More on Delaware AD Chrissi Rawak no longer leaving her position with the Blue Hens to take over as USA Swimming’s CEO. A statement from USA Swimming yesterday: “In the past few days, USA Swimming was made aware, for the first time, of the existence of a report that was filed with the U.S. Center for SafeSport after Chrissi Rawak’s appointment was announced. These matters, which we are only now coming to understand, were previously unknown and were not disclosed to USA Swimming during the rigorous vetting process of Ms. Rawak. This process was led by a reputable search firm and a dedicated stakeholder task force, followed well-established best practices, and was conducted with the highest possible degree of due diligence, including external reference and background checks. Immediately upon receiving limited information from the Center earlier this week, USA Swimming raised the matter with Ms. Rawak (with approval from the Center, which has exclusive jurisdiction over this claim), at which point Ms. Rawak informed us of her decision to resign. We are and remain bound by confidentiality obligations under the SafeSport Code, which we take very seriously in order to protect the integrity of the reporting process and of any athletes involved. This matter remains exclusively with the Center.” (link)

The NCAA has distributed new guidance on the timeline to opt into or out of the House settlement as a memo indicates March 1 for those who intend or “believe they are likely to provide benefits. [...] The March 1 date is intended to provide an estimate of the volume of institutions that will need to be onboarded and trained.” Further, the formal opt-in timeline is no later than June 15 with the caveat of “If the settlement is not approved by June 15, 2025, this date will be revisited.” (link)

St. Bonaventure AD Bob Beretta on opting into the House settlement: “In full disclosure when we started speaking about this back in the fall, I was not of a mind that that we should opt in and and the more I’ve researched, talked to colleagues, talked to conferences, I feel like we have no choice but to opt in now, because the opportunity costs of not opting in could be devastating to our success. [...] I just had a conversation with someone at the Atlantic 10 yesterday and they said they don’t see how any school in the Atlantic 10 will be able to remain competitive if they don’t opt into this agreement because of the fear of that $600 limit, it could be very restrictive on attracting players and retaining talent. And we want the best possible student-athlete to attend St. Bonaventure. We want them to be excellent academically, excellent socially, excellent athletically, and it’ll be very difficult to attract players without the certainty of being able to share enhanced benefits with them. I think we’ve heard this many times and you see it in baseball. Investing, spending money doesn’t guarantee success, but if we don’t invest, it almost guarantees failure. It just doesn’t give us an opportunity to get to the starting line.” Bonnies President Dr. Jeff Gingerich: “That portion of the settlement, $260,000 per year, we will be receiving that much less each year, which we generally count on, for the next 10 years. But that’s regardless of whether we opt in or whether we do not opt in. I’ll be very transparent that I actually consider that to be very unfair for schools like ours to be paying back players of other universities, but that’s one of the realities of the court case and it doesn’t depend on whether we opt to or not.” (link)

Canisius will not opt into the House settlement for next year as Golden Griffins AD Bill Maher comments: “We think the most prudent thing to do is to take the year and make sure how it all shakes out, if the settlement is approved, and what the best course of action is.” Meanwhile, Niagara AD Simon Gray indicates the Purple Eagles will opt in: “We felt the need to adapt to the modern era of college athletics and align ourselves with the most competitive sector of Division I. [...] We’re cognizant of what’s happening, and we’re thinking creatively, of innovative ways we can find resources. Primarily, though, it’s going to be fundraising and activating those that are passionate about Niagara athletics and willing to step up and help us be competitive. Any form of revenue generation is on the table, but we’ve got to do this within the mission of Niagara. That is not up for debate.” (link)

Saint Joseph’s AD Jill Bodensteiner and Kraft Analytics Group CEO Jessica Gelman sat down with AthleticDirectorU’s Tai M. Brown for a discussion on data analytics and its role in revenue generation for athletics departments. Gelman shares insight from KAGR’s work with the NCAA to create a fan database and offers Bodensteiner advice on how to utilize Saint Joseph’s current resources to effectively translate data from third-party partners into tangible action items to enhance fan engagement and donor relations. Bodensteiner sums up her intention for tapping into the power of data analytics by pointing to the ability to make “data-informed decisions,” generate revenue and create departmental efficiencies. Bodensteiner notes that through various development initiatives, alumni could conceivably receive multiple phone calls from SJU per week, so “it just looks like the left hand's not talking the right hand. Meanwhile, they're getting daily emails from Barnes & Noble because they purchased something online and so it's really important to us – and I think a lot of Institutions, including ours – have been so afraid of that, that we've said, ’Stop, let's be careful on how we outreach.’ So I think we were almost so concerned about overdoing it that we’re now undergoing it, so we’ve got to find that sweet spot.” Gelman explains that “the first piece of work and analysis” that should be done is to determine how many emails are stakeholders getting because “you want to reach them…with the right product at the right time with the right message, which is “one of the consistent challenges of not having a golden record of how that person is interacting and engaging.” More on ADU. Extra Points publisher Matt Brown examines U.S. Soccer’s proposal to overhaul the college soccer model and shares a presentation deck shown to coaches at the United Soccer Coaches Convention in December. While the proposal pointed out multiple times that U.S. Soccer would eventually want to support “all of college soccer across the men’s and women’s game”, the organization proposed a “pilot program” centered around schools from the largest conferences. According to a different version of the proposal circulated earlier in 2024, the pilot program was specifically centered around the Big Ten, ACC, and a handful of SEC, Big 12 and Mountain West programs that sponsor men’s soccer. Rather than playing in traditional conference affiliations, the U.S. Soccer proposal called for these schools to organize around geographic lines. These teams would then play in a national tournament in the spring at the US National Training Grounds in Atlanta rather than the NCAA Tournament in December. Brown notes that as it stands now, teams who wish to remain NCAA members in good standing must play in the NCAA Tournament. “Could that rule be changed in the future? Sure, although the industry folks I’ve talked to have said there isn’t a formal effort to do that at the moment. But any push to make these changes would need the buy-in and deep involvement of conference commissioners, athletic directors, and potentially even university presidents. It’s not something that college coaches could do on their own.” Meanwhile, Brown points out that “if the goal of a pilot program was to center around the best men’s soccer programs, or even the ones that invest the most, administrators tell me you wouldn’t draw the line at just the Big Ten, ACC and various FBS friends. That would not create the best on-field product, and could dramatically cheapen the value of the NCAA Tournament.” Furthermore, Brown believes it will be “very important for U.S. Soccer to shift more of their conversations away from just coaches” and more towards ADs and conference leaders. Sheppard Mullin Partner/Sports Industry Team Co-Head Brian Anderson makes the case in an SBJ op-ed that private equity – which he distinguishes from private credit – can revolutionize college sports. “Private equity investors offer athletic departments more than immediate capital. By leveraging their operational expertise and the resources of their portfolio and network, they can help programs improve their business models and operations. This support might include implementing cutting-edge technologies to enhance fan engagement, branding, performance analytics, stadium commercialization and digital transformation, positioning athletic programs for sustained success.” That said, Anderson acknowledges there are complications, particularly as they relate to Title IX and athletic department budget structures, which fall under the umbrella of the university. Ultimately, Anderson concludes that “private equity will invest in college sports, but initial efforts may target a small number of elite college football programs. These programs are likely to adopt innovative legal and governance structures to navigate current uncertainties. As these models succeed, other schools will need to adapt to remain competitive, potentially paving the way for broader private investment opportunities. Over time, private equity is positioned to fundamentally reshape college sports.” (link)

One Power 4 football scouting director tells The Athletic’s Sam Khan Jr. that “as someone who sat in staff meetings in April and May hearing about two of our freshmen that had been on the campus for four months who were getting calls from other schools because of how they were doing in spring ball and the spring game, yeah, I totally get where coaches are coming from” when it comes to canceling spring games due to tampering concerns. Others called the concerns “overblown” given the timing of the spring portal window, with one P4 recruiting coordinator remarking: “I’m not turning on ESPN to watch Nebraska’s spring game. That’s not going to do anything for me. When guys go in the portal, we go and watch the film from the fall. We’re not watching spring practice tape. That’s not what we’re making our final evaluation on.” Tulane HC Jon Sumrall adds: “If they’re gonna leave, they’re gonna leave anyways. So I don’t waste a lot of time or energy thinking about [who’s watching our spring game].” TCU HC Sonny Dykes brings up another angle, which is players using spring games as a bargaining chip, and says: “If you’re going to expand the College Football Playoff, if you’re going to keep the (spring) transfer portal, then I think spring football probably doesn’t make a whole lot of sense. Maybe the first three weeks of June now start to make sense, where you have OTAs.” Ultimately, Sumrall just wants to make sure his players are getting reps: “Let it be known that football practice is good for having a good football team. … This is a developmental game. We need to practice football, whether you tell me I can do it in March, April, June, whatever, we’ll figure it out.” (link)

Powerade is launching the “It Takes More To Get This Far” campaign ahead of March Madness, and SBJ’s Xavier Hunter notes Connecticut men’s hoops student-athlete Alex Karaban, NC State women’s basketball student-athlete Saniya Rivers and Arizona men’s basketball student-athlete Caleb Love, each of whom were added to Powerade’s collegiate roster in December, are featured in the campaign. Hunter also notes the “national campaign includes a 30-second TV spot. Supporting content and activations will be featured on streaming CTV as well as online platforms, digital, social media, programmatic, out-of-home, and retail extensions throughout the tournaments. Powerade is also partnering with more than 35 NIL athletes for supporting digital and social media content.” Coca-Cola’s BodyArmor Sports Nutrition Division CMO Thomas Gargiulo says the increasing number of competitors in the market has led the brand to shift its marketing approach: “In the past it was traditionally through your mass media vehicles. Now looking at how we’re trying to tap into that younger consumer base, we’re looking at influencers [and] that’s why we’re looking into more social media-driven communication.” The campaign’s creative was made by WPP OpenX and led by Ogilvy. Delaware AD Chrissi Rawak will not be the new CEO of USA Swimming after all, with the organization’s board of directors releasing the following statement yesterday: “USA Swimming today announced that, due to unforeseen personal circumstances that we learned about late this week, Chrissi Rawak will not assume the role of President and CEO. Shana Ferguson remains in place as Interim CEO. While this outcome is not what we expected or hoped for, we maintain the utmost confidence in the strength of our organization, leadership team, staff and strategic direction.” (link)

Big East Commissioner Val Ackerman and National Sports Law Institute Executive Director Matt Mitten held a debate with Athletes.org Co-Founder Jim Cavale and KVD Strategies Founder/former FTC attorney Katherine Van Dyck about whether the NCAA should have an antitrust exemption as part of the AEI Education Policy Debate series. Cavale characterized the NCAA as a “serial antitrust violator” and argued: “We need to innovate right now in college athletics, and there's a middle ground to get this done. They don't need an antitrust exemption, they need a road to address their issues the same way other commercialized sports leagues have done it.” Ackerman and Mitten maintained that the NCAA needs a “safe harbor” to protect its tradition of amateurism and education activities, with Ackerman commenting: “Antitrust, employment, Title IX, and tax law are all colliding in the college sports space. We believe Congress is most equipped to reconcile these federal laws and provide the clarity needed to bring order to activities that are near and dear to the hearts of athletes, coaches, campus communities, and legions of fans all across our country.” Van Dyck did not disagree but argued that college athletes need a collective bargaining agreement: “If the NCAA college athletes are allowed to unionize, the NCAA can bargain with them and resolve all of the issues that you just heard about. Giving the NCAA a wholesale antitrust exemption is totally unnecessary, and it would flip about 135 years of U.S. competition and labor policy upside down.” After the event, based on an audience poll, the team of Cavale and Van Dyck were declared the winners with 65% of the audience agreeing that the NCAA should not receive an antitrust exemption. Inside Higher Ed has released its 2025 Survey of College and University Presidents, conducted with Hanover Research, which finds that 89% of respondents somewhat or strongly agree with the statement that they enjoy being president. Meanwhile, 88% somewhat or strongly agree their governing board sufficiently supports them, 73% indicate their shared governance model works well and 60% agree that political efforts to influence institutional strategy poses a threat to their institution. Despite the widespread agreement that their own governing boards support them, just 41% of respondents agree that governing boards across the country support their presidents and/or chancellors. Perhaps the most surprising revelation is just 37% of campus CEOs agreeing that the pros of tenure outweigh the cons. SMU higher ed professor Michael Harris notes tenure can be a “thorn in the side of presidents and provosts” but says it can also serve as a buffer to political attacks on academic freedom. “Presidents understand – even if tenure is a pain for them to deal with – the damage it would do to them in recruiting faculty [to lose tenure]. So there’s a self-interested argument on keeping tenure, even if they personally would like for the whole industry to get rid of it.” Presidents were asked to select up to two entities they believe to be most at fault for the rising tensions regarding campus speech and 70% pointed at politicians, 27% ticked faculty and 18% selected students. Regarding students’ mental health, 81% believe their institution has done a good or excellent job of promoting student wellness, but just 44% somewhat or strongly agreed that undergraduate mental health is improving on their campus. Full report. (link)

The San Diego State-affiliated MESA Foundation says it will work with “north of $2 million” in NIL dollars to help construct the Aztecs’ 2025-26 Men’s Basketball roster as conversations with current student-athletes have already begun. MESA Foundation Founder Jeff Smith on if the budget is large enough: “What I would say is, even though that is twice as big as it was last year, we are very aware that in order to retain the group of guys we have and to address a few of the openings, we could be in the range of $1 million to $1.5 million behind where we need to be. [...] It just remains to be seen if the numbers we’ve offered is enough to keep everybody. At the same time, we’re very aware that other schools and other collectives, despite players not being in the portal, are already doing whatever they can to corrupt some of our guys for potential opportunities to go other places. That’s just the reality of it.” (link)

As it turns out, U.S. District Court Judge Tilman “Tripp” Self is an NCAA Football referee who has worked in the Southern Conference, leading the counsel of Georgia Baseball student-athlete Dylan Goldstein to file for Self to vacate his ruling yesterday denying Goldstein of additional eligibility due to a potential conflict of interest. Sportico’s Michael McCann & Daniel Libit: “While Self’s second career as a referee is not widely known, it is hardly a secret, raising questions about whether Goldstein’s legal team flagged it as a potential conflict of interest. A request for comment emailed to Goldstein’s lead attorney went unanswered. [...] It’s possible Goldstein’s attorneys, mindful of judicial discretion on whether to step aside, decided against such a request. The litigation began on Feb. 18, giving Goldstein limited time to secure an order that allows him to play this spring, and any delay in the proceedings caused by the assignment of a new judge could have been a problem. Also, given that Self does not appear to have been an employee of the NCAA, the attorneys might have believed there is not a sufficient conflict.” (link, link)

USA Today’s Steve Berkowitz reveals the witness list for Tuesday’s U.S. House subcommittee hearing on college sports and NIL: South Carolina Football HC Shane Beamer, Illinois AD Josh Whitman, former Duke track & field student-athlete Emily Cole, former Abilene Christian football student-athlete Anthony Egbo Jr., and former Clemson football student-athlete/VP of the College Football Players Association Justin Falcinelli. Kennyhertz Perry attorney Mit Winter points out that Egbo is the “former vice-chair of the NCAA Division I student athlete advisory committee so that likely hints at what his testimony will look like.” (link)

The Athletic’s Chris Vannini writes on what comes next after EA Sports College Football 25 broke industry sales records. EA Sports SVP Daryl Holt: “It outperformed all our expectations. It’s become part of the cultural landscape of college football this year. It was exciting and fun and amazing to see. The title became the belle of the ball (within EA). [...] We went into it knowing there was a lot of stuff we couldn’t get into the first year. So there’s a lot of meat left on the bone.” Vannini: “Some of the most common requests from gamers are game modes and features that were available in older versions or other sports games: an expanded Road to Glory mode with more time spent as a high school player; Mascot Mode, in which every player on the field is replaced with a plush mascot; the ability to play online dynasties across different gaming consoles; access to great teams from throughout college football history.” What about the potential for a college hoops game? Holt: “There was a clear need, want, desire from our community and the faithful were there (for college football). As developers, we try to figure out how we can get creative on reaching other aspects of sports, whether that be a smaller sport or one that doesn’t have a game. But right now, my focus has been on American football. We’ll keep looking for those things, but as a developer and working in sports, you’re always tapping your head going, what else could be possible?” Lots more. (link)

Wichita State’s home attendance across men’s and women’s basketball, volleyball, softball and baseball was 315,828 during the 2014-15 school year but dipped to 181,055 in 2023-24 and is on track to decline further this year. Softball is the lone sport of the group with an uptick in fans, going from 284 in 2016 to 826 last year. Part of the dip in men’s hoops could be attributed to the change from the Missouri Valley Conference to the American Athletic Conference in 2017. Assoc. AD for Strategic Communications Tami Cutler observes that most MVC games were Friday and Saturday nights while AAC ones are played on Sundays: “We’re competing with other things, church and… (the Kansas City) Chiefs and other things. And so … the Sunday matches… kind of turned into, well, … it doesn’t matter who we’re playing because … people already have activities planned for that day.” The athletics department conducts fan experience surveys at the end of each season and hosts regular listening sessions to try to help turn the attendance numbers around.
