A trio of writers from The Athletic outline the next steps of the proposed House settlement, as well as gathering some new commentary on the latest developments. Herrick Feinstein Sports Law Group co-chair Irwin Kishner: “My strong sense is that when it gets to this level, way more matters are closed, in the sense of they go forward as opposed to they blow up. It’s not unheard of, but I think if you’re looking at the percentages, it seems to me there’s a real desire in the political situation to sort of make this happen.” Troutman Pepper Locke litigation partner Cal Stein: “The House settlement started with the goal of the NCAA putting an end to the losses it has taken in these litigations all over the country, but the great irony is that it’s really just going to lead to more lawsuits.” As for potential Congressional intervention for college athletics, Stein comments, “I’m a little bit skeptical, or maybe a lot skeptical, that we’re anywhere near that happening. I don’t know that it’s a priority for Congress.” (link)

Legal Updates:

+ From in front of the Law360 paywall: “The NCAA and a group of Division I volunteer baseball coaches have reached a settlement ‘in principle’ to end a proposed antitrust class action that challenged the organization’s since-repealed ‘uniform wage fix’ bylaw that prevented volunteer coaches from getting compensated market value for their services.” (link)

+ Kennyhertz Perry attorney Mit Winter with updates on Wisconsin football student-athlete Nyzier Fourqurean’s attempt for additional years of eligibility: “The judge in the Fourqurean v. NCAA case did not rule after today’s hearing. He’s taken the motion for TRO/preliminary injunction under advisement.” (link); From Law360: “The NCAA is pushing back against a University of Wisconsin football player’s request for a temporary injunction against its allegedly anticompetitive eligibility rule, arguing the rule achieves the exact opposite by giving more students the opportunity to play.” (link)

+ Fontenot v. NCAA plaintiffs’ attorney Garrett Broshuis says over 150 athletes have opted out of the proposed House settlement and joined the Fontenot case, according to multiple reports. Yahoo’s Ross Dellenger notes the group includes “40 All-Americans & 70+ all-conference selections” and “pushes the number of total House opt-outs to more than 300 – still a fraction of the class (40K+). Another 200+ have filed House objections as well.” (link, link)

President Donald Trump has signed the “No Men in Women’s Sports Executive Order” prohibiting transgender women from female sports. Trump: “The radical left has waged an all out campaign to erase the very concept of biological sex and replace it with a militant transgender ideology. With this executive order, the war on women’s sports is over.” (link)

A number of NCAA leaders including NCAA Board of Governors Chair/Baylor (DI) President Linda Livingstone, over a dozen commissioners and ADs, coaches association CEOs and more have penned a letter to Congress over concerns around student-athlete employment. The quartet writing, in part: “We are gravely concerned by the looming threat of a sweeping employment mandate, which could potentially turn all student-athletes (regardless of where they compete or what sport they compete in) into employees of their universities. This type of broad employment mandate would be financially untenable for the vast majority of America’s collegiate athletic departments, and would likely result in thousands of shuttered programs. Many of the worst impacts are expected to fall on women's sports. With this in mind, we urge you to cosponsor and pass legislation affirming that student-athletes will not be deemed employees of their universities.” Full letter. (link)

The DIIICA partners with the National Association of Sports Officials (NASO) on a series of initiatives to recruit, train and support officials in DIII. Initiatives include a marketing campaign across all conferences with the message “Say Yes to Officiating,” partnerships NIRSA and NFHS to explore more opportunities for officials, work to address behavioral issues in sports and more. DIIICA President/SCIAC Commissioner Jenn Dubow: “We are excited to begin our partnership with NASO and with these new initiatives, we're not only addressing the immediate challenges of recruitment and retention but also building a strong foundation for the future of officiating. By investing in education, mentorship, and community engagement, we are reaffirming our commitment to supporting officials and elevating the overall experience for everyone involved in Division III athletics.” (link)

Dave Campbell’s Texas Football’s Cory Hogue reports the ASC will continue with the double round-robin scheduling format for the 2025 Football season. Hogue: “Most coaches from both conferences [ASC and SCAC] did not like the double-round-robin format last season, and some of the expansion of the NCAA Division III playoffs to 40 teams and the incorporation of the NCAA Power Index (NPI) would encourage teams to schedule games against more formidable opponents. Unfortunately, the formula used by the NPI last season rewarded teams to play weaker schedules. […] This means there is no incentive for SCAC schools or schools from other conferences to play the ASC programs. In other words, the current system makes it extremely difficult for all ASC teams, particularly Mary Hardin-Baylor and Hardin-Simmons, to find DIII nonconference opponents next season.” (link)

Hendrix will add Women’s Flag Football as its newest sport, with the upstart program to compete at club level in spring 2026 and varsity level in spring 2027. AD Amy Weaver: “Our athletic department strives to provide a transformative experience for our student-athletes. With the addition of women's flag football, we can continue to provide phenomenal opportunities for our young women to compete at the collegiate level, which aligns with our mission to promote greater accessibility and inclusivity in athletics. Reports of concussions in the NFL decreased by 17% when compared to the 2023 season, according to league data, which indicates there were 182 total concussions combined in the preseason and regular season (games and practices) in 2024, compared to 219 in 2023. Notably, only 44 concussions in preseason games and practices, and The Athletic’s RJ Kraft notes the only year lower was in 2020 when 30 concussions occurred during practices and there were no preseason games that year due to COVID. NFL EVP for Communications, Public Affairs & Policy, Health & Safety Initiatives Jeff Miller: “This year had a notable decrease over last year as the result of improved equipment, continued rules changes and enforcement, [and] culture change around head injuries. … That is not to say that there is not a lot more work for us to do. We believe that the game, while safer, is no less exciting than it has ever been.” Kraft adds that the “new dynamic kickoff rule led to a lower concussion rate (down 43% vs. the 2021-2023 average) with more kicks being returned – a 57% increase that saw 332 kicks returned. Seven kickoffs were returned for touchdowns, the most since 2021. Despite more kicks being brought back, the league saw the same number of concussions on kickoffs (eight) from year to year. The dynamic kickoff also led to the fewest lower extremity strains on kickoffs since at least 2018 due to slower average player speeds.” (link)
