Nebraska AD Troy Dannen sits down with KETV 7’s Andy Kendeigh as the pair discuss revenue sharing with student-athletes: “We know we have a $20M expense coming up next year. I think if you ask any of our coaches, the first dollar, the most important dollar that will be spent will be the revenue share dollar. It’s tomorrow’s scholarship. It’s recruitment and retention. It is, as good as the coaching staff is, none of us are better than the student-athletes on the field. So, making sure we have a way to resource that. Finding ways to cut or reallocate things within our budget to hit that priority. At the same time, how do we drive new revenue? We’ve made a commitment to not raise prices until at least upgrades to the stadium are down. So, certainly this isn’t a matter of ‘how do we go to the fans and say we’re going to gouge you for more?’ so we can transfer that to the student-athletes. Our fans have been, and this might sound pollyanna-ish, but our fans have been with us. We owe something back to them and as this evolves that is that we don’t immediately rent to them. Part of the stadium project is to create new revenue streams, but at least that becomes optional for fans and not just the ticket prices going up twenty percent.” Lots more. (link)

Southern Illinois boss Tim Leonard talks about the same challenges: “It’s basically an added expense that just hits your budget over night. I mean essentially it’s another mandate that you have to figure out. It’s essentially going to cost us a half million dollars a year and then you throw on whatever number on top of that you feel like you have to be competitive. So, it’s never ending with our business because a lot of these expenses are mandates with not a lot of lead up time. Doesn’t matter if you have the money or not, boom you have to do it. [...] We’re competitive in the Missouri Valley. I’m not concerned with anything other than winning the Valley. Once we become dominant in the Valley, then we can look beyond to see what we need to do further to advance in the NCAA postseason. But, right now we just need to get there. Doesn’t matter what sport, that’s what people determine as a success factor. That’s all I’m worried about. [...] We’re probably leaning toward opting in. I don’t see any advantage to opting out. If you opt in, you don’t have to do any of those things. We’re committed to remaining as competitive as we possibly can within the Missouri Valley Conference.” Leonard goes on to say the SIU athletics endowment is “not bad” & would like to spend money being raised right now on nearterm needs. Green & Spiegel Individual and Olympic Sports Practice Group Leader Ksenia Maiorova & Vertical Screen Senior Director & Associate General Counsel John Mazzeo submit an entry for AthleticDirectorU on how direct payments to student-athletes in the coming new model of college athletics creates a critical immigration problem. From the article: “The independent contractor approach not only fails to protect international student-athletes but also leaves universities vulnerable to liability under Department of Homeland Security (DHS) regulations. Universities can be charged with ‘knowing hire’ violations even if the compensated athletes are not W-2 employees of the school, but are instead independent contractors reporting income on IRS Form 1099. This is because under the Immigration Reform and Control Act of 1986 (IRCA), ‘a person or other entity who uses a contract, subcontract, or exchange…to obtain the labor of an alien in the U.S. knowing that the alien is an unauthorized alien…with respect to performing such labor, shall be considered to have hired the alien for employment in the United States in violation of [IRCA’s hiring provision].’ Knowing hire violations expose institutions and its administrators to both civil and criminal liability.” Lots more. The Mercury News’ Jon Wilner believes the NFL adding an 18th regular season game would cause even more conflict with the College Football Playoff schedule: “The NFL’s regular season wouldn’t end until the second Sunday (in January), with the wild card round (six games over three days) on the third weekend and the divisional round (four games over two days) on the fourth. In fact, if the NFL simply moved its current TV schedule back one week to accommodate the 18th game, the wild card matchup played on Monday night would start at the same time, and on the same network (ESPN), as the CFP championship game. It all suggests a revamped calendar in which the NFL sucks up all the media oxygen and CFP games are relegated to the nooks and crannies of the TV schedule that limit audience.” Wilner suggests three options for the CFP: 1) Work around the NFL, which could mean Tuesday night championship game; 2) Play the CFP title tilt the weekend before the Super Bowl (though that means lengthening the college seasons even more); or, 3) Move the title game up a week (“This is the best solution, by far, but it carries enormous complexities — specifically, it would require the sport to untether itself from the New Year’s games.”). South Carolina Football HC Shane Beamer believes the SEC should be viewed differently when it comes to selecting the College Football Playoff field: “The fact of the matter is we beat the ACC champion on their field this year and didn’t get in. And I understand why we didn’t get in and why Clemson did. I’m not sour about that, but I do believe this league is just different than others, and there has to be some consideration. … Look I’ve got great respect for other conferences. I’ve been to other conferences. I’ve been part of the ACC, I’ve been part of the Big 12. There’s no question that there’s good football everywhere. But when you just talk about the teams in this league and the teams you play week in and week out, it’s different. And you look at the NFL draft every single year, it’s 20 straight years that the SEC has led the nation in draft picks. People can say, ‘Well, it doesn’t matter.’ Well, yeah, it does. We’re playing the best players in the country.” Beamer goes on to remark that "I’ve been a part of other leagues where you go into a stadium and there are 20,000 people in the stands, and you’re in a Power Four conference. Not in this conference. Every road venue you go in, you’re playing in front of 70, 80, 90, 100,000 people every single Saturday.” (link)

Extra Points purveyor Matt Brown writes on Nebraska’s decision not to hold a spring football game, wonders if it’s that big of a deal: “Here’s a list of all the other schools that brought in over 50,000 fans last year: Zero. Only nine schools brought in at least 40,000…and since these are official school numbers, not scanned tickets, it’s safe to assume these are all almost assuredly overcounts. [...] There isn’t a true, nationwide fan-driven demand for in-person simulated games. There are 100+ markets that can draw 20,000+ fans to an actual college football game in the Fall, when fans expect those games to happen. In mid-April? Looks like there’s about twenty.” Brown points to a number of reasons to support the data, including programs not having enough healthy linemen, a challenge that is unlikely to get any easier with a potential decrease in roster sizes. ESPN’s Myron Medcalf explores how BYU is going all-in on men’s basketball. Among others, the Cougars have the financial backing of Focus Services CEO Paul Liljenquist, who proclaimed, “You’re not going to outbid us,” days after he and colleagues had committed almost eight figures to secure A.J. Dybantsa. When HC Kevin Young first got to Provo, he did a Power Point presentation to the Cougars’ wealthiest boosters, whose combined net worth exceeded $10B, per sources, and according to Medcalf: presented “everything he believed he could achieve at BYU if they promised to back him. That approach -- an organized, passionate address that made the boosters feel like they were part of the team and not just rich backers -- appealed to the business-savvy crew that left the meeting as believers.” Dybantsa on his choice of schools: “They have an NBA staff, all the way down to the dietician, strength coach, analytics guy. And my ultimate goal is to go to the NBA. Why not surround myself [with those resources] a year early?” Young: “After [Dybantsa] announced he was coming here, we were already getting some interesting calls and now it's like, between me and the rest of my staff, we're fielding some pretty interesting calls, whether that be potential games, potential [nonconference tournaments] that people want us to play in or from recruits from all over the world. And so it's kind of putting us in a spot where we're like, OK, hopefully that all has legs, and now we can be selective on who we bring in.” More. (link)

The ACC increasingly appears to have weathered the storm after two years of infighting only to be faced with a new, albeit less existential problem, according to Sports Illustrated’s Pat Forde, who observes: “Now it has to fix basketball. The league has undergone an incredible coaching brain drain over the last three years, losing institutions all over the place. … The presumption is that Jon Scheyer can make Final Fours and win national titles at Duke, perhaps as soon as this season, but he has to actually do it. Hubert Davis made a Final Four at North Carolina, but he’s also in danger of missing the NCAA tournament for the second time in three seasons. The product has cratered at Syracuse and Virginia. The staying power post-legend remains to be seen at both FSU and Miami, which are experiencing downturns this year. … Duke is the only ACC team assured of a high seed, with Clemson, Louisville and Pittsburgh all hurting their résumés with upset losses within the last week. There is little distinction between second place and 15th at the moment. But this figures to be a temporary problem in a league where basketball is too big to chronically fail. If football continues to upgrade itself – hello, Bill Belichick – the ACC is in solid position for the rest of the 2020s. Given the assaults upon its credibility over the previous 18 months – from the outside and within – that’s a successful survivor’s tale.” (link)

CBS Sports for the first time ever used an on-campus production site for a linear broadcast when Kansas State hosted Oklahoma State on January 29. CBS SVP for Remote Production Steve Karasik: “Once the ball tipped, if you were watching this game on CBS Sports Network, you would never know that students were part of this production and it was being done from a facility that we had never used before. Overall, I think it was a really successful debut. We plan to use the Kansas State facility in the future and will be looking at other facilities in the Big 12 to see if we can add to this and do more in upcoming seasons.” CBS’ Big 12 hoops games are broadcast via an ESPN sublicense, and Karasik explains that “we were excited about the addition of Big 12 basketball to our CBS Sports Network package because it’s a premiere conference with a lot of great teams and a lot of great venues. We were told that the Big 12 had started an initiative of doing in-house productions for various sports. We ended up looking at all the schools and identified Kansas State as the one with the best facilities that could do a game up to CBS Sports standards.” The Wildcats recently constructed a ~$7M production site and Karasik says two production staffers sent to check out the studio “reported that the facilities were really good and they thought we would be able to do a game there.” (link)

Former Texas Tech quarterback Patrick Mahomes will be squarely in the spotlight during today’s Super Bowl & CBS’ Brandon Marcello writes on the deep relationship between Mahomes, the Red Raiders & the Kansas City Chiefs. Tech AD Kirby Hocutt looks back to Mahomes first approaching him about the potential of full brand alignment: “He wanted his alma mater with Adidas – and at the same time he had the vision for growth of his 'Gladiator' logo, his brand.” Even after the the synergy was rolled out, Texas Tech VP of Marketing & Communications Matt Dewey still thought there was more to unlock: “A lot of the content just kind of seemed to gloss over Texas Tech, so I reached out to them and said, 'Hey, what could we do to get his Texas Tech story to be part of his broader Kansas City Chiefs story?’” The result was a seven-year marketing agreement between the two that runs through 2027 & is worth $6.47M. Deliverables for Texas Tech inside Arrowhead Stadium include video board & ribbon board ads, as well as “Tech-branded content regularly appears on the Chiefs' social media and radio broadcasts as well.” Notably from Marcello: “Applicants to Texas Tech from the Kansas City area have ‘gone up significantly’ during the marketing agreement, Hocutt said. About 100 students from the Kansas City area have enrolled at Tech, Dewey said.” (link)

The Mercury News’ Jon Wilner breaks down how the ACC’s ESPN extension impacts the possibility of Memphis, Tulane and/or USF joining the Pac-12: “Four months later, the American schools are not off the table. But they would only leap into the Pac-12 if the financial math made sense. Here’s what we know and what we presume: The Pac-12 is seeking a media rights deal in excess of $10M per school annually, according to sources. Does that mean $18M, $15M or $12M? Our hunch is the target figure is closer to $12M. And we should also remind folks that it’s a negotiation. The target figure and the final number are often quite different. The rock-bottom number, in our view, is $7M per school annually. That would approximately double the Mountain West’s current payout and essentially equal the average distribution the American schools receive from their contract with ESPN. If you toss the target number and the rock-bottom number into a cauldron, the end result would be a media rights deal worth roughly $9M to $10M annually per school. … Put another way: Would an offer of $10M per year from the Pac-12 be enough to exceed what Memphis, Tulane and USF are receiving annually and cover the additional travel costs? (Also, Memphis really wants to join the Big 12 — whether it’s realistic or not — and the school won’t make any moves that could potentially complicate the strategy.).” (link)

Sportico’s Michael McCann goes deeper on Friday’s decision by U.S. District Court Judge Denise J. Casper to deny Maryland-hopeful Baseball student-athlete Trey Ciulla-Hall additional eligibility after playing four seasons at Stonehill. McCann: “Casper said she was ‘not convinced’ the NCAA incorrectly applied its own rules. The judge noted that the Skyhawks played 32 games in spring 2021 and Ciulla-Hall played in 21 of those games. Those benchmarks, Casper noted, meant that Ciulla-Hall played in a season that counts under NCAA rules. The judge also reasoned that Ciulla-Hall has not established a likelihood the NCAA and its member schools violated antitrust law by denying his eligibility. Casper noted that Ciulla-Hall hasn’t ‘pointed to evidence’ showing that denial of his eligibility reflects harm to the marketplace for college athletes. The judge also cited precedent standing for the proposition that judges reviewing NCAA rules should take caution before entering injunctions. Otherwise, she mentioned, judges run the risk of intruding on complex business arrangements. Casper also underscored that her denial of a preliminary injunction does not mean Ciulla-Hall will necessarily lose his case.” Ciulla-Hall’s attorney: “We are disappointed with the ruling. We believed Trey had a compelling case. However, the time constraints played a significant part on both sides.” (link)

Yesterday’s hoops ledger featured the MAC-Sun Belt Challenge, but Toledo Men’s Basketball HC Todd Kowalczyk said pregame he would like to see the event moved to earlier in the season: “I just wish our league commissioner would stop trying to do this in February. It makes zero sense. And, in my opinion, it's a big mistake on his part to put our players and all the players in our league in harm's way. It's not right.” Ironically, after the Rockets won 72-69 over James Madison, Kowalczyk added: “That was March-level intensity. So much for a meaningless game.” The Toledo Blade’s David Briggs goes further on the MAC’s lackluster hoops year overall as it sits at 23rd out of 31 leagues according to the NET rankings. Commissioner Jon Steinbrecher chimes in: “We’re looking at a lot of different things. I'm not sure where we'll come out, but I know we'll have some pretty interesting conversations in the postseason as we look into this. The good thing is no one is satisfied.” (link)

James Moore & Co. Partner Katie Davis points to changes in National Institutes of Health funding that could have ripple effects for athletics. On Friday the NIH announced it was capping indirect grant costs at 15% against the historical industry average of 27-28%. From Forbes Michael Nietzel: “Universities depend on indirect cost reimbursement to defray a significant portion of these expenses, and a cut of this magnitude will leave many of them scrambling to fill the huge budget holes that it almost immediately creates.” Davis: “For those in D1 athletics, you now have more competing priorities for limited institutional support.” (link)

Tennessee introduces a new NIL bill that Kennyhertz Perry attorney Mit Winter writes is “very specific on things it allows/requires.” The bill highlights that schools & collectives can operate free media networks featuring student-athletes while paying them a percentage of revenue. They can have talent fees on athletics revenue that can be utilized for NIL compensation and establish NIL funds to attract and manage revenue from NIL activities, including alumni donations. They can create incentive based revenue-sharing models that allocate at least 50% of NIL generated funds to student-athletes and their representatives, and the bill also creates a licensing system for NIL representatives under which they have a fiduciary duty to athletes. The Athletic’s Chris Vannini provides the details on Ohio State Football HC Ryan Day’s buyout as part of his new contract with the Buckeyes. If fired without cause, the buyout would start at $80.5M, a remaining average of $11.5M per year, subject to offset from a new job. His buyout to leave would start at $6M through January 31, 2026, fall to $4M and then lower each subsequent year. (link)

Arkansas Deputy AD for Integrity and Student-Athlete Success Dan Trump tells Arkansas Business that with the Super Bowl coming up “we’ll be sending out a reminder to all of our student-athletes and staff about ‘Don’t bet on it,’ and those types of things. It’s a kind of a continual message that has been ramped up. [Gambling] is so prevalent.” Trump also says he’d like to see the state institute a ban on prop bets because “that’s where you see the majority of the online abuse. Are we going to get to a point where gambling on college athletics is against the law? No, the toothpaste is out of the tube. But can we ban the prop bets involving student-athletes? That’s something that’s been pursued at the NCAA level, because I think that’s where we see the biggest problems.” Arkansas State FAR David Kern worries about how the abuse can affect the student-athletes’ lives. “It creates anxiety, depression, gambling debt, other risky things. I know the impact of addiction on their life.” (link)

FootballScoop’s John Brice offers a glimpse inside the “Rat Pack Clinic,” which he describes as the “invitation-only, word-of-mouth…best kept secret and top off-the-books draw at any AFCA Convention.” The group is led by Troy HC Gerad Parker and includes coaches from all levels, including power conference ACs and FBS and FCS HCs. Parker tells Brice: “The ‘Why’ to do this is I have a lot of good friends that I love and want to help in this profession in any way that I can, and to pay tribute to Phil. Make sure you treat this profession the right way, because it will take care of you if you do that. But if you’re an asshole, you’re out. If you take care of it and treat it the right way, it will take care of you.” Parker is referencing former Charlotte AC Phil Ratliff, who passed away in 2015 and comes from Parker’s hometown of Louisa, Kentucky. This year’s iteration was standing room-only, and Brice notes the “evening usually features five or six speakers and always hits on all three phases of the game. There are some audibles this night, because taking care of the game, as Parker intones this crowd, doesn’t always mean a guarantee of job security. The Kansas City Chiefs are launching their own production company, Foolish Club Studios, which will “develop scripted and unscripted content for both shortform and longform platforms,’ according to The Hollywood Reporter’s Alex Weprin, who notes the Chiefs have “already experimented in the sector, as with last year’s Hallmark Channel film Holiday Touchdown: A Chiefs Love Story; and with the online claymation short A Kingdom Christmas Story: Hail Merry.” Weprin notes the team already has one in-house production team (65 Toss Power Trap Production group) that is focused on football content, and Foolish Club will focus more on “entertainment fare that expands the boundaries of what the team is currently doing.” Chiefs Chair/CEO Clark Hunt: “Foolish Club Studios is a tribute to my father in so many ways. My father constantly pushed boundaries and inspired innovative thinking, and that is exactly the ethos we expect this new studio to embrace as we expand our ambitions in storytelling and continue to make the game more accessible to our fans.” (link)
