The NCAA will settle an antitrust lawsuit filed by four states and the District of Columbia, per Sportico's Michael McCann, who adds: "The settlement is expected to remove a potential complication for the NCAA as it seeks to convince U.S. District Judge Claudia Wilken to grant final approval of the settlement resolving the House, Carter and Hubbard antitrust litigations. In Tennessee et. al v. NCAA, a group of attorneys general maintain that NCAA member schools and conferences have illegally conspired through NCAA rules to restrain how recruits can discuss opportunities with NIL collectives. At issue is the so-called 'NIL recruiting ban' wherein the NCAA prohibits the use of NIL contracts as a recruiting inducement." As of now, the parties have signed a term sheet, with the settlement to be finalized by March 17. More. (link)

Juniata AD Nikki Ayers sits down with D3.ticker’s Anthony Grassi at the 2024 Women Leaders Convention to dive into returning to lead her alma mater, instilling competitiveness from the AD chair and more. As a Juniata Hall of Famer from her playing days, Ayers on her focus for the Eagles: “It's my job to try and build our program to instill confidence in our coaches and confidence in our student-athletes that, why not us. And try and transform the experience that they're having there into a more competitive experience, so we get ourselves out of bottom of the conference. […] We're making those strides and we're really doing our job as a department in instilling confidence in our student-athletes that they can do it, that they can put in all of the work that they do in the offseason with sport performance and everything that they do on the field, the court, the pool, everything that they're doing, can lead to success on the field as well. For me, it's really about going in and believing in yourself and that's something that I really want all of our coaches to to be able to have and then that trickles down to our students as well.” On the successes of Volleyball: “I think everyone in the department, in terms of the department vibe, champions our volleyball programs, but the volleyball programs also champion the rest of our sports. When I got to Juniata, the big thing was is everyone says, ‘Oh where do you work?’ and I say, ‘Juniata.’ ‘Oh volleyball. Volleyball's great.’ That's the one immediate thing that people think of and my goal as the athletic director is to be like athletics, athletics is great at Juniata, in addition to the academic piece of things. For me, the volleyball program being who it is and how good they are and the fact that they're so humble and the fact that they push everyone else to be better, it's just a great competitive environment that really helps with our department culture.” More only on BOSCA. Sarah Comstock, VP for Student Affairs and Dean of Students at University of Puget Sound, discusses how she developed her philosophy on athletics after the department was recently reassigned to report to her. She talks about her input in creating a profile for hiring a new director of athletics. Comstock also gives insight into the importance of the position and how athletics fits into the mission of the university.

U.S. Congressman Tim Walberg (R-MI) is asking the Government Accountability Office to examine how DI and DII schools’ spending on athletics programs and facilities impacts the cost of tuition and fees. Walberg adds in the request that “new policies may put further pressure on schools to spend money on high-quality athletic programs to recruit and retain the best athletes.” (link); Citing an NCAA report, Walberg, who chairs the House Education and Workforce Committee, noted that in 2022, the median revenue of DI athletic departments through donor contributions, ticket sales and media rights was $8.4M, while the median total department expenditures was $30.3M. The proportionate gap between those revenue streams and overall expenses was even more pronounced at the DII level. While Walberg’s Michigan district includes just one DI school (Western Michigan), Sportico’s Daniel Libit points out that “after Walberg became chair, the first piece of legislation passed out of the House Education committee was also college sports-related: a bill preventing federal funds from being spent on any organization – such as the NCAA – that allows transgender athletes to compete in women’s sports.” (link)

An independent review into a Tufts Men’s Lacrosse team workout last September resulted in 24 of 61 participants developing rhabdomyolysis and nine students being hospitalized. The instructor for that session was a third-party Navy SEAL instructor who “appeared to lack credentials to supervise group exercise,” and the workout “did not follow principles of acclimatization that are necessary to avoid injury during training.” Per the AP: “The review concludes that Tufts personnel need a better understanding of their roles and responsibilities in the future to prevent a similar scenario from happening again.” (link)

+ Ithaca has received a major gift to support a $4M outdoor Track & Field facility, with the majority of funding coming from supporters. The eight-lane, 400-meter track and natural grass infield is expected to be complete in early September. (link)

Women's Flag Football Growth:

+ According to the National Federation of State High School Associations, the fastest growing high school sport for girls is flag football, which experienced a 173% increase in participants in just three years. The fastest declining sport is basketball, which lost 6,000 participants in just one year. (link)

+ Virginia Wesleyan will add Women’s Flag Football as its 26th program, starting next spring. AD Andrea Hoover-Erbig: “We are excited to offer opportunities for women to participate in flag football at the collegiate level.
