Wisconsin (DI) Football student-athlete Nyzier Fourqurean is suing the NCAA after his waiver request for another season of eligibility was denied today, claiming his time playing at Grand Valley State should not count towards his eligibility. From the brief: “Here, Plaintiff is facing the same fate as Pavia. The fact that one played in junior college and the other in Division II is a distinction without a difference as it relates to the economic impact of limiting the athlete’s eligibility in Division I. Both would be deprived of not only athletic participation in Division I but also the related economic opportunities afforded to Division I athletes through NIL Compensation and revenue sharing opportunities if the bylaws control.” A hearing on Fourqurean’s motion for a temporary restraining order has been set for February 4. Following the lawsuit, PSAC Commissioner Steve Murray: “Okay….I’ve seen enough! I’m sorry, but this is crazy crazy! Let’s go to 5 year clock once you step on campus, no waivers, no exceptions, nothing. Just monitor progress towards degree standards. If you can play 5 seasons, great, if you can’t then aw shucks, you got your degree!” (link); Gulf South Commissioner Matt Wilson responds: “DII needs to initiate a broad eligibility review immediately. @PSACcommish idea was one I added as a topic for ‘Think Tank’ but was not prioritized by participants, What if you get 3 or 4 years of D2 eligibility if you complete your AA degree? […] Division II needs to further distinguish ourselves from D3 and NAIA. In light of new litigation, a broad eligibility review may give us that opportunity. We also need either a new committee or new staff focused on strategic initiatives & discussions for D2. […] I think the way we do eligibility, how we run championships, and the access we give to those championships are things we need to double down on. There are plenty of D2 schools operating athletics on a D3 model with modest scholarships.” (link, link)

NCAA VP of Academic and Membership Affairs Dave Schnase joined Connect's Bryan Fischer at the NCAA Convention to discuss the latest on NIL Assist, regulations, roster caps and what the NCAA is doing to prepare for the implementation of potential changes. Since coming online, NIL Assist has recorded roughly 112K transactions worth $200M. “It’s giving us a good baseline for data. More importantly, though, it’s got this educational module. So, we have 60 modules within that particular element being viewed by a lot of people. The one that's most popular is Invesco QQQ's How Not to Suck at Money. It’s really a great video. We have another one from the Patent and Trademark Office that's being watched a lot. So for us, it's about getting the word out, helping people understand what NIL is all about, even as a place to start.” Regarding the NIL clearinghouse with Deloitte, Schnase says it’ll take some time to perfect. “At some point people are going to make judgments about a deal that’s maybe not in compliance with the fair market value, and that’s when they need to make sure they have the right enforcement mechanisms in place.” Full Q&A on Connect. From this month’s Chamionships Committee meeting, the group has asked sport committees to provide feedback on using NPI as a metric for postseason selecting by June, when the group will recommend either “a metric be adopted via noncontroversial legislation, 2026 Convention legislation, or whether to decide not to recommend a metric for selections at all.” The Softball committee will reseed teams for the final championship site using KPI. In Football, committee members has expressed caution around permitting sideline-to-player helmet communitications, citing “the high cost to implement the technology and the concern regarding a permissive rule becoming indirectly mandatory for schools that may feel they must invest to avoid a competitive disadvantage. Committee members also are concerned about the impact on the postseason if some conferences have implemented the technology during the regular season and others haven’t.” This comes as the Football Rules Committee is exploring allowing this outside of FBS members. Nebraska-Kearney Football has been placed on probation for two years following recruiting violations by former HC Josh Lynn and two ACs. News Channel Nebraska’s Michael Shively: “Assistant coaches used university money to pay for one-way airfare for six football recruits, provided or paid for transportation and provided hotel lodging for some of the recruits. The total value of the impermissible benefits was $1,872. The benefits are impermissible because the NCAA requires recruits to return home in order for a trip to qualify as an official visit. At least some of the recruits never returned home and participated in preseason practice soon after arriving. The infractions came to light after Lynn left UNK for West Texas A&M in Dec. 2022. West Texas self-reported a similar violation in summer of 2023 and told the NCAA that Lynn said he used the same approach at UNK.” Penalties include 83 fewer official paid recruiting visits, a vacation of 32 games that three recruits participated in, and a fine of $3,744. Eastern New Mexico’s new Assoc. AD for Leadership Development and Outreach Sia Poyer will start the Greyhound Athletics Presidential Leadership Academy, which will be fully funded by a $2.5M donation. Starting next month, the GAPLA’s inaugural class of roughly 35 student-athletes will go through a yearlong leadership development curriculum with sessions every three to four weeks based on lessons from the Janssen Sports Leadership Center. ENMU Chancellor James Johnston: “(GAPLA) will provide student athletes with the training and education to translate leadership traits they may exhibit on the court or field into marketable job skills that will serve them for a lifetime. Sia is the right person to begin this academy, and I look forward to seeing the great things he will do with this opportunity.” (link)
