Virginia Tech President/DI Board of Directors Chair Tim Sands would like to see NIL return to “something more like, ‘OK, say you’re an influencer, a student-athlete should be able to earn money off that as well as a student who’s not a student-athlete.’ So I think that’s fair. How you govern or manage that whole process with NIL I think is going to be a determining factor in whether we have competitive equity at the top or not. And that’s all to be resolved.” The Hokies plan on “jumping in with both feet” when it comes to revenue-sharing, but Sands is hesitant to increase student fees. “We can’t just arbitrarily jack those up. … [Hokies AD] Whit [Babcock] and his team and advancement do a great job of raising money for athletics, but we have a new world going forward, and we’ll need to do more. So it’s not just one bucket; we need to look at every bucket. And where we have discretionary resources, athletics is going to be a priority. Not the only one, but one that we need to put higher up than we did before just because we want to be competitive.” Also from Sands: “I think one of the great things about these [college football] models that people are proposing, especially from the outside, is that they’re making people think. And I think the impact of those proposals is not going to be adopting one of them or the other one or something like that. It’s going to be, ‘OK, this is the way we should be thinking. Let’s imagine a future state and then let’s figure out how to get there.’ That’s the really hard part.” More from Sands. (link)

Sports Business Journal’s Mollie Cahillane writes on how ESPN handled the Sugar Bowl postponement due to the tragic events in New Orleans on Wednesday morning. SVP of Production Mark Gross with perspective on the overall situation: “We knew across the board it was going to be acknowledged, but we didn’t have all the facts. We were still trying to understand what was going on and the impact it was going to have in the sports world. Juggling a sports network, program, schedule, production, certainly pales in comparison to the tragedy in New Orleans. We'll figure out when these different shows could be on. It’s not that big of a deal. [...] The one thing is first and foremost [Wednesday] was, is our crew safe? Anybody from our crew could have been in the middle of this attack. It was New Year’s Eve; people might have been out. But fortunately, no one was a part of it.” ESPN still pulled off a MegaCast for the Sugar, but without ESPN2 in the mix, which broadcasted the Under Armour All-American Game. (link)

USA Today’s Matt Hayes spent the weekend embedded with the Boise State football team leading up to Tuesday’s Fiesta Bowl matchup with Penn State, and Broncos HC Spencer Danielson talked about the importance of proving what Boise is doing works even if it’s different than what everyone else is doing: “You’ve got coaches and programs and administrations that now have golden handcuffs. They're beholden to the money. They’ve changed what they believe to win games. They don’t want to, but everyone else is doing it. So what choice do they have? … Once you do that, once you change what you believe as a coach and a person, you can never go back. Because you’ll have to change everything.” Hayes highlights star defensive lineman Ahmed Hassanein, “who left a difficult home life in Cairo, Egypt, and eventually found his way to Boise State because his brother knew Danielson from their time together at Azusa Pacific (DII). At halftime, with Boise State trailing 17-7, he stood in the middle of the locker room screaming, ‘This is ain’t no Cinderella story. We deserve to be here. This will not be my last game here.’ Now the end of his time at Boise State had set in, and it was crushing. ‘Coach D,” Hassanein said, his voice halting through tears. ‘You saved my life. I want everyone to know that. You saved my life. I love you.” With revenue-sharing looming for the 2025 season, Hayes notes that for the schools that can’t afford to fully fund it, “there’s only one fallback position. And you can’t miss. Broncos AD Jeramiah Dickey: “I still believe culture is king. As we professionalize our sport, I’m watching these other teams and how much money they have and the value of their franchises, they’re not always winning. Athletes.org Co-Founder Jim Cavale shares seven predictions for 2025: 1) The NCAA will approve the House settlement and revenue sharing with athletes will start this summer (2025). 2) Collectives will be regulated and more like localized agencies. 3) Schools are going to overhaul their budgets and commercialize sports even further. 4) Private capital is coming into college athletics. 5) More lawsuits from athletes against the NCAA and suing the schools. 6) Congress to become more involved in college athletics. 7) A bipartisan bill will get done in Washington DC if the athletes have a voice within the bill. Athletes must have a medium to negotiate all of the key points. Cavale says of the NIL FMV mechanism proposed under the House settlement: “Expect this system to fail. Athletes are not going to report all their transactions and collectives aren’t going to be fully regulated because in American labor it’s proven you can’t regulate fair market value. But it is going to change how collectives operate because collectives will now have to be like local agencies and do more creative NIL deals.” (link)

Bowl game swag bags are now subject to taxation for many players, as Sportico’s Brendan Coffey observes: “When college players were prevented from cashing in on their NIL, taxes weren’t an issue: Unpaid college students usually aren’t filing income tax returns, with gifts still placing them well below the income level requiring filing a return—currently $14,600 on the federal level, but lower in some states with their own income tax. But now that some football players are getting paid thousands to reportedly millions of dollars to play, athletes have the unavoidable responsibility to pay taxes on cash and goods they receive.” In this year’s Armed Forces Bowl, Coffey notes that Oklahoma players “probably received goods worth more than $2,500 from the bowl and sponsors,” and “while there’s a belief that individual gifts under $600 aren’t taxable, that’s not the case. … Still, it’s not like the bowl or sponsors are going to issue players a 1099…so they can get away with not disclosing it on their taxes, right?” Galway Family Office Managing Principal Craig Brown tells Coffey: “If I give you a gift, I report I didn’t have to pay tax on all my income, because I’ve passed that off to individuals (as gifts or marketing expenses) … The structure of the IRS is to follow the dots—they’re going to follow the money to get the tax.” Exacerbating matters, self-employed individuals get audited at four times the rate of the average U.S. taxpayer, “and not paying estimated tax liability quarterly, as required of the self-employed, brings interest charges from the government, plus penalties.” Brown adds: “If they haven’t paid any taxes, they conceivably owe—[plus] penalties and interest on top of that could be crippling, a hole you can never dig out of.” (link)

President Joe Biden has signed an anti-hazing bill for higher ed institutions with federal student aid. The Washington Post’s Nichole Asbury: “The Stop Campus Hazing Act, which passed in the U.S. Senate earlier this month, mandates institutions publicly share hazing statistics, including the name of the organization involved and details of the behavior that incited a hazing violation. It also provides an explicit definition of the term and requires institutions to implement education and prevention programs on campus.” (link)

Diamond Sports Group has emerged from bankruptcy as the rechristened Main Street Sports Group. According to a press release from Main Street, the company completed a financial restructuring under Chapter 11 bankruptcy and has a “significantly deleveraged balance sheet. Main Street Sports emerges with a healthy capital structure and is well positioned, with valuable professional team rights across the MLB, NBA and NHL, to elevate the fan experience and drive incremental value for its team, league and distribution partners. … The Company will continue to serve fans under the FanDuel Sports Network name, through its naming rights agreement with FanDuel for its 16 regional sports networks.” Since filing Chapter 11 in March 2023, the company has “resolved complex legal matters, completed its operational separation from Sinclair, and secured key go-forward agreements with its top team, league and distribution partners. Importantly, terms were also reached on prominent partnerships with Amazon’s Prime Video and FanDuel that bolster the Company’s platform and direct-to-consumer (DTC) offerings.” (link)

Denver has secured the NWSL’s 16th franchise at an expansion fee of $110M, according to Sportico’s Eben Novy-Williams, who reports: “Backers of the Denver bid, principally IMA Financial Group CEO Robert Cohen, submitted their first payment to the league on Tuesday. … The $110M expansion fee is more than double the previous NWSL record for new teams and is also the biggest expansion fee ever paid in U.S. women’s sports.” The group, Novy-Williams continues, will “likely commit to spending a certain amount of dollars in launching the team. Sixth Street-owned Bay FC, which started play in 2024, pledged a $125M commitment at launch, which included a $53M expansion fee. … The value of NWSL teams has exploded in recent years, with recent sales valuing Angel City FC at $250M and San Diego Wave at $113M. The average club is worth $104M, according to Sportico’s September team valuations. It was up 57% from the prior year.” Denver was one of three finalists for the team along with Cleveland and Cincinnati. (link)

There will be an “unpredecented” law enforcement presence in place for the Sugar Bowl that just kicked in New Orleans, according to Louisiana Governor Jeff Landry, who said today that members of the Louisiana National Guard, as well as correctional officers and members of other state law enforcement divisions have been deployed to the city to help with security. Meanwhile, New Orleans Police Superintendent Anne Kirkpatrick remarked that the city would have as much security in place for the Sugar Bowl as it was planning to use for next month's Super Bowl: "We are in partnership with many other partners. Both local, federal, military police, and so forth, will be here, and so we're going to have absolutely hundreds of officers and staff lining our streets, lining Bourbon Street, lining the French Quarter. So, we are staffing up at the same level, if not more so, than we were preparing for [the] Super Bowl." FBI Counterterrorism Division Deputy Assistant Director Christopher Raia notes federal agents have completed their investigation of Bourbon Street and have turned the area over to the city and says: "We do not assess, at this point, that anyone else is involved in this attack, except for Shamsud-Din Jabbar.” (link)

+ New Mexico State has parted ways with AD Mario Moccia and appointed Deputy AD for Strategic Initiatives and Leadership/SWA Amber Burdge as Acting AD, effective immediately. President Valerio Ferme, who took over on January 1: “After carefully reviewing the recent report issued by the New Mexico Department of Justice, I felt we needed a fresh start in our athletics program. I have utter confidence in Dr. Burdge’s ability to lead our Athletic Department, and look forward to working with her in the coming months.” Ferme and Burdge will hold a press conference on Friday. + South Carolina State AD Nathan Cochran has departed after a year in Orangeburg to pursue other opportunities. Former Football HC Buddy Pough will serve as Interim AD. (link)
+ Several leaders throughout the industry pay tribute to South Carolina AD Ray Tanner as he steps down from his role, including Coastal Carolina AD Chance Miller, who served as a Deputy AD for 11 years under Tanner. "Ray's been like a father figure to me for 11 years plus now. He gave me a start at the university and saw something in me. I don't know what he saw, but he believed in me and kept letting me rise up through the athletics department mentoring me the entire time. What I'll remember most is we'd huddle up addressing some problem or issue, it would inevitably turn into him giving me a teaching moment, or have ‘Storytime with Ray’ is what I used to call it. He'd tell some story that would inevitably get back to what we were addressing at the moment. I learned a lot from him, and still learn from him. He means a lot to me.” Current Gamecocks football student-athlete Luke Doty adds: “He's always been there in team meetings. He'll show up to practice pretty much every single day of the week and stop by, say hello. … He just makes sure that we know that he has our backs, and he'll do anything for us. Whether it's going forward in the program or in our professional lives. He's always taken care of us. Going to be sad to see him leave, but definitely extremely happy that I've been able to develop a relationship with him and have him as my AD the last five years.” Sinclair Broadcast Group EVP Brian Bark, who played baseball for Tanner at NC State: "He exemplifies commitment, strong character, and discipline, while inspiring excellence in others. That is what I saw in my college life and beyond. His ability to be coached not only enhanced his personal growth but also made him an outstanding coach and leader. More on Deloitte’s role as the third-party administrator for fair market value NIL assessments. Venable IP Partner Phillip Sheng interprets the NCAA’s Q&A from December 9 as a “carefully crafted statement that the NCAA is putting up a wall between themselves and Deloitte so that Deloitte can be truly independent in their assessments. Otherwise, there is indeed a contradiction.” Kennyhertz Perry attorney Mit Winter adds: “Yeah that could be it. Conferences/new clearinghouse entity are possibly the party engaging with Deloitte.” (link); Prominent sports attorney Tom Mars: “The NCAA is making the P4 conferences retain Deloitte to develop the FMV system, thus making them the defendant in the inevitable litigation by collectives, marketing agencies and/or athletes who opt out of the House (case) class action. Big 12 Commissioner Brett Yormark has released a statement regarding a non-targeting call in the Peach Bowl this week. It reads, in part: “As a member of the College Football Playoff Management Committee, I have had multiple discussions seeking clarity surrounding the targeting call on Arizona State’s final drive of the 4th quarter with [College Football Playoff Executive Director] Richard Clark. Moving forward, we need to address CFP officiating to ensure national standards are developed. These standards will be crucial to the CFP’s future, and I look forward to discussing them with my fellow committee members when we meet next.” (link)

VCU plans to share revenue with student-athletes beginning next academic year. The new expense will cost VCU between $4M and $5M and require the athletic department to find new streams of revenue. Rams AD Ed McLaughlin told the VCU Board of Visitors: "Amateurism as we know it is dead. There is a new collegiate model. … For me, [not fielding a football team] is a huge benefit looking at limited revenues going forward.” How the department will come up with the money needed to pay student-athletes is yet to be determined, as McLaughlin notes: “We have to make the financial jigsaw puzzle fit together.” (link)

Extra Points publisher Matt Brown believes the movement toward college athlete employment is in peril because “you know who generally isn’t very sympathetic to the rights of organized labor, especially when it comes to expanding who can and cannot join a union? Republicans. The Dartmouth team is betting that it is better to wait until Democrats control the NLRB again, because losing risks establishing precedent that could hurt future unionization efforts.” As for what comes next, some, including Athletes.org Founder Jim Cavale, believe the decision will not slow down the movement. In fact, Cavale believes that “in the near future, some colleges are simply going to decide for themselves to recognize athletes as employees” rather than waiting for the courts to do it for them.” Brown is less optimistic, noting that regardless of how many conservative and/or liberal judges have ruled against the NCAA, judges don’t write laws. “My cynical view here is that appealing to process, procedures, or a nonpartisan analysis of The Law in a world where Trump is president and Republicans have unified federal government control is just not a smart bet. If they want to do something, over the next two years, they're just gonna do it. Don’t have enough Democratic votes to get to 60? Fine. If [Senator Ted] Cruz (R-TX) wants it bad enough, he’ll shove it into some budget reconciliation act and dare Democrats to stop him.” More. (link)

Lawmakers in Indiana have filed a bill to ban transgender women’s participation in college sports. House Bill 1041, authored by Representative Michelle Davis (R-Whiteland), contains virtually identical language to the bill that Gov. Eric Holcomb vetoed three legislative sessions ago. Holcomb’s veto was overridden by the Legislature’s GOP supermajority. The bill would apply to both state and private colleges, as well as associations that put on intercollegiate sporting events. It would also require out-of-state teams who allow transgender women to play on their teams to notify the teams they plan to play against in Indiana at least 60 days in advance. The bill also permits students to file a lawsuit against their school if they feel they were "deprived of an athletic opportunity" or "directly or indirectly injured" as a result of a violation of the policy. Indiana’s legislative session began January 9. (link)

Fanstake CEO Greg Glass talks about the recently launched platform, which allows fans to “stake an athlete” by directing money directly to them. “What we’re trying to do is create a free market. We feel like the part that’s missing in NIL is the democratization of it, where the kids hopefully see their fair market value based on the demand and it makes it a little easier for your retail fan to participate where it’s no risk.” The AP’s Eric Olson explains that a “Nebraska fan, for example, could pledge $5, $10 or more to an athlete. If the athlete chooses Nebraska and wants to collect money that has been staked by an individual or group of fans, the athlete would be required to enter into an NIL agreement with Fanstake to satisfy NCAA rules. Glass said the NIL deals vary depending on the amount of money involved, but all require the athletes to promote Fanstake in some fashion.” If the athlete chooses another school, the fans are refunded. Glass says student-athletes keep at least 90% of the money while an additional 3% is distributed among teammates who also agree to promote Fanstake. The remaining money goes to Fanstake, and Glass notes: “We don’t actually engage into an NIL deal until they are at the school, but we allow the fan bases to help tell the athlete what the demand looks like and how much money potentially is there.” (link)
