ACC Winter meetings are in full swing and Commissioner Jim Phillips sat for a one hour special edition of Inside ACCess. On the ESPN contract extension: “It’s a really big deal… We’re going through a period of restabilization and this is a big anchor of that.” On the broader changes in college athletics: “There is so much change going on, but all of us are working hard to settle this thing down over a period of time to focus on the big things.” Phillips says the biggest challenges of the new world are “A combination of things. Not only are you waiting for Judge Claudia Wilken’s decision, but you’re trying to build a model that supports that judgement. How will that be documented? You have to build a portal. … You’re not only working toward that but you have a new governance structure that you’re trying to put together. … It’s no secret that the A4 is wanting to have more autonomy and more freedom, those are massive projects to be undertaken at the same time. Those are things we’ll talk about at length here.” His thoughts of protecting the ACC in the College Football Playoff, specifically as it relates to the league’s championship game: “You have to be nimble and creative. … As it is now, what motivation is there to not protect your regular season champion? If we’re not going to make sure the conference championship participants within the top 12 are protected, we need to address that.” Lots more. (link)

The Athletic’s Brendan Marks & Matt Baker report on North Carolina’s contingency planning for conference realignment as a result of Clemson & Florida State’s legal challenge against the ACC. The Tar Heels spent more than $600K on legal & professional services for the project codenamed “The Carolina Blue Matter.” Former Board of Trustees member Chuck Duckett in an email to former Board Chairman John Preyer: “We have a landing spot if things blow up. [...] Let FSU and Clemson pay the attorneys and see what happens. We all learn via their expense.” Preyer in return: “I firmly believe that ‘protecting UNC financially’ requires us to explore every available avenue to depart a conference that is in financial decline and is primarily serving its bottom tier schools. While Carolina once led the ACC, that time is long gone. The current Commissioner is not serving our best interests and simply ‘asking’ for transparency will not get us anywhere but would be a welcome change.” More. (link)

Our condolences to the UNLV community as a student-athlete on the football team passed away yesterday. A statement from the school: “UNLV Athletics was notified earlier today of the passing of a student-athlete who was a member of the football team at their off-campus residence. This is an extremely difficult day for our athletics department and the university community. Out of respect for the student’s family and pending formal notification of next of kin by the Clark County Coroner’s Office, the university has no further information to share at this time. The University is providing mental health and related support services to those in need. The cause of death will be released by the Clark County Coroner’s office.” (link)

Alabama AD Greg Byrne does not believe a financial penalty - no matter how large - will curtail court & field stormings after big wins. Instead, Byrne says it’s time to consider the ultimate stick - an automatic & immediate loss for the home team. Byrne also comments: “It's hard to think you can have enough security to hold back thousands of people that want to get on the field. You can have a show a force of it, but at the end of the day, when those folks come and get on the field, it's hard to push 'em back. That's why you have to, I believe, stop the original motion of getting them to go to the field. People say it's just a celebration. It is a celebration, but it's not a safe one.” SEC Commissioner Greg Sankey on Byrne’s idea: “I think that's a tough proposition. I do think there's more than Greg in this league who feel that way, though.” More Sankey: “A lot of people want to make their TikTok videos in that moment. We've had visiting players approached and insulted pretty aggressively, so somebody can make a video recording. Those aren't healthy realities. I've had conversations with folks at ESPN. It would be helpful if our media partners didn't glorify the moment repeatedly. We've had candid conversations about that. That certainly hasn't stopped our media partners from showing those moments.” (link)

Auburn originally planned to build a new basketball practice facility, but instead will renovate Neville Arena to the tune of $9M. The new project will be titled “Neville Arena – Team Support Improvements," and “will renovate 22,500 square feet within the arena providing enhancements to the existing practice gym, scholarship lobby upgrades, and relocated and enlarged team meeting and office spaces within the men’s and women’s basketball suites.” Why the shift in plans? Tigers AD John Cohen: “There was a time when facilities were the number one priority in terms of the recruitment of student athletes. Now, I think it’s very safe to say there are different priorities. I would say that facilities probably might not be number one or two at this point. Are they important? Yes. Are we proud of our facilities at Auburn? Yes. Are we thankful for the people, the donors, who have made these fabulous facilities happen? Absolutely, but the world has changed. We have to prepare. We have to prepare for the inevitable, which is NIL deals, amounts, payments, there’s no question that’s going to take center stage. … If you went to the NFL right now and you took the top 20-30 highest paid players, not one of them is going to say, ‘Yeah, I’m making this amount, and I’ve made more than this guy, but he’s got a nicer indoor facility than I do. So, I’m going to give back the 5 million and say I want a nice facility.’ That’s not how it works, nor in a free market, that’s really not how it should work.” (link)

D1Baseball’s Mark Etheridge delves into whether baseball in the nationally dominant SEC could ever hit a championship participation lull similar to that of its football brethren the past two seasons. Potential threats cited by Ethridge include non-SEC programs going all-in on NIL, roster caps dispersing SEC talent elsewhere, and the Pavia ruling leading to older, more experienced rosters nationwide that could counteract the SEC’s talent, but one unidentified SEC HC isn’t so sure: “I don’t think there are a lot of outside threats. The Big Ten in baseball is not a threat because they don’t invest in it. The ACC was good last year but I think with how the collectives are in the ACC compared to the SEC, I don’t see long-term threats. The biggest threat to the SEC is tearing itself apart or just losing the edge. We’re still dominating the CWS at this point. As long as the SEC keeps investing, I think the SEC will lengthen its gap.” (link)

+ You don’t see this every day. Clemson Baseball HC Erik Bakich will serve a two-game suspension stemming from last year’s Super Regional ejection. As such, he is not allowed in the stadium. Instead, he will be calling the game from his hotel room across the street on the Tigers’ flagship station 105.5 The Roar. Bakich: “I can’t get ejected on the radio. So I will be commentating to the best of my ability with our folks on Clemson Athletic Network. I’ll be on the radio doing my very best from there. Yeah, weird kind of dumb rule. Can’t even step foot in the stadium. But whatever, we’ll make the best of it.” (link)
+ According to Law360, Michigan State told a federal judge “it’s time to permanently toss its former football coach’s wrongful termination suit, saying Mel Tucker has repeatedly failed to plausibly allege that his firing was motivated by money, race or university leaders’ self-interest.” (link)

Northern Arizona AD Mike Marlow announces he will retire at the end of the month after seven years leading the Lumberjacks. SBJ’s Ben Portnoy talks to a number of stakeholders around the industry to get a sense of if the College Football Playoff’s expanding footprint is impacting Men’s Basketball. NCAA SVP of Basketball Dan Gavitt: “[That] is undoubtedly true at some level. But in real, practical terms, I don’t know that from a viewership and attendance standpoint, it had as dramatic an impact as I thought it may.” ACC Commissioner Jim Phillips offers an additional perspective: “People talk about ‘March Madness’ quite a bit, which is still the greatest tournament that there is in sports. That can’t be the [only] focal point. There has to be a meaningful and a visible regular season that draws the interest of fans when there’s direct competition in the marketplace, specifically football.” Color UConn AD David Benedict a bit skeptical: “Look, I don’t think because the College Football Playoff is going longer that people are deciding, ‘Hey, I’m not going to watch basketball on Tuesday, Wednesday, Thursday, Friday, Saturday, because there’s a football game on Monday.’ If you like college basketball and there’s good content on, then I think you’re going to watch it.” Tennessee AD Danny White provides another voice: “We’re playing 15 games before you hit January — that’s half the season. And then, at the same token, we’re playing a boatload of baseball and softball games before basketball season is over and before the sun comes out most places in the country. I just think there’s a smarter way to do it. We should probably stop competing with ourselves in terms of the overlap of sports and try to have greater emphasis and a better platform and spotlight for each sport to stand alone, and let our fans and everyone celebrate it and focus on it more.” Lots more. Florida State AD Michael Alford, along with Miami (FL) peer Dan Radakovich, sat down with ESPN’s Andrea Adelson & David Hale from the ACC Winter Meetings as the pair discussed revenue sharing & the future of college athletics. Alford on how his job has changed as a result of the House settlement & other notable developments over the past two years: “100% it’s changed, but it’s changing for the better. The House settlement continues to look like it’s going to end in April, which puts everything on a level playing field. But then looking at your budget and everything it’s going to impact, the redistribution of those dollars, and planning for it has changed (the job) a little bit. I go back to my 10 years in the NFL of how we evaluated Fair Market Value and how we evaluated that and now how that’s going to come into play. So it’s pretty similar, just with a collegiate twist on it. [...] We’ve known it’s coming, so we’ve been preparing about how we’re going to adjust our business practices.” Radakovich: “It’s also changed day-to-day how we work because we grew up in a very different collegiate athletics business than what we have today. Today, it is more about how we are getting the resources that we need to fund a new $20M expense. Michael being at a public institution, Miami being a private institution, we go about it in different ways, but at the end of the day it’s still a resource that needs to come forward from somewhere. Both institutions see the value of athletics to the university brands, alumni bases and realistically for the State of Florida, because us along with the University of Florida, we’re the biggest brands in the state. Protecting that and making sure we continue to move forward as an athletic program and as a good part of the institution, that takes up a lot of the day.” Alford goes on to say he’s most worried about not losing “winning edge resources” for sports other than Football to ensure a premium student-athlete experience and continued championship opportunities. More. (link)

Oregon State AD Scott Barnes says he can foresee hiring a General Manager in the future to lead revenue-share decisions for Football, but for now it’s a process fully up to Beavers HC Trent Bray. Barnes: “The growth of our NIL program will eventually dictate hiring an executive-level position that will oversee all of it.” Barnes also indicates a decision on whether or not to hold a spring game is also Bray’s call. (link)

Per James Moore & Co. partner Katie Davis, the Department of Education’s memo regarding Title IX’s impacts on NIL has been removed from its website. (link); Meanwhile, the Department of Education is “urging” the NCAA “to restore to female athletes the records, titles, awards, and recognitions misappropriated by biological males competing in female categories.” (link)

Until the full Big 12 revenue share kicks in, the Houston athletic department will receive a loan from a university endowment to address its $9-10 million shortfall. As the Cougars work to double their annual budget, Chancellor Renu Khator says: “I think athletics should have the same resources that I see other teams in my league in the Big 12 because if we don't have resources, how are we going to have the tools they need to be successful? If we all want to win, then we've got to give them tools.” (link)

ESPN’s Max Olson digs into Texas Tech Football’s haul from the transfer portal as billionaire booster Cody Campbell, who doubles as the Founder of The Matador Collective, was prepared to invest upwards of $5M into new additions & wound up spending double that with 17 new transfer student-athletes. Campbell points back to preparation that started back in the summer: “A few people caught on later, but nobody was ahead of the curve like we were in terms of planning for it. [...] We are going to have the most talented roster in the conference, and I don't think it's going to even be close. We have never, ever been in that position.” Interesting nugget from Red Raiders GM James Blanchard: “You might watch tape and be like, 'The NFL likes this guy? I don't really like him.' Listen, they got way more information than we do. So, take the ego out of it. If the NFL is saying this guy is a sixth- or seventh-round draft pick ... let's lean towards the guys who do this all the time and let's have an advantage.” Also: “Campbell declined to disclose contract terms, but sources told ESPN that all three (new student-athletes) signed deals exceeding $1 million for 2025.” (link)

More NIL Today…
+ According to Kennyhertz Perry attorney Mit Winter, a newly introduced Utah NIL bill would permit schools, “institutional marketing associates” and other third parties to compensate student-athletes without fear of NCAA penalties, while also outlining that student-athletes aren’t employees because of direct payments and making contracts between schools & athletes public records. Winter notes a number of conflicts he sees between the bill and the proposed House settlement, including no mention of a cap on school payments and that “it would appear to allow collectives to pay athletes without fear of the NCAA/new enforcement entity enforcing the House settlement’s restrictions on collectives.” (link); Complete bill text. (link)
+ A bill introduced in Arizona would prohibit conference and athletic associations from stopping schools from compensating student-athletes for utilizing their NIL per SUNY Cortland sports law professor Daniel Greene. Additionally, receiving NIL compensation wouldn’t affect student-athlete employment status or classify them as employees. (link); Full bill. (link)
