The U.S. Department of Justice has filed a statement of interest in House v. NCAA, expressing concerns that the settlement "may not 'cure the ill effects of the illegal conduct'" as it "allows the NCAA…to continue fixing the amount" schools can pay for NIL, according to Boise State law professor Sam Ehrlich, who adds: “The DOJ is essentially asking Judge Wilken to either (1) sever the revenue sharing cap from the settlement; or (2) essentially allow the cap to be a subject of future litigation. Whoa.” (link); Full filing, which includes the following: “Although the Proposed Settlement raises the level at which those payments are capped, that cap remains determined by agreement among competing employers (Division I colleges and universities) and restrains competition among schools for payments above the cap. Not only does this enshrine, for ten years, an agreement among competitors to limit compensation, a facially anticompetitive restraint, but the NCAA may attempt to use the cap’s incorporation into a court-approved settlement as a shield against future antitrust actions seeking more complete injunctive relief. Accordingly, the United States respectfully requests that the Court (i) decline to approve the Proposed Settlement or, in the alternative, (ii) make clear that approval of the Proposed Settlement does not constitute a judgment of the competitive impact of the Salary Cap Rule or a determination that the Salary Cap Rule complies with the antitrust laws.” (link)

In response to the DOJ statement, Sportico’s Michael McCann: “My guess: the life expectancy on a DOJ statement of interest made on Jan. 17 is about 3 days. I doubt it has any sway on Judge Wilken and could be rescinded, too. If the DOJ had filed this last fall, it ‘might’ have had an impact. Now? It looks more like a move to get attention.” (link)

U.S. Senator Ted Cruz has released a statement to Yahoo’s Ross Dellenger calling the latest Title IX guidance a “great idea if Biden’s intent is to kill both men’s and women’s college sports. Mandating so-called equal pay when not all sports generate equal revenue will force some colleges out of athletics altogether. Everyone wants to be paid like Michael Jordan, but that’s not the way the world works. I predict this scheme will die on January 20th.” (link)

NCAA President Charlie Baker recognizes it might make sense for some governance changes when it comes to the Power 4, telling SBJ’s Ben Portnoy: “Let’s face it, everybody in the [Power 4] is going to be participating in institutional NIL. Not everybody in DI is going to be doing that, right? … They should be in a position to make decisions that might differ from what other people would choose to do within D-I.” Atlantic 10 Commissioner Bernadette McGlade, in discussing a recent document proposing that the P4 schools take over NCAA championships, says: “The decision is up to the [Power 4]. If they want to separate from the NCAA and become their own association under their umbrella of the CFP, they certainly have the wherewithal and the wealth to do so.” Illinois AD Josh Whitman adds: “Right now, we’re very much in the information gathering stage. What the SEC submitted is one of many proposals that has been put forward by a variety of different groups and that will be considered as part of the overall effort, along with the other ideas that have been introduced. It’s a process.” The document has stoked fear among some that the Power 4 taking over NCAA championships will disrupt March Madness, and NCAA SVP for Basketball Dan Gavitt remarks: “There’s a strong consensus that [the Equal Conference Fund] should remain. The [P4] commissioners have said, even with their interest in evolving the championships and the governance structure, that they don’t want to change the automatic qualification for conferences, and that they feel committed to that. But format and revenue distribution could be looked at, and ultimately it’ll be a decision by the membership and those above me. … We have to be open-minded and recognize what’s happening in another major sport.” (link)

Southern Miss Men’s Basketball student-athlete John Wade III is immediately eligible after reaching a settlement with the NCAA. Context from the Hattiesburg American: “Wade enrolled at UC Davis in 2018 but was not on the basketball team. He transferred to Contra Costa Community College (CCCAA) and joined its basketball team for the 2019-20 season. It did not hold a season in 2020-21 because of the COVID-19 pandemic. He then transferred to Cal State Northridge for the 2022-23 season but sat out because he said he was harassed by then-coach Trent Johnson. Wade transferred again to Cal State Stanislaus (DII) last season. The NCAA argued that Wade was ineligible because his five-year eligibility clock began when he was at UC Davis, even if he wasn't on the basketball team.” (link, link)

New Hawaii President Wendy Hensel hopes to have a new permanent AD in place by the summer and told the UH Board of Regents: “In anticipation of this I’ve had some initial conversations to start identifying who in the community are the right people to sit on this search committee. My hope is we will have somebody in place by the end of the summer — if we’re lucky, at the beginning of the summer. It just depends on how quickly this can all move forward with the important steps we need to take on community input. We will start immediately.” Board member and former Hawaii Governor Neil Abercrombie remarked at the meeting that the new AD should be a contracted rather than at-will employee and also called for the university to utilize a search firm. “When you hire a search firm you’re going to get a deeper, I think, list of possible candidates and it’ll be geographically I think a little more complete than the last one.” Hensel appeared to agree, saying: “There are search firms that specialize in this and have specialized teams that do this type of work. We will certainly reach out to them and begin expeditiously. Our goal is to be as transparent as possible with the community throughout. So I look forward to working with all of you and we’ll get started.” (link)

Indiana eliminated 25 positions this week, including 12 that were open and will not be filled, in preparation for revenue-sharing. According to the Indianapolis Star’s Michael Niziolek and Zach Osterman, Hoosiers Deputy AD/SWA Mattie White is among those being laid off. They add: “According to a source with knowledge of the layoffs, the athletic department isn’t planning on cutting any sports. Additionally, there were no cuts to any of the various teams’ coaching staffs or personnel and the department isn’t asking employees to take pay cuts. … The Herald-Times and IndyStar understand [Hoosiers AD Scott] Dolson has been working aggressively both internally and externally to streamline costs while opening new revenue streams. Indiana’s shift to third-party vendors Legends (apparel) and Levy (hospitality and concessions) were both designed to improve the department’s overall financial position.” (link)

NJ Advanced Media’s Brian Fonseca and Steve Politi unpack Lowenstein Sandler’s investigation results concerning the conduct of former Rutgers AD Pat Hobbs and Scarlet Knights Gymnastics HC Umme Salim-Beasley. The report on the investigation, which was released today, found Salim-Beasley “lost control” of her program and “at times, presided over a divided and dysfunctional organization,” that “her conduct clearly wounded many of (the gymnasts) in significant ways” and that there was “no reasonable doubt that the gymnasts responses were sincere.” Additionally, Salim-Beasley was having an undisclosed relationship with Hobbs that violated University policy, the report concluded “based on the aggregate, available evidence.” The report, which cost Rutgers $705K, did not recommend whether the university should hand down any disciplinary action against Salim-Beasley; however, she was placed on paid administrative leave Friday while, per the school, “we continue to review and consider the findings of the investigation and appropriate next steps that are in the best interest of our student-athletes, the gymnastics program, and the University moving forward.” Also from the report: “Multiple Athletics officials and other University staff perceived that there appeared to be a relationship of some kind between Salim-Beasley and Hobbs,” causing issues and “two high-ranking Athletics employees each independently confronted Hobbs about it.” Fonseca and Politi note that “when confronted by investigators, Hobbs refused to cooperate and Salim-Beasley refused to answer questions about the relationship, even though her contract demands that she cooperate fully with any university probe.” Lots more. Oklahoma State AD Chad Weiberg in a letter to fans writes: "Oklahoma State remains determined to compete for championships in the Big 12 Conference and at the highest levels of college athletics. To do so, we will need to have access to an additional $20.5M annually. … We will take a hard look at our operating expenses. If something doesn’t improve our competitiveness, recruiting or generate revenue, it will be reviewed. Campus support will be key. President [Kayse] Shrum has been a leader in supporting OSU Athletics throughout conference realignment and our shifting landscapes. She, along with our Board of Regents, believes in the value of athletics in the campus experience and OSU’s mission. As always, our alumni, donors and fans control our destiny. + South Carolina inks Women’s Basketball HC Dawn Staley to a new deal that will pay her $4M annually and will increase by $250K every year until it ends in 2030. The contract also includes a $500K signing bonus, which brings its total value to $25.25M. The agreement makes Staley the highest paid coach in women’s basketball, surpassing LSU HC Kim Mulkey, who earns $3.2M per year. If Staley leaves the Gamecocks before the end of the deal, she would be required to pay the school a departure fee equivalent to the compensation remaining on the contract. The buyout would not apply if she departs for an HC or AC gig in the NBA or the WNBA. This clause was not included in Staley’s previous contract. (link, link)

The NCAA Board of Governors reviewed the results of the 2023-24 attestation cycle of the NCAA Policy on Campus Sexual Violence. In 2023-24, zero schools attested late, compared with 21 doing so in 2022-23. Additionally, 13 schools failed to attest in 2022-23, compared with four in 2023-24. The board credited the improvement to changes made to streamline and simplify the process for schools, as well as membership feedback. Baylor President/Board Chair Linda Livingstone: "The Board of Governors is encouraged by the positive response from our member schools in meeting the attestation requirements. The enhancements in our process have clearly made a difference, and we will continue to support our institutions in maintaining these high standards." The Sun Belt has issued a public reprimand and a $100K fine to Marshall for opting out of its bowl game in December. “While the conference acknowledges the medical model and best practice guidance adhered to by Marshall, as well as their fundamental concern for the health and safety of the remaining eligible student-athletes to compete in a safe and viable manner, the nature and timing of this decision was detrimental to the Sun Belt Conference and its membership, to Army, the Radiance Technologies Independence Bowl, the American Athletic Conference and ESPN.” (link)

North Florida has unveiled renovations to the weight room and Buster Browning Athletic Training Room at Hodges Stadium. The Buster Browning Athletic Training Room was outfitted with upgraded flooring, treatment tables, therapeutic modalities and a completely renovated HydroTherapy Room, while the weight room has been newly equipped with state-of-the art strength and conditioning equipment that includes eight Sorienx Power Racks, upgraded rubber bumper plates and PLAE flooring with eight inlaid platforms. + Sportico's Daniel Libit: "In a nine-page 'fact sheet' released Thursday, Office Civil Rights clarified that, under Title IX, NIL money paid to college athletes should be held to the same gender-equity standards as athletic scholarships. Specifically, it stated that the amounts paid to athletes through NIL deals should be considered part of a school's athletic financial assistance, just as grants-in-aid and cost-of-attendance funds are. [...] OCR further stressed that even when NIL payments are made by third parties, such as booster clubs or collectives, schools remain responsible for ensuring that these funds do not create sex-based disparities." They've built an incredible team of front executives that I think are poised for sustained growth, and Elevate will empower us to kind of optimize our search processes and strategies through advanced data insight and technology while also benefiting from their exceptional network within the ecosystem.” Marks explains that “as we think of continuing to drive ways to add value back to our partners…we wanted to build a best-in-class search and talent organization. We researched the space heavily, and Kyle and Bowlsby Sports Advisors have built a tremendous brand across the space and credibility and reputation that we think fits extremely well inside of what elevate has already built.” Bowlsby goes on to note that “I think [this] makes us a unique offering in the marketplace in the fact that we're not going to just get to know candidates in the next wave of talent via search, but we're getting to know these individuals through true partnerships, and we're going to get to know them at an early point in their careers. That actually aligns with the model that we've had the last four-and-a-half years because our niche has been really getting in on Olympic sports searches, getting in at lower level mid-major searches and getting to know the next wave of talent in this business.” (link)

Sports Illustrated’s Pat Forde examines the potential impact of the Power 4’s recent working document which included a proposal to take control of NCAA championships and gets this from one administrator: “We can’t kill the golden goose, the national treasure. Do. Not. Mess. With. The. Tournament.” Yet, there are other ways for the Power 4 leagues to get what they want, and Forde advises the remaining 28 conferences to be on the lookout for “a push to expand the men’s and women’s basketball tournaments past the current 68, to 72 or 76 (for starters). … At this point, it seems close to inevitable. And guess who the power leagues would expect to see inhaling those extra bids? Themselves, of course.” Additionally, “how the teams are selected and seeded—and by whom—could also be up for review. The administrator I spoke to favors leaning more on metrics, putting all the Top 50 teams in the NCAA NET ratings in the field. Using the NET ratings for this season as of Wednesday, this would be the breakdown by conference for the men’s tournament: 14 from the SEC, 11 from the Big Ten, nine from the Big 12, six from the ACC, three from the Big East, three from the Mountain West, two from the WCC, one from the American and one from the Big West. That’s nine leagues. To make that math work and still include the champions of every conference, the bracket would have to expand to at least 76.” Lots more. (link)

SEC Commissioner Greg Sankey: “It is an interesting conversation, but there is a lot that needs to be understood. Why is this the right idea? Can the NCAA actually escape its waiver-granting behavior? Will schools stop seeking waivers? What is the relationship of this proposed change to the current legal environment—does it resolve issues or create more concerns? How does a five-year eligibility model change access to college athletics opportunities for students entering from high school? These and other questions need to be answered during a continuing conversation on the five-year eligibility idea.” ACC Commissioner Jim Phillips: “Is this good for student-athletes? Will our institutions have the discipline not to seek waivers, legal measures? What does it do to high school seniors and the roster compression they have felt throughout COVID? Certainly, we should discuss as we look to the future but I am certainly not ready to endorse at this moment.” (link)

On Thursday, the NCAA Division I Council approved legislation allowing college baseball programs to ramp up their preparation time to 27 practices over a 35-day period leading up to Opening Day. This marks an increase over the previous rule in place, which was essentially 18 practices over 21 days. The adopted legislation will go into effect on August 1 of this year. (link)

Florida Men’s Basketball AC Taurean Green is alleged to have sexually assaulted a woman who is an athletics department employee in March of last year during “a meeting with her in the athletic facilities,” per ESPN’s Paula Lavigne. The allegation was brought forward as part of the university’s Title IX investigation into claims surrounding Gators HC Todd Golden: “She said that inquiry made her realize there could be concerns about a pattern of behavior and other women could be affected.” More. Nevada Sports Net’s Chris Murray has obtained a “heavily redacted” copy of UC Davis’ agreement to join the Mountain West. Among the deal points that are included is UC Davis’ first right of consideration/application if the MW elevates a football program from the FCS level. Murray notes that “could complicate the MW attempting to add a different FCS school like North Dakota State, South Dakota State, Montana, Montana State or Sacramento State, although the MW is under no obligation to select UC Davis for elevation for full-member status, including football.” Additionally, UC Davis will get a phased-in share of the MW's NCAA Tournament units, starting with one-sixth share of those units in 2026-27, a two-sixth share in 2027-28 and so on by a one-sixth share each year until getting full-share status in 2031-32. For each NCAA Tournament unit earned by UC Davis, it will increase its share by one-sixth. UC Davis would owe the MW $3M if it does not join the conference in 2026. The Aggies also agreed to increase the annual men's basketball expenses to certain financial levels in 2026-27, 2027-28 and 2028-29; those specific benchmarks were redacted. Tulsa World’s Michael Peters takes a look at the Tulsa football personnel operation under new HC Tre Lamb and GM Mason Behiel. Peters notes Behiel is “managing a budget of somewhere between $2.5M and $3M that TU has to compensate its football roster. That figure is a combination of money the school provides for NCAA allowable payments like revenue-sharing, scholarships, cost of attendance and academic achievement awards, as well as money from the independent NIL collective.” Lamb says Golden Hurricane AD Justin Moore “has implemented all this, and he’s got a great plan. This is very similar to what the big boys do at the Southeastern Conference and the Big Ten. That’s what we want this to look like.” Lamb estimates as much as 80% of the TU roster will still rely on the standard athletic scholarship as its main source of compensation. He plans to pay starters who stuck through the coaching change and likely some transfers because “North Texas, Memphis, Tulane, UTSA and UAB are the schools we’re seeing the most in recruiting, and those guys are throwing $60K, $70K at these guys, so we’ve got to be able to compete.” As for Behiel’s role, Lamb explains: “He’s like the guy playing moneyball, trying to fit the pieces to the puzzle in the right spots. But he’s a separator and the liaison with the collective, with the administration for revenue-sharing and the head coach and staff. So we wanted there to be a clear separation there so it doesn’t get dirty and cloudy.” (link)

Texas Tech’s 20-year stadium naming-rights agreement with AT&T runs through June 2026 and the next rights will be open for bidding. Red Raiders AD Kirby Hocutt: “We have started initial conversations on naming rights to Jones AT&T Stadium. We've had initial conversations with AT&T and look forward to ongoing conversation there, so that will be an ongoing, or you could say, a new revenue stream, because AT&T's sponsorship payment was all done up front. So it's been 15-plus years since we've had a revenue stream there, so that'll be a new revenue stream for us.” The stadium name switched from Jones SBC Stadium to Jones AT&T Stadium in April 2006 after SBC acquired AT&T in 2005. The original agreement with SBC in 2000 was a 20-year naming for $20M, paid out over 10 years and an extension with AT&T, finalized in 2007, was a 20-year naming for $21M, paid out over six years. Deputy AD Jonathan Botros notes that “In addition to the naming of the stadium. They also have a sponsorship package that includes exclusivity, so no other telecom partner can partner with us, so there's a lot of value there.” (link)
