The DII Management Council has authorized a comprehensive eligibility review through the Academic Requirements Committee and Legislation Committee after recent legal action (more on that below). The council did not, however, decide to issue a blanket waiver for those who previously competed at non-NCAA institutions to retain their eligibility for this academic year, similar to the one issued in DI. In response, PSAC Commissioner Steve Murray: “Today DII Management Council chose to try and restore sanity to the extension of eligibility that has been circulating in the NCAA. 6, 7, 8 years of eligibility is not appropriate for D2 Athletes. We should be about completing degrees, not how long you can stay in college and play. Glad D2 ManCo is establishing a comprehensive review of eligibility. I like the 5 year, no waiver idea. But what I do know, is D2 does the best job of figuring out solutions to our problems….when we work together. And we will.” MIAA Commissioner Mike Racy with a different perspective: “I guess your National Representatives on the Management Council believe that your work in helping JUCO transfer student-athletes continue their D2 education through competition is not as important as it is for your D1 colleagues.” (link, link)

Illinois Springfield AD Mike Hermann chats with NPR Illinois’ Beatrice Bonner about his priorities and what drew him to UIS. On the latter, Hermann became disheartened with the transactional shift in DI, adding: “I intentionally sought out an opportunity at a Division II school. I intentionally sought out an opportunity at a place in the midwest where I’m from to get back to the midwest. I intentionally sought out a place that wants to build with the community. We’re the only four-year school in town. We’re the only one with the NCAA moniker. We can really own this town. We can become this town’s team and I think with some work and some connection we can really do that.” Hermann’s priorities for the Prairie Stars: building the culture as one of the best programs in the GLVC, continuing to enhance and systemize the student-athlete experience, and upgrading outdoor facilities. A trio of writers from The Athletic outline the next steps of the proposed House settlement, as well as gathering some new commentary on the latest developments. Herrick Feinstein Sports Law Group co-chair Irwin Kishner: “My strong sense is that when it gets to this level, way more matters are closed, in the sense of they go forward as opposed to they blow up. It’s not unheard of, but I think if you’re looking at the percentages, it seems to me there’s a real desire in the political situation to sort of make this happen.” Troutman Pepper Locke litigation partner Cal Stein: “The House settlement started with the goal of the NCAA putting an end to the losses it has taken in these litigations all over the country, but the great irony is that it’s really just going to lead to more lawsuits.” As for potential Congressional intervention for college athletics, Stein comments, “I’m a little bit skeptical, or maybe a lot skeptical, that we’re anywhere near that happening. I don’t know that it’s a priority for Congress.” (link)

+ From in front of the Law360 paywall: “The NCAA and a group of Division I volunteer baseball coaches have reached a settlement ‘in principle’ to end a proposed antitrust class action that challenged the organization’s since-repealed ‘uniform wage fix’ bylaw that prevented volunteer coaches from getting compensated market value for their services.” (link)

+ Kennyhertz Perry attorney Mit Winter with updates on Wisconsin football student-athlete Nyzier Fourqurean’s attempt for additional years of eligibility: “The judge in the Fourqurean v. NCAA case did not rule after today’s hearing. He’s taken the motion for TRO/preliminary injunction under advisement.” (link); From Law360: “The NCAA is pushing back against a University of Wisconsin football player’s request for a temporary injunction against its allegedly anticompetitive eligibility rule, arguing the rule achieves the exact opposite by giving more students the opportunity to play.” (link)

+ Maryland (DI) Baseball student-athlete Trey Ciulla-Hall has filed a "Pavia-like" lawsuit against the NCAA, according to Boise State Asst. Professor Sam Ehrlich, who explains Ciulla-Hall “argues his 2020-21 year at DII Stonehill College shouldn't count, both under recent precedent & due to COVID-related extenuating circumstances. This is a very similar fact pattern to the lawsuit filed last week by Wisconsin football's Nyzier Fourqurean.” (link)

+ Fontenot v. NCAA plaintiffs’ attorney Garrett Broshuis says over 150 athletes have opted out of the proposed House settlement and joined the Fontenot case, according to multiple reports. Yahoo’s Ross Dellenger notes the group includes “40 All-Americans & 70+ all-conference selections” and “pushes the number of total House opt-outs to more than 300 – still a fraction of the class (40K+). Another 200+ have filed House objections as well.” (link, link)

A number of NCAA leaders including NCAA Board of Governors Chair/Baylor (DI) President Linda Livingstone, over a dozen commissioners and ADs, coaches association CEOs and more have penned a letter to Congress over concerns around student-athlete employment. The quartet writing, in part: “We are gravely concerned by the looming threat of a sweeping employment mandate, which could potentially turn all student-athletes (regardless of where they compete or what sport they compete in) into employees of their universities. This type of broad employment mandate would be financially untenable for the vast majority of America’s collegiate athletic departments, and would likely result in thousands of shuttered programs. Many of the worst impacts are expected to fall on women's sports. With this in mind, we urge you to cosponsor and pass legislation affirming that student-athletes will not be deemed employees of their universities.” Full letter. (link)

President Donald Trump has signed the “No Men in Women’s Sports Executive Order” prohibiting transgender women from female sports. Trump: “The radical left has waged an all out campaign to erase the very concept of biological sex and replace it with a militant transgender ideology. With this executive order, the war on women’s sports is over.” (link)

The NFL is exploring options to create professional men’s and women’s flag football leagues and has received a “tremendous amount of interest” from investors, according to Commissioner Roger Goodell, who says: “That'll be a big part of the Olympics in a few years. But it's also something that we want to look at all levels, the youth level all the way up, and we're exploring very aggressively now an opportunity to create a professional-type league for both men and women.” A source tells SBJ’s Ben Fischer the interest from investors includes entities not involved with the NFL. Additionally, the extent to which the NFL would be involved has yet to be determined, as Fischer explains the league could be the “league organizer” or “more of a collaborator.” Goodell: “This is something that we've been working on for several months, and there’s a tremendous amount of interest from players, from investors, to people who recognize, particularly, that women's sports are in a place where it's real and it’s something we all want to be part of.” (link)
