Axios’ Dan Primack sits down with Arctos Partners Co-Founder/Managing Partner Ian Charles and asks what role he expects private equity to play in college sports. Charles: "I hope the answer is zero. The collegiate landscape is very unstable and unpredictable, which is stating the obvious. And anyone who tells you they know how it's going to play out is not being authentic or they're delusional. The idea that putting a piece of structured paper or pref paper or loan structure on top of a nonprofit institution that doesn't have institutional-grade business leadership…the idea that's a stabilizing thing or a healthy thing I find very hard to believe." Charles confirms Arctos, which has stakes in the likes of the NFL’s Buffalo Bills, NBA’s Golden State Warriors & MLB’s Boston Red Sox, has received inbound interest from college programs and explains: “What we've said to everyone is unless we can figure out a way together to bring stability to the situation we're not comfortable. There will be a couple of deals that get cut in college athletics, and it may break an institution that matters to a community in this country, which isn't a good look for private equity. Their pitch is we will help you grow your revenue, but that's a very low-credibility pitch. Most of the revenue streams at these universities are locked for long horizons. The media contracts are done at the league level. No sponsor is going to help you on ticketing. No sponsor is going to materially help you on sponsorship. Those are the big levers of value creation." Still more from Yahoo’s Ross Dellenger on the realities of the House settlement’s implementation, as he notes the “structure is ripe for legal action – even the two leading plaintiff attorneys who struck the House settlement have publicly expressed doubt in its legality.” SANIL Co-Founder Jason Belzer: “I don’t think the clearinghouse is going to be able to last very long. It’s just the reality. There are a lot of ways around the clearinghouse. Who is to say what fair market value is? They are crazy to think that guys are going to sit around while a third party is going to judge whether these deals are real.” Dellenger reminds the House plaintiffs’ attorney Jeffrey Kessler last month remarked: “If the NCAA (and power conferences) tries to punish a student or school, if they try to take action against an NIL (collective), I think they’ll probably see that NIL organization in court.” In fact, Brian Davis, an attorney in California who represents more than 100 football players in the NIL space, plans to file a legal objection to the settlement over the issue. “I don’t think there is any world where you can require a submission of an NIL contract to some third-party clearinghouse to determine fair market. I don’t see that ever surviving a challenge in the courts without collective bargaining.” Aside from the potential for more legal battles, Notre Dame AD Pete Bevacqua points out the enforcement issue remains. “It’s going to come down to enforcement. You get dinged, so what happens? Are there any repercussions?” (link)

High Point is making club sports an extension of the athletic department. Panthers AD Dan Hauser: "High Point University has an extensive history of maximizing opportunity through creative strategic initiatives, and we are very excited to announce the Intercollegiate Club Sports Plan. The NCAA collegiate sports landscape has changed tremendously with the transfer portal, NIL, and the House Settlement resulting in decreased athletic opportunities for high school graduates. The HPU Intercollegiate Club Sports Plan will create the ability to fill this competitive sports participation need at an elite experience level. We look forward to our new ICS Athletic Director Stephen Denny's leadership as we transform and grow the program for the future." HCU ICS will feature over 30 teams and 850 athletes, with the long-term plan to add more offerings, though scholarships will not be available at the inception. (link)

With two consecutive seasons without a representative in the College Football Playoff championship, Yahoo’s Ross Dellenger wonders whether the Deep South’s stranglehold on the sport is coming to an end, and former Bowling Green/Utah/Florida/Ohio State Football HC Urban Meyer remarks: “The question is, is the SEC’s dominance over? It is. It’s over. Now, next year’s another year. But for (these) two years, it’s over.” Meanwhile, political commentator/former Bill Clinton campaign strategist James Carville, a diehard LSU fan, says: “I don’t see this as any reshuffling. They’re not going to stop playing football down here. I’m not too worried about it. SEC football is going to be fine. I’d be surprised if they don’t win six of the next 10.” Like others, Dellenger observes that NIL and the transfer portal have made it easier to get players out of the region and distribute them more equally across the country, but former LSU/Vanderbilt/Indiana HC Gerry DiNardo sees it differently: “I think it’s a competition of the two conferences rather than a resurgence of one or the other. I think they’re both very similar other than their culture differences because of where they are located. Can you say one conference is stronger than the other? I don’t think so. … We all have four blue bloods playing this week. Tell me what’s changed? I see no shift. It’s a haves and have-nots business and it’s never going to change. You’re never supposed to say never but I’m saying it now.” (link)

Monday’s FCS Championship between North Dakota State and Montana State averaged 2.4M viewers on ESPN and peaked at 3.1M, marking a 132% YoY increase. It was the second-most-watched FCS title game on record. (link)

Prices for Iowa’s football season ticket renewals will range from $370 to $460, which the athletics department says is an average increase of “around 4%.” Those figures do not include the minimum annual donation required for those seats. (link)

Former Ohio State QB Terrelle Pryor’s lawsuit seeking lost NIL opportunities is barred by statutes of limitation and is incompatible with IP law, according to the NCAA, which argues Pryor’s claims are also preempted by his membership in resolved class action lawsuits led by Ed O’Bannon, Sam Keller and Shawne Alston. Sportico’s Michael McCann explains further: “The NCAA points out that federal antitrust claims have a four-year statute of limitations, which for a lawsuit filed in 2024 would cover claims going back to 2020. Pryor played at Ohio State from 2008 to 2010, obviously long before 2020. The NCAA also notes that his unjust enrichment claim has a maximum statute of limitations of six years, which is useful for claims arising from activities as far back as 2018 but not 2010. Pryor’s case, the NCAA insists, is ‘more than a decade too late.’ The NCAA also accuses Pryor of building a case based on ‘nonexistent rights,’” citing Marshall v. ESPN in which the Sixth Circuit reasoned that college players lack a right in the broadcasts or rebroadcasts of games. “While Pryor maintains the NCAA owes him money for the use of publicity rights in game footage, the NCAA maintains that argument fails per Marshall and other precedent.” More from McCann. Pepperdine has postponed tomorrow’s women’s hoops matchup with Portland as the Palisades Fire continues to spread in the area. The schools are working with the WCC on rescheduling the contest. (link); In the latest update from Pepperdine, school officials say the Palisades Fire is now approximately three miles east of the Malibu campus and approaching the area burned in the Franklin Fire, which is 2.4 miles from campus. “As the fire moves westward and approaches the burned area from the Franklin Fire, fuel for the fire will significantly decrease. The Palisades fire has burned more than 11,800 acres but continues to pose no immediate threat to the Malibu campus. The University is also monitoring multiple other fires around the Los Angeles area, which continue to grow but are not a threat to campus. (link); Meanwhile, evacuation warnings have been issued for Pasadena, and the Eaton Fire is currently about four miles away from the Rose Bowl. Our thoughts are with all those impacted. (link)

VCU’s men’s basketball game against Fordham tonight will be played without fans due to an ongoing water crisis in Richmond, where malfunctions in the city’s reservoir system have prompted a boil water advisory – if people have water at all. Rams AD Ed McLaughlin: “We wanted to wait as long as possible but water service has not returned to the Siegel Center, despite assurances throughout the last two days that it would. We hoped to serve the role of a place for our fans to gather and enjoy a few hours of happiness during a time when so many people in our community have suffered grave challenges. Shutting our doors to fans has major financial implications for our department and major impact on the student-athlete experience. We did not make this decision lightly and gave it as much time as humanly possible. As a city resident still without water, I know what the length of this outage has done to many homes in our community. We look forward to having fans back in the Siegel Center next Tuesday night, Jan. 14, when we host Saint Louis University.” (link)

Tulane announces the launch of Ascend TUgether, a Green Wave Club fundraising campaign with an immediate goal of raising $4M in unrestricted giving and increasing Green Wave Club membership to 3,500 donors by May 2025. Green Wave Club members contributed a record $3.6M in FY24. Green Wave AD David Harris: "As those who follow college athletics know, this is a time of enormous change in our industry. Throughout that change and whatever evolution is to come, the foundation of our department is built on gifts to the Green Wave Club. There are numerous ways to support Tulane Athletics, but this is clear: In order to achieve the lofty goals we have for Tulane Athletics, we must grow Green Wave Club donor support. … As a department, we have taken on significant new expenses and are prepared to meet the needs of the moment in a meaningful way. We recognize the future college athletics landscape will only increase the pressure for expanded resources and the work to grow department revenues is never-ending.” (link)

The Connecticut-focused Bleeding Blue for Good collective is no longer accepting donations and has made plans to shut down. Executive Director Jared Guy Thomas explained in a New Year’s Eve post that “we will enter a wind down phase that we expect to take us through the end of June as we meet all of our commitments. At that point, we expect revenue-sharing to begin. Money already collected will continue to be used to partner UConn student-athletes with deserving Connecticut charities.” Net revenue for the collective in 2022 and 2023 was $1.73M, and Thomas declined to give a specific revenue figure for 2024 other than to say it was “significantly more.” (link)

According to D1Baseball’s Kendall Rogers, the CAA is “considering going back to a COVID-era conference scheduling practice where teams in the league essentially only play teams in their specific regions. Would be a crippling move for a league with RPIs of 7 and 10 the last two seasons. Obviously, several coaches are irate at the possibility of going to this scheduling model. It would, for instance, really harm teams like Northeastern who are in a CAA region with lesser RPI teams, etc.” (link)

KRQE News has obtained New Mexico State President Valerio Ferme’s termination letter to former AD Mario Moccia which read, in part: “This letter will serve as notice of termination of your employment as the NMSU Director of Athletics for cause, effective February 2, 2025. You will be provided with paid administrative leave for one month, beginning today and ending February 2, 2025.” In the letter, Ferme also instructed Moccia that he would have to contact HR to retrieve his personal items from his office within one week. Moccia also had 24 hours to turn over all NMSU materials, including recruiting records, keys to NMSU vehicles, credit cards, devices, and any other NMSU property. Ferme said NMSU would give him up to two weeks to return any courtesy vehicle he may have received. (link)

More from Yahoo’s Ross Dellenger on how schools are preparing for the House settlement implementation, as one collective official talks about spending beyond the revenue-share cap: “If you’re not spending close to $20M all-in on your football roster, you’re not going to be in the top 20 of schools. That’s where we are trending. The trick is, what’s that regulatory body going to look like to justify the $7M for your football roster?” Opendorse Co-Founder Blake Lawrence tells Dellenger that “the big question will be the clearinghouse and the role in determining fair market value. Is it on a per-activity basis or per-contract basis? If a collective is going to pay an athlete $100K over the course of a year, it may raise a red flag, but what if they break it down: 20 appearances at $5,000 a pop?” With the settlement slated for a July 1 effective date, The Collective Association President Russ White expects there to be some “big paydays” before then as “schools are getting as much money off the books as they can.” SANIL Co-Founder Jason Belzer says the market is inflated by 40% right now and he anticipates the number of quarterbacks making at least $1M (currently around 10, he says) to at least double, if not triple. He projects the average power conference starting quarterback annual salary to be $700K — a 100% jump YoY. “It’s the definition of what happens when you give somebody a blank check. It’s like how lottery winners go bankrupt. ‘Here’s a $20M budget that we’re going to pay! Go spend it!’” (link)

With bowl ratings particularly strong this season, Bowl Season Executive Director Nick Carparelli tells SBJ’s Ben Portnoy: “It continues to amaze me how some people want to diminish the excitement and the impact of bowl season when year-in and year-out it delivers, in a way, far greater than almost any other sporting event you can create in a three-week time period.” Charlotte Sports Foundation Executive Director Danny Morrison adds: “A lot of questions have been answered in this particular bowl season. It was the first year of the [expanded] CFP, and there were some questions about, ‘Well, I wonder the impact that it might have on the non-CFP games.’ For the metrics to say that the non-CFP games were compelling…and then the TV ratings were even better than they've ever been, that answered a lot of questions.” While opt-outs remain a concern going forward, Carparelli notes several collectives are now including language that makes certain payments contingent on players competing in bowl games and tells Portnoy: “This year, more than [anything else], has proven what we've been saying: College football needs bowl games. The College Football Playoff is awesome. … And regardless of how big the CFP may ever get, there's never going to be enough opportunities in the playoff alone to reward deserving teams for a successful season, especially when the definition of success is very, very different for some schools than they are for others.” (link)

ESPN President of Content Burke Magnus adds some numbers: “Here is my annual post to the ‘there are too many bowl games crowd.’ The 33 non-CFP bowls on ESPN nets this year averaged 2.7M viewers +14% YoY & the largest audience since 2019-20 & P18-49 (+21%). 14 of the 33 bowls hit at least a 5-year high and five hit a 10-year high.” (link)

College hockey’s independent schools have discussed holding a postseason tournament, according to College Hockey Insider’s Mike McMahon, who notes that a “rough outline for one that would coincide with the conference tournaments has been developed. Sources said Lindenwood would likely host the tournament because it has the facilities to host multiple teams and is centrally located between the Eastern schools (Long Island and Stonehill) and the Alaskan schools.” The programs aren’t necessarily trying to organize the tournament for a bid in the NCAA Tournament, which McMahon notes would not be forthcoming anyway since there are only five teams. Rather, the coaches “want something to play for at the end of the season. This would allow the independent programs to compete for a tournament championship after the regular season. One hangup is the NCAA allowing the teams to exempt those games from their 34-game maximum. For now, everything is in wait-and-see mode. Some coaches hope the tournament will happen as early as next season.” McMahon adds: “I hope we see this happen. From a coaching standpoint, it has to be challenging to keep players motivated for the entire year when there isn’t a playoff to play for at the end of the season. At least this would allow those teams to compete for a trophy, like the schools in leagues. If all this needs is the NCAA to exempt the games, I hope they approve it and the plans move forward. It’s all about the student-athlete experience, right?” (link)

Wisconsin Women’s Hockey HC Mark Johnson raves about the team’s experience at Wrigley Field over the weekend: “You know, the only thing I missed out on was going out for warmups and participating, because, I mean, how often would you get a chance to skate at Wrigley? Like, never. Those are just moments that are special.” The Badgers fell in a shootout loss to Ohio State, but UW captain Casey O’Brien said after the game: “I don’t think the score is gonna be the big takeaway from this. I think just like, pregame, getting to walk around, see everything. … It was such a cool opportunity for our team. Regardless of how the game was going to go, we were going to come out with a smile. We’re really honored to be provided this opportunity that was so special, and I think everyone's probably going to remember this for the rest of their lives.” Men’s hockey student-athlete Ryland Mosley adds: “The (national) anthem, I had chills the whole time. And just looking around and seeing all those people, they were loud, and it was just a great atmosphere.” The Big Ten reported an attendance of 24,788 on Saturday after 25,709 for two men’s games Friday, when Notre Dame tied Penn State and won an eight-round shootout and Ohio State edged Michigan. Sun Devil Source’s Chris Karpman reports that when a large portion of NIL money Arizona State men’s basketball student-athletes Joson Sanon and Jayden Quaintance had expected to receive from a docuseries deal did not materialize several months ago, “other methods of servicing the agreements were undertaken to ensure the players would still be paid in full.” Quaintance’s father, Haminn, confirmed as much responding to a Barstool Arizona post suggesting that ASU's NIL interests were unable to pay: “Fake news. [Sun Devils HC Bobby] Hurley and [Rossini] kept their word and went above and beyond." When asked whether the docuseries never making it to production has had a negative impact on recruiting, Hurley responded: "Not at all. I think you saw that with the responses (from Sanon and Quaintance's father). We honor our commitments here.” Hurley also noted that “a lot of times in business negotiations things break down and you don't get a deal done. It happens all the time in the business world. So, we didn't get the deal that we hoped we could get with that. We're going to explore and be creative and try and find ways to maximize our NIL program and we'll still continue to talk to people if we find a situation that makes sense. Otherwise, I have an E:60 myself, so I don’t need the extra publicity. I’m good.” (link, link)

Momentous Sports Partners has officially launched as a full-service NIL agency with a list of 27 clients headlined by high-profile men’s basketball student-athletes including Kansas’ Hunter Dickinson, North Carolina’s R.J. Davis, Baylor’s Jeremy Roach and Auburn’s Johni Broome. Co-Founder Joey Pennavaria says the agency will focus on players who plan to play multiple years in college. “We want to be somewhat complementary, but also not even necessarily recruiting the same guys as the top NBA agencies. Those guys are gonna go after the Cooper Flaggs, the guys that are for-sure one-and-dones. Those were the guys we wanted to recruit. But there’s so many more athletes now in college basketball that need representation because they’re professionals as well and can make really good money – life-changing money. They’re not NBA deals or NBA-sized deals, but there’s so many of these guys that need this help. That’s the white space that we saw.” (link)

The total number of FBS players to enter the transfer portal surpassed 2,200 on Monday, according to ESPN’s Max Olson, who notes that “when you take out the players who've withdrawn from the portal, you're left with 2,095 scholarship transfers as of Monday night. Getting to 2,095 transfers in this portal cycle by Jan. 6 represents an almost 30% increase in transfers year-over-year.” So far, more than 1,100 transfers have committed to or signed with their next school, including 260 Group of 5-to-Power 4 transfers, a nearly 40% increase YoY. Olson also submits that this year’s cycle is the first to truly resemble free agency in pro sports. “The shift to revenue-sharing in 2025 and Power 4 athletic departments preparing to invest $10-15M in their football rosters for next season has pumped more money into the marketplace than ever before. The cost of retaining players and recruiting transfers has significantly increased this offseason as more players depend on agents to maximize their value. … Much like in pro sports, coaching staffs are having to make tough decisions on who they can and cannot afford to bring back. The recruitments have changed, too. Players aren't taking five official visits and holding commitment ceremonies. If they're satisfied with the opportunity and the dollar figure, they're getting a deal done quickly. If a team can get a top target in for a visit, they're going to offer whatever it takes to get the player to cancel the rest of their trips and sign.” Also from Olson: “The death of the one-time transfer rule has helped lead to more than 660 FBS scholarship players re-entering the portal during this cycle to move on to their third, fourth or even fifth school of their career. That's more than 30% of all scholarship players in the portal.” More. (link)
