NCAA President Charlie Baker sits down with Sports Illustrated/Connect's Bryan Fischer at the 2025 NCAA Convention to dive into the latest with the House settlement, efforts in Washington, D.C., his future in the role and much more, including whether there’s a plan if the House settlement is not approved. Asked whether he believes collective bargaining could occur under his leadership, Baker says it’s “really not my call” and adds: “Nothing in this space happens all at once. It all ends up being incremental. You can push it as hard as you want. I certainly talked about creating some sort of a framework like this over a year ago, and I'm thrilled with where we are with regard to that…but I think fundamentally I'm kind of where – believe it or not – where [NCPA Executive Director] Ramogi Huma was, which is let's get the settlement done and then let's see what happens after that.” Baker also describes his goal for college sports overall post-House: “I don't want kids to have to rely on text messages from anybody to determine whether or not somebody who's offering them something is real. I don't want kids to be in a position where they feel like they're being lied to or discover they're being lied to after the fact. I want the primary relationship between a young person and a school to be the primary relationship so that schools have an obligation and a responsibility to help those young people not only advance on the field, but also in the classroom and in their own personal development. … I also want to see us be in a place and in a time where people believe there’s accountability and transparency.” Baker on his work in D.C.: “[The] big message I got from Washington [D.C.] when I first started visiting with people [from Congress] was: ‘Clean up your own house and then come talk to us.’ And that was code for ‘Deal with the post-eligibility insurance stuff, do something about additional benefits in some sort of model that looks like the one where we're working with the courts and with the A4 on, and then if you want to come talk to us, come talk to us.’” With the patchwork of state laws and lawsuits continuing to pop up, Baker says the message is starting to resonate with federal lawmakers that “on some issues there probably needs to be a national standard. They probably ought to deal with the employment question, they probably ought to deal with the NIL piece, and they’ve really got to give the NCAA the ability to at least make reasonable rules and have them stick.” (link)

Closing Time in Nashville:

+ The DII Management Council will allocate $2.8M in surplus funds from 2023-24, with $2.2M going to member institutions who will receive around $8K each. Most of the remaining $600K will go towards “various championship items, including joint championship events.” DII Executive Board Chair/Goldey-Beacom President Colleen Perry Keith: “The $2.2 million supplemental distribution will provide much-needed financial support to our member institutions, allowing them to continue their mission of providing a balanced and enriching collegiate experience. Additionally, the investment in championship items, including joint championship events, reflects our dedication to celebrating the achievements of our student-athletes.” The council also approved noncontroversial legislation to eliminate academic-year-in-residence starting August 1, increase major infractions accountability for individuals involved in such cases, create an exception for “limited sports betting violations,” and more. The division will also be sending out a comprehensive membership survey next week to help develop its next strategic plan that would begin January 2026. (link)

+ The DII membership approved seven legislative proposals during today’s business session, with one proposal being moot due to the adoption of an all-sport change allowing student-athletes to compete in up to 30% of competitions during their initial year of enrollment and retain that year of eligibility. + The NCAA makes it official, announcing women’s wrestling as its 91st championship sport. NCAA President Charlie Baker: "We are thrilled that women's wrestling will be an NCAA sport, making it the 91st championship that we host. We extend a big thank you to everyone who supported this effort and the athletes, coaches and fans for their passion for a fast-growing and exciting sport that brings even more opportunities for women to participate in athletics." + GSC Commissioner Matt Wilson on the passing of Football AQs: “According to the NCAA Division II staff and governance committees, this will lead directly to expansion of the bracket to 32 teams. I’m excited to see this happen as early as possible but certainly no later than Fall 2026.” (link)

+ The NCAA Board of Governors reviewed the results of the 2023-24 attestation cycle of the NCAA Policy on Campus Sexual Violence. In 2023-24, zero schools attested late, compared with 21 doing so in 2022-23. Additionally, 13 schools failed to attest in 2022-23, compared with four in 2023-24. The board credited the improvement to changes made to streamline and simplify the process for schools, as well as membership feedback. Baylor President/Board Chair Linda Livingstone: "The Board of Governors is encouraged by the positive response from our member schools in meeting the attestation requirements. The enhancements in our process have clearly made a difference, and we will continue to support our institutions in maintaining these high standards." Title IX-NIL Guidance:

+ Sportico's Daniel Libit: "In a nine-page 'fact sheet' released Thursday, Office Civil Rights clarified that, under Title IX, NIL money paid to college athletes should be held to the same gender-equity standards as athletic scholarships. Specifically, it stated that the amounts paid to athletes through NIL deals should be considered part of a school's athletic financial assistance, just as grants-in-aid and cost-of-attendance funds are. [...] OCR further stressed that even when NIL payments are made by third parties, such as booster clubs or collectives, schools remain responsible for ensuring that these funds do not create sex-based disparities." + NCAA President Charlie Baker on if he believes the guidance will remain under the Trump Administration: “That process usually takes a while for all the elements that are usually associated with the turnover in administration. Some stuff happens right away, some stuff happens later and some stuff never changes at all.” (link)

+ NCAA Board of Governors Chair/Baylor President Linda Livingstone: “Because it is Title IX, in many ways it is a school level issue — conferences or the NCAA don’t typically give guidance on it. We’re going to all have to, as schools, go back and see what we think are the implications are for what we’re doing.” (link)

+ Illinois AD Josh Whitman, who is on the NCAA Board of Governors: “We need some time to read, digest and understand it. This whole thing has been an exercise for us in contingency planning. The world has changed over and over just in the last six months. We’ve been building plans on top of plans for some time now and this is just the most recent example of where we’re going to need to take some new guidance under advisement and figure out what if any changes we need to make to the strategy we developed.” (link)

+ House case co-counsel Jeffrey Kessler to Sportico: “This has no impact on the settlement at all. The injunction does not require the schools to spend the new compensation and benefits that are permitted to any particular group of athletes and leaves Title IX issues up to the schools.” (link)

+ ESPN’s David Hale gets this: “...admins knew this was a possibility all along, but I doubt it’ll change any immediate plans for rev share distribution. As 1 admin told me, ‘We’re gonna get sued either way. Better to get sued with a winning football program than a losing one.’” (link)

The U.S. Department of Justice has filed a statement of interest in House v. NCAA, expressing concerns that the settlement "may not 'cure the ill effects of the illegal conduct'" as it "allows the NCAA…to continue fixing the amount" schools can pay for NIL, according to Boise State (DI) law professor Sam Ehrlich, who adds: “The DOJ is essentially asking Judge Wilken to either (1) sever the revenue sharing cap from the settlement; or (2) essentially allow the cap to be a subject of future litigation. Whoa.” (link); Full filing, which includes the following: “Although the Proposed Settlement raises the level at which those payments are capped, that cap remains determined by agreement among competing employers (Division I colleges and universities) and restrains competition among schools for payments above the cap. Not only does this enshrine, for ten years, an agreement among competitors to limit compensation, a facially anticompetitive restraint, but the NCAA may attempt to use the cap’s incorporation into a court-approved settlement as a shield against future antitrust actions seeking more complete injunctive relief. Accordingly, the United States respectfully requests that the Court (i) decline to approve the Proposed Settlement or, in the alternative, (ii) make clear that approval of the Proposed Settlement does not constitute a judgment of the competitive impact of the Salary Cap Rule or a determination that the Salary Cap Rule complies with the antitrust laws.” (link)

Simon Fraser has rolled out a new strategy for athletics, which includes the final decision to discontinue Football. From the university: “Through continual review and improvement of all activities, the strategy calls on leadership to ensure the long-term sustainability of the department and its programs. Highlights of the new strategy include a stronger commitment to recreation programs to benefit all SFU students and efforts to encourage the SFU community to experience varsity games as part of university life. […] In addition, like universities and colleges across the country, Simon Fraser University is facing an uncertain financial climate. While these challenges are recent – and do not impact the university’s decision on football – they do reinforce the need for stronger financial prudence across all aspects of the university including Athletics & Recreation.” (link, link - full strategy)

The National Student Clearinghouse Research Center announces that a “methodological error” affected its previous calculation of the number of first-year students enrolling this past fall. In October, the center’s annual preliminary report stated that freshman enrollment had declined by 5% compared with the fall of 2023, marking the first drop since the start of the pandemic. In actuality, freshman enrollment increased, but Executive Director Doug Shapiro declined to specify by how much. The methodological error, Shapiro explained, “caused the mislabeling of certain students as dual-enrolled rather than as freshmen, and as a result, the number of freshmen was undercounted, and the number of dual-enrolled was overcounted. … The Research Center will release its Current Term Enrollment Estimates report on January 23 – this report is not based on preliminary data, encompasses nearly all institutions of higher education, and uses different methodologies to determine freshman enrollees.” (link, link)
