The NCAA is considering allowing five years of eligibility for players in all sports moving forward, according to CBS’ Jon Rothstein, who notes there is “no timetable on when a decision will be made, but the topic will continue to be discussed in the early part of 2025. (link)

The NLRB has approved the SEIU’s request to withdraw its petition to unionize the Dartmouth (DI) Men’s Basketball team, per Sportico’s Michael McCann, who adds: “A request of this nature means the union voluntarily no longer wishes to proceed and informs the NLRB it doesn’t want the agency’s jurisdiction to enforce any rights. Withdrawal is not automatic and must be granted by the agency. The timing of the request reflects the union’s desire to have it reviewed by the agency before President Joe Biden’s term ends on Jan. 20. It is also not an isolated maneuver in that representation withdrawal requests for other labor matters are anticipated over the next couple of weeks. […] If the union waited until after Jan. 20, there is concern the request would be denied so that the agency could then reject the union and create precedent. The players have seen their (and other Dartmouth athletes’) school health care benefits improve while they have been a bargaining unit. They could still file a lawsuit seeking backpay and other compensation associated with the Fair Labor Standards Act and accompanying state laws on grounds they have been recognized as employees. However, that would necessitate a new legal action and is unlikely to happen. Their efforts are instead expected to focus on developing the Ivy League Players’ Association as a vehicle to negotiate group licensing deals on behalf of Ivy league athletes on a conference-wide level.” (link, link)

The DII Membership Committee has adopted noncontroversial legislation to remove the ability for provisional members in the third year of the process to use NCAA registered marks, while maintaining the ability to use the DII specific logo throughout the process. (link)

Lawmakers in Indiana have filed a bill to ban transgender women’s participation in college sports. House Bill 1041, authored by Representative Michelle Davis (R-Whiteland), contains virtually identical language to the bill that Gov. Eric Holcomb vetoed three legislative sessions ago. Holcomb’s veto was overridden by the Legislature’s GOP supermajority. The bill would apply to both state and private colleges, as well as associations that put on intercollegiate sporting events. It would also require out-of-state teams who allow transgender women to play on their teams to notify the teams they plan to play against in Indiana at least 60 days in advance. The bill also permits students to file a lawsuit against their school if they feel they were "deprived of an athletic opportunity" or "directly or indirectly injured" as a result of a violation of the policy. Indiana’s legislative session began January 9. (link)

+ Frostburg State rolls out details from its Retrenchment Plan Committee recommendations to eliminate a $7.7M recurring annual deficit, which include the termination of four faculty and four non-tenure-track faculty in addition to 17 senior faculty retiring or entering phased retirement over the next fiscal year and four administrators including two VPs planning to retire or depart the institution. + President Joe Biden has signed an anti-hazing bill for higher ed institutions with federal student aid. The Washington Post’s Nichole Asbury: “The Stop Campus Hazing Act, which passed in the U.S. Senate earlier this month, mandates institutions publicly share hazing statistics, including the name of the organization involved and details of the behavior that incited a hazing violation. It also provides an explicit definition of the term and requires institutions to implement education and prevention programs on campus.” (link)
