Six former Florida State men’s basketball student-athletes – Darin Green Jr., Josh Nickelberry, Primo Spears, Cam’Ron Fletcher, De’Ante Green and Jalen Warley – have filed a lawsuit against FSU HC Leonard Hamilton in which they allege Hamilton promised each of them $250K in NIL payments from the coach’s “business partners.” Yahoo’s Ross Dellenger: “As evidence of the NIL promises, the complaint includes multiple text-message exchanges among players, between players and Hamilton, and between players and Will Cowen, an executive with one of Florida State's NIL collectives. In one of the more striking revelations, FSU players say they boycotted a practice before a Feb. 17 game against Duke. They ‘walked out of the gym’ during practice to show their frustration over the unpaid NIL promises and they intended to boycott the game as well, the claim says. Hamilton discovered the plan and, in a meeting in the team’s film room, re-emphasized that the money would be in the players’ accounts the very next week. Players competed in the game, losing to the Blue Devils, 76-67.” Heitner Legal Founder Darren Heitner is representing the student-athletes and notes: “My primary goal with this lawsuit is to obtain relief for several FSU basketball players who relied on promises from their Head Coach. Additionally, I hope this action causes everyone in the NIL space to think twice before taking advantage of athletes. … It is vitally important to hold people accountable to the promises they make. This is a situation where the entire roster relied on Coach Hamilton’s promise and he failed to deliver. This is about holding him accountable and hopefully this prevents this from happening again at FSU or elsewhere.” (link, link)

Florida State in a statement explains that “upon learning recently of the allegations made by former men’s basketball student-athletes, the university has worked diligently to determine what transpired last season. Though our inquiry is not yet complete, at this point we know of no unfulfilled commitments by FSU in terms of scholarships or other appropriate benefits or the Rising Spear Collective relative to NIL payments owed to the athletes. We support Coach Hamilton’s right to defend himself against these allegations and look forward to an expeditious resolution of this matter.” (link)

Sportico’s Michael McCann & Eben Novy-Williams point out the complaint against Hamilton indicates he was “smart” in that he “avoided responding in writing” to address the unpaid promises. He instead said he’d call a family member. McCann & Novy Williams subsequently explain: “One hurdle for proving breach of contract is the apparent absence of a written agreement. Like other states, Florida has a ‘Statute of Frauds,’ which holds that contracts generally must be in writing to be enforceable. However, there are exceptions that can make an oral agreement enforceable. One is if the contract can be performed within a year. The complaint stresses that Hamilton’s promises ‘could have been completed within one year’ and that payment was in exchange for the players to play at FSU in the 2023-24 season. The complaint also includes claims for promissory estoppel, which asserts that the players relied to their detriment on a $250K promise, and Hamilton should not be left off the hook. They could have enrolled at other colleges or transferred to them but pledged to FSU in anticipation of $250K.” Hamilton, the writers continue, could argue that “players are misconstruing ordinary recruiting into enforceable contracts. Hamilton might also argue the promised arrangements were only conditional, and not every condition was met. Mindful of the statute of frauds, he might also dispute that they were intended to be performed in only one year.” (link)

Former Arizona State men’s swimming student-athlete Grant House talks with Yahoo’s Ross Dellenger about the landmark court case that bears his name. Dellenger reports that over the last several months, some individuals against the settlement have aired their grievances with House. He’s received dozens of messages, and even a phone call, from people threatening to violently harm him. He labels a few of them as “death threats” and says: “It was quite shocking and it’s been emotionally challenging to work through. Never imagined it would escalate to that level.” House also tells Dellenger he did not agree to the roster limitations that could cost his own sport hundreds of positions and says he was “shocked” earlier this month at the attorneys’ requests for more than $700M in fees. “It’s interesting how the finances are allocated for people (attorneys) who have already been very successful in the biggest class-action lawsuits and who have been some of the most successful lawyers in sports. It’s interesting that they needed more money after all that.” Meanwhile, House is “seeking adjustments to the settlement from the judge herself. He recently helped author a letter that, while praising the settlement, urged U.S. District Court Judge Claudia Wilken to create more ability for athletes to hold a voice within college athletics’ new model.” House: “It is about us, the athletes, and we need to be involved in these discussions and have thoughts heard. It was quite shocking that there wasn’t more communication [from the attorneys]. People say ‘What else do we need? We’ve got NIL.’ We need regulation, protections, clauses put in place to protect programs and athletes.” Overall, House believes the settlement is a “huge positive step” but adds: “This isn’t the end-all be-all. It’s not the answer we should stick with for the rest of time. It’s a starting point and a leverage point to go forward and develop this over time.” (link)

Action Network’s Brett McMurphy cites multiple sources who say there will be “in-depth discussions” about changing the College Football Playoff seeding process for the 2025 season when the conference commissioners meet later this month. This would provide first-round byes to the top four teams in the final rankings regardless of whether it won a conference title, sources said. … The most popular concept for 2025 is to still give automatic bids to the five highest-ranked conference champions but award the top four seeds to the selection committee’s four-highest ranked teams.” One commissioner says: “We should be open to getting (the seeding) right regardless of what that means. But protecting conference champions and securing a spot in the playoff is a must.” McMurphy points out that “what makes this tricky to pull off is there must be unanimous agreement by all parties: conference commissioners, the College Football Playoff management committee and, of course, ESPN has to give its blessing. That’s the only way the final year of the contract could change.” (link)

UNC Wilmington AD Michael Oblinger says the $800K the athletic department received from the state in sports betting tax revenue is “a wonderful thing for us. Anytime you can have additional revenue streams – whether you’re enhancing revenue streams or developing new ones – it’s obviously very important to what we’re trying to do here.” Oblinger was able to approach Chancellor Aswani K. Volety about expediting an overhaul of Brooks Field, where the Seahawks play baseball, two years early because of the new revenue. New turf, dugouts and outfield walls are being installed, and upgrades to the school’s tennis courts and sports medicine facility are now possible as well, and Oblinger notes: “Those are things that we need to do. We’re putting that money to good use.” The Seahawks are not including the revenue figures in the budget due to its sporadic nature, as Oblinger points out: “It’s one of those situations where it’s difficult to forecast what this year will look like, what next year will look like down the road.” (link)

Illinois experienced “record-breaking ticket revenue” for the third consecutive men’s basketball season last year, according to Illini AD Josh Whitman, who notes in a year-end letter to fans that the I FUND in FY24 generated $8.27M, marking the highest annual giving in a decade. Additionally, the ICON collective has provided “millions of dollars in opportunities for Fighting Illini student-athletes.” (link)

The IRS has denied 501(c)(3) status to another NIL collective, citing case law and reasoning that the organization’s primary purpose was to further student-athletes’ compensatory opportunities. The letter, whose recipient is redacted, explains: “Based on the facts presented, your primary purpose is to provide student-athletes opportunities to be compensated for the use of their NIL. Thus, you serve the private interests of your contracted student athletes rather than a public interest. To qualify for exemption under IRC Section 501(c)(3), you must serve a public, rather than a private interest. … Because you spend all your resources on the payment of your student athletes, you operate for their private interests.” (link, link – full letter)

Auburn Men’s Basketball HC Bruce Pearl bemoans the current state of sport, saying: "Graduation rates have been destroyed because of the combination of NIL and transfer portal working together. Understand families being in a situation where they may never make more money than they are making right now, and so that's what they are being guided by. And so we are teaching kids to flee, not fight." (link)

LSU Volleyball HC Tonya Johnson joins Coaches.wire’s Daniel Gillman from the 2024 AVCA Convention to discuss the growth of the sport and ways to continue increasing viewership, including cutting back timeouts. Johnson also talks about the impact of the House settlement, how she advises her team to approach social media, whether new pro leagues will attract more international student-athletes and lots more. When it comes to social media, Johnson says the choice is completely up to the players. “I think the great thing about all of this and everything that's happening is it's their choice, and if they want to take the time to do that and promote themselves and promote their social media and get it out there, I encourage it. And if they don't, I'm fine with that, too.” Johnson takes a page out of Tigers AD Scott Woodward’s playbook when it comes to the House settlement – namely, that there is “opportunity in chaos.” Johnson: “The plan that our administration has going forward, I think it protects us and it includes us, so I’m grateful for that. But I think there’s going to be a lot of changes, and you’re going to see a lot of interesting things happen, but I think if we don’t embrace it and we don’t get on board with it, we’re going to be left behind.” Throughout her 30-year career, Johnson says she’s always been told to carry as many players as she wanted “because of gender equity and Title IX.” Now, with a cap of 18, Johnson says coaches will “make those tough decisions, and you hope that everybody is okay from it, and they come back from that and they understand the why and you have to go on.” Complicating the situation, however, is the timing of the recruiting calendar for volleyball, as Johnson points out her 2026 class has been finished since the summer. “So we’re having to re-evaluate some things…and make sure we’re at that cutoff of 18 and make sure we have all the right pieces in place.” Full Q&A. ESPN’s David Hale examines the state of Group of 5 football, and Mountain West Commissioner Gloria Nevarez acknowledges there’s “a gap between us and them. There's always been a gap. It's gotten wider, but as long as this expanded CFP has access, it doesn't matter what brand or conference you're from, that's what makes us relevant and allows us to compete." Hale subsequently notes that “multiple Power 4 athletic directors who spoke to ESPN suggested the industry was leaving money on the table by handing a [College Football Playoff spot to a program that was unlikely to draw viewership or even play a competitive game.” The numbers seem to confirm the aforementioned gap is widening, as Hale notes that non-power conference football teams had a winning percentage of .240 against P4/5 teams from 2006-12. That figure fell to .189 from 2014-21 and again to .142 in 2022-24. Furthermore, wins against P4/5 teams with records of 7-5 or better have fallen from 12 in 2021 to five in 2022, seven in 2023 and just one in 2024. AAC Commissioner Tim Pernetti says he's not worried about being left out of the CFP, “but he also suggested any attempt to keep Group of 5 teams out of the playoff would result in quick antitrust litigation.” Pernetti also reiterates his support for an NIT-style G5 playoff that could possibly include teams from the P4 who didn’t make the CFP as a way to boost revenue. "There's four [conferences] that are going to get left out of the CFP and will be assigned to whatever bowl tie-in they have. There's no guarantee they have something truly meaningful to play for in the postseason. … What's the downside of more meaningful postseason football if it's additive?" The idea still faces pushback from those like San Diego State AD John David Wicker, who says: “I'm not interested in playing in a G5 playoff. I'm interested in the College Football Playoff." Boise State AD Jeramiah Dickey shares an update on the missing goalposts from the Broncos’ conference championship victory: “We are working with campus on one of the posts as a fraternity has it (signed by @PostMalone 🔥🙏🏼). Most of it has been cut up already and God knows where it is 🤷♂️ Great memory for them! Epic. The other one…have had a few people tell me a season ticket holder has it and is trying to sell it. Through a contact, this person has my number. Willing to discuss. If you know who this person is, please connect me. Good for both for getting it out of the river…We believe both were done the night of, which is impressive as it was a cold one. A night Bronco Nation won’t forget! Disappointed we couldn’t get them back. Would have been a great opportunity to support student-athletes, department & football program. If people kept it for personal collection, good for them! If they’re trying to monetize it for personal gain, doesn’t sit well and I won’t forget.” Dickey says the athletic department would have liked to cut them up to sell with proceeds supporting the program. FIU AD Scott Carr joined AthleticDirectorU’s Tai M. Brown to offer insight into developing an institutional brand through storytelling. Carr, who ascended to the AD chair via his background in ticketing, marketing, events and promotion and fundraising, discusses his strategies for external communication, including his mantra: “If it’s not on social media, then it didn’t happen.” As part of his quest to consistently and creatively tell FIU’s story, Carr and his team developed a special Miami Vice-inspired football uniform, the reveal of which garnered 1M+ views in less than 24 hours. Carr: “If you’re not telling people who you are and what you’re accomplishing – whether that’s academics, whether that’s competitively, whether that’s fundraising or ticket sales – then you’re not doing your job.” Carr and Brown also discuss how to tell a student-athlete’s story when they’re only in a program for a year due to transfer portal pressures; how to make the fan experience a storytelling opportunity; and why it’s valuable to develop a Hall of Fame for a young program. Carr says the youth of the school and the athletic department were part of what attracted him to FIU and he plans to lean into that when creating a Hall of Fame: “There are so many reasons to have a Hall of Fame. Part of it is one of the things you learn at FIU is you'll talk to people and they'll tell you they love their experience. They [got a] great education that launched them and then you say, ‘Well when was the last time you were back on campus?’ And it's been like 20 years and you're like, ‘Well, come back.’ But there has to be that draw and so we really want to focus on a Hall of Fame and having that induction ceremony to draw people [back to campus].” More on ADU. Penn State Football HC James Franklin believes “one of the most important things we can do is, let's get a commissioner of college football that is waking up every single morning and going to bed every single night making decisions that's in the best interest of college football. I think Nick Saban would be the obvious choice if we made that decision. Now, Nick will probably call me tonight and say, 'Don't do this,' but I think he's the obvious choice, right?" While speaking with the media ahead of this week’s Fiesta Bowl, Franklin also proposed eliminating conference championship games so the season is shorter and the College Football Playoff selection committee can have a more fair comparison. "When you have a committee sitting in a room trying to compare apples to apples, or oranges to oranges, it's hard to do that when not everybody's playing under the same model. Get rid of the conference championship game. That will shorten the season and help with the window a little bit." Franklin went on to suggest that every conference play the same number of league games and start the season a week earlier to "take some stress off of the academic calendar,” adding: “God forbid we talk about academics, right? … Maybe I'm old school and maybe I'm a traditionalist, but I still believe in the model. Rather than just say this is a problem, I thought I would throw out a few recommendations, but I think one of the most important things we can do is let's get a commissioner of college football." If the House settlement is approved and revenue-sharing is capped, third-party NIL money “will be a recruiting differentiator,” according to Kennyhertz Perry attorney Mit Winter, who explains there’s “confusion on how third-party NIL deals will be viewed. … One area I’ve seen a lot of misinformation on is which third-party deals will be subject to a fair market value analysis. Some believe all third-party deals will. That’s not correct. Only deals with ‘associated entities or individuals’ will undergo the FMV analysis. … So who will qualify as associated entities & individuals? We know NIL collectives and ‘boosters’ will. Beyond that, we’ll have to wait & see until the review process begins.” Regarding deals that are subject to an FMV analysis, Winter submits: “I think the FMV analysis system is going to be subject to some litigation. I can see some boosters and collectives not being happy when their deals are rejected. It will also be interesting to watch what happens when boosters and collectives get a sense of what values the new system will allow for athlete deals. I expect we’ll see a lot of deals right at those values. Schools that have boosters willing to fund collective deals at these levels, and that get good at acquiring deals for athletes with third parties that aren’t associated entities or individuals, will be able to essentially guarantee payments above the cap.” (link); Headlining sports attorney Tom Mars adds: “Whatever one might think about the House v. NCAA settlement, the NCAA retaining an accounting firm to determine the FMV value of college athletes is nothing short of an invitation for wealthy donors to sue the NCAA for illegal interference with their third-party NIL deals.” (link)

Atlantic 10 Asst. Commissioner for Championship Administration Meghan Bertovich sits down with Connect's Steph Garcia Cichosz at the 2024 Women Leaders Convention to talk about growing up within college athletics and pursuing a career through the conference office. Bertovich, the daughter of former Atlantic 10 Commissioner Ron Bertovich, discusses the secret to putting on a world-class championship event, offers advice to first-time convention attendees, reflects on her process for evaluating career opportunities, and talks about managing conflict as a team leader. To forestall any perception that she bounces around arbitrarily between jobs, Bertovich says she tries to stay at a new post for at least three to five years and explains: “Plus, I also find it takes a year to get acclimated and then a year to kind of find yourself and figure out your own processes in the company. And then by year three it's like, ‘Okay, I know what I'm doing and that's really the year I try to evaluate ‘Is this really for me?’ Because just going in you might not like the people, you might not like the work, but you might not also understand it. So, things might change – things will always change.” Bertovich on achieving a work-life balance: “I don't have balance. There’s times of the year where I’m 90% work, 10% personal and other times of the year it’s more like 60/40. So, I just find that I surround myself with a great support system and really rely on them to say, ‘Hey, I’m really not in a good place today.
