The NCPA, which spearheaded the effort to unionize athletes in the ongoing USC case, has submitted a motion to withdraw its charge against the NCAA and USC, per ESPN’s Dan Murphy, who notes Dartmouth basketball players recently withdrew the only other active NLRB case for unionization. (link)

NCPA Executive Director Ramogi Huma explains the group decided to pull its petition because of recent progress made in the effort to compensate college athletes. He also noted that five states, including California, now have statutes that allow schools to directly pay their athletes NIL money while prohibiting the NCAA or conferences from punishing them. “Together, these state laws and the change in respondents’ position on compensating its college athletes serve as powerful catalysts toward USC (and other universities) paying their football and basketball players fair compensation.” Sportico’s Daniel Libit adds: “Left unsaid in the motion for withdrawal was the consequence of the 2024 presidential election—the agency will likely take a much less favorable attitude towards college athlete employment under incoming president Donald Trump.” Libit also notes that an NCAA spokesperson says in a statement that "student-athlete leaders" from DI to DIII are opposed to college athletes gaining employee status and that the legality of the issue "can only be addressed by Congress." U.S. Senator Ted Cruz (R-TX) tells ESPN’s Dan Murphy he’s not interested in saving the NCAA but would rather give the association the legal runway it needs to save itself. “College sports is in crisis right now. If Congress doesn't act, we risk seeing devastation." Meanwhile, Senator Richard Blumenthal (D-CT) tells Murphy he’s working on a bipartisan effort with Cruz and Senators Jerry Moran (R-KS) and Cory Booker (D-NJ) and is close to finalizing a “very strong discussion draft” of a new bill. He adds: “The political stars seem to be aligning.” As part of the compromise, Blumenthal indicates the lawmakers are discussing a special carve-out for student-athletes that would allow them to collectively bargain without becoming employees. "That might be an option. Enabling collective bargaining without employment status certainly has to be taken seriously. We're talking about a variety of different possibilities." As for whether such legislation will create an even playing field, The Collective Association President Russell White says ADs will simultaneously create rules to establish competitive equity and brainstorm ideas to find a competitive advantage. "It might be the same meeting. Topic 1: Putting guardrails in place. Topic 2: Ways around the guard rails. They know they're going to have to find ways around these." More from Murphy. (link)

+ WSVN anchor Josh Moser reports former Georgia QB Carson Beck agreed to a $4M NIL package to sign with Miami (FL). “This is in line with the reported deal Tulane transfer QB Darian Mensah (2-year/$8M deal) signed with Duke. Different market this year considering Cam Ward was reportedly paid $1.5M last season.” (link)
+ Former Duke QB Maalik Murphy’s decision to transfer to Oregon State came as a surprise to Kentucky, where collective operators had offered Murphy a seven-figure deal, according to JohnCanzano.com’s namesake. One UK source tells him: “We were mostly worried about Auburn.” Canzano notes that Murphy “was familiar with several OSU coaches and liked the campus, but in today’s world – money talks. Oregon State’s NIL deal with Murphy: $1.5M in cash. Sources familiar with the agreement told me it contains even more upside. Believe what you’d like about the great locker room culture and the beautiful campus in Corvallis. After conversations with involved parties at the schools that lost out on Murphy, I’m convinced OSU’s financial package simply put the Beavers at the front of the line. Kyle Bjornstad, the head of the Dam Nation Collective, declined to comment on the specifics of Murphy’s NIL deal. He told me: ‘It’s not my dollar figure to share, but I can tell you he was a big get.’” Beavers HC Trent Bray tells Canzano that landing Murphy was about more than signing a QB. “The perception of us being the little brother who isn’t on the national, big-time stage has to stop. The guys we’ve been able to pull in prove we’re a national player. We deserve to be at the table. We’re going to be at the table.” (link)
+ Mega-agent Drew Rosenhaus explains on The Pat McAfee Show that rather than recruiting student-athletes out of college around their junior years, “now we’ve got to start with high school guys.” Rosenhaus notes his agency began representing Michigan DL Mason Graham, who is projected to be a top 10 pick in the NFL Draft, when he was a freshman for the Wolverines. Rosenhaus also points out that current NIL contracts are year-to-year, adding: “Players right now are professional football players in college. They’re getting new contracts every year, there is free agency every year, there is no salary cap, there are no rules. The ability to transfer is almost unlimited, guys are getting paid coming out of high school. I love it, I'm for the players…[but] in any system we need structure. Every other professional league has rules. We have a cap, we have a structure, we have a draft order, we have waivers, we have trade deadlines. This doesn't exist in college football, so it is very chaotic. But to get back to your question, a guy like Mason Graham, we started recruiting him as a freshman, and we were fortunate to sign him when his availability was up, but it doesn’t always work like that. … It’s kill or be killed. We’ve got to earn our business every day.” (link)
+ Oklahoma Governor Kevin Stitt has issued an executive order that will allow the state’s colleges and universities to facilitate direct payments to student-athletes for the use of their NIL. He explains that “this executive order ensures that these student-athletes have access to the same opportunities as their peers in other states. It’s about leveling the playing field and maintaining the competitive edge that defines Oklahoma athletics. This action is a critical step to protect Oklahoma’s student-athletes and ensures they have the opportunity to succeed on and off the field.” Oklahoma President Joseph Harroz and Oklahoma State President Kayse Shrum both voiced their support for the EO, with Harroz saying: “This action strengthens our ability to recruit, retain and cultivate extraordinary talent, positioning our student-athletes for success in every aspect of their lives.” (link)
+ State lawmakers in Illinois have introduced a bill that would amend the Student-Athlete Endorsement Rights Act, providing that if an athlete earns $250K+ from the use of their NIL, then any academic scholarship granted to them shall be reduced by $1 per dollar the athlete earns over $250K. + James Moore & Co. Partner Katie Davis shares “another IRS letter denying 501c3 status to NIL collective, explaining that promo/publicity provided to charities does not make you exempt as charitable because it provides substantial private benefit to athletes and that private benefit was intentional.” It is at least the sixth such letter sent by the IRS. As in the others, the name of the collective is redacted. (link)
+ Middle Tennessee State announces The Blue Bloods in the Round event, which will bring together MTSU alumni Luke Laird, Jamie Moore, Natalie Hemby, and Gordie Sampson. The event will be hosted by country artist Jet Jurgensmeyer and is sponsored by the Athlete Licensing Company. It will also be promoted by MTSU student-athletes, with the athletes receiving NIL money through the ALC CONIC app for their posts on social media promoting the show. (link)

Venu, we hardly knew you. ESPN, Fox and Warner Bros. Discovery are scrapping plans for the streaming service, effective immediately, explaining in a joint statement: “In an ever-changing marketplace, we determined that it was best to meet the evolving demands of sports fans by focusing on existing products and distribution channels. We are proud of the work that has been done on Venu to date and grateful to the Venu staff, whom we will support through this transition period.” The Athletic’s Andrew Marchand and Richard Deitsch note the “Fubo deal, plus a recent agreement between Disney and DirecTV to offer Disney’s streaming services in select packages, means those entities will be able to add ‘skinny bundles’ in sports that will be Venu Sports-esque, according to a source briefed on the reasoning. The fact that DirecTV and Dish indicated they could have interest in continuing the litigation that Fubo just ended also factored into shuttering Venu.” As for what comes next, Marchand writes: “ESPN will — likely in August — begin its own all-you-can-eat, direct-to-consumer service…that is currently expected to be priced in the $25-30 range. Fubo and DirectTV and maybe others will be able to hit the $50 limited sports bundle, while viewers could have a more traditional streamer, like Fubo or YouTubeTV for $80 that would include other channels.” Meanwhile, Puck’s Matthew Belloni suggests that ESPN might “supercharge the offering with Fox Sports, whose combo of the NFL and college football, World Series baseball, and much more would give Flagship more than $15B worth of sports rights in one service.” (link)

Utah AD Mark Harlan continues to be in headlines, this time with a letter to Utes supporters: “The University of Utah will be adding athletics scholarships and sharing revenue with student-athletes at the maximum allowable threshold, which is expected to total $20.5 million in the 2025-26 academic year, pending the expected final approval of the proposed House vs. NCAA settlement in April. The Crimson Collective, the local entity that has been supporting and operating the fundraising and activation for Utah Athletics student-athletes' name, image and likeness opportunities, has been extraordinary in support of our student-athletes' NIL endeavors. The proposed settlement allows universities to manage all of these operations, including fund-raised dollars that will go directly to the University for our student-athletes going forward. As such, we will take that great baton that they are handing to us and continue to raise the bar with our NIL funding and corporate and community support in 2025. We will forever be grateful for the Crimson Collective's leadership team, their board and all who have invested in cultivating opportunities for our student-athletes. It is imperative that we go all-in on this investment in order to recruit, develop and retain the elite students who will continue to ensure that Utah Athletics excels in the way we've grown accustomed to expect.” (link)

Athletes.org Co-Founder Jim Cavale joins JohnCanzano.com’s eponymous proprietor and expresses his opinion that college football needs to unite, noting that despite being more popular, it is outperformed by about six dollars to one by MLB and the NBA “because it’s not centralized and running as one league. So the thing that could be done to generate billions more a year in revenue from the media deal and other initiatives is real and it’s going to be felt a lot more now that schools have to come up with $20M more a year to pay athletes via the House settlement. So, having somebody that leads that charge, I think, is going to be really important. And you ask what would a central office for college football do? First of all, it would centralize scheduling. We’d have less arguments over who had a better schedule and what conference and all these different things because we have a centralized schedule. We have better matchups more often, which means more viewers and more media money. We would take the 13th through 25th CFP teams that don't make the 12-team playoff and we'd run an NIT with them using all the other bowls and get great ratings and generate more money that way.” Cavale also notes that collective bargaining can not occur until college football is centralized. Cavale goes on to remark that many of the student-athletes he talks to outside of football and men’s and women’s basketball understand they’re unlikely to receive any revenue-sharing, “and they’re fine with that. They just want to keep their sport and their scholarships and their benefits. … I’ve talked to football players who don’t want an annual transfer portal. They want there to be some structure because they want to see a commitment to the program, but you can’t set any of these rules without creating a partnership between the athletes and the league they play in. Extra Points purveyor Matt Brown responds to reports the Power 4 is pushing to gain operational control of postseason events & the belief it could lead to a P4 breakaway. Of note from Brown: “Do you know what one of the biggest benefits of a big ol’ DI is for the biggest conferences? Shared legal liability! The big talking point at NACDA when NCAA President Charlie Baker and others discussed the proposed settlement to House was this settlement would ‘bind’ all of D1 membership together. While I disagreed with the idea that slapping some band-aids on House would grant labor and legal peace to NCAA membership, to the best of my current knowledge, there is something to the idea that the settlement does sort of stick everybody together for a little while. If you blow up the NCAA and set off to do a new thing with 70ish of the biggest schools, you can’t ask (or force lol) Southern Utah, Central Arkansas or Vermont to help pay your legal bills. You have to deal with your own insurance, your own antitrust exposure, and your own political risks. That gets expensive, quick.” More. (link)

Despite being a freshman, Ohio State WR Jeremiah Smith should be allowed to enter the NFL Draft, according to USA Today’s Dan Wolken, who points out it’s been two decades since former Buckeyes standout RB Maurice Clarett challenged the NFL’s eligibility rules. “It’s time for someone to try again. And nobody has come along with a better case than Smith. … In a sport where evaluating players can be brutally tough, assessing Smith is comically easy. No nuance is required to see how intelligently he runs routes, how proficiently he catches the ball and how naturally he separates from defenders. Few, if any, receivers have ever come into college football as advanced as Smith.” In fact, Wolken notes that “NFL scouts and analysts generally agree that if he were eligible for this year's NFL draft, he would be in play – if not the outright favorite – to be picked at No. 1. … The thin lines on which Clarett’s case was decided 20 years ago underscore how fragile the NFL’s hold really has been on forcing players to go to college for three years. What if [Clarett’s attorney] had filed the case in a different circuit that wasn’t in the NFL’s backyard? Would a Supreme Court with today’s makeup of six conservative justices have taken the case?” Wolken goes on to point out that when Clarett challenged the rules, there was fear that players who rushed to leave college would leave a “generation of washouts who didn’t get the big NFL payday and messed up their education/college development. Now, valuable college players might be able to make as much or nearly as much money by staying an extra year as they would getting drafted in the middle of the third round. It's just a completely different economic calculation.” More. (link)

A statement from the NewsGuild reads, in part: “Instead of doing the right thing by its Athletic workers, Times management is continuing the charade of pretending it operates separate newsrooms in an attempt to keep a two-tiered system that disenfranchises Athletic workers. Management’s decision does not come as a surprise, given The New York Times’ long history of union-busting. We filed for an election at the National Labor Relations Board, and that process is moving forward. Sports jobs are Times Guild jobs. It’s that simple.” (link)

Private-college presidents and chancellors are preparing for a year of conflict in 2025, as The Chronicle of Higher Education’s Eric Kelderman explains: “Many of the presidents feel their sector is deeply misunderstood and under pressure from constituents across the political spectrum whose demands are conflicting or impossible to satisfy, such as cracking down on protests while allowing free speech or attracting new students at the same time as cutting programs and faculty.” DePauw (DIII) President Lori White: “We’re all trying to figure out how we can speak to one another in ways that kind of lower the volume and try to find some common ground so that we can move forward.” There are also concerns about ongoing efforts to ban DEI and crack down on transgender athletes’ participation from the incoming Trump administration. National Association of Independent Colleges and Universities President Barbara Mistick: “It is going to be this whole miasma of things that just keep popping up and you’re going to see them. It’s going to be what happens in the newspaper; something happens in an institution and it becomes front page news. Next thing you know, we’re going to see it on the House floor.” Mistick, however, believes Secretary of Education nominee Linda McMahon will be a good manager for the department. “We will be fortunate to have her. She had great experience at the [Small Business Administration] in the last [Trump] administration. She understands how to run a big organization.” (link)
