U.S. District Judge Claudia Wilken has released details on the House settlement final approval hearing to be held on April 7. Due to time constraints, Wilken has limited the objectors that will be called as part of the hearing. Boise State professor Sam Ehrlich shares the list and points out Wilken has attached a note explaining that the “Court cannot order changes to the agreement. Objectors should address whether they wish the Court to reject the settlement and set the case for trial.” Ehrlich submits this is likely in response to those who have asked Wilken to push the NCAA to change roster limits. Other notable objectors that will be allowed to speak are Livvy Dunne and objectors represented by former NBPA exec director Michele Roberts.” (link)

WCC Commissioner Stu Jackson joins the WCC Points in the Paint podcast with Sean Farnham and Dave Flemming and says that “in a perfect world it would have been great going into the conference tournament that we would have been assured of perhaps three bids in the NCAA Tournament. We still may get there but, again, we wouldn't even be in that position, quite frankly, without a stronger and deeper conference. And it's incumbent upon us as we look at the conference in the future that we focus on our original objective, [which is] to continue to try to build the overall strength of our existing members but, as importantly, if we add members, they need to be members that add basketball strength for both the women and the men.” Regarding the changes throughout the industry, Jackson explains he’s “comfortable in a sphere of injustice, which is what I feel conferences like ours have suffered. Over the past months, first with the process of the House settlement and the damages that conferences like ours incurred as a result of the defendants being the NCAA and the Power 5 conferences…only to be repeated once again when we're in this phase of redefining NCAA governance and implementation and what that governance would look like, we find ourselves once again in a position where we are in the dark waiting for, as I termed it, the tablets to be handed down.” Because of conference expansion, Jackson points out that several teams will make this year’s NCAA Tournament despite having conference records at or below .500. “Their resumes are going to be worthy for NCAA participation, unfortunately to the detriment of teams in mid-major conferences that perhaps have better records – and, you could argue, maybe better teams.” Full podcast. Outgoing Stanford AD Bernard Muir tells SBJ’s Ben Portnoy that “I think right now, what Stanford’s gonna try to do is figure out what does the House impact have on the department. Revenue is going to be critical. We jumped into the ACC taking a bit of a haircut, so tightening the belt from a budgetary standpoint, really focusing on where to strategically put the resources across the entire department [are crucial]. And then, like I said, revenue generation is going to be critical. And then really trying to calibrate how you invest in a 36-sport program and be able to compete on a national stage, especially in the programs that garner great exposure. … I think we’ve all had to adapt and adjust really quickly on the fly and I know my AD peers are doing that right now. We’re talking about dollars, primarily – whether we put it in our student-athletes’ pockets through [revenue] sharing, or whether we provide additional scholarships. I still think this is rooted in an educational endeavor, and there’s something to be garnered by being on a campus and spending as long as you can in one place and getting a degree.” What’s next for Muir? “People mentioned the ‘Retirement’ word. I feel a little young for that. I’m thankful that I at least have a chance to assess, and hopefully, knock on wood, my health stays good and I can jump into something else when the timing’s right.” (link)

Virginia will not support a diving program next year, according to SwimSwam Editor in Chief Braden Keith, who notes UVA, “like other ACC teams, are limited at 30 athletes on each of their men’s and women’s swimming & diving teams, and the Cavaliers don’t necessarily have to make many cuts to get under those numbers as they host a relatively lean roster as it is. Sources close to the program told SwimSwam that the Cavaliers have a lower goal than that, though. While the program is open to going up to those limits, their goal is to be closer to 24 swimmers per gender. … This move is reflective of what many Division I coaches have told SwimSwam, which is that they view the smaller rosters as an opportunity to give athletes more individual attention and manage a more nimble roster. One coach even proposed to SwimSwam a limit of 12 swimmers and a number of divers.” (link)

SBJ’s Ben Portnoy checks in with several stakeholders around the industry to hear what they have to say about the increasing number of schools hiring football GMs. Blueprint Sports CEO Rob Sine: “It’s a fad right now that is appropriate that a lot of people are focusing on because professional sports is penetrating this industry top to bottom in a lot of different areas. Professional sports have been doing roster management for a long time, so it makes sense to bring it to the college level. But you also look at the roster or the staff size at a professional sports team compared to a college, you can’t just check a box and say, ‘Hey, I’ve got a GM that I’m paying hundreds of thousands of dollars a year,’ or ‘I have a software solution.’ … How do you make it actionable? How do you go out and actually negotiate, recruit and look for the right student athletes, build the right budget to afford the players you want to pick? It all has to be linked together. So much of it right now is sitting in boxes in departments across the country, and I’m not quite sure that they know what they have or what they’re going to be getting to in the long run.” The Athlete Group Partner Jake Rosenberg: “This GM role, it’s not only a title, but it really starts absorbing a lot more of the responsibility and true autonomy in the team build. It becomes more empowered over time. And not really to head coaches' detriment, but to the head coaches' benefit in the sense that coaches are doing a lot of work that is really outside their primary skills that are skills unto themselves, and that the entire team as a whole would benefit by someone else really handling. “There are just so many new functions that were not part of the process at all in the past, and now are part of the process and are being handled by coaches. They’re really kind of taking away from a lot of the true skills and value that these coaches are able to add.” (link)

The sports industry is becoming more adept at implementing loyalty programs, according to SBJ’s Bret McCormick, who notes that “for years, the industry has asked fans to hand over their data with little to offer in return, but modern loyalty and fan engagement programs are making this exchange a better deal for fans. Sports properties are providing more exclusive content, merchandise, concessions items and experiences, and in some cases, team apps are the primary way to view a team’s game broadcasts. What were once ‘grind and earn’ points-based loyalty programs are beginning to more closely resemble memberships or subscriptions. Within sports property C-suites, the view of these programs is shifting, too, from cost centers to revenue generators that touch all areas of a modern sports enterprise.” Next League Chief Digital Officer Shripal Shah tells McCormick: “They’re starting to get a broader understanding that it’s actually the tip of the spear for everything else that they’re trying to do, like fan identification, automated fan journeys, personas, segmentation and increasing share of [digital] wallet.” McCormick goes on to highlight Minnesota’s loyalty program and explains: “Besides offering money-can’t-buy types of experiences as rewards in the Gopher Loyalty program, Minnesota athletics particularly focuses on including children-focused events in the rewards catalogue, a popular offering for grandparent fans that helps as ‘that 5-, 6-, 7-, 9-year-old starts to develop their affinity for Gopher athletics,’ said Michael Kelly, director of development and annual giving strategy.” Lots more. The Pat McAfee Show’s eponymous host says his Field Pass contract with the College Football Playoff has expired and said last week that “we don’t know if that’s ever going to happen again.” On3’s Alex Byington notes that it’s “unclear whether McAfee’s contract with the College Football Playoff will be renewed for the 2025 season or beyond, but with six months before any actual games kickoff, there’s plenty of time for discussions to pick back up.” Regarding his future with ESPN, McAfee responded to those who have speculated it may be coming to an end: “While we were [in Disney World] during our [two-week] break, with how long it was, some people were wondering – I’ve heard – in the industry, ‘Oh, Pat McAfee and the show are never coming back to ESPN.’ They thought we were gonna sail off into the sunset. Never come back. Then I popped my ass into Disney and I think, ‘Is this not enough of a mention?’ I am literally in Mickey Mouse’s town having the time of my life. We are so incredibly grateful that we get to do this. I think that was a lot of the thought while we were gone is just gratitude, perspective, appreciation, and also, it’s time to get back to work.” (link)

Dayton is cutting its workforce by 65 positions, including 45 professional faculty members whose contracts will not be renewed and 20 staffers whose positions have been eliminated. According to President Eric Spina, the cuts will amount to roughly $25M over three years, and “these changes are part of UD’s response to the broad set of challenges facing higher education that we’ve discussed in numerous working groups, town halls and Q&A sessions. But today, our focus is on our colleagues who received this difficult news and the impact on their lives.” (link)

The ACC, Florida State and Clemson have settled their legal dispute after agreeing to change the league's revenue distribution model and significantly reduce exit penalties for members wanting to leave the conference before 2036. According to ESPN’s Andrea Adelson, the “grant of rights remains in place through 2036, but beginning next year, the exit fee will be $165M. That fee then declines by $18M per year, leveling at $75M in 2030-31. Any team that pays the exit fee can leave with its media rights intact.” Clemson AD Graham Neff: "The ACC is an excellent fit for Clemson. The academic prestige and reputation we so emphasize here at Clemson is a natural fit with other members of the ACC. The historic football success the league has had and that Clemson has had in the ACC and access to the College Football Playoff currently – this is a great home for Clemson." Florida State AD Michael Alford adds: "We started this path on what was best for not only FSU but for the conference and this really incentivizes everyone in our conference to have the opportunity to go out and choose a path. That's all we ever asked for, was for the opportunity for us to compete nationally amongst our peers, and it's also going to make the league better." ESPN’s David Hale reports the “brand distribution will be based on a weighted five-year average of ratings as a % of total ACC viewership, with a more heavy value put on more recent years.” (link, link); Commissioner Jim Phillips says the “new structure demonstrates the ACC embracing innovation and further incentivizing our membership based on competition and viewership results. The settlements, coupled with the ACC’s continued partnership with ESPN, allow us to focus on our collective future." Clemson projects the new ACC rev-share model would give the school the opportunity to make an additional $120M over the next 6 years.(link)

Sportico’s Daniel Libit notes that “from the start, Democratic subcommittee members quickly seized on the opportunity to draw parallels between the debate over [NIL] and President Trump’s recent efforts to limit [NIH] funding to universities. Congressman Frank Pallone (D-NJ) remarked: “Today, If we truly want to address the real crisis affecting our colleges and universities, we should focus on the financial disaster they face, exacerbated by President Trump and his complicit Republican Congress.” Libit further contextualizes the hearing by noting it comes on the heels of last week’s confrontation between Trump and Ukraine President Volodymyr Zelensky and the administration’s imposition of 25% tariffs on imports from Canada and Mexico. “In this tense environment, the hearing itself reiterated the deep divisions within Congress on how to address college sports reform. As has become common over the past year, subcommittee Democrats emphasized athlete rights—which include employee protections—while Republicans focused on restoring stability to the system.” Congressman Rep. Jay Obernolte (R-CA) “set an ambitious precedent for forthcoming bills,” per Libit, who quotes Obernolte as saying: “We have an opportunity to create a system where everybody wins. Let’s not mess it up.” Libit subsequently posits: “One way for Congress to avoid that fate is to uphold its long-standing tradition of holding NIL hearings without enacting actual legislation. And, true to form, as Tuesday’s hearing drew to a close, a House Judiciary subcommittee unveiled plans to convene a second college sports panel next week.” (link)

CBS’ Dennis Dodd shares more takeaways from the hearing, including Congresswoman Diana Harshbarger asking how student-athletes’ fair market NIL value should be determined. When no one answered, Harshbarger remarked: “I know you’re speechless.” Dodd points out Illinois AD Josh Whitman did answer. While Harshbarger and Representative Lori Trahan (D-MA) were well-informed, Dodd notes several other lawmakers were not and subsequently observed: “Just a thought, I wonder how many of this Commerce Committee know Josh Whitman is chair of the NCAA Council. … Amid the rooting (‘Go Gators!’ ‘Go Dawgs!’) and the uninformed (Actual Congressman: ‘Is there a plan to share the revenue?’) I didn't hear the words ‘collective bargaining’ once today in this NIL hearing. With all due respect to the witnesses who shared their time, I'd like to see one of these committees invite an All-American at a P4 school player making $2M a year. And an NIL marketing agent. And an attorney in the trenches like Darren Heitner.” Dodd also writes: “This recently from a stakeholder in the NIL debate. ‘Whoever their [schools, conferences, NCAA] lobbyists are have no friggin’ idea what they’re doing … They’re not talking about the things that worry Congress. They’re talking about the things that worry them.’” Overall, Dodd sums up: “If I had a conclusion on NIL hearing No. 11, it would be the same conclusion I had after NIL hearings Nos. 1-10: The NCAA isn't getting an anti-trust exemption.” (link)

Little Rock is opting into the House settlement. (link); Minnesota Duluth will also opt into the House settlement. As for what that means and whether UMD will add roster spots in hockey and pay student-athletes, Bulldogs AD Forrest Karr says: “Our hope is to keep moving our programs forward. We intend to keep both programs in the position to be nationally competitive. Each decision that we make moving forward, whatever the rules end up being, each decision that we make will be informed by changes being made at other WCHA and NCHC programs. It will depend, at least in part, on donor support. We’re going to be working with donors to help support these changes. … We want to make sure we fully understand what the landscape looks like. Our intent will be to keep both the programs nationally competitive. It’s going to be an interesting few months, but our overall intent is to make sure that our hockey programs are strong, and we’re going to work with our donors to do that.” (link)

The College Football Playoff Management Committee has appointed Baylor AD Mack Rhoades as selection committee chair for 2025. Additionally, the selection committee is adding former Michigan State Football HC Mark Dantonio, Maryland AD Damon Evans, longtime sportswriter Ivan Maisel, Middle Tennessee State AD Chris Massaro and former Ole MIss All-American tight end Wesley Walls. The management committee has also asked longtime USA Today writer/former selection committee member Steve Wieberg to return. (link)

Utah has received a $14M estate gift from an anonymous donor to create an endowment that will significantly benefit key initiatives for women's athletics in perpetuity. This marks the second significant estate gift for Utah’s women's sports. Paired with the $6M planned gift from Harriet and Leo Hopf, the total now reaches $20M pledged to support future generations of female student-athletes. That total has “created the impetus for the launch of the Crimson Club Legacy Society, established to build long-term sustainable excellence for the University of Utah. The Crimson Club Legacy Society honors individuals and families who contribute to the development of such excellence by leaving the ultimate legacy for University of Utah student-athletes, coaches and athletic programs through charitable estate gifts.” (link)

Nevada finished FY24 with $53.3M in revenue and $53.9M in expenses, resulting in a deficit of nearly $600K, according to Nevada SportsNet’s Chris Murray, who notes the shortfall pales in comparison to UNLV’s, which “is expected to report to the Board of Regents this week a $20.891M deficit in 2024. The Rebels’ annual fiscal year report included revenue of $50,796,087 against expenses of $71,687,510. … UNLV began the year with a $6,023,848 self-reported deficit from the previous fiscal year, building a two-year deficit of almost $27M.” Murray goes on to report that “one of the biggest reasons for Nevada's 2024 deficit was mandatory cost-of-living increases instituted by the Nevada System of Higher Education. Those COLAs included a 14% and 11% raise for university's employees making less than $200K. That led to increased expenses for the Wolf Pack that were not matched by increased revenue after Nevada turned a small profit in fiscal year 2023 ($23,344). Wolf Pack AD Stephanie Rempe identifies ticket sales as the biggest area for potential growth. "The hardest part is that all of our premium spaces in football are sold out and we don't have premium spaces in Lawlor (Events Center). Another area is philanthropy, which is why we have a full staff that are now fundraisers. Sponsorship. We were $110K away from hitting rev-share this year (through Learfield). So, that's a huge positive.” Also of note from Murray: “Of Nevada's $53.917M budget, 46.5% was provided by state, student and university fees (a total $25.051).” Lots more. (link)

Arizona’s new eight-year apparel deal with Nike has a total value of $44M, an average of $5.5M per year, according to the Arizona Daily Star’s Michael Lev, who notes the Wildcats’ current Nike deal is worth $2.3M per year. Lev also reports that “in recent years, the athletic department’s apparel expenditures exceeded its allotment from Nike by as much as $2.5M in a given year. That money had to come out of the department’s budget. Under the new contract, that money can be spent on revenue-sharing and/or other operational costs.” (link)

Big Ten Network averaged 78K viewers for its women’s basketball coverage this season, good for the network’s second-best figure on record behind last season's record-setting numbers fueled by Caitlin Clark, according to SBJ’s Austin Karp, who notes BTN increased its number of WBB games this season from 49 in 2023-24 to 61. Karp also points out the “arrival of several West Coast schools led to a 31% uptick in WBB viewership in the Pacific Time Zone.” (link)

Penn Entertainment CEO Jay Snowden admitted during last week’s earnings call that “when we announced our partnership with ESPN [to create ESPN Bet] in the summer of ‘23, both sides of this partnership made it very clear that we expected to compete for a seat at the podium. And we’re not on pace right now to do that. So, I would just say that, our expectations as we’re moving through 2025 are that we’re continuing to show improvements in both the sports betting business, of course, and the online gaming business as well. And if we’re not hitting the levels that we expect to as we move through the year and you approach the end of the calendar year, then you’ve got levers operationally. … Of course, as you get into 2026, you hit the third anniversary of our relationship with ESPN. And both sides expect to be in a really good place. I mean, we are heads down, laser-focused. We have tremendous plans in place for 2025 and 2026. But if for whatever reason we’re not hitting the levels that we need to, then obviously as you’re approaching that third anniversary, you have a three-year clause in the contract that both sides will have to do what’s in their best interests.” It was also revealed on the earnings call that less than 0.1% of ESPN app users have linked an ESPN Bet account.
