Wisconsin (DI) Football student-athlete Nyzier Fourqurean is suing the NCAA after his waiver request for another season of eligibility was denied today, claiming his time playing at Grand Valley State should not count towards his eligibility. From the brief: “Here, Plaintiff is facing the same fate as Pavia. The fact that one played in junior college and the other in Division II is a distinction without a difference as it relates to the economic impact of limiting the athlete’s eligibility in Division I. Both would be deprived of not only athletic participation in Division I but also the related economic opportunities afforded to Division I athletes through NIL Compensation and revenue sharing opportunities if the bylaws control.” A hearing on Fourqurean’s motion for a temporary restraining order has been set for February 4. More than 300 former Michigan football players have joined a lawsuit filed against the NCAA and Big Ten in September. The suit, as reported, alleges the NCAA, Big Ten and Big Ten Network used former Wolverines’ NIL without permission. Plaintiffs’ attorney Jim Acho: “An overwhelming number of players – almost all of whom are all financially successful I might add – reached out, wanting to join this lawsuit because they said it was out of principle. Money was made off their backs, they were denied the right to use their name and image and everybody knew decades ago it was wrong. It was unlawful. It was unethical. And these men want to make a statement.” (link)

Connecticut AD David Benedict covers several topics with WFSB’s Erin Connolly, who asks about potential realignment plans. Benedict responds: “The best answer is what I usually tell people. Look, my job is to do what I believe is in the best interest of our athletics program, our coaches, student-athletes. Obviously I'm not the lone decision maker on this campus, but certainly I'm always going to try to recommend to our president, to our board of trustees what is going to position UConn Athletics for both the short and long term. So if there was an opportunity that presented itself, it would be something that we would have to consider. But at this point in time we're proud members of the Big East. We’re an independent football program, we have hockey programs in Hockey East, so we have lots of different relationships throughout the intercollegiate athletic world and we're committed to providing those transformational experiences and trying to compete at the highest level. If we ever get to a place where we can't do that in our current existence, then it would require us to look elsewhere, but that’s not the case right now.” Benedict goes on to say that “we talk about needs and wants a lot on this campus and what I would say is a lot of wants we can’t fund. As it relates to the really big picture with football and an on-campus stadium, I think in a perfect world we would have an on-campus stadium. But we don't live in a perfect world, and we have a great facility. It just happens to be 20 minutes down the road and right now the biggest priority for us is to have a year-in, year-out competitive football program. … We need to fill up the facility that we have. I think it's hard to start talking about wanting to have something else when you're not even filling up what you have.” Full interview. (link)

New Mexico AD Fernando Lovo talks with the Albuquerque Journal’s Geoff Grammer about his first couple months in the role, which have included a search for a new Football HC and the departure of Asst. VP/Deputy David Williams. Regarding the latter, Lovo notes: “I had already started the wheels in motion looking at what a restructure would look like, and what makes the most sense for New Mexico. It’s not just copy-and-paste from what you’ve seen elsewhere. There are things you know and you’ve seen that work. How do you want to incorporate them into the structure? Certainly, that plays a role. But I’ve also been meeting one on one with each staff member over the last couple of weeks. I’m slowly making my way through trying to get everybody, which has been so helpful to me, because I’ve been able to take myself down to the day-to-day operation of who does what. What have they been doing? What are their strengths? Where can we improve?” With so much still in flux, Lovo credits his predecessor for leaving the athletic department in a strong position. “I’ve said it before, and I’ll say it again. What Eddie [Nuñez] was able to do in building a championship-level culture here is really incredible. So, ensuring we don’t take a step back, but also modernizing – or if you want to say the word professionalizing the approach in some areas to adapt and change with the times is something that I’ve been keenly focused on.” (link)

Saint Louis AD Chris May comments on the fight that broke out in the stands and delayed the end of SLU’s men’s basketball matchup with VCU by several minutes earlier this week: “We've got a campus group investigating, looking into it, and that's not what college basketball is all about. Arkansas AD Hunter Yurachek shared details about the reseating of Bud Walton Arena. From the Fayetteville Flyer’s Todd Gill: “Current season ticket holders will be guaranteed the same number of tickets they had for the 2024-25 season as long as they contribute at the Big Hog ($500) level or higher and meet the new ticket limit guidelines. However, specific seats are not guaranteed. The new plan also introduces a top donor tier, Broyles-Matthews Diamond, which requires an annual donation of $40K or more and allows members to purchase up to 14 season tickets and receive up to three parking passes. Lower membership levels will have reduced ticket and parking limits. Unlike in years past, there are no fixed donation levels for specific seating sections. Instead, fans will select seats based on their donation level.” (link)

Nebraska Volleyball HC John Cook announces his retirement after 25 seasons and four national championships. The Huskers have named Louisville HC/former Husker volleyball student-athlete Dani Busboom Kelly as Cook’s successor and signed her to a six-year contract. (link); On his monthly radio program, Huskers AD Troy Dannen explained that Cook had earned the right to name his successor, and “the only thing I think I could do in this case was screw it up because it is a no-brainer. She’s also building her own legacy and her own program. And not everybody wants to go home. Not everybody wants to follow the greatest.” The timing of the announcement, Dannen noted, occurred when it did so that both coaches would have time to inform their players before word leaked. “They didn't read about it on social media, there weren't rumors flying around. And so there were a lot of people involved in this to make it happen, from the social media group, to media relations, to just getting the contract done, to the business (office), so many people involved. And the fact that it didn't get out — the fact that the coach (Cook) was able to go tell the girls himself, that Dani was able to go tell the athletes at Louisville herself — it means so much. … It was maybe a once-in-a-lifetime sequence of how it worked, but Louisville and Nebraska worked really well together behind the scenes.” (link)

More from Dannen’s radio show, during which he noted the Huskers would hold their last spring football practice on April 26, but “I am not going to call it a game. Do not expect it to be a 'spring game' because I do not expect it to be a game. I don't know what it's going to be yet – really that's [Football HC Matt Rhule’s] call.” Dannen went on to note that “true games as we've known them in the spring are falling by the wayside for a lot of reasons, but there will be something. … It’s a different era from a compensation standpoint and NIL era, the transfer portal opens right after the spring dates. Kennyhertz Perry attorney Mit Winter reports another objection to the House settlement has been filed “by attorneys who represented Ed O’Bannon against the NCAA, on behalf of eight past, present & future college athletes. It argues the settlement terms are illegal (b/c they violate antitrust law), unenforceable, and unfair. … The same attorneys also filed objections on behalf of current and future athletes before preliminary approval was granted.” The attorneys have asked the court to speak at the final fairness hearing on April 7. Boise State professor Sam Ehrlich reports nine more objections were filed to the House settlement docket yesterday. Seven of the nine cite roster limits, while one objection relates to the exclusion of preferred walk-ons and one to the amount of the settlement. Full rundown. (link)

Clarkson Law Firm attorney Arthur Bryant argues in a Sportico op-ed that the House settlement “cannot stand. It discriminates against women athletes in violation of Title IX, replaces one illegal price-fixing agreement with another, and creates roster limits that are already depriving thousands of athletes of the chance to play college sports. It also flouts both the class action rules and the U.S. Constitution, which require that class members with conflicting interests—like the female and male athletes here—be represented by separate lawyers devoted to them.” Bryant goes on to the amended agreement submitted to U.S. District Court Judge Claudia Wilken purported to “expressly provide the release of claims by class members does not extend to…any Title IX claims.” Bryant: “But that wasn’t true. The amended agreement defines as ‘Unreleased Claims’ all Title IX claims other than those ‘arising out of or relating to the distribution of the Gross Settlement Fund’ – the exact distribution the women athletes said was unfair. It releases those claims, moreover, not only against the NCAA and the conferences, who say Title IX does not apply to them (it does, because the schools delegated their athletic oversight and coordination activities to them), but against all of their member schools, to which Title IX undoubtedly applies.” The settlement also violates antitrust law, according to Bryant, who concludes: “This whole process was unfair. The proposed settlement was cooked up by lawyers who did not adequately represent women or athletes subject to the roster caps. Any questions? The proof is in the pudding. And the proposed settlement cannot stand.” Lots more. (link)

Front Office Sports’ Amanda Christovich adds to her reporting on AFCA’s lobbying efforts and is told by Executive Director Craig Bohl the group hopes Congress will consider a few specific issues, starting with the lack of regulation for NIL agents. Bohl: “You have people that will claim to be agents that are going and representing student-athletes. They’re not regulated. You have some young people that are now listening, and when their back’s up against the wall, they don’t understand what their value is at.” The second issue is the transfer portal, as Bohl explains that players “should have the ability to go on the open market within the balance of being able to have some order and roster stability for these programs.” Christovich: “The organization has not taken a formal position, however, on the best way to remedy these issues. For example, it hasn’t decided whether athletes should be considered employees, or whether collective bargaining is the best way forward for college football.” While AFCA is still “vetting the concept” of collective bargaining, Bohl notes: “If you look at the NFL, many of their challenges have been solved with collective bargaining.” (link)

Mountain West Commissioner Gloria Nevarez has released a statement concerning conference realignment that reads, in part: “A good deal of speculation has recently been offered by various media outlets regarding the current and future status of the Mountain West, and other collegiate athletic conferences. While I cannot and will not comment on other leagues, I can share some facts about the Mountain West. First, the seven member institutions who are the foundation of the Mountain West have fully committed to the future of the Conference. Each member has cemented that commitment by executing a Grant of Rights Agreement, effective July 1, 2026, through June 30, 2032. Second, the Conference and its foundational institutions are successfully executing a future membership strategy that will ensure the strength and stability of the Mountain West through June 30, 2026, and into the future. Third, in consultation with our advisors, we are actively engaged in the rapidly evolving and fluid media rights landscape to best position the Conference for the next iteration of our television agreement which would commence July 1, 2026. … The Mountain West is confident in its legal position and strategic plan to address the ongoing litigation with both the Pac-12 and several member institutions who have publicly expressed their intent to depart the Conference.” (link)

The CAA announces its member institutions “have committed to opting into the pending NCAA House settlement by March 1, 2025.” (link); Hero Sports’ Sam Herder reports the CAA has not set a cap on football scholarships. “By opting in, CAA football programs will have 105-player roster limits. And, if they can fund it, a team can go above 63 scholarships.” (link)

ITA Board Chair Jon Vegosen and President/CEO David Mullins have submitted a letter of concern to U.S. District Court Judge Claudia Wilken regarding the House settlement which states: “If the proposed settlement of the House v NCAA case were to move forward as currently constituted, it could possibly cause irreparable damage to a very large number of non-football and non-basketball sports programs on college campuses, including tennis. This includes hundreds of thousands of student-athletes and tens of thousands of college coaches.” Specifically, Vegosen and Mullins “find incredibly disturbing the proposal that 95 cents of every dollar being distributed for past damages and through revenue-sharing moving forward are only going to two sports. … Leading sports business experts can make the case for the value and revenue that varsity tennis has brought and brings to college campuses, whether at Stanford, Tulsa, Princeton “and/or countless other colleges and universities of different sizes and missions.” Other specific objections include the “fallacy of NIL” and the “hypocrisy of amateurism regarding prize money for elite college tennis players.” Regarding the latter, they write: “At the same time when it is reported that the pay of some football players is now three to four, or even six, million dollars per year, tennis players have been told that they may not accept prize money for well-earned victories at the U.S. Open” and other tournaments. “The hypocrisy is maddening. We do not believe that Division I athletics can move to a ‘professional model’ where top football stars are being paid millions of dollars per year to compete, while the enterprise tries to hang on to the last thread of ‘amateurism’ in other sports such as tennis.” Full letter. The Collective Association is meeting next week in Washington, DC., according to Yahoo’s Ross Dellenger, who notes that “more than 45 collective leaders will gather to discuss the House settlement and their own collective bargaining proposal. U.S. District Court Judge Loren AliKhan halted the Trump administration’s freeze on federal grants and loans. A hearing has been set for February 3, at which point the judge will determine whether to issue a longer-term stay while a lawsuit filed by a coalition of organizations, including the National Council of Nonprofits and the American Public Health Association, moves forward. The freeze had been set to take effect at 5 PM on Tuesday. (link, link)

Iowa’s women’s basketball team generated $3.2M in ticket sales during Caitlin Clark’s final season, according to The Athletic’s Scott Dochterman, who notes that is “by far the most in Big Ten history.” The program’s ticket sales the previous year totaled $1.4M, then a school record. Dochterman also points out that all nine Iowa road games last season were sold out, and at six of the away sites, those programs combined for nearly $1.5M more in ticket sales than in fiscal year 2023. The Athletic has yet to receive financial statements from Indiana, Rutgers and Northwestern. The team, Dochterman continues, should “break its revenue mark once again after selling out the 2024-25 season. In addition, the 2023-24 season marked the first time the Iowa’s women’s basketball program outsold the men, which slumped by more than $500K to $2.9M in ticket sales. (link)

Ohio State Football Quality Control Coach Joe Lyberger was placed on administrative leave in December due to a university investigation. According to a letter obtained by ESPN’s Heather Dinich, Lyberger was instructed to immediately return all university property and keys, and not delete any "emails, documents, and/or materials produced during your tenure as an employee." Dinich adds that the letter “did not specify the allegations against Lyberger. The investigation was initiated by the school's Office of Institutional Equity, which helps the campus community ‘prevent and respond to all forms of protected class harassment, discrimination and sexual misconduct.’” Lyberger’s attorney, Sam Shamansky, tells Dinich he is also unsure of the allegations. “[The letter] is a bunch of vagaries. Can you imagine being in a criminal justice system and not knowing exactly what you're accused of doing? If you've got evidence, show it. If you have videotapes, let's see them. Why are we waiting around? My client has been asking for this information for a month." (link)

Illinois Football HC Bret Bielema appears to have an axe to grind with former Michigan HC Jim Harbaugh. Bielema dug up a video from Harbaugh’s days with the San Francisco 49ers in which Harbaugh remarked: “You always want to be above approach. Especially when you’re good because you don’t want people coming back and saying ‘Oh they’re winning because they’re cheating.’ We want to be above the approach in everything, play by the rules. If you cheat to win then you’ve already lost.” Bielema then commented: “Really…. [sic] Why did you leave? Was looking forward to playing but understand why you ran to the NFL. See you in the future and can’t wait.” Meanwhile, the Chicago Tribune’s Brad Biggs notes he “had a nice chat” with Bielema at the Senior Bowl. “He stopped in during the middle of a recruiting trip to see WR Pat Bryant. Bielema is going to let his Twitter/X comments stand when asked about the Michigan/Harbaugh matter.” (link)

+ Lafayette faculty members on Tuesday passed a vote of no confidence in President Nicole Hurd by a count of 102-86. In the motion, some faculty members indicated that Hurd has "failed in her presidential duty and violated the principles of shared governance in several ways,” including the December 7, 2024, Strategic Plan Approval Update co-authored with Board of Trustees Chair Robert E. Sell. Faculty members say Hurd misrepresented the faculty's rejection of the proposed strategic plan and therefore forfeited the trust and confidence of the faculty. (link)
