The NCAA sent a memo to Division I schools today providing them with instructions on how to opt into the revenue-sharing component of the House settlement ahead of the March 1 deadline, according to Yahoo’s Ross Dellenger, who adds: “The NCAA also sent to DI members today a letter detailing the House transition team's work in developing a new LLC to manage & enforce the industry's new rev-share system.” The “named defendants – the Big Ten, SEC, ACC, Big 12 and Pac-12 - are ‘assumed’ to be opting into the settlement.” In detailing how the annual revenue-share cap is calculated, Dellenger notes the NCAA clarifies that donations tied to season tickets are not part of the calculations. In light of last week’s reporting by Yahoo’s Ross Dellenger that the Power 4 is considering the creation of a NewCo LLC to oversee the implementation of the House settlement, CBS’ Dennis Dodd posits the newly created CEO position atop the LLC “would get college sports as close to that Supreme Leader as there has ever been. … A source with intimate knowledge of the transition team told CBS Sports that the executive board underneath the CEO would probably be ‘weighted’ toward the SEC and Big Ten. However, sources say that who that CEO person (or persons) will be is less important than the penalties that can be applied. In a post-House world, that's where major college sports is likely to clash next.” Dodd also offers that “we're basically witnessing a takeover by the Power Four conferences (ACC, Big Ten, SEC, Big 12) of major college sports. They're the ones who are on record as wanting their own governance structure. They're the ones who can (largely) afford revenue-sharing. They're the ones who have (historically) broken the most rules. Now they're going to reset them.” The primary issue, noted sports attorney Tom Mars says, is the process itself, as he quips: "What can go wrong with a [new] committee that includes people that would be policing their competition?" Husch Blackwell partner Jason Montgomery adds: "It's such a nuanced specialty of a combination of quasi-legal and NCAA principles that is going to be mushed together further. People who have not had experience dealing with recruiting, athletics, basketball, football, can't speak the language." As for who would possibly head this new entity, Dodd provides five names suggested by sources: Former West Virginia AD/NCAA EVP for Regulatory Affairs Oliver Luck, former Alabama Football HC Nick Saban, former Stanford Football HC David Shaw, former Secretary of State Condoleezza Rice and former Colorado/Washington/UCLA Football HC Rick Neuheisel. More from ACC Commissioner Jim Phillips’ sitdown with ESPN’s David Hale and Andrea Adelson on Inside ACCess, during which Phillips said of the College Football Playoff: “We went into Championship Saturday, and there were two teams in the country that were not playing In the championship Saturday game for their conference, and they were secure in having a spot in the 12-team field. We had two teams participating, one which was inside the top 12 – SMU at 10 – that maybe if they lose by two touchdowns that game they’re out. That to me needs to be rectified and talked about. And if we're not going to change that – which is fine, we just all need to know what we're playing by – then what motivation is there to not protect your regular season champion – an SMU team that was 11-1, top 10 in the country? And for some reason they put themselves at risk playing in the championship game.” Phillips says of further CFP expansion: “I haven't cemented how I feel about whether it's 12 or 14, maybe 16. SBJ’s Ben Portnoy catches up with several college hoops stakeholders to get a sense of how they plan to continue increasing the sport’s value, and Connecticut AD Dave Benedict says: “The compelling things for down the road are what should the schedule look like, and should there be an expansion of games? [There] certainly shouldn’t be any limitations as to how you construct the schedule anymore. What does basketball need to do to not just maintain its historical level of interest but build on it? I don’t think that is going to happen with how we currently do things.” Big East Commissioner Val Ackerman says more attention needs to be paid to the early part of the season: “I don’t know if we could do much more to make our [conference] games more exciting. Conference tournaments on the men’s side are in good shape. It’s really, what could you do in October, November, December, maybe the summertime to provide a lift you’re not getting from the existing schedule and calendar?” NCAA SVP of Basketball Dan Gavitt also weighs in: “[These are] reasonable questions to ask and things to consider. They’re, in some ways, not new, but there are new components -- the length of the college football season and potentially NFL [schedule changes]. How do we continue to operate in those spaces and continue to make college basketball as popular as it’s been for a very long time?” (link)

The Department of Education’s Office for Civil Rights (OCR) has rescinded the Biden administration’s guidance on NIL compensation. Acting Assistant Secretary for Civil Rights Craig Trainor calls the guidance “overly burdensome, profoundly unfair, and it goes well beyond what agency guidance is intended to achieve. Without a credible legal justification, the Biden Administration claimed that NIL agreements between schools and student athletes are akin to financial aid and must, therefore, be proportionately distributed between male and female athletes under Title IX. Enacted over 50 years ago, Title IX says nothing about how revenue-generating athletics programs should allocate compensation among student athletes. The claim that Title IX forces schools and colleges to distribute student-athlete revenues proportionately based on gender equity considerations is sweeping and would require clear legal authority to support it. That does not exist. Accordingly, the Biden NIL guidance is rescinded.” (link); Congresswoman Lori Trahan (D-MA) responds: “College sports may change, but schools' legal obligations under Title IX doesn't. If Donald Trump and Republicans in Congress won't defend women's sports, the courts will have to.” (link); Senator Ted Cruz (R-TX) also weighs in: “Government intervention and mandates kill opportunities for athletes, especially in women's and Olympic sports. Alberto Osuna Sanchez, a Tennessee baseball student-athlete who competed in junior college, has filed a suit claiming that his JUCO years should not be counted. Yahoo’s Ross Dellenger notes Osuna Sanchez has a pending waiver with the NCAA to play an additional season and adds: “This is the baseball version of the (Diego) Pavia suit, which triggered the NCAA to issue a waiver to those in a similar situation. However, the waiver does not extend to Osuna Sanchez to compete in the 2025 baseball season. It extends only to those using a 4th year in Fall 25/Spring 26.” (link)

Virginia finished FY24 with $153.5M in revenue and $145.6M in expenses to finish with a surplus of $7.9M. The Virginian-Pilot’s David Teel points out that “UVA’s biggest 2023-24 upticks were ticket sales, up 17.7% to $16.6M, and media rights, up 9.2% to $33.2M. … [UVA’s] largest expenses were $30.3M for coaches’ salaries, up 2.7%, and $24.4M for scholarships, up 7.5%. Hoos Deputy AD/COO/CFO Steve Pritzker tells Teel there weren’t any financial surprises last year and says of the House settlement: “That’s something we continue to work on with the university, trying to find ways to be competitive in the changing landscape. But the court case hasn’t been settled yet, and so we’re trying to balance what’s possible without having full clarity. It would be a disservice if I gave you an (exact) answer because it might be completely different in eight weeks. We’re all taking a stab at it and doing the best we can.” (link)

Louisville generated a record $150.6M in revenue while also racking up a record $165.17M in operating expenses during FY24. The Courier-Journal’s Payton Titus notes this is the third time in the last six years the Cardinals have reported a net negative revenue to the NCAA. Titus also reports the deficit comes despite receiving $7.07M in direct institutional support, more than triple its previous high of $2.2M. Cards AD Josh Heird: "For three years (2021-2024), our men’s basketball program did not experience success, which resulted in a significant decline in revenue, reflected in our current deficit. Also reflected in the deficit are the significant expenses incurred by the men’s basketball coaching staff transition in (March) 2024. As with many of our peers, inflationary factors in Fiscal Year 2024 resulted in higher operating and salary expenses. As we enter the revenue-sharing era of college athletics, we will continue to explore every option available to us to maximize revenue while mitigating expenses. Every area of our department has a responsibility to ensure the fiscal health of our athletics department, now and into the future.” UL’s payroll increased from $49.36M in FY23 to $54.63M in FY24. Coaching salaries increased by $4.1M, while support staff and administrative salaries increased by $1.6M. UL paid out $7.58M in severance. Rutgers ranked seventh in the Big Ten in overall spending at $178.3M during FY24, trailing Ohio State ($292.7M), Michigan ($238.3M), Penn State ($215.1M), Nebraska ($213.5M), Wisconsin ($186.7M) and Michigan State ($180.5M). Meanwhile, NJ Advance Media’s Keith Sargeant notes the Scarlet Knights reported the third-lowest revenue among conference programs at $136.8M, ranking ahead of only Maryland ($127.8M) and Purdue ($134.9M). “Rutgers also received $28.6M in subsidies, the largest total amount in the Big Ten, according to the NJ Advance Media review. It reported a $41.5M shortfall, which when added to the subsidies, means the department’s deficit topped $70M for the second time in four years. Since joining the Big Ten in 2014, Rutgers’ athletic deficit has ballooned to $438.9M, according to an 11-year review of the university’s budgets.” Scarlet Knights Interim AD Ryan Pisarri: “We are continually evaluating ways to maximize our current revenues in athletics. Bringing our multimedia rights and corporate partnerships in-house has already proven beneficial for maintaining a greater share of our revenues in those areas. In addition to revenue, it will be equally important for us to examine our current operating expenditures to ensure future success. + Alabama is the latest state to introduce a bill that would exempt NIL dollars from state income taxes. If enacted, the legislation would go into effect on Oct. 1, 2025, and would be applied retroactively to Jan. 1, 2025, while remaining in effect through 2027, according to On3’s Pete Nakos. (link)
+ The "Georgia High School NIL Protection Act" has been introduced during the state’s legislative session, and NIL attorney Daniel Greene observes: “Of note, this act provides for the automatic expiration of NIL contracts after the athlete graduates high school or is no longer enrolled. + SBJ’s Ben Portnoy looks back at RevelXP’s third year in charge of the College Football Playoff’s premium experience and observes that “this year’s efforts around the CFP title game included featuring KC and the Sunshine Band as part of the Playoff Premium Champion’s Party hosted at the historic Tabernacle concert hall in downtown Atlanta, among other varying VIP events for customers throughout the weekend.” CEO Wes Day: “There are more big games more frequently and also just more games in cool, new locations that are great to travel to. We’ve seen that in fan behavior and group travel and, therefore, larger groups that we’re hosting in the regular season.” At just over a decade old, the CFP “continues to evolve as a high-profile place for decision makers and sponsors to gather,” according to Portnoy, and Day remarks: “This trend around the national championship, it’s not the Super Bowl, it is college football. ACC Winter meetings are in full swing and Commissioner Jim Phillips sat for a one hour special edition of Inside ACCess. On the ESPN contract extension: “It’s a really big deal… We’re going through a period of restabilization and this is a big anchor of that.” On the broader changes in college athletics: “There is so much change going on, but all of us are working hard to settle this thing down over a period of time to focus on the big things.” Phillips says the biggest challenges of the new world are “A combination of things. Not only are you waiting for Judge Claudia Wilken’s decision, but you’re trying to build a model that supports that judgement. How will that be documented? You have to build a portal. … You’re not only working toward that but you have a new governance structure that you’re trying to put together. … It’s no secret that the A4 is wanting to have more autonomy and more freedom, those are massive projects to be undertaken at the same time. Those are things we’ll talk about at length here.” His thoughts of protecting the ACC in the College Football Playoff, specifically as it relates to the league’s championship game: “You have to be nimble and creative. … As it is now, what motivation is there to not protect your regular season champion? If we’re not going to make sure the conference championship participants within the top 12 are protected, we need to address that.” Lots more. (link)

The Athletic’s Brendan Marks & Matt Baker report on North Carolina’s contingency planning for conference realignment as a result of Clemson & Florida State’s legal challenge against the ACC. The Tar Heels spent more than $600K on legal & professional services for the project codenamed “The Carolina Blue Matter.” Former Board of Trustees member Chuck Duckett in an email to former Board Chairman John Preyer: “We have a landing spot if things blow up. [...] Let FSU and Clemson pay the attorneys and see what happens. We all learn via their expense.” Preyer in return: “I firmly believe that ‘protecting UNC financially’ requires us to explore every available avenue to depart a conference that is in financial decline and is primarily serving its bottom tier schools. While Carolina once led the ACC, that time is long gone. The current Commissioner is not serving our best interests and simply ‘asking’ for transparency will not get us anywhere but would be a welcome change.” More. (link)

Our condolences to the UNLV community as a student-athlete on the football team passed away yesterday. A statement from the school: “UNLV Athletics was notified earlier today of the passing of a student-athlete who was a member of the football team at their off-campus residence. This is an extremely difficult day for our athletics department and the university community. Out of respect for the student’s family and pending formal notification of next of kin by the Clark County Coroner’s Office, the university has no further information to share at this time. The University is providing mental health and related support services to those in need. The cause of death will be released by the Clark County Coroner’s office.” (link)

Alabama AD Greg Byrne does not believe a financial penalty - no matter how large - will curtail court & field stormings after big wins. Instead, Byrne says it’s time to consider the ultimate stick - an automatic & immediate loss for the home team. Byrne also comments: “It's hard to think you can have enough security to hold back thousands of people that want to get on the field. You can have a show a force of it, but at the end of the day, when those folks come and get on the field, it's hard to push 'em back. That's why you have to, I believe, stop the original motion of getting them to go to the field. People say it's just a celebration. It is a celebration, but it's not a safe one.” SEC Commissioner Greg Sankey on Byrne’s idea: “I think that's a tough proposition. I do think there's more than Greg in this league who feel that way, though.” More Sankey: “A lot of people want to make their TikTok videos in that moment. We've had visiting players approached and insulted pretty aggressively, so somebody can make a video recording. Those aren't healthy realities. I've had conversations with folks at ESPN. It would be helpful if our media partners didn't glorify the moment repeatedly. We've had candid conversations about that. That certainly hasn't stopped our media partners from showing those moments.” (link)

Auburn originally planned to build a new basketball practice facility, but instead will renovate Neville Arena to the tune of $9M. The new project will be titled “Neville Arena – Team Support Improvements," and “will renovate 22,500 square feet within the arena providing enhancements to the existing practice gym, scholarship lobby upgrades, and relocated and enlarged team meeting and office spaces within the men’s and women’s basketball suites.” Why the shift in plans? Tigers AD John Cohen: “There was a time when facilities were the number one priority in terms of the recruitment of student athletes. Now, I think it’s very safe to say there are different priorities. I would say that facilities probably might not be number one or two at this point. Are they important? Yes. Are we proud of our facilities at Auburn? Yes. Are we thankful for the people, the donors, who have made these fabulous facilities happen? Absolutely, but the world has changed. We have to prepare. We have to prepare for the inevitable, which is NIL deals, amounts, payments, there’s no question that’s going to take center stage. … If you went to the NFL right now and you took the top 20-30 highest paid players, not one of them is going to say, ‘Yeah, I’m making this amount, and I’ve made more than this guy, but he’s got a nicer indoor facility than I do. So, I’m going to give back the 5 million and say I want a nice facility.’ That’s not how it works, nor in a free market, that’s really not how it should work.” (link)

D1Baseball’s Mark Etheridge delves into whether baseball in the nationally dominant SEC could ever hit a championship participation lull similar to that of its football brethren the past two seasons. Potential threats cited by Ethridge include non-SEC programs going all-in on NIL, roster caps dispersing SEC talent elsewhere, and the Pavia ruling leading to older, more experienced rosters nationwide that could counteract the SEC’s talent, but one unidentified SEC HC isn’t so sure: “I don’t think there are a lot of outside threats. The Big Ten in baseball is not a threat because they don’t invest in it. The ACC was good last year but I think with how the collectives are in the ACC compared to the SEC, I don’t see long-term threats. The biggest threat to the SEC is tearing itself apart or just losing the edge. We’re still dominating the CWS at this point. As long as the SEC keeps investing, I think the SEC will lengthen its gap.” (link)

East Carolina’s Pirate Club has raised a record $82M in new gifts and commitments over the past three years, including $23M in 2024. More than 10K individuals or businesses contributed last year, including 3,450 new donors. Women’s basketball TV numbers are in as No. 4 Texas’ 66-62 upset of No. 2 South Carolina last Sunday garnered 1M viewers to rate as the most watched WBB contest of the 2024-25 season on ESPN platforms. Sunday’s match-up at the Moody Center in Austin officially peaked at 1.3M viewers. (link)

The Duke vs. Clemson contest on Saturday peaked at 2.8M and averaged 2.1M, making it the second most watched game on ESPN platforms this season and third across all networks. Arkansas vs. Alabama averaged 1.5M viewers, peaked at 2.0M, while Iowa State vs. Kansas peaked at 1.2M with an average of 1.0M viewers.
