Big East Commissioner Val Ackerman and National Sports Law Institute Executive Director Matt Mitten held a debate with Athletes.org Co-Founder Jim Cavale and KVD Strategies Founder/former FTC attorney Katherine Van Dyck about whether the NCAA should have an antitrust exemption as part of the AEI Education Policy Debate series. Cavale characterized the NCAA as a “serial antitrust violator” and argued: “We need to innovate right now in college athletics, and there's a middle ground to get this done. They don't need an antitrust exemption, they need a road to address their issues the same way other commercialized sports leagues have done it.” Ackerman and Mitten maintained that the NCAA needs a “safe harbor” to protect its tradition of amateurism and education activities, with Ackerman commenting: “Antitrust, employment, Title IX, and tax law are all colliding in the college sports space. We believe Congress is most equipped to reconcile these federal laws and provide the clarity needed to bring order to activities that are near and dear to the hearts of athletes, coaches, campus communities, and legions of fans all across our country.” Van Dyck did not disagree but argued that college athletes need a collective bargaining agreement: “If the NCAA college athletes are allowed to unionize, the NCAA can bargain with them and resolve all of the issues that you just heard about. Giving the NCAA a wholesale antitrust exemption is totally unnecessary, and it would flip about 135 years of U.S. competition and labor policy upside down.” After the event, based on an audience poll, the team of Cavale and Van Dyck were declared the winners with 65% of the audience agreeing that the NCAA should not receive an antitrust exemption. Inside Higher Ed has released its 2025 Survey of College and University Presidents, conducted with Hanover Research, which finds that 89% of respondents somewhat or strongly agree with the statement that they enjoy being president. Meanwhile, 88% somewhat or strongly agree their governing board sufficiently supports them, 73% indicate their shared governance model works well and 60% agree that political efforts to influence institutional strategy poses a threat to their institution. Despite the widespread agreement that their own governing boards support them, just 41% of respondents agree that governing boards across the country support their presidents and/or chancellors. Perhaps the most surprising revelation is just 37% of campus CEOs agreeing that the pros of tenure outweigh the cons. SMU higher ed professor Michael Harris notes tenure can be a “thorn in the side of presidents and provosts” but says it can also serve as a buffer to political attacks on academic freedom. “Presidents understand – even if tenure is a pain for them to deal with – the damage it would do to them in recruiting faculty [to lose tenure]. So there’s a self-interested argument on keeping tenure, even if they personally would like for the whole industry to get rid of it.” Presidents were asked to select up to two entities they believe to be most at fault for the rising tensions regarding campus speech and 70% pointed at politicians, 27% ticked faculty and 18% selected students. Regarding students’ mental health, 81% believe their institution has done a good or excellent job of promoting student wellness, but just 44% somewhat or strongly agreed that undergraduate mental health is improving on their campus. The San Diego State-affiliated MESA Foundation says it will work with “north of $2 million” in NIL dollars to help construct the Aztecs’ 2025-26 Men’s Basketball roster as conversations with current student-athletes have already begun. MESA Foundation Founder Jeff Smith on if the budget is large enough: “What I would say is, even though that is twice as big as it was last year, we are very aware that in order to retain the group of guys we have and to address a few of the openings, we could be in the range of $1 million to $1.5 million behind where we need to be. [...] It just remains to be seen if the numbers we’ve offered is enough to keep everybody. At the same time, we’re very aware that other schools and other collectives, despite players not being in the portal, are already doing whatever they can to corrupt some of our guys for potential opportunities to go other places. As it turns out, U.S. District Court Judge Tilman “Tripp” Self is an NCAA Football referee who has worked in the Southern Conference, leading the counsel of Georgia Baseball student-athlete Dylan Goldstein to file for Self to vacate his ruling yesterday denying Goldstein of additional eligibility due to a potential conflict of interest. Sportico’s Michael McCann & Daniel Libit: “While Self’s second career as a referee is not widely known, it is hardly a secret, raising questions about whether Goldstein’s legal team flagged it as a potential conflict of interest. A request for comment emailed to Goldstein’s lead attorney went unanswered. [...] It’s possible Goldstein’s attorneys, mindful of judicial discretion on whether to step aside, decided against such a request. The litigation began on Feb. 18, giving Goldstein limited time to secure an order that allows him to play this spring, and any delay in the proceedings caused by the assignment of a new judge could have been a problem. Also, given that Self does not appear to have been an employee of the NCAA, the attorneys might have believed there is not a sufficient conflict.” (link, link)

USA Today’s Steve Berkowitz reveals the witness list for Tuesday’s U.S. House subcommittee hearing on college sports and NIL: South Carolina Football HC Shane Beamer, Illinois AD Josh Whitman, former Duke track & field student-athlete Emily Cole, former Abilene Christian football student-athlete Anthony Egbo Jr., and former Clemson football student-athlete/VP of the College Football Players Association Justin Falcinelli. Kennyhertz Perry attorney Mit Winter points out that Egbo is the “former vice-chair of the NCAA Division I student athlete advisory committee so that likely hints at what his testimony will look like.” (link)

The Athletic’s Chris Vannini writes on what comes next after EA Sports College Football 25 broke industry sales records. EA Sports SVP Daryl Holt: “It outperformed all our expectations. It’s become part of the cultural landscape of college football this year. It was exciting and fun and amazing to see. The title became the belle of the ball (within EA). [...] We went into it knowing there was a lot of stuff we couldn’t get into the first year. So there’s a lot of meat left on the bone.” Vannini: “Some of the most common requests from gamers are game modes and features that were available in older versions or other sports games: an expanded Road to Glory mode with more time spent as a high school player; Mascot Mode, in which every player on the field is replaced with a plush mascot; the ability to play online dynasties across different gaming consoles; access to great teams from throughout college football history.” What about the potential for a college hoops game? Holt: “There was a clear need, want, desire from our community and the faithful were there (for college football). As developers, we try to figure out how we can get creative on reaching other aspects of sports, whether that be a smaller sport or one that doesn’t have a game. But right now, my focus has been on American football. We’ll keep looking for those things, but as a developer and working in sports, you’re always tapping your head going, what else could be possible?” Lots more. (link)

Wichita State’s home attendance across men’s and women’s basketball, volleyball, softball and baseball was 315,828 during the 2014-15 school year but dipped to 181,055 in 2023-24 and is on track to decline further this year. Softball is the lone sport of the group with an uptick in fans, going from 284 in 2016 to 826 last year. Part of the dip in men’s hoops could be attributed to the change from the Missouri Valley Conference to the American Athletic Conference in 2017. Assoc. AD for Strategic Communications Tami Cutler observes that most MVC games were Friday and Saturday nights while AAC ones are played on Sundays: “We’re competing with other things, church and… (the Kansas City) Chiefs and other things. And so … the Sunday matches… kind of turned into, well, … it doesn’t matter who we’re playing because … people already have activities planned for that day.” The athletics department conducts fan experience surveys at the end of each season and hosts regular listening sessions to try to help turn the attendance numbers around. The Big 12 unveiled its first-ever “XII Court”, an XII-branded court on which the 2025 Phillips 66 Big 12 Men’s and Women’s Basketball Championships will be played on. The NCAA’s revenue increased by $91M YoY to $1.38B in FY24, marking the highest inflation-adjusted total in at least two decades, per USA Today’s Steve Berkowitz; however, with the $2.78B House settlement factored into its FY24 accounting, the NCAA’s total liabilities jumped from $304M in FY23 to $3.06B, resulting in a net asset total of minus-$1.97B. Sportico’s Daniel Libit and Eben Novy-Williams note the association “said it ended the year with $1.03B of financial assets available within a year—which includes cash ($265.8M), accounts receivable ($55.6M) and investments that can be quickly liquidated ($705.9M). That’s up from $815.3M in fiscal 2023.” Setting aside the House settlement, the NCAA ran a surplus of nearly $166M in FY24 and CFO Mario Morris says: "With an overall revenue increase of $91M this fiscal year, the NCAA continues to provide its membership with sound fiscal operations and its student-athletes with quality benefits and an unmatched championship experience. We anticipate a debt-free NCAA in 2025, and moving forward, revenue generation is top of mind and efforts to reduce costs are a priority. Good fiscal responsibility positions the NCAA to better weather future expenses, while continuing to look for improvements that help member schools." WCC Commissioner/NCAA Men’s Basketball committee member Stu Jackson joins the Canzano & Wilner podcast and says the Power 4 conferences “dictated” the College Football Playoff revenue-share, the “fast-forward, we saw it again with the House settlement and in part because the four conferences, along with the NCAA, were defendants in the case, they essentially dictated our responsibility as other conferences what our level of participation would be in the damages and the options that we had with respect to revenue-sharing if and when the House settlement was approved. Throughout both of those processes there were a lot of people kept in the dark, and here we are, once again, facing a potential restructuring of NCAA governance and what championships will look like going forward, and we're somewhat in the dark again. And for me it's a lost opportunity for leadership because anytime you have that much responsibility, I think as a leader, who’s someone that knows where this is all going…has a responsibility to show everybody else what that direction looks like. And that has not happened. … And here we are in this mess where many of the conferences, like ours and institutions across all conferences nationally, are sitting in the dark waiting for the tablets to be handed down.” When it comes to expanding the NCAA men’s and women’s basketball tournaments, Jackson says he’s “all for it as long as the value of the basketball unit that many conferences around the country rely on for their athletic department budgets isn't compromised. If financially the NCAA is able to somehow negotiate an expansion of the tournament that brings in more revenue as to not compromise that unit, okay. But I don't think the NCAA tournament is broken with a field of 68.” Lots more. (link)

MAAC Commissioner Travis Tellitocci says the league is considering a rebrand that may or may not include a name change: "Our identity isn't really well understood. We're often referred to as 'the MAAC with two As,' or 'the MAAC that doesn't have football' or 'the other MAAC.' Metro Atlantic Athletic Conference, it's a bit of a mouthful. So there's often even confusion about what that stands for. We frequently get 'Mid Atlantic' or some other misinterpretation. It's a challenge I think we continue to navigate as we look to strengthen our brand and our identity." Conference leaders have met with focus groups including alumni, athletes, administrators and others to discuss the matter, but Tellitocci notes that “at the end of the day, there might be a desire to keep things exactly how they are. I just think it's important to have the conversation and explore ways to better brand ourselves, not only in the Northeast, where there's a stronger recognition, but nationally as well." Former Commissioner Rich Ensor says a name change has been discussed several times over the years. "Always a question about perceived brand confusion nationally versus messing with your established brand regionally. And what do you use instead and how much new brand confusion do you inject into (the) marketplace and with the fans? It's not an inexpensive process on many levels with name/logo changes, but it can inject a new vitality…if backed by a strong rollout campaign." (link)

Aggies AD Trev Alberts: “We are entering a new era of collegiate athletics and Texas A&M is positioned to be a strong leader. This partnership with Playfly reflects our commitment to innovation, maximizing our revenue potential, and providing new opportunities for our student-athletes, fans, and corporate partners. Our ability to find and grow, approved, fair market NIL deals to organically grow our cap will be critically important. Ohio State AD Ross Bjork tells Columbus Business First’s Amanda Tonoli that while OSU is a self-sustaining athletic department, “how we spend our money and how we make our money has to be different” given the changes in the industry. Bjork adds that “the goal” is to keep OSU’s 36 sports, and the Buckeyes are still “going through the mapping of what does revenue-sharing look like” in terms of how much each sport gets. “We’ll have an allocation to football. We’ll have an allocation to a couple other sports. Not every athlete will receive that check, that type of support.” Bjork believes NIL will “sort of level set, because you’ll now have institutional dollars” and he notes the Buckeyes have “reworked the budget and (generated) new revenue and cut expenses.” Still, he maintains OSU must continue to invest in facilities and further monetize them. “The team, before I got here, came up with the stadium tour idea. That is essentially just sort of a found revenue source. ... It hasn’t even been a year, (and) we’re approaching almost $1M.” (link)

Georgia AD Josh Brooks covers several topics on The Paul Finebaum Show, including his advocacy for the league as a whole to get as many teams in the College Football Playoff as possible: “I believe in the strength of this league, and the strength of this league is the quality from one to 16, so I’m always going to advocate for as many of our teams to get in as possible.” Brooks also notes that “you hate to judge everything based off one year of the 12-team format and say, ‘Well, this is what it is,’ but I do have concerns. You have recent stories where certain games have been canceled in series – Power 4 matchups out of conference – and there's been comments made to the regard of they didn't think that game would help them, it would only hurt them. That's frustrating to read because that shows that the committee probably isn't putting enough weight on strength of schedule, which only then hurts our fans, hurts our product if we’re not able to go schedule those games and we have to go water down the schedule because our primary focus shifts from quality of competition to quantity of wins and that’s not great for anyone.” (link); Brooks also believes that adding a ninth conference football game would likely mean more revenue from ESPN: “Obviously we’ve got great brand and the conference is strong, and if you look at the viewership reports from college football this year, the SEC was all over it…so we know there’s a lot of value there.” (link)

Florida State AD Michael Alford says the West Sideline Club seats at Doak Campbell Stadium are sold at 92% capacity (2,174 seats); the Dunlap Champions Club is sold at 82% capacity (2,860 seats); and the West chairback seats, which only recently have gone up for sale, are at 29% (2,379). Alford also notes FSU has already “reached or exceeded” its projected capital gift commitments for both the West Sideline Club ($28.6M) and Champions Club ($28.9M). Meanwhile, a new standalone football facility is slated to be completed in August, but Alford says the team will likely wait to move in until the first bye week in early September. (link)

San Diego State AD John David Wicker called the Pac-12 Enterprises HQ a “phenomenal facility” and told fans this week that “not only are they going to be able to help us produce our content, about half of the production capability of the facility, we’re going to be able to go out to other entities, Major League Baseball, the NBA, Cal, Stanford, other institutions, produce their content and then they’re going to pay us to do it. It’s another revenue stream that we’re going to have.” Wicker added of conference expansion: “We’ll figure out if we’re adding one, two or three more schools and whether they’re coming in all of their sports. They might be coming in in some of their sports. There’s a lot of work to get done, but our goal is to be done with that by June 30, so people can let their other conference know they’re going to come join the Pac-12, the best conference on the West Coast.” Wicker didn’t specify exactly how much revenue SDSU will share with student-athletes but said it won’t be the full $20.5M. “If anybody wants to write us that check right now, we’ll be happy to share that amount. But otherwise, we’ll be at a number lower than that.” (link)

St. Bonaventure will opt into the House settlement, and Bonnies AD Bob Beretta explains this is a “move designed to strengthen our university as a whole, not just Athletics. President Gingerich and our Board of Trustees recognize the value a successful men's basketball program brings to the university, and I appreciate their leadership in this moment of significant change. Texas Tech announces FY24 revenues of $126.78M and operating expenses of $126.71 for a surplus of a little over $70K per the Lubbock Avalanche-Journal’s Don Williams. It marks a return to a more normal budget range, following an outlier related to the new football facilities project that created a $10.4M surplus in FY23, stemming largely from a $56.25M increase in realized department contributions. TTU’s largest sources of FY24 operating revenue came from media rights, NCAA & conference distributions ($36.85M), gift contributions ($32.28M), royalties, licensing and advertising/sponsorships ($17.05M) and ticket sales ($16.75M down from $18.21M in FY23). Tech also “subsidized athletics with $8.26 million in indirect institutional support for athletics facilities debt service and $6.513 million in direct institutional support.” Citing one less home game this season, football’s operating budget decreased from $80.8M in FY23 to $72.5M in FY24. The biggest budget expenses came from compensation ($49.05M - split almost eventually between coaching and support staff/admin pay, benefits & bonuses), direct overhead and administrative costs ($12.92M), athletic facilities debt service, rental fees and leases ($12.20M), team travel ($9.42M) and scholarships ($7.94M). Overall, football ($28.47M) and men’s basketball ($2.51M) were the only two Red Raider sports to finish FY24 in the black. (link)

The Football Rules Committee has proposed modifications to the injury timeout rules for the 2025-26 season to state that if medical personnel enter the field to evaluate an injured player after the ball is spotted, that player's team would be charged a timeout. If the team does not have any timeouts remaining, a 5-yard delay-of-game penalty would be assessed. The committee notes the “impetus for recommending this change is to provide an in-game mechanism that can curtail the faking of injuries because committee members think these actions negatively affect the overall perception of the game.” Committee members also proposed that if a game reaches a third OT, each team would have one timeout to use until the game is concluded. Currently, teams are allotted one timeout for each overtime period. Other recommendations include: When the decision on instant replay is announced, the referee says only that the call on the field is "upheld" or "overturned." The terms "confirmed" and "stands" would not be used. Additionally, it was proposed that coach-to-player communication, similar to that used in FBS last year, be permissive for FCS teams. (link)

HBO’s Hard Knocks will cover North Carolina’s football program instead of an NFL team this summer. According to Front Office Sports’ Ryan Glasspiegel, NFL Films turned to the Tar Heels because they could not find an NFL team willing to take part. NBC Sports’ Josh Alper adds that the New York Giants were the featured team during free agency and the draft last season, and “their stint will be best remembered for General Manager Joe Schoen explaining to team co-owner John Mara why he wouldn’t re-sign Saquon Barkley as a free agent. Mara told Schoen how much it would bother him if Barkley signed with the (Philadelphia) Eagles, which is exactly what happened and Mara had to watch the former Giant win the Super Bowl. The desire to avoid something similar likely contributed to the lack of interest from NFL teams, but the prospect of going behind the scenes as Belichick prepares for his first season as a college coach makes for a pretty good alternative for the series.” (link)

Legal Matters…
+ Fresno State has joined with the NCAA to investigate “allegations that two men's basketball players participated in daily fantasy contests based on their own performances.” Junior forward Mykell Robinson was removed from the roster, after playing in a Jan. 11 game against Nevada, following reports that he and associates made wagers and created fantasy entries including the under on his points and rebounds in contests in which he participated. Already dismissed senior guard Jalen Weaver told ESPN that “he played a daily fantasy contest on his points total in the Bulldogs' home game against New Mexico on Dec. 31.” In addition, senior guard Zaon Collins was recently held out of a game against Air Force for allegedly betting on pro sports, but remains part of the current roster. Prior to the Air Force contest, Weaver and Collins were two of the Bulldogs’ top three scorers at 12.5 and 12.0 ppg, respectively. (link)
+ Georgia baseball student-athlete Dylan Goldstein’s motion for a preliminary injunction allowing him to play for the Bulldogs in 2025 was denied on Friday by U.S. District Middle Court Judge Tripp Self, just three days following an in-person hearing. Goldstein's attempt to gain another season of eligibility, after one campaign at a junior college, came following the NCAA’s blanket waiver after Vanderbilt quarterback Diego Pavia received an injunction to play in the fall of 2025. The NCAA waiver only covered athletes for the 2025-2026 academic year, not baseball players this spring. (link)
+ Oregon Representative John Lively (D-7) has introduced House Bill 3694 which would conflict with the House settlement’s NIL disclosure provisions and cause potential problems over independent contract review. Among the bill’s provisions is a “clause stating that any organization with authority over intercollegiate sports cannot require an athlete to disclose the terms of an NIL deal if the contract prohibits the athlete from disclosing.” The bill “also states that while college athletes may have to disclose NIL deals to their schools, those schools must treat the information as ‘confidential’ and exempt from disclosure under public records laws.” (link)
