Buchalter attorneys Douglas M. DePeppe and Robert B. Hinckley Jr. are asking U.S. District Court Judge Claudia Wilken to “enjoin the NCAA from taking any further action regarding the House v. NCAA case, unless or until the court grants final approval after a scheduled hearing on April 7,” per Sportico’s Daniel Libit and Michael McCann. The pair are representing an “unrepresented sub-class” & here’s their core argument: “Requiring schools to opt in to roster limits before the court has even ruled on any filed objections is putting the cart before the horse, further jeopardizing athletes who may be cut from their teams before the settlement is approved.” More from Libit & McCann: “Although not a formal motion for an injunction or restraining order, the letter calls for a significant move by Judge Wilken, who has not expressed opposition to the NCAA’s March 1 deadline.” (link)

CollegeAD shares details of Towson AD Steve Eigenbrot’s extension, which runs through May 31, 2030, and includes a base pay of $325K. While the salary figure remains unchanged, Eigenbrot received a $50K contribution to his deferred compensation plan before January 1 and is set to receive another $15K before June 1. He can earn another $15K and $20K over the next two years, respectively. Additionally, Eigenbrot is in line for a $15K bonus as long as the APR score is 980 or higher for each team. Should Eigenbrot leave before the contract expires, he would owe $150K in 2025-26, $100K in 2026-27, $75K in 2027-28, $50K in 2028-29 and $25K in 2029-30. The buyout figure is reduced by $25K if President Mark Ginsberg is no longer in office. (link)

As part one of his series on the “new-world Pac-12 schools,” JohnCanzano.com’s namesake spent two days on the Boise State campus and in town and observed: “The air is clean. The people are friendly and passionate. The downtown streets have ample parking. But what’s immediately evident is that the community views Boise State as the local major professional sports franchise.” Broncos AD Jeramiah Dickey recognizes that: “We’re the biggest brand in the state. We’ll be on the plus side within 3-5 years if we do it right. … We have to always be thinking about what’s next. We can not settle. We can not find success and stop — you have to double down. … We don’t need what everyone has. We just need more than we’ve got. We’ve got to go out and find more.” When asked why the Broncos took up the Pac-12 on its offer to join the league, Dickey: “The purgatory of ‘maybe’ is worse than making the wrong decision. We are running a business, and you have to make business decisions. We could all see where the industry was heading.” Canzano notes that in December, Dickey met with high-level Boise State donors as the football team prepared to play Penn State in the College Football Playoff. In discussing his vision for the department, freshly minted Villanova AD Eric Roedl explains that “our football program is a real program of excellence, and we’ve sustained success for a long period of time. Villanova has a good thing with where our program is right now. We’re always going to explore the best path forward, but I don’t think there’s any sense that would change for football right now. We just want to provide resources and continue to build the brand around Villanova football here.” Roedl also says that in a post-House world “there’s a place for a school like Villanova, and our national brand is as strong as anybody’s. We’re going to have to be aggressive. We’re going to have to go out and really educate our donor base, our fan base, on what it’s going to take to be successful and to continue to compete for national championships. So, there’s going to have to be a change in mindset.” (link)

The Mercury News’ Jon Wilner back-of-the-napkin maths the media rights situations for the Mountain West and Pac-12 and explains that “according to industry experts, media valuation analysis focuses on the games controlled by the conference in question. In other words: on home games. … In all, the new Pac-12 played 27 home games listed in the SportsMediaWatch ratings database; those averaged 639K viewers. There were 14 Mountain West home games listed; they averaged 323K viewers. If you’re scoring at home, a trend should be emerging. The new Pac-12 averaged 26% more viewers than the new Mountain West in all games (720K compared to 535K). But the Pac-12 audience was double that of the Mountain West (639K to 323K) when we filtered for home games only – in part because the Northern Illinois-Notre Dame number is removed. Spoiler alert: As we continue to drill down, the disparity will increase.” Ultimately, Wilner calculates that if the Mountain West’s per-school distribution remains at $3.5M, the Pac-12 could expect to bring in upwards of $10M per school. “Or perhaps the new Mountain West only receives $2.5M per school, meaning a 3x valuation results in the new Pac-12 collecting $7.5M.” (link)

Connect’s Bryan Fischer sits down for a wide-ranging Q&A with SEC Men’s Basketball Assoc. Commissioner Garth Glissman at the 2025 NCAA Convention. Glissman discusses how his background as a corporate attorney and the NBA’s VP of Basketball Operations informs his role now, what SEC coaches and administrators have tasked him to take on, thoughts on the potential for tournament expansion, using the NFL’s marketing model to shape how the league promotes hoops SEC and more. With the House settlement approaching, Glissman tells Fischer he’s encouraging coaches to “engage in thought exercises across a variety of contingencies and, I think they need to be thinking in if-then scenarios and be flexible in their thought exercises. I've also encouraged them to study the pro sports models because…in pro sports you have a roster and every player theoretically could be making a different salary amount, could be on a different contract in terms of its duration. … What we are now undertaking in college athletics is something that pro sports has been doing for many decades and so a lot of lessons can be learned in terms of what does roster building look like? A bill introduced this week in the West Virginia House of Delegates would prohibit the NCAA from investigating athletes for NIL activities. It would also allow institutions to provide NIL dollars and share revenue and prohibit athletes from engaging in specific NIL deals, including alcohol, drugs, tobacco and gambling. The bill also states that “nothing in this article shall be construed to qualify a student-athlete as an employee of an institution because the student-athlete engages in name, image, or likeness opportunities.” (link)

On Montlake’s Christian Caple obtained a blank revenue-sharing MOU template from Washington and reports: “The agreement permits the school a sub-licensable, transferable license to use just about any conceivable facet of the athlete’s name, image and likeness for the duration of their eligibility. If an athlete transfers, the school agrees to make a ‘reasonable attempt’ not to use their NIL to promote them as part of the program, but retains the right to ‘archival uses and historical signage,’ as well as other uses that do not imply current team membership. The school also is ‘permitted to sell-off’ any existing products featuring the athlete’s NIL after a transfer.” Additionally, the school and its sublicensees are not required to discontinue use of the athlete’s NIL after their eligibility expires, but they can’t use the athlete’s NIL to sell goods or services. Caple goes on to write: “Yes, schools are still pretending this isn’t pay-for-play. Per the MOU template: ‘The parties understand and expressly agree that the Consideration is not provided in exchange for the Athlete’s commitment to attend the Institution or participate in the Institution’s Program (i.e., not ‘Pay-for-Play.’). This clause seemingly is at odds with another clause which dictates — in bold font, even — that the school, ‘after good faith discussion with the Athlete,’ may increase or reduce the agreed-upon compensation relative to the athlete’s ‘NIL value.’ In fact, the MOU states, the proposed payment structure is ‘a projected amount based on the current promotional value of using the Athlete’s NIL.’” More from Caple. Former Homeland Security House Committee staffer Matthew Wein pens a guest post for Extra Points on the topic of gambling. “The leagues that have the most to lose from a major gambling-related incident are unsurprisingly the four major North American leagues (MLB, NBA, NFL, and NHL) and the major collegiate conferences. They are also the entities that have the resources to design and implement a scalable solution. … Now, the major sports leagues are all independent entities and it doesn’t make sense nor does it seem feasible for there to be an American Sports Commissioner to serve as a sort of Czar overseeing all sports in the United States. And now we are seeing threats bleed across sports. As mentioned above, the federal investigation that began with Jontay Porter expanded to fellow NBA player Terry Rozier and now includes at least three men’s college basketball programs and maybe more. There are business and security benefits to the leagues collaborating and cooperating publicly, not just with each other, but also with the betting platforms, to maintain the integrity of their individual sports and sharing information on common threats and known gambling cheats. … Rather than leave this matter (and their sports’ reputation) to the States, leagues ought to take on this effort and leverage the existing tools, or use their tools as a template to create their own, in-house tools. Over the New Years holiday we saw the real life harms associated with the threats linked to sports gambling—even if those links are somewhat indirect. We have entered an era where, to paraphrase cybersecurity expert Josh Corman, threats from bits and bytes will have a real impact on flesh and blood.” Lots more. (link)

Major League Baseball & ESPN will officially go their separate ways after the upcoming season, putting a high-profile sports rights package back on the open market. The deal could have continued for three more years at $550M annually, but MLB Commissioner Rob Manfred pointed to a “shrinking platform” in some strong words: “...we do not believe that Pay TV, ESPN’s primary distribution platform, is the future of video distribution or the best platform for our content. As of December 2024, ESPN was available in 53.6M homes, down from its peak of over 100M homes in 2011 and 69M homes when we struck the current deal in 2021. Furthermore, we have not been pleased with the minimal coverage that MLB has received on ESPN’s platforms over the past several years outside of the actual live game coverage.” If that figure of 53.6M makes you pause, it should. Former Fox Sports Networks President Bob Thompson: “Manfred is saying ESPN is down to 53 million? Nowhere near the numbers anyone is reporting for ESPN.” (link)

North Carolina AD Bubba Cunningham addresses UNC’s conference realignment exploration dubbed the Carolina Blue matter, telling The Athletic’s Matt Baker and Brendan Marks: “We had two conference members sue the conference. You don’t know what the outcome is going to be. So just doing our due diligence of ‘What are some scenarios that could happen? And how do we best position ourselves for a future that is uncertain?’ That’s as simple as it is. … It’s not quite the Magnificent Seven, but it’s OK.” Meanwhile, Baker and Marks report the “Carolina Blue matter is now a matter for the Orange County (N.C.) Superior Court because of a public records lawsuit filed Wednesday. David McKenzie, a local lawyer whose work includes First Amendment cases, accused UNC of illegally withholding its full legal bills with Skadden – documents he had requested under public records laws. His suit also contended that vague bills UNC has released appear to be a “deliberate effort to create a misleading public-facing record.” Cunningham goes on to tell Baker and Marks that UNC never came close to engaging in legal action against the ACC, explaining that “we were in a holding pattern, but we didn’t think it was necessary for us to file.” Documents indicate that UNC was engaged with Skadden through at least November, but Cunningham says he doesn’t know whether the Tar Heels are still contracting with the firm. He does say of Skadden’s work that it was more internally focused on UNC — the school’s brand value, for instance, and its most attractive qualities should future realignment occur — than surveying the larger landscape. North Dakota AD Bill Chaves has released a statement on the House settlement that reads, in part: “Here's the odd part: The NCAA is requiring that we declare whether we plan to opt in by March 1, while the lawsuit's settlement will not occur until April 7. Here's the other odd part: Schools such as UND had no voice in the settlement, yet we would still have to pay damages, whether we ‘opt in’ or not. Today we indicated to the NCAA our intent not to opt in at this time. We believe this is the most responsible course of action, as the lawsuit has not yet been settled, and all the conditions are not yet known. Of course, we will revisit this decision at this time next year or post the settlement decision on April 7th. … The NCAA proclaims student-athletes will receive ‘extra benefits’ if a university ‘opts in.’ This may be the case for some, but in the aggregate and if you consider the roster limits for all sports, this settlement might actually harm sports and student-athlete participation at UND as well as other student-athletes around the country. Further, if one asks the right questions, you may actually discover that schools such as UND might be supporting student-athletes in a greater way financially than some ‘opt in’ schools. Without any input from member institutions, the NCAA made another curious decision recently (February 12th). Schools that compete across multiple divisions (DI, DII and DIII) are now allowed to ‘opt in’ to their specific Division I sports on a program-by-program basis. This decision gives these schools a special status and benefit that are not conferred to broad-based Division I programs like UND. … Sponsoring broad-based programming is a long-valued tenant of the NCAA that is being trampled on by this decision.” (link)

Syracuse has launched Champion 'CUSE: The Campaign for Syracuse Athletics, a $50M fundraising effort that will focus on “attracting and retaining champion-caliber student-athletes while ensuring they have access to best-in-class resources, facilities and the training needed to perform and excel at the highest levels.” Orange AD John Wildhack: “College athletics is evolving at warp speed, but one thing remains the same: Syracuse Athletics will continue to cultivate outstanding student-athletes who win championships, succeed in the classroom and contribute meaningfully to our campus, their communities and society." Arizona is implementing a Competitive Fee for season tickets for 2025-26, including a $50 fee for each football and men’s basketball season ticket and a $25 fee for women’s basketball, baseball and softball. A note from the athletic department also indicates the Wildcats have “reduced expenses in other areas, renegotiated vendor contracts, worked aggressively on securing corporate sponsorships, restructured the department’s debt and reimagined our philanthropic initiatives.” (link)

The SEC appears to be inching closer to a nine-game football slate, particularly if the league secures four AQs to the College Football Playoff, according to The Athletic’s Seth Emerson. SEC Commissioner Greg Sankey yesterday indicated there is a “lot of interest” in going to nine games as some schools who were against it have changed their minds. “I think people change. Positions change. There’s been a lot of phone calls in advance of the meeting: ‘What are you thinking? What do we need to look at? Are there different ways to form this?’” On the media side, Emerson notes there are a few reasons ESPN may be willing to increase its payout to the league for the additional conference game: “The situation with the ACC appears to be stabilizing, so there’s some certainty there. Then there’s the CFP contract, which ESPN agreed to in March 2024, going through the 2031 season. Perhaps more importantly, there are the ratings from the 2024 season. … The SEC had six of the 10 highest-rated non-Playoff games, and 15 of the 21 highest-rated games involved at least one SEC team. If the SEC goes to a nine-game schedule, certain rivalries will continue to be played every year.” Asked when the league ultimately needs to decide whether it will add a ninth game, Sankey replied: “Right before we send out the press release.” (link)

Texas Attorney General Ken Paxton is seeking a temporary restraining order against the NCAA, claiming its new policy that prevents biological men from participating in women's sports attempts to circumvent President Donald Trump’s executive order. Paxton: "The NCAA's sleight of hand is designed to intentionally deceive consumers into believing that biological men are no longer allowed to participate in women's sports. Far from aligning with President Trump's executive order or basic reality, the NCAA's new policy treats sex as a changeable characteristic determined by a birth certificate instead of biology. I am asking the court to enjoin the NCAA from continuing these deceptive schemes and protect women's sports." Outkick’s Armando Salguero: “Granting the TRO could put pressure on the NCAA to answer questions as to why it claims to abide with the President's Executive Order when, in fact, biological men can continue participating in women's sports as long as they simply change the sex on their birth certificate.” (link)

Illinois is the latest state to consider legislation that would exempt student-athletes’ NIL compensation from income taxes. Representative Travis Weaver (R-93), the bill’s sponsor, tells CBS’ Richard Johnson: "The nice thing about this is it's not existing revenue, which I think makes it a lot easier. It's hard to cut a tax when it's something that you have been collecting and it's baked into your budget, whereas this, we've never been taxing, NIL [income], not to mention that there hasn't really been any, right? … The reality is, we're going to collect more tax revenue when Illinois football is successful. We're going to sell a heck of a lot more tee shirts and baseball caps, and we're going to have more people staying in our hotels, and they go to the U of I for games. So I think we’ve got to continue to be competitive in sports, and we've got to keep up with what other states are doing." James Moore & Co. Partner Katie Davis notes bills like these may face hurdles before being signed into law: "To me, [these bills are] the definition of special interest and shows just how important college sports are as a whole. … It doesn't include other college students who are earning an income. It doesn't include other influencers that are using their name, image and likeness. [The Georgia bill] doesn't include NFL players that are either playing for the Falcons or playing against the Falcons and the Jock tax that they're charged. So it's just very specific." (link)

So Long Spring Games…
+ Texas will not have a spring football game this year, and Longhorns HC Steve Sarkisian explains that part of the reason is because the team has played 30 games over the past two seasons. Additionally, this year’s team has a lot of young players, “so the development that’s needed for these guys to get ready for the fall is a little bit different than it used to be. So our approach is going to be a little bit more NFL-driven, kind of more of an OTA style early on, and as we grow into more of the scrimmage formats in the second half of spring ball, I just don't know if rolling the ball out and playing the game when we only get 15 practices is the best for us to maximize the opportunities that we get.” (link)
+ UCF is also unlikely to play a spring game, according to Knights Senior Assoc. AD for Brand Communications Adam Widman, who explains: "Given our current stadium construction, we are exploring other options. There will be some scrimmages that will be open to the public. Our goal is to give fans the opportunity for more of an in-depth look at the team via these open practices. … This enables fans to come out multiple times to watch the players practice and scrimmage. We also are opting not to broadcast our games or scrimmages, which is in line with more than half of other Big 12 schools.” (link)

Georgia is set to debut the new-look Foley Field this baseball season after completing a $45M renovation that includes a new playing surface, a high-tech pitching and hitting facility, and a new team lounge. Bulldogs AD Josh Brooks: “You have a vision for what you want to build, and the space looked really tight and small. It was hard to appreciate it in drawings. Getting to see it in real life, up close and in person, it’s remarkable. I gave (UGA athletic staff members) Matt Brachowski and Tanner Stines a hard time saying they really underpromised and overdelivered on this one because it really kind of blew my mind of how much space they were able to create there.” The grandstand has an extended canopy to provide more shade and there is a new section for seating down the third base line, stretching down to field-level past the relocated Georgia dugout which is closer to the team’s new training facility. Denver announces renovations to Peter Barton Lacrosse Stadium in a project titled "Barton 2027." The Pioneers have secured initial gifts totaling $3M to support the renovation, which is already underway and includes a new Daktronics videoboard with a 70% increase in digital space compared to the previous board. This offseason's upgrades also include the installation of a wall ball training area on field level, field shot clocks and a renovation of the Sie Tower that currently hosts the Gold Club members on game days.
