes in a year-end letter to fans that the I FUND in FY24 generated $8.27M, marking the highest annual giving in a decade. Additionally, the ICON collective has provided “millions of dollars in opportunities for Fighting Illini student-athletes.” (link)

The IRS has denied 501(c)(3) status to another NIL collective, citing case law and reasoning that the organization’s primary purpose was to further student-athletes’ compensatory opportunities. The letter, whose recipient is redacted, explains: “Based on the facts presented, your primary purpose is to provide student-athletes opportunities to be compensated for the use of their NIL. Thus, you serve the private interests of your contracted student athletes rather than a public interest. To qualify for exemption under IRC Section 501(c)(3), you must serve a public, rather than a private interest. … Because you spend all your resources on the payment of your student athletes, you operate for their private interests.” (link, link – full letter)

Auburn Men’s Basketball HC Bruce Pearl bemoans the current state of sport, saying: "Graduation rates have been destroyed because of the combination of NIL and transfer portal working together. Understand families being in a situation where they may never make more money than they are making right now, and so that's what they are being guided by. LSU Volleyball HC Tonya Johnson joins Coaches.wire’s Daniel Gillman from the 2024 AVCA Convention to discuss the growth of the sport and ways to continue increasing viewership, including cutting back timeouts. Johnson also talks about the impact of the House settlement, how she advises her team to approach social media, whether new pro leagues will attract more international student-athletes and lots more. When it comes to social media, Johnson says the choice is completely up to the players. “I think the great thing about all of this and everything that's happening is it's their choice, and if they want to take the time to do that and promote themselves and promote their social media and get it out there, I encourage it. And if they don't, I'm fine with that, too.” Johnson takes a page out of Tigers AD Scott Woodward’s playbook when it comes to the House settlement – namely, that there is “opportunity in chaos.” Johnson: “The plan that our administration has going forward, I think it protects us and it includes us, so I’m grateful for that. But I think there’s going to be a lot of changes, and you’re going to see a lot of interesting things happen, but I think if we don’t embrace it and we don’t get on board with it, we’re going to be left behind.” Throughout her 30-year career, Johnson says she’s always been told to carry as many players as she wanted “because of gender equity and Title IX.” Now, with a cap of 18, Johnson says coaches will “make those tough decisions, and you hope that everybody is okay from it, and they come back from that and they understand the why and you have to go on.” Complicating the situation, however, is the timing of the recruiting calendar for volleyball, as Johnson points out her 2026 class has been finished since the summer. “So we’re having to re-evaluate some things…and make sure we’re at that cutoff of 18 and make sure we have all the right pieces in place.” Full Q&A.
