With his football program heading to the College Football Playoff Championship game, Notre Dame AD Pete Bevacqua indicates the Fighting Irish are committed to remaining independent in the sport. “No secret, the expansion of the CFP from four to 12 teams has helped enormously, because as an independent, as with other schools, we get better opportunities, better percentages of getting in the playoffs, and the more you knock on that national championship door, the better. And we like the freedom, quite frankly, it gives us. The fact we were able to play Navy at MetLife and had the Shamrock Series against Army at Yankee Stadium, that we can continue that great rivalry with USC -- we really get to move around the map and keep that very national presence. It's a wonderful thing for our football program and, quite frankly, it's a wonderful thing for the university. … The fact that we can maintain our independence in football and be a part of a wonderful conference in all of our other big sports with the ACC and our Big Ten relationship with hockey, we're very happy with that.” (link)

Former USC Executive Senior Assoc. AD/SWA Joyce Bell Limbrick has filed a lawsuit against the university alleging race and gender harassment, discrimination, retaliation and the failure to prevent discrimination and retaliation by former Trojans AD Mike Bohn, per the Los Angeles Times’ Ryan Kartje. From the filing: “[Bohn’s] incessant, racially charged remarks made Joyce feel uncomfortable and undervalued, but more than that — he actively isolated her from the executive team and undermined her work. She already was vulnerable as the only Black woman on the team, and rather than support her, the university allowed Bohn to make her life hell.” USC says it will have no comment until it has fully reviewed the complaint. Boise State Asst. Professor Sam Ehrlich shares another letter posted to the House case, this one by Auburn freshman Swim student-athlete Keaton Rice who writes: “Half of the men’s swimming and diving team would be released which would terminate $6000 annual scholarship the NCAA gives each of us. We would also lose the free dining plan and free healthcare we receive for being an athlete. There are many other monetary perks that we would lose for no longer being on the team: free tutoring and tickets to all athletic events are just a couple. [...] It is too late for me to enter the portal and find another school but it is cost prohibitive to remaining without all the financial benefits of being an athlete. You must consider the thousands of us that will be in the same position and allow us to be ‘grandfathered in’ since we made decisions for our future based on circumstances that were previously set in stone!” (link)

Southern Miss Men’s Basketball student-athlete John Wade III's court hearing challenging the NCAA's ruling on his eligibility for a temporary injunction was granted in continuance yesterday by Judge Taylor McNeel, who will make a ruling on Wade's focus on challenging the NCAA for breaching antitrust laws on the grounds of Vanderbilt Football student-athlete Diego Pavia's recently granted preliminary injunction. Brittani Willett, executive director of the Arizona State-focused Sun Angel Collective talks with SBJ’s Ben Portnoy about capitalizing on ASU’s College Football Playoff appearance: “We obviously were able to be a part of [the CFP], and now we have this national eye on us. The amount of people that have reached out and been like, ‘I have never watched an ASU game, but I saw this game, and now I’m cheering for the Sun Devils going forward,’ has been pretty significant.” Leading up to the expected July 1 implementation of the House settlement, Blueprint Sports CEO Rob Sine tells Portnoy: “This feels a lot like 2022 all over again. Everybody is trying to suddenly figure out, ‘Great, this law passed and now we can do NIL. Crap. Now what?’” If/when the settlement is implemented, Sine expects the 25 collectives his company operates to begin offering financial opportunities above the rev-share cap. “Very clearly, we’re the NIL marketing agency for athletic departments. The bottom line is we’re the group that’s going to go out and get that extra $3-7M that a school is going to want to really round out their budget.” For now, though, all parties agree there will be a lot of accelerated dealmaking in this six-month stretch. Willett: “The next six months we feel are pretty much the most important six months that we have been involved in.” (link)

Extra Points publisher Matt Brown examines how athletics and academics could be better integrated based on a paper published by Florida professor Molly Harry and North Carolina professor Erianne Weight. One method the professors advocate involves classes or specific curriculum targeted towards athletes. From the paper: “Some scholars envision a more comprehensive model, one that draws inspiration from performance art majors like music or theater. In this vein, athletics would be treated as an academic discipline, complete with courses in sport psychology, coaching principles, exercise physiology, community service, sport analytics, group dynamics, and biomechanics, among others. Such a curriculum could allow athletes to deeply engage with their sport as both a practice and a field of study, legitimizing the skills they develop and opening doors to academic credit for athletic participation.” Brown notes there are other options “beyond offering Football 301,” such as offering classes open to both student-athletes and non-athletes. “Off the top of my head, I know Michigan and Oklahoma State have offered for-credit classes about the NIL industry because I’ve helped provide information for their students. … While non-athletes can often take these sorts of classes to satisfy marketing, communication or business major requirements, the courses are typically designed with the needs and experiences of college athletes in mind.” Brown goes on to suggest schools and athletic departments ask themselves: “What are some of the day-to-day challenges that you currently use outside help to address? Could any of these potentially be done by students, even students outside your department? If your department is, say, spending too much money on software tool XYZ, how could the computer science department help?” Lots more. (link)

The American Association of Colleges and Universities, in partnership with the American Association of University Professors and NORC at the University of Chicago, conducted a national survey of higher ed faculty to understand their perspectives on and experiences with academic freedom. More than one-third of all faculty say they have less academic freedom today when it comes to teaching content without any interference (35%), speaking freely as citizens (36%), and speaking freely when participating in institutional governance (38%). Those who joined the faculty in 2017 or earlier are significantly more likely than those who joined in 2018 or later to say they have less academic freedom today when it comes to teaching content without interference (44% vs. 27%), speaking freely as citizens (44% vs. 23%), and speaking freely when participating in institutional governance (47% vs. 27%). Additionally, half of all respondents (50%) said that colleagues at their institutions are more careful today to avoid controversial topics when revising curricula. Significant percentages said colleagues in their academic program or department are less willing to express controversial views in their courses (39%), on social media (38%), and at professional conferences (30%). When gathering with colleagues at informal campus events or social gatherings, 61% of faculty have observed a tendency to avoid controversial topics. Full report. (link)

The UFC’s current deal with Disney expires at the end of this calendar year & Bloomberg’s Lucas Shaw reports the mixed-martial-arts league is looking for a new agreement worth over $1B annually. Notably from Shaw: “TKO CEO Ari Emanuel and President Mark Shapiro are taking the lead on the negotiations and believe they have at least four or five prospective buyers for the rights, (sources) said. They include Amazon.com Inc., Netflix Inc. and Warner Bros. Discovery Inc., which just lost the rights to the NBA, as well as Google’s YouTube, at least for the pay-per-view matches.” (link)

The NCPA, which spearheaded the effort to unionize athletes in the ongoing USC case, has submitted a motion to withdraw its charge against the NCAA and USC, per ESPN’s Dan Murphy, who notes Dartmouth basketball players recently withdrew the only other active NLRB case for unionization. (link)

NCPA Executive Director Ramogi Huma explains the group decided to pull its petition because of recent progress made in the effort to compensate college athletes. He also noted that five states, including California, now have statutes that allow schools to directly pay their athletes NIL money while prohibiting the NCAA or conferences from punishing them. “Together, these state laws and the change in respondents’ position on compensating its college athletes serve as powerful catalysts toward USC (and other universities) paying their football and basketball players fair compensation.” Sportico’s Daniel Libit adds: “Left unsaid in the motion for withdrawal was the consequence of the 2024 presidential election—the agency will likely take a much less favorable attitude towards college athlete employment under incoming president Donald Trump.” Libit also notes that an NCAA spokesperson says in a statement that "student-athlete leaders" from DI to DIII are opposed to college athletes gaining employee status and that the legality of the issue "can only be addressed by Congress." U.S. Senator Ted Cruz (R-TX) tells ESPN’s Dan Murphy he’s not interested in saving the NCAA but would rather give the association the legal runway it needs to save itself. “College sports is in crisis right now. If Congress doesn't act, we risk seeing devastation." Meanwhile, Senator Richard Blumenthal (D-CT) tells Murphy he’s working on a bipartisan effort with Cruz and Senators Jerry Moran (R-KS) and Cory Booker (D-NJ) and is close to finalizing a “very strong discussion draft” of a new bill. He adds: “The political stars seem to be aligning.” As part of the compromise, Blumenthal indicates the lawmakers are discussing a special carve-out for student-athletes that would allow them to collectively bargain without becoming employees. "That might be an option. Enabling collective bargaining without employment status certainly has to be taken seriously. We're talking about a variety of different possibilities." As for whether such legislation will create an even playing field, The Collective Association President Russell White says ADs will simultaneously create rules to establish competitive equity and brainstorm ideas to find a competitive advantage. "It might be the same meeting. Topic 1: Putting guardrails in place. Topic 2: Ways around the guard rails. They know they're going to have to find ways around these." More from Murphy. (link)

+ WSVN anchor Josh Moser reports former Georgia QB Carson Beck agreed to a $4M NIL package to sign with Miami (FL). “This is in line with the reported deal Tulane transfer QB Darian Mensah (2-year/$8M deal) signed with Duke. Different market this year considering Cam Ward was reportedly paid $1.5M last season.” (link)
+ Former Duke QB Maalik Murphy’s decision to transfer to Oregon State came as a surprise to Kentucky, where collective operators had offered Murphy a seven-figure deal, according to JohnCanzano.com’s namesake. One UK source tells him: “We were mostly worried about Auburn.” Canzano notes that Murphy “was familiar with several OSU coaches and liked the campus, but in today’s world – money talks. Oregon State’s NIL deal with Murphy: $1.5M in cash. Sources familiar with the agreement told me it contains even more upside. Believe what you’d like about the great locker room culture and the beautiful campus in Corvallis. After conversations with involved parties at the schools that lost out on Murphy, I’m convinced OSU’s financial package simply put the Beavers at the front of the line. Kyle Bjornstad, the head of the Dam Nation Collective, declined to comment on the specifics of Murphy’s NIL deal. He told me: ‘It’s not my dollar figure to share, but I can tell you he was a big get.’” Beavers HC Trent Bray tells Canzano that landing Murphy was about more than signing a QB. “The perception of us being the little brother who isn’t on the national, big-time stage has to stop. The guys we’ve been able to pull in prove we’re a national player. We deserve to be at the table. We’re going to be at the table.” (link)
+ Mega-agent Drew Rosenhaus explains on The Pat McAfee Show that rather than recruiting student-athletes out of college around their junior years, “now we’ve got to start with high school guys.” Rosenhaus notes his agency began representing Michigan DL Mason Graham, who is projected to be a top 10 pick in the NFL Draft, when he was a freshman for the Wolverines. Rosenhaus also points out that current NIL contracts are year-to-year, adding: “Players right now are professional football players in college. They’re getting new contracts every year, there is free agency every year, there is no salary cap, there are no rules. The ability to transfer is almost unlimited, guys are getting paid coming out of high school. I love it, I'm for the players…[but] in any system we need structure. Every other professional league has rules. We have a cap, we have a structure, we have a draft order, we have waivers, we have trade deadlines. This doesn't exist in college football, so it is very chaotic. But to get back to your question, a guy like Mason Graham, we started recruiting him as a freshman, and we were fortunate to sign him when his availability was up, but it doesn’t always work like that. … It’s kill or be killed. We’ve got to earn our business every day.” (link)
+ Oklahoma Governor Kevin Stitt has issued an executive order that will allow the state’s colleges and universities to facilitate direct payments to student-athletes for the use of their NIL. He explains that “this executive order ensures that these student-athletes have access to the same opportunities as their peers in other states. It’s about leveling the playing field and maintaining the competitive edge that defines Oklahoma athletics. This action is a critical step to protect Oklahoma’s student-athletes and ensures they have the opportunity to succeed on and off the field.” Oklahoma President Joseph Harroz and Oklahoma State President Kayse Shrum both voiced their support for the EO, with Harroz saying: “This action strengthens our ability to recruit, retain and cultivate extraordinary talent, positioning our student-athletes for success in every aspect of their lives.” (link)
+ State lawmakers in Illinois have introduced a bill that would amend the Student-Athlete Endorsement Rights Act, providing that if an athlete earns $250K+ from the use of their NIL, then any academic scholarship granted to them shall be reduced by $1 per dollar the athlete earns over $250K. + James Moore & Co. Partner Katie Davis shares “another IRS letter denying 501c3 status to NIL collective, explaining that promo/publicity provided to charities does not make you exempt as charitable because it provides substantial private benefit to athletes and that private benefit was intentional.” It is at least the sixth such letter sent by the IRS. As in the others, the name of the collective is redacted. (link)

Venu, we hardly knew you. ESPN, Fox and Warner Bros. Discovery are scrapping plans for the streaming service, effective immediately, explaining in a joint statement: “In an ever-changing marketplace, we determined that it was best to meet the evolving demands of sports fans by focusing on existing products and distribution channels. We are proud of the work that has been done on Venu to date and grateful to the Venu staff, whom we will support through this transition period.” The Athletic’s Andrew Marchand and Richard Deitsch note the “Fubo deal, plus a recent agreement between Disney and DirecTV to offer Disney’s streaming services in select packages, means those entities will be able to add ‘skinny bundles’ in sports that will be Venu Sports-esque, according to a source briefed on the reasoning. The fact that DirecTV and Dish indicated they could have interest in continuing the litigation that Fubo just ended also factored into shuttering Venu.” As for what comes next, Marchand writes: “ESPN will — likely in August — begin its own all-you-can-eat, direct-to-consumer service…that is currently expected to be priced in the $25-30 range. Fubo and DirectTV and maybe others will be able to hit the $50 limited sports bundle, while viewers could have a more traditional streamer, like Fubo or YouTubeTV for $80 that would include other channels.” Meanwhile, Puck’s Matthew Belloni suggests that ESPN might “supercharge the offering with Fox Sports, whose combo of the NFL and college football, World Series baseball, and much more would give Flagship more than $15B worth of sports rights in one service.” (link)
