Another first-ever legal situation as Wisconsin-to-Miami (FL) football student-athlete Xavier Lucas says he will enroll in Coral Gables without entering the transfer portal. Yahoo’s Ross Dellenger with context: “The move, for now, avoids a legal filing. (Lucas’ attorney Darren) Heitner had planned to file suit against the NCAA and Wisconsin over antitrust claims related to the situation, accusing Wisconsin of blatantly violating NCAA rules by not inserting Lucas’ name into the portal as he requested and questioning the legality of the NCAA’s transfer portal. Wisconsin officials have remained quiet on the situation. However, the school is declining to enter Lucas into the portal as he signed a two-year revenue-share agreement last month before requesting a transfer.” Hanging in the balance is the Big Ten-templated agreement Lucas inked with the Badgers that precludes his NIL to be used by any other school. Heitner points to extenuating circumstances, including a life-threatening illness suffered by Lucas’ father, that should have led to Lucas going into the portal in common fashion. The NCAA added a statement to the situation: “NCAA rules do not prevent a student-athlete from unenrolling from an institution, enrolling at a new institution and competing immediately.” Lots more. House case plaintiff attorney Steve Berman on yesterday’s Department of Justice statement of interest, in part, “Where has the DOJ been the last 20 years while we have been fighting this battle - nowhere. And now they wish to block what was zero revenue sharing that will be tens of billions - shame on them.” (link)

Sportico’s Michael McCann writes on the DOJ’s move: “In addition to the lateness of this filing and the fact that Trump’s DOJ isn’t bound by it, it is also important to remember that a settlement reflects a give-and-take. As their attorneys have implied during court hearings, the NCAA and the power conferences wouldn’t have agreed to settle if the result was an unrestrained free market for college sports. The $21 million cap reflects that bargain. It is a cost control that made a settlement sensible for the NCAA and its president, Charlie Baker. It also made sense for the players’ attorneys. They might have won the cases and forced a free market, but the litigation would have been tied up in appeals for many years. They might have also lost, which is a point that is often overlooked—just because Wilken found the NCAA’s defenses unpersuasive, doesn’t mean a jury would.” More. (link)

The Supreme Court unanimously upheld the government’s upcoming ban on TikTok. The Protecting Americans from Foreign Adversary Controlled Applications Act is set to take effect on Sunday and makes it unlawful for American companies to distribute TikTok unless the U.S. operation of TikTok is severed from Chinese control. The Act is tantamount to a ban since there is no near-term plan for such a separation. Sportico’s Michael McCan notes that in a per curiam opinion—which is Latin for “by the Court” and is used when the author isn’t identified—the Court held the Act “satisfies constitutional scrutiny under the First Amendment. Among the reasons cited is that the ban is content neutral, meaning it does not target speech based on a particular viewpoint or position. Instead, the ban reflects ‘a foreign adversary’s control over the platform.’” President Biden, according to the Associated Press, will not enforce the ban on Sunday and will leave questions of enforcement to incoming President Donald Trump. McCann notes that “Trump on Friday posted on Truth Social that he and Chinese President Xi Jinping had a ‘very good’ call. Trump said he expects to work with his counterpart on solving problems, including TikTok. Reading between the lines, it seems like TikTok going into hibernation on Sunday might not be a long-term slumber.” (link)

New Lehigh AD Jeremy Gibson was officially introduced yesterday in Bethlehem: “Lehigh has the ability and strength and the foundation to do athletics and to do it in a way that few other institutions in this country are willing to do, and I’m really proud to be able to step into this role with the responsibility and trust to carry forward all the great things that have been said about this program. Whatever the landscape looks like, there are going to be opportunities for schools to do things the right way. And if our values are aligned with what I think they should be, President [Joseph] Helble and the board of trustees will collectively make the right decisions. [...] We’re going to decide what is going to make us great and how we’re going to measure greatness. We’re going to pursue it, but we’re going to pursue it the right way.” (link, link)

An anonymous group of business people, which calls itself the Community for a Stronger NMSU and consists of many individuals with active relationships with New Mexico State and its athletic department, has delivered a “Memorandum of Concern” to the office of President Valerio Ferme and the NMSU Board of Regents. In part, the group stated the decision to fire AD Mario Moccia “with cause” — which would withhold more than $1M remaining on Moccia’s employment contract — was not only unjust, but has created great concern in Ferme’s ability to run the university and could affect donor support. Notably, the group is not advocating for Moccia to be reinstated. More from the Albuquerque Journal’s Geoff Grammer: “The letter’s authors are advocating the ‘with cause’ determination be withdrawn and also ‘strongly urge’ Ferme to ‘respect the history and culture’ of NMSU and to ‘repair the relationship between (NMSU) and its stakeholders.’ The letter warns Ferme his every decision will now be ‘under intense scrutiny’ because ‘the community now questions (his) ability to make sound, well-informed decisions.’” (link)

Northern Illinois AD Sean Frazier suggests the implementation of a buyout clause in agreements with student-athletes that could serve as a buffer for non-Power 4 departments: “From the G5 perspective, we’re fine with the developmental side of things. There’s a certain level of respect there. But this could help institutions like us, where there’s a flat fee, or dollar amount, that’s a show of appreciation for the development of the game. [...] This is one of the guardrails that could get us to the point of acknowledging that, yes, you still can buy your team, but it shouldn’t be the wild, wild west.” (link)

Betting integrity firms are investigating Tuesday's men's college basketball game between Eastern Michigan and Central Michigan after multiple sportsbooks reported unusual wagering activity. Integrity Compliance 360 distributed an alert to its clients stating that a bettor had attempted to place "their largest wager to date" on CMU to cover the spread in the first half. The alert, in part: "While investigating, the operator also found two other high stakes wagers from two accounts in a different jurisdiction, both on Central Michigan 1st Half spread.” The alert further noted that Tuesday's game was the second involving EMU to be flagged by sportsbooks this season. IC360 also sent an alert regarding suspicious betting activity on a Wright State-EMU game on Dec. 21. In both instances, the suspicious betting was against the Eagles. A statement out of Ypsilanti: “We became aware of the matter on Wednesday and a review is underway. At this time we do not know anything further about what may have precipitated the suspicious activity. We are working with the Mid-American Conference and will provide further details as we learn additional information.” The suspicious activity happened in Connecticut and Tennessee. (link)

Illinois announces a $1M gift from the Irwin Family Foundation in support of the Fighting Illini Center for Excellence (FICE), located in the Northeast Tower of Memorial Stadium. This gift increases the total amount of donations to the university from the IFF to more than $25M over the last four decades. The FICE renovations include the addition of the latest AV experiences, an open layout with glass-faced perimeter spaces for natural light, study and lounge areas, small collaboration rooms, a group study room, a lecture/conference space and individual tutor and office spaces. There is a separate Todd & Anne Klipp Video Room, which will be utilized by both men’s and women’s hoops teams. The U.S. Department of Justice has filed a statement of interest in House v. NCAA, expressing concerns that the settlement "may not 'cure the ill effects of the illegal conduct'" as it "allows the NCAA…to continue fixing the amount" schools can pay for NIL, according to Boise State law professor Sam Ehrlich, who adds: “The DOJ is essentially asking Judge Wilken to either (1) sever the revenue sharing cap from the settlement; or (2) essentially allow the cap to be a subject of future litigation. Whoa.” (link); Full filing, which includes the following: “Although the Proposed Settlement raises the level at which those payments are capped, that cap remains determined by agreement among competing employers (Division I colleges and universities) and restrains competition among schools for payments above the cap. Not only does this enshrine, for ten years, an agreement among competitors to limit compensation, a facially anticompetitive restraint, but the NCAA may attempt to use the cap’s incorporation into a court-approved settlement as a shield against future antitrust actions seeking more complete injunctive relief. Accordingly, the United States respectfully requests that the Court (i) decline to approve the Proposed Settlement or, in the alternative, (ii) make clear that approval of the Proposed Settlement does not constitute a judgment of the competitive impact of the Salary Cap Rule or a determination that the Salary Cap Rule complies with the antitrust laws.” (link)

I doubt it has any sway on Judge Wilken and could be rescinded, too. If the DOJ had filed this last fall, it ‘might’ have had an impact. Now? It looks more like a move to get attention.” (link)

U.S. Senator Ted Cruz has released a statement to Yahoo’s Ross Dellenger calling the latest Title IX guidance a “great idea if Biden’s intent is to kill both men’s and women’s college sports. Mandating so-called equal pay when not all sports generate equal revenue will force some colleges out of athletics altogether. Everyone wants to be paid like Michael Jordan, but that’s not the way the world works. I predict this scheme will die on January 20th.” (link)

NCAA President Charlie Baker recognizes it might make sense for some governance changes when it comes to the Power 4, telling SBJ’s Ben Portnoy: “Let’s face it, everybody in the [Power 4] is going to be participating in institutional NIL. Not everybody in DI is going to be doing that, right? … They should be in a position to make decisions that might differ from what other people would choose to do within D-I.” Atlantic 10 Commissioner Bernadette McGlade, in discussing a recent document proposing that the P4 schools take over NCAA championships, says: “The decision is up to the [Power 4]. If they want to separate from the NCAA and become their own association under their umbrella of the CFP, they certainly have the wherewithal and the wealth to do so.” Illinois AD Josh Whitman adds: “Right now, we’re very much in the information gathering stage. What the SEC submitted is one of many proposals that has been put forward by a variety of different groups and that will be considered as part of the overall effort, along with the other ideas that have been introduced. It’s a process.” The document has stoked fear among some that the Power 4 taking over NCAA championships will disrupt March Madness, and NCAA SVP for Basketball Dan Gavitt remarks: “There’s a strong consensus that [the Equal Conference Fund] should remain. The [P4] commissioners have said, even with their interest in evolving the championships and the governance structure, that they don’t want to change the automatic qualification for conferences, and that they feel committed to that. But format and revenue distribution could be looked at, and ultimately it’ll be a decision by the membership and those above me. … We have to be open-minded and recognize what’s happening in another major sport.” (link)

Southern Miss Men’s Basketball student-athlete John Wade III is immediately eligible after reaching a settlement with the NCAA. Context from the Hattiesburg American: “Wade enrolled at UC Davis in 2018 but was not on the basketball team. He transferred to Contra Costa Community College (CCCAA) and joined its basketball team for the 2019-20 season. It did not hold a season in 2020-21 because of the COVID-19 pandemic. He then transferred to Cal State Northridge for the 2022-23 season but sat out because he said he was harassed by then-coach Trent Johnson. Wade transferred again to Cal State Stanislaus (DII) last season. The NCAA argued that Wade was ineligible because his five-year eligibility clock began when he was at UC Davis, even if he wasn't on the basketball team.” (link, link)

New Hawaii President Wendy Hensel hopes to have a new permanent AD in place by the summer and told the UH Board of Regents: “In anticipation of this I’ve had some initial conversations to start identifying who in the community are the right people to sit on this search committee. My hope is we will have somebody in place by the end of the summer — if we’re lucky, at the beginning of the summer. It just depends on how quickly this can all move forward with the important steps we need to take on community input. We will start immediately.” Board member and former Hawaii Governor Neil Abercrombie remarked at the meeting that the new AD should be a contracted rather than at-will employee and also called for the university to utilize a search firm. “When you hire a search firm you’re going to get a deeper, I think, list of possible candidates and it’ll be geographically I think a little more complete than the last one.” Hensel appeared to agree, saying: “There are search firms that specialize in this and have specialized teams that do this type of work. We will certainly reach out to them and begin expeditiously. Our goal is to be as transparent as possible with the community throughout. So I look forward to working with all of you and we’ll get started.” (link)

Indiana eliminated 25 positions this week, including 12 that were open and will not be filled, in preparation for revenue-sharing. According to the Indianapolis Star’s Michael Niziolek and Zach Osterman, Hoosiers Deputy AD/SWA Mattie White is among those being laid off. They add: “According to a source with knowledge of the layoffs, the athletic department isn’t planning on cutting any sports. Additionally, there were no cuts to any of the various teams’ coaching staffs or personnel and the department isn’t asking employees to take pay cuts. … The Herald-Times and IndyStar understand [Hoosiers AD Scott] Dolson has been working aggressively both internally and externally to streamline costs while opening new revenue streams. Indiana’s shift to third-party vendors Legends (apparel) and Levy (hospitality and concessions) were both designed to improve the department’s overall financial position.” (link)

NJ Advanced Media’s Brian Fonseca and Steve Politi unpack Lowenstein Sandler’s investigation results concerning the conduct of former Rutgers AD Pat Hobbs and Scarlet Knights Gymnastics HC Umme Salim-Beasley. The report on the investigation, which was released today, found Salim-Beasley “lost control” of her program and “at times, presided over a divided and dysfunctional organization,” that “her conduct clearly wounded many of (the gymnasts) in significant ways” and that there was “no reasonable doubt that the gymnasts responses were sincere.” Additionally, Salim-Beasley was having an undisclosed relationship with Hobbs that violated University policy, the report concluded “based on the aggregate, available evidence.” The report, which cost Rutgers $705K, did not recommend whether the university should hand down any disciplinary action against Salim-Beasley; however, she was placed on paid administrative leave Friday while, per the school, “we continue to review and consider the findings of the investigation and appropriate next steps that are in the best interest of our student-athletes, the gymnastics program, and the University moving forward.” Also from the report: “Multiple Athletics officials and other University staff perceived that there appeared to be a relationship of some kind between Salim-Beasley and Hobbs,” causing issues and “two high-ranking Athletics employees each independently confronted Hobbs about it.” Fonseca and Politi note that “when confronted by investigators, Hobbs refused to cooperate and Salim-Beasley refused to answer questions about the relationship, even though her contract demands that she cooperate fully with any university probe.” Lots more. Oklahoma State AD Chad Weiberg in a letter to fans writes: "Oklahoma State remains determined to compete for championships in the Big 12 Conference and at the highest levels of college athletics. To do so, we will need to have access to an additional $20.5M annually. … We will take a hard look at our operating expenses. If something doesn’t improve our competitiveness, recruiting or generate revenue, it will be reviewed. Campus support will be key. President [Kayse] Shrum has been a leader in supporting OSU Athletics throughout conference realignment and our shifting landscapes. She, along with our Board of Regents, believes in the value of athletics in the campus experience and OSU’s mission. As always, our alumni, donors and fans control our destiny. + South Carolina inks Women’s Basketball HC Dawn Staley to a new deal that will pay her $4M annually and will increase by $250K every year until it ends in 2030. The contract also includes a $500K signing bonus, which brings its total value to $25.25M. The agreement makes Staley the highest paid coach in women’s basketball, surpassing LSU HC Kim Mulkey, who earns $3.2M per year. If Staley leaves the Gamecocks before the end of the deal, she would be required to pay the school a departure fee equivalent to the compensation remaining on the contract. The buyout would not apply if she departs for an HC or AC gig in the NBA or the WNBA. This clause was not included in Staley’s previous contract. (link, link)

The NCAA Board of Governors reviewed the results of the 2023-24 attestation cycle of the NCAA Policy on Campus Sexual Violence. In 2023-24, zero schools attested late, compared with 21 doing so in 2022-23. Additionally, 13 schools failed to attest in 2022-23, compared with four in 2023-24. The board credited the improvement to changes made to streamline and simplify the process for schools, as well as membership feedback. Baylor President/Board Chair Linda Livingstone: "The Board of Governors is encouraged by the positive response from our member schools in meeting the attestation requirements. The enhancements in our process have clearly made a difference, and we will continue to support our institutions in maintaining these high standards." The Sun Belt has issued a public reprimand and a $100K fine to Marshall for opting out of its bowl game in December. “While the conference acknowledges the medical model and best practice guidance adhered to by Marshall, as well as their fundamental concern for the health and safety of the remaining eligible student-athletes to compete in a safe and viable manner, the nature and timing of this decision was detrimental to the Sun Belt Conference and its membership, to Army, the Radiance Technologies Independence Bowl, the American Athletic Conference and ESPN.” (link)

North Florida has unveiled renovations to the weight room and Buster Browning Athletic Training Room at Hodges Stadium. The Buster Browning Athletic Training Room was outfitted with upgraded flooring, treatment tables, therapeutic modalities and a completely renovated HydroTherapy Room, while the weight room has been newly equipped with state-of-the art strength and conditioning equipment that includes eight Sorienx Power Racks, upgraded rubber bumper plates and PLAE flooring with eight inlaid platforms.
