ESPN’s Sugar Bowl broadcast began with a message from President Joe Biden, who said: “Today, all of America stands with the people of New Orleans. We pray for those killed and injured in yesterday’s attack and we’re grateful to those brave first responders who raced to save lives. We’re glad the game is back on today, but I’m not surprised, because the spirit of New Orleans can never be kept down.” (link)

There will be an “unpredecented” law enforcement presence in place for the Sugar Bowl that just kicked in New Orleans, according to Louisiana Governor Jeff Landry, who said today that members of the Louisiana National Guard, as well as correctional officers and members of other state law enforcement divisions have been deployed to the city to help with security. Meanwhile, New Orleans Police Superintendent Anne Kirkpatrick remarked that the city would have as much security in place for the Sugar Bowl as it was planning to use for next month's Super Bowl: "We are in partnership with many other partners. Both local, federal, military police, and so forth, will be here, and so we're going to have absolutely hundreds of officers and staff lining our streets, lining Bourbon Street, lining the French Quarter. So, we are staffing up at the same level, if not more so, than we were preparing for [the] Super Bowl." FBI Counterterrorism Division Deputy Assistant Director Christopher Raia notes federal agents have completed their investigation of Bourbon Street and have turned the area over to the city and says: "We do not assess, at this point, that anyone else is involved in this attack, except for Shamsud-Din Jabbar.” (link)

Big Chair Developments…
+ New Mexico State has parted ways with AD Mario Moccia and appointed Deputy AD for Strategic Initiatives and Leadership/SWA Amber Burdge as Acting AD, effective immediately. President Valerio Ferme, who took over on January 1: “After carefully reviewing the recent report issued by the New Mexico Department of Justice, I felt we needed a fresh start in our athletics program. I have utter confidence in Dr. Burdge’s ability to lead our Athletic Department, and look forward to working with her in the coming months.” Ferme and Burdge will hold a press conference on Friday. (link)
+ South Carolina State AD Nathan Cochran has departed after a year in Orangeburg to pursue other opportunities. Former Football HC Buddy Pough will serve as Interim AD. (link)
+ Several leaders throughout the industry pay tribute to South Carolina AD Ray Tanner as he steps down from his role, including Coastal Carolina AD Chance Miller, who served as a Deputy AD for 11 years under Tanner. "Ray's been like a father figure to me for 11 years plus now. He gave me a start at the university and saw something in me. I don't know what he saw, but he believed in me and kept letting me rise up through the athletics department mentoring me the entire time. What I'll remember most is we'd huddle up addressing some problem or issue, it would inevitably turn into him giving me a teaching moment, or have ‘Storytime with Ray’ is what I used to call it. He'd tell some story that would inevitably get back to what we were addressing at the moment. I learned a lot from him, and still learn from him. He means a lot to me.” Current Gamecocks football student-athlete Luke Doty adds: “He's always been there in team meetings. He'll show up to practice pretty much every single day of the week and stop by, say hello. … He just makes sure that we know that he has our backs, and he'll do anything for us. Whether it's going forward in the program or in our professional lives. He's always taken care of us. Going to be sad to see him leave, but definitely extremely happy that I've been able to develop a relationship with him and have him as my AD the last five years.” Sinclair Broadcast Group EVP Brian Bark, who played baseball for Tanner at NC State: "He exemplifies commitment, strong character, and discipline, while inspiring excellence in others. That is what I saw in my college life and beyond. His ability to be coached not only enhanced his personal growth but also made him an outstanding coach and leader. As a result, he has achieved remarkable success in both his personal and professional life.” Lots more. (link)

More on Deloitte’s role as the third-party administrator for fair market value NIL assessments. Venable IP Partner Phillip Sheng interprets the NCAA’s Q&A from December 9 as a “carefully crafted statement that the NCAA is putting up a wall between themselves and Deloitte so that Deloitte can be truly independent in their assessments. Otherwise, there is indeed a contradiction.” Kennyhertz Perry attorney Mit Winter adds: “Yeah that could be it. Conferences/new clearinghouse entity are possibly the party engaging with Deloitte.” (link); Prominent sports attorney Tom Mars: “The NCAA is making the P4 conferences retain Deloitte to develop the FMV system, thus making them the defendant in the inevitable litigation by collectives, marketing agencies and/or athletes who opt out of the House (case) class action. Lawyers call that passing the hot potato.” (link)

Big 12 Commissioner Brett Yormark has released a statement regarding a non-targeting call in the Peach Bowl this week. It reads, in part: “As a member of the College Football Playoff Management Committee, I have had multiple discussions seeking clarity surrounding the targeting call on Arizona State’s final drive of the 4th quarter with [College Football Playoff Executive Director] Richard Clark. Moving forward, we need to address CFP officiating to ensure national standards are developed. These standards will be crucial to the CFP’s future, and I look forward to discussing them with my fellow committee members when we meet next.” (link)

VCU plans to share revenue with student-athletes beginning next academic year. The new expense will cost VCU between $4M and $5M and require the athletic department to find new streams of revenue. Rams AD Ed McLaughlin told the VCU Board of Visitors: "Amateurism as we know it is dead. There is a new collegiate model. … For me, [not fielding a football team] is a huge benefit looking at limited revenues going forward.” How the department will come up with the money needed to pay student-athletes is yet to be determined, as McLaughlin notes: “We have to make the financial jigsaw puzzle fit together.” (link)

Extra Points publisher Matt Brown believes the movement toward college athlete employment is in peril because “you know who generally isn’t very sympathetic to the rights of organized labor, especially when it comes to expanding who can and cannot join a union? Republicans. The Dartmouth team is betting that it is better to wait until Democrats control the NLRB again, because losing risks establishing precedent that could hurt future unionization efforts.” As for what comes next, some, including Athletes.org Founder Jim Cavale, believe the decision will not slow down the movement. In fact, Cavale believes that “in the near future, some colleges are simply going to decide for themselves to recognize athletes as employees” rather than waiting for the courts to do it for them.” Brown is less optimistic, noting that regardless of how many conservative and/or liberal judges have ruled against the NCAA, judges don’t write laws. “My cynical view here is that appealing to process, procedures, or a nonpartisan analysis of The Law in a world where Trump is president and Republicans have unified federal government control is just not a smart bet. If they want to do something, over the next two years, they're just gonna do it. Don’t have enough Democratic votes to get to 60? Fine. If [Senator Ted] Cruz (R-TX) wants it bad enough, he’ll shove it into some budget reconciliation act and dare Democrats to stop him.” More. (link)

Lawmakers in Indiana have filed a bill to ban transgender women’s participation in college sports. House Bill 1041, authored by Representative Michelle Davis (R-Whiteland), contains virtually identical language to the bill that Gov. Eric Holcomb vetoed three legislative sessions ago. Holcomb’s veto was overridden by the Legislature’s GOP supermajority. The bill would apply to both state and private colleges, as well as associations that put on intercollegiate sporting events. It would also require out-of-state teams who allow transgender women to play on their teams to notify the teams they plan to play against in Indiana at least 60 days in advance. The bill also permits students to file a lawsuit against their school if they feel they were "deprived of an athletic opportunity" or "directly or indirectly injured" as a result of a violation of the policy. Indiana’s legislative session began January 9. (link)

Fanstake CEO Greg Glass talks about the recently launched platform, which allows fans to “stake an athlete” by directing money directly to them. “What we’re trying to do is create a free market. We feel like the part that’s missing in NIL is the democratization of it, where the kids hopefully see their fair market value based on the demand and it makes it a little easier for your retail fan to participate where it’s no risk.” The AP’s Eric Olson explains that a “Nebraska fan, for example, could pledge $5, $10 or more to an athlete. If the athlete chooses Nebraska and wants to collect money that has been staked by an individual or group of fans, the athlete would be required to enter into an NIL agreement with Fanstake to satisfy NCAA rules. Glass said the NIL deals vary depending on the amount of money involved, but all require the athletes to promote Fanstake in some fashion.” If the athlete chooses another school, the fans are refunded. Glass says student-athletes keep at least 90% of the money while an additional 3% is distributed among teammates who also agree to promote Fanstake. The remaining money goes to Fanstake, and Glass notes: “We don’t actually engage into an NIL deal until they are at the school, but we allow the fan bases to help tell the athlete what the demand looks like and how much money potentially is there.” (link)

With the Sugar Bowl being postponed to 4 PM ET today due to the tragedy in New Orleans early Wednesday morning (link), Action Network’s Brett McMurphy reports the Gator Bowl between Ole Miss and Duke has been pushed back to an 8:05 PM kick. (link); SEC Commissioner Greg Sankey: "The decision to postpone tonight's Sugar Bowl was made in the best interest of public safety. Lives were tragically lost last night and we are appreciative that public officials and law enforcement agencies continue to work with great diligence to ensure the safety of the New Orleans community." Among those reportedly killed in the tragic attack were former Princeton football student-athlete Martin "Tiger" Bech. Additionally, two 19-year-old Fort Myers women – Elle Eisele, a University of Georgia student, and Steele Idelson, a San Diego State University student – were both critically injured. Princeton Football HC Bob Surace said of Bech: "There was no more appropriate nickname of a Princeton player I coached. He was a 'Tiger' in every way – a ferocious competitor with endless energy, a beloved teammate and a caring friend. Our last conversation was about how proud I was of the growth he showed during his time at Princeton and the success he was having after graduation. My love goes to the entire Bech family." (link)

New TCU AD Mike Buddie to the Fort Worth Star-Telegram’s Steven Johnson: “Fort Worth, Texas, is a fantastic place to call home. (This) is an institution that’s value-based and mission driven with clearly incredible alignment between the chancellor, the president and this transition of their career paths. It’s the type of leadership you need to have in place to do great things. [...] You get the opportunity to be at (Army) West Point, it kind of changes your perspective on things. It really put me in a position to be patient. When this opportunity came open it was a quick and easy decision to pursue it.” More: “We certainly need to be in a leadership position in the Big 12. As we learned recently, you can’t let your guard down, you never know what realignment is out there on the horizon. As we’re going into uncharted waters with revenue sharing and continuing how to best operate within this new world of the transfer portal. Being proactive and positioning the department for all these new challenges and opportunities is job one. Then at the core of what all of us get into this business for is to win championships. I think if you’re competing for a Big 12 championship, you’re going to be in the discussion for a national championship.” (link)

Meanwhile, Army West Point names Deputy AD/Chief Administrative Officer/General Counsel Abby Howard as Interim AD. Superintendent Lt. Gen. Steven W. Gilland and Board of Directors Chair Corky Messner will organize and oversee a national search committee to select a new permanent AD. (link)

Arizona State AD Graham Rossini talked with media members about the importance of building the Big 12 football brand following yesterday’s 2OT loss to Texas in the College Football Playoff. “I think today helped, and we were proud to carry the torch on behalf of the Big 12, and we want to get to a situation where multiple teams from our conference are in this playoff. We like to build the brand, we want challenging schedules, we want to be in these national conversations so I do believe tonight was helpful.” Rossini says this year’s CFP appearance is “not meant to be a one-time showing, and that starts with investing in the program…and that comes from coaching leadership, that comes from program resources, that comes from connecting a fan base in a way that we’re working hard every single day to do that, and we’re going to use all these moments as such. … We have people that have been a part of this environment that are choosing to come back to it, we have people who haven’t been a part of it that now want to be a part of it and that’s going to be a building block.” Rossini goes on to note that ASU has focused on increasing the overall football budget and HC Kenny Dillingham’s performance bonuses will “unlock dollars for him to use discretionary for the rest of the football staff. We want to attract great coaches to be a part of this football program and we want to do everything we can to retain them.” Regarding Dillingham’s extension, Rossini says it was a chance to “build our relationship and understand what matters to him and what matters to him is the chance for longevity, but more importantly a chance to lead these young people who are so special to him." Iowa State AD Jamie Pollard announces several changes ISU will implement to address an impending $20M increase in operating expenses: “We are raising the annual Cyclone Club giving levels by 20%, starting with the 2025 drive year. You will receive your renewal notice in February from the Cyclone Club. We will begin adding state sales tax on all ticket sales beginning in the Fall 2025 (currently we pay state sales tax out of the ticket price). Adding state sales tax to all ticket sales will allow us to better align financially with those Big 12 institutions that are tax exempt in their respective states, or institutions that are already adding sales tax (K-State) or are in the process of adding sales tax (Iowa). We are increasing the price of women's basketball season tickets from $199 to $249 to reflect demand and help fund the costs of sharing revenues with our women's basketball student-athletes. In addition, we are continuing to explore other opportunities to increase revenues and/or reduce expenses, including asking our coaches and department heads to reduce their respective annual operating budgets by 10%. … Although none of us like price increases, we must make these changes. We have prided ourselves on not asking you for what we can get, but rather asking you for what we need. That philosophy has served our department, and fan base, extremely well throughout the years, and we believe that these changes are no different.” (link)

After the NCAA clarified to D1.ticker that it has “no plans to engage with Deloitte in any capacity” regarding fair market value assessments of NIL deals, Heitner Legal Founder Darren Heitner asks: “Is it that the conferences retained Deloitte, and not the NCAA at the Association level?” To which Opendorse Co-Founder Blake Lawrence responds: “This is correct.” (link)

Kennyhertz Perry attorney Mit Winter tells CBS’ Matt Norlander that student-athletes not being paid what they’ve been promised verbally is "more common than people think, even at [power-conference] schools.” The situation involving Florida State Men’s Basketball HC Leonard Hamilton and six former student-athletes who say he promised money but didn’t deliver “again points out the need for athletes to have everything in writing via written contracts,” Winter continues, adding: “It also shows how much power the athletes have if they decide to wield it.” As for whether the players can win their suit against Hamilton, attorney Mitch Gilfillan tells Norlander: “There are legitimate questions regarding an NIL representative, coaching staff member or university staff member's oral promise to pay NIL to secure a commitment. In some cases, an oral contract may be deemed a valid contract if certain conditions are met. Whether there was a 'meeting of the minds' on the NIL terms for the FSU basketball players will likely have to work itself out through discovery by sworn deposition testimony. However, six players allegedly hearing the same story and promise to pay could be difficult to overcome. The lawsuit is not based around one individual, but numerous people all with the same story. … If a jury found [Hamilton] liable, the verdict could go well above the $1.5M that the six plaintiffs are trying to recoup.” The case is further complicated by whether Hamilton’s alleged promise to pay the players via business partners rather than FSU’s collective runs afoul of NCAA rules, and Winter explains: "It gets tricky because the payments were ostensibly for NIL services, not playing basketball at or attending FSU even though everyone knows that's what they were being promised payment for. There could be lots of interesting stuff that comes out of discovery, if the case gets that far." Lots more, including 10 predictions from Norlander regarding the rest of the men’s hoops season. New Mexico men’s basketball student-athlete Shane Douma-Sanchez has filed a civil rights complaint against the university and HC Richard Pitino claiming, in part, that the team’s coaching staff “disregarded incidents of hazing and violent behavior.” Douma-Sanchez claims he was punched in the nose and hit in his already-injured shoulder by an unnamed teammate after a flight to Palm Springs for a tournament last month. According to the lawsuit, the fight occurred after Douma-Sanchez was subject to prior name-calling and harassment which “made him feel unwelcome and unsafe on the team”… and that “UNM turned a blind eye to a pattern of misconduct.” UNM has yet to formally respond to the suit, which was filed on Monday. Monmouth Men’s Basketball HC King Rice has been suspended for today’s CAA opener against Stony Brook for violating the league’s sportsmanship policy by making derogatory postgame comments about a referee following Monmouth’s season-ending loss to Charleston in March. Rice’s specific comments about the official in question were: “When a guy comes in and it’s the first time I’ve seen him all year, he’s totally disrespectful, he told me I couldn’t talk to my staff, he tried to show me up all day. He’s a clown, and I don’t respect that at all. Haven’t had them all season, they come in with their fake muscles – and for two hours are in control of everybody’s lives. It’s not fair. He should stay in the ACC. I watch his games. He does not do that to anybody else. So I’ll take it today. I just hope he gets better, too. My team will get better. But you don’t come in the first time all season and be flexing on coaches.” (link)

Louisville announced the commitment of five-star class of 2025 point guard Mikel Brown with a pre-produced video introduction during halftime of the Cardinals’ matchup with North Carolina on Wednesday. Perhaps the bigger story, however, is this from WDRB’s Eric Crawford: “Also in the crowd to see the introduction – Brown’s agent, Christian Dawkins, who became famous (or infamous) in Louisville for his role in the Brian Bowen case and FBI pay-for-play scandal at the school, which among other things, cost Hall of Fame coach Rick Pitino and athletic director Tom Jurich their jobs.” (link)
