The plaintiffs in the House case made several filings with the court yesterday, according to Yahoo’s Ross Dellenger, who notes yesterday was the deadline for motions for the final settlement and for responses to the objections. Dellenger also notes the defendants are expected to make similar filings as well. (link); According to Sportico’s Michael McCann, the parties filed a motion for final approval which argues that the response by class members to the settlement “has been overwhelmingly positive.” The motion states that out of nearly 390K class members, only 3,433 class members (about 0.88%) opted out and only 73 (about 0.019%) filed objections. The motion further maintains the objections largely reflect a “misunderstanding of the settlement’s terms” and stresses the settlement does not provide the NCAA or its members with antitrust immunity. McCann also explains U.S. District Judge Claudia Wilken will consider the objections, but “antitrust class action settlements are usually approved. The motion filed Monday addresses these arguments by maintaining they are off base. For instance, with respect to roster limits, the motion suggests that relatively few athletes will lose positions versus alleged ‘enormous benefits of the settlement’ for the class as a whole.” Per the motion: “The move to roster limits was part of the overall settlement compromise, and any negative effects are dwarfed by the extraordinary benefits provided by the settlement to the Settlement Classes as a whole.” McCann adds: “As to objections regarding Title IX and employment law, the motion stresses that the settlement does not extinguish those (and other) claims. To that point, Wilken might reason that objections that rely on other areas of law or that raise the possibility of subsequent litigation fall outside the focus of her review.” More. (link)

SEC Commissioner Greg Sankey indicated on The Paul Finebaum Show that he’s in favor of a nine-game conference slate as long as it makes sense within the broader context of the College Football Playoff. “One of the issues in the room for our athletics directors is what seemed to matter most, is the number to the right, the number of losses. And how do we understand what that means for our schedule moving forward? I’m one who said I really think we ought to be trying to move towards a nine-game conference schedule. I think that can be positive for a lot of reasons. You watch the interest around conference games. But not if that causes us to lose opportunities. … We have to recognize the CFP selection process is an important governing factor, or decision making factor, that contributes to the eventual outcomes of whether it’s non conference games or whether it’s the number of games played within conferences.” Sankey also confirmed ADs have discussed what he calls “allocations” rather than guaranteed CFP bids, adding: “They’ve also talked about ideas of evaluating strength of schedule and trying to better understand how that analysis is made. How can we better understand how the CFP selection committee makes its decisions? That’s really not a specific judgment; it does need to inform our decision-making. … We had athletic directors express opinions, and I respect their right to do so. When those became very much the focus, I think we should probably slow down a little bit in jumping to conclusions because there’s a lot of work to do in a short period of time, whether it be our scheduling decisions or discussions about the future College Football Playoff.” (link, link)

Alabama AD Greg Byrne believes “there's a way to get to nine” conference games, adding: “We'll see if it makes sense for the conference as a whole. We're one vote in there. But, again, we've scheduled as though we were playing off playing eight conference games." Byrne says when it comes to College Football Playoff expansion he doesn’t have a “strong opinion right now. I think the expansion to 12 was good for opportunities. And, you know, it gives fan bases hope. I also said this publicly — I know one of the main parameters when the CFP was formed with strength of schedule, and I still think that that's something we need to pay attention to. I've seen some schools come out and say, 'Well, it doesn't make any sense to schedule good non-conference games.' Well, it's not good for college football. It's not good for the fan bases. It's not good for the young men on the teams. We all know here in Alabama, there's a lot of excitement when it comes to some of those games and I think that's good for the health of the game of college football. But at the same time, too, that needs to be recognized and not have it be two vs. three losses, one vs. two losses, whatever that looks like as the deciding factor. Not all schedules are created the same.” (link)

Davidson AD Chris Clunie joins Connect’s Bryan Fischer from the 2025 NCAA Convention to share his perspective on the changes to college athletics, positioning his department in a period of flux, collaborating with fellow conference members and his viewpoint on revenue-sharing. Regarding the uncertainty, Clunie explains it’s important to adhere to core principles. “It’s the ability to say, ‘All right, here are non-negotiables and here are things that are flexible.’ The settlement comes into play and we want to opt in. We want to be able to step into revenue-sharing specifically around men's and women's basketball. That’s important for us, especially being in a basketball-centric conference with the Atlantic 10. And then the other piece is how do you also continue to make strides in Olympic sports and all of your other programs? We don't want to take a step back. We see it as an opportunity even in a challenging era to move forward.” Clunie is in favor of expanding March Madness, explaining that “because of the inequity that schedules and the transfer portal with NIL has caused, the ability to expand the tournament and provide more access – that's the biggest piece. Provide more access for teams I think is the biggest piece, and I think if you run the models you can do it in a way which is not too cumbersome for the NCAA.” Full conversation on Connect. (link)

Nevada will opt into the House settlement, according to Wolf Pack AD Stephanie Rempe, who explains: "The financial implications are enormous, and the burden is heavy, but these are new realities that we must accept and view as opportunities if we want Nevada Athletics to remain relevant in tomorrow’s college athletics landscape. The mission for Nevada Athletics is simple – compete at the highest level athletically without compromising our academic mandate to graduate our student athletes and prepare them for life after college." Virginia AD Carla Williams and Duke AD Nina King participated in a Black History Month roundtable discussion with Fiesta Sports Foundation CEO Erik Moses, and Williams explained she never set out to be a pioneer, “but now that I’ve been doing it, yes, let’s go. I’m so glad I’m in this position and have this opportunity and appreciate the significance of being a pioneer. I think it’s helped me professionally, but also personally, and has given me the opportunity to teach my children about the importance of being allies and championing women in spaces and people of color.” King noted that “once you do get in the chair, then it becomes a very lonely space really quickly. And finding who you can rely on, who you can count on, who you can confide in, is really a challenge at the beginning. And so thankfully, I had Carla and [Vanderbilt AD] Candice [Lee] right away, once I did take that step, but really kind of figuring out who that personal network is, was something that I had to quickly do once I got into the chair.” Both women emphasized the importance of obtaining a PhD or JD with Williams explaining: “I felt like I needed to check every single possible box to take that off the table for not being considered for the job.” King added: “We’re overqualifying ourselves for positions so that we don’t give people the choice, which unfortunately we’re watching lots of others get hired for the same jobs that are underqualified or we have way more experience and qualifications than they do.” (link)

SBJ’s Ben Portnoy catches up with several Football GMs to discuss what the role actually entails, and Alabama GM Courtney Morgan explains that if “you look at Tennessee, you look at Florida, you look at all the SEC schools, we all have nice weight rooms. We all have big facilities. We’ve all got crazy fan bases. The only thing that separates you are the people in your building, because consumers buy from who all they like. Kids choose schools by the feeling that you give them when they come into your building. It’s the same way when I was in sales. When you walk out of an office, what feeling did you give that customer?” Stanford GM Andrew Luck adds: “I feel a little bit like a traveling preacher — proselytizing and evangelizing about Stanford football. Folks have counted us out. Had we been humming along and rolling, I’m not in this job. I understand that.” As far as who’s making staff decisions, Luck notes that remains the head coach’s call, “but it does have my stamp on it, if you will. I co-sign things, and I view it as my job to ask, hopefully, questions that are relevant to the process and think about the structure of things. But, to me, the head coach absolutely needs full agency and empowerment over his staff. … I was curious how Coach Taylor would take this, because there’s a lot of responsibility taken off of his plate — and he was thrilled.” Meanwhile, MB Sports Consulting Founder Matt Banker tells Portnoy: “It’s sort of like a trendy title, but schools that have understood things about how [college sports are] going to work are positioning the right people to do those roles, and not just keeping up with the Joneses to hire someone just to say you have a general manager. And I guarantee you, once a couple schools were announcing that they’ve got GMs even a year ago or so, the first things that were happening were head coaches calling their AD [to say], ‘We need one of these.’” (link)

With Georgia baseball student-athlete Dylan Goldstein requesting that U.S. District Judge Tilman “Tripp” E. Self III be removed from the case due to his work as a college football referee, Sportico’s Daniel Libit chronicles the myriad instances where sports has collided with the federal bench. Libit points out that “a 2018 study, published in American Economic Journal: Applied Economics, analyzed Louisiana’s juvenile court decisions between 1996 and 2012 and determined that judges tended toward issuing harsher sentences when ruling in the immediate aftermath of their home state’s college football team losing. In 2022, researchers from Troy University and South Carolina’s College Sports Research Institute analyzed 174 judges who ruled in cases involving the NCAA between 1973 and 2020. The NCAA prevailed in 63% of these rulings. Furthermore, CSRI determined, judges that were born in Southeastern Conference states were 43% more likely to rule in favor of the NCAA than those born outside the SEC’s footprint.” Meanwhile, in just this past year, U.S. District Judge David Orson Carter, who lettered in track & field at UCLA, ruled to enjoin UCLA from accessing the baseball facilities until the U.S. Department of Veterans Affairs could come up with a plan for the 10-acre tract “such that the provisions of services to veterans is the predominant focus of the activities.” A month later, Carter agreed to allow UCLA temporary access to the stadium through the 2025 college baseball season after it agreed to pay the VA $600K for a temporary lease. Arizona has extended its apparel partnership with Nike in a new deal that starts July 1, 2025, and runs through June 30, 2033. According to UA, the new agreement “significantly increases Arizona's annual Nike product allotment” and ensures the Wildcats “will have more flexibility in outfitting its teams and maximizing the impact of Nike's premier offerings.” (link)

Texas Tech plans to acquire the property on which the new Donald Womble Football Center sits from the Red Raider Facilities Foundation and structure a payment plan of more than $200M over 30 years, according to the Lubbock Avalanche-Journal’s Don Williams. Red Raiders Deputy AD Jonathan Botros: "Some of that, of course, will be repaid by gifts that continue to come in from pledges, so if somebody did a five-year pledge or a three-year pledge and they started it last year, their initial pledge payments would have gone to Red Raider Facilities Foundation, but once Texas Tech purchases the property back, the remaining pledge payments will go to Texas Tech and we'll use that to pay back commercial paper." Williams notes the total of gifts and pledges now stands at nearly $116M, and Tech plans to pay off the difference via a “combination of philanthropic gifts, financing, game-day premium revenue generated by the south end zone and operating revenue on the annual budget.” Botros says the “transfer of ownership would be somewhere around the end of March, beginning of April." Ole Miss is set to introduce the Founders Suites at Vaught-Hemingway Stadium. The suites start at $5M per and require an initial payment of $2.5 million upfront, with the remaining balance due before the 2027 football season kicks off. Each suite offers 24 seats—16 outdoor and eight indoor—with the option to purchase up to eight standing-room-only tickets, bringing the maximum capacity to 32. Rebels Senior Assoc. AD for Development/CEO Denson Hollis says the Founders Suites come with exclusive parking, dedicated catering services, Bluetooth-enabled suites, and high-end kitchen finishes. (link)

Oklahoma will debut a new fan-centric football event to replace the traditional spring football game. The "Crimson Combine" will feature OU players and coaches participating in combine-style drills, skills challenges, on-field fan engagement activities, autograph and photo opportunities, and more. Sooners AD Joe Castiglione: "This is a brand new spring football tradition for our fans. Crimson Combine will spotlight our players while also giving our fans the ability to get closer to the action and have the chance to engage directly with our team and coaching staff. We're planning some unique activities that will highlight our players and provide high entertainment value for everyone in attendance." (link)

Florida State and Clemson will vote tomorrow on an agreement that would settle the four ongoing lawsuits between the schools and the ACC and establish a new revenue-distribution strategy “that would solidify the conference's membership for the near future,” according to ESPN’s Pete Thamel, David Hale and Andrea Adelson, who add that the “ACC Board of Directors is scheduled to hold a call Tuesday to go over the settlement terms. In addition, Florida State and Clemson have both called board meetings to present the terms at noon ET Tuesday. All three boards must agree to the settlement for it to move forward, but sources throughout the league expect a deal to be reached.” The revenue-distribution model, which has been termed a “brand initiative,” will be funded through a “split in the league's TV revenue, with 40% distributed evenly among the 14 longstanding members and 60% going toward the brand initiative and distributed based on TV ratings. Top earners are expected to net an additional $15M or more, according to sources, while some schools will see a net reduction in annual payout of up to about $7M annually, an acceptable loss, according to several administrators at schools likely to be impacted, in exchange for some near-term stability.” Additionally, the total cost to exit the league after the 2029-30 academic year is expected to drop to below $100M. That penalty is also set to be just one number, not an exit fee and loss of media rights revenue. (link)

Big 12 Commissioner Brett Yormark talks with SBJ’s Ben Portnoy about his plans for basketball and says from a media perspective “if you think about what we’ve done over the last six months with ESPN specifically, we’ve diversified our media partners when it comes to basketball. Everyone knows that ESPN and Fox are two big platforms, but moving into next year, Fox now becomes a distribution partner for basketball. We’ve announced TNT. CBS has taken a bigger position in their sublicensing efforts with ESPN. So next year, we’re going to have [a minimum of] four major partners and all their resources marketing and promoting Big 12 basketball, which, to me, is critically important.” The league will continue exploring international growth, as Yormark notes 12% of students at Big 12 schools come from outside the U.S., “and I think there’s real upside, because it’s easy to use basketball as a catalyst to grow into that international marketplace for obvious reasons, and the growth of the game internationally. We certainly want to play in that area for all the right reasons when you think about just building the brand of basketball.” On moving basketball’s media day away from its traditional site in Dallas, Yormark says: “We’re thinking about moving media days, no different than what we did with football. But how do we move media days as a tentpole around the country into important markets to grow our brand of basketball and our narrative? We did that with football and went to Las Vegas. It was reported we’re coming back to Dallas this year, but we’re going to rotate in and out of Dallas. I think the opportunity to do basketball the same way is critically important for us, because our media days in general, basketball and football, have become tentpole events.” More from Yormark. Former Penn State AD Sandy Barbour, former America East Commissioner Amy Huchthausen and former Duke field hockey student-athlete/ACC SAAC Chair Piper Hampsch argue in an SBJ op-ed that SAAC is an “idea whose time has passed.” Assuming the House settlement is approved, Barbour, et al. contend that “how it will be distributed — whether the lion’s share goes to student athletes in football and men’s basketball (they are the only true revenue producers at most colleges) or divided equitably among all athletes — simply cannot be decided with SAAC reps.That’s why student-athletes must move beyond SAAC and demand a viable role in the negotiations — a true seat at the table. 2024 should be the last year when student athletes perform without some form of collective-negotiated agreement with their institution. SAAC offers only the illusion of influence. True power remains with the NCAA, college and conference administrators and coaches. SAAC reps are not even chosen by student-athletes. They’re usually selected by college coaches or athletic directors, and conference executives. Student-athletes should choose who speaks for them in determining the distribution of revenue and other terms of their participation. … Another SAAC failing: Athletes from football and men’s basketball are vastly underrepresented. Of 31 members of the current D-I Student-Athlete Advisory Committee, only six (less than 20%) play football or men’s basketball.” They conclude: “In short, SAAC is outdated; all but extinct. With it, student athletes may have a seat in the room, but not at the table. And if you’re not at the table, as is often said, you’ll likely be on the menu.” (link)

The Athletic’s Ralph Russo and Chris Vannini wonder whether anyone can stop the SEC and Big Ten’s push for increased College Football Playoff AQs, which one administrator says is “wrong and it’s pre-rigged. It flies in the face of earning your way into a championship field.” Russo and Vannini cite colleague Stewart Mandel, who recently pointed out that history suggests the Big Ten and SEC don’t need AQs to dominate the CFP selections, “but they do need them to create some new late-season TV inventory in the form of additional championship weekend CFP play-in games, which many administrators believe is the real impetus for the proposed change. The problem for the ACC and Big 12 — aside from the fact they might not be able to create the same type of additional revenue-generating inventory from play-in games — is the potential perception hit that comes with formalizing their second-class status among the Power 4. How damaging can that be? Think back to the four-team CFP. All involved agreed the most severe of unexpected consequences was the brand damage done to conferences that struggled to qualify for the Playoff.” If the Big Ten and SEC continue with this push, Russo and Vannini note that “it’s hard to gauge how much appetite there would be within the group to start filing lawsuits against each other, but several athletic directors said they hoped their conference leadership was already talking to legal counsel. … Whether any legal challenge to the CFP agreement between the conferences would ultimately be successful is almost inconsequential. The simple filing of a lawsuit in a receptive home court could be enough to bog down the process and create CFP stagnation and uncertainty.” Other hurdles that could stymie the SEC and Big Ten’s plans include political pressure, ESPN and public pushback. For example, The Paul Finebaum Show’s eponymous host last week remarked: “I understand the seeding issue, but I believe they are completely wrong about guaranteeing bids. Doing our show yesterday, even SEC fans are calling in saying they don’t like it. There’s something inherently wrong about stacking the deck before the season.” (link)

Extra Points publisher Matt Brown analyzes Northern Illinois’ decision to join the Mountain West/Horizon League and points out the Huskies will save hundreds of thousands of dollars in travel by playing non-football sports in the Horizon. “Saving a few hundred thousand bucks on athlete travel would be significant to any department, but it’s especially critical for NIU. According to the school’s FY24 NCAA financial filing…NIU reported just under $30M in total operating revenues, which is on the lower side in the MAC. NIU also spent a little over $3M in athletic travel. Knocking $500K or so off that figure would represent a very significant savings. Saving that money (and potential airline miles) for the rest of the department also makes it easier for NIU to stomach the football travel required for the Mountain West move. While the school does expect to spend money on flights to places like Logan and Las Vegas, the increased television revenue from the MWC TV deal, plus increased ticket and gameday revenues associated with playing on Saturday (instead of the mid-week #MACTION games), are expected to more than make up the difference.” Brown goes on to point out that NIU is attempting to emulate Army and Navy in playing a more national schedule for football while pursuing more regional models for their other programs. “If the plan works, NIU is betting that the increased TV revenue from football and the cost savings from the Horizon will allow the institution to better support athlete revenue sharing and competitiveness across the board. That will mean a few strange football road trips, but if the Huskies are playing on Saturdays and competing for league titles, the school is betting that fans won’t mind too much.” (link)

The Rutgers-focused Knights of the Raritan has received an anonymous $250K donation to support NIL efforts, and the school is launching a matching campaign through which fans are encouraged to make one-time donations for any program they choose to KOTR. Those donations will be matched for every dollar up to the $250K. Once the original contribution is matched, it will unlock another $500K, boosting the total pot of money to $1M. (link)

CBS’ Dennis Dodd reports that “Penn State and Hershey Medical Center (Penn State Health) have settled a whistlerblower and wrongful termination suit with former Penn State trainer Scott Lynch, CBS Sports has learned. The settlement figure is $5.25M plus 6% interest per year. That could result in another $250K, per sources. Lynch is a former Penn State NCAA champion wrestler. His attorney Steve Marino is a former Penn State gymnast. Saquon Barkley and Trace McSorley testified this past summer on James Franklin’s behalf in the case.” (link)

U.S. District Judge Charles E. Atchley Jr. has denied Tennessee baseball student-athlete Alberto Osuna’s motion to preliminarily enjoin the NCAA rule counting JUCO seasons as DI seasons. Heitner Legal Founder Darren Heitner: “The court held that Osuna failed to demonstrate a strong likelihood of success on his Sherman Antitrust Act claim because he did not establish that the JUCO Rule produces substantial anticompetitive effects in the market for Division I athletics.” Atchley, Heitner adds, “found insufficient evidence to conclude that the JUCO Rule dissuades athletes from attending junior colleges, disadvantages junior colleges in recruitment, or has harmful downstream effects on consumers. The Court expressed sympathy for Osuna's position but determined that, based on the current record, the extraordinary remedy of a preliminary injunction was not justified.” Atchley, in his ruling, noted that “for an organization that professes to prioritize the well-being of its student-athletes, the NCAA’s conduct has in many ways been questionable at best and self-interested at worst.” Boise State professor Sam Ehrlich notes there are now three distinct antitrust approaches to one NCAA rule: “1. Even a limited record shows the rule is commercial and has anticompetitive harm (Pavia); 2. The rule is non-commercial (Goldstein); 3.
