Cal Baptist has informed the Big West it will accept an invitation to join the league and leave the WAC in 2026, Action Network’s Brett McMurphy reports, adding: “Utah Valley also has Big West invitation, but has not informed the league of its decision yet, source said. Cal Baptist will pay a $1.2M entry fee to join Big West.” (link)

Presidents in the Mountain West are “irked” that the five schools leaving for the Pac-12 have neither given official notice of their departures nor wired the requisite $5K exit deposit, according to JohnCanzano.com’s eponymous publisher, who writes: “They’ll tell you that the ‘Mountain West Five,’ as they’re often called, not only bailed but are still clinging to their board seats, trampling the league’s conflict of interest policy by sitting in on meetings with the Pac-12. … Both conferences insist they’ve got a winning hand. Both sides will tell you they’re not afraid to go to court. Yet, we all know university presidents are risk-averse and eager to settle.” One Mountain West board member tells Canzano: “We don’t want to throw mud at the Pac-12. We just want to move forward. We feel like we’re in a good place as a conference. We should be together (in a merger). We’d be stronger together. But if we’re going separately, how about you just do you and let us do us?” Several MW sources compare the current legal dispute with the Pac-12 (and the amount of attorneys’ fees) to that which was recently settled between the ACC and Clemson and Florida State. On that score, Canzano notes former Fox Sports President Bob Thompson was the court-appointed mediator. Thompson “isn’t a judge or a lawyer. But he negotiated a pile of media rights contracts in his 25 years in the industry. The parties needed someone who knew and understood the landscape. It would have taken too long to educate a retired judge on the nuances of the media-rights world and values, so Thompson was the pick. I suspect if former Pac-12 Commissioner George Kliavkoff had the sense to hire Thompson to consult in 2022, the conference might have accepted that fateful $30 million offer from ESPN and lived on.” (link)

SBJ’s Ben Portnoy weighs in on the ACC’s settlement with Florida State and Clemson and credits Commissioner Jim Phillips with "keeping the league afloat.” Portnoy explains: “Clemson and Florida State wanted out. It wasn’t clear whether ESPN would extend its media rights agreement ahead of an early 2025 deadline. All that felt like precursors to another conference realignment fire sale (I’ll concede I wasn’t totally sure how the ACC would soldier on, either). And yet, here in March 2025, the ACC is alive and seemingly set to exist for the foreseeable future between moving toward settling the aforementioned lawsuits and ESPN extending its deal through 2036 last month. Phillips deserves ample credit for all that, even if it might seem his hand was forced.” Portnoy goes on to ask: “How does that old proverb go? Necessity is the mother of innovation? That’s all good and well, but if that forced innovation leads to building a skyscraper out of popsicle sticks, it’s probably not going to hold in a hurricane. Perhaps we look up four years from now, the current Power Four is kaput and high-major college sports look completely different than they do today. In this moment, though, Phillips has navigated the S.S. ACC tugboat through a typhoon. He deserves his flowers.” (link)

Georgia Tech AD J Batt met today with the Board of Trustees. According to the Atlanta Journal-Constitution’s Chad Bishop, “new turf is scheduled to be installed at Bobby Dodd Stadium over the summer and the Fanning Center, currently under construction, remains on track to be completed in the spring of 2026. The final steel beam is scheduled to go in during a ceremony Friday.” Bishop also reports the Yellow Jackets made a $500K net gain from the football team’s appearance in the 2024 Birmingham Bowl, adding: “Some of the department’s expenses were over budget in the second quarter for the fiscal year 2025, but there are concerted efforts, including increased ticket revenue and the renewal of the school’s contract with Adidas, to make up for those expenses.” (link)

James Madison AD Matt Roan tells the Daily News Record’s Shane Mettlen that he wants JMU to be at the top of the Sun Belt in terms of revenue-sharing. He also aims to compete with some of the most successful Group of 5 football programs such as Boise State, Tulane and Memphis. “The specific number is not yet finalized because of university processes. But we know what those benchmarks are. We want to make sure we are leading the league with respect to that. That comes from our ability to forecast what our self-generated revenues will be.” Roan goes on to assert: “I cannot be clearer, that whatever we do in the rev share space, it will not be due to student fees. It will be based on our ability to generate revenues ourselves as an athletic department, and then it will be based on our ability to realize certain operational efficiencies.” While Roan doesn’t commit to the exact rev-share distributions per sport, he suggests it could be similar to the 75%/15%/5% model many schools appear to be using for football, men’s basketball and women’s basketball, respectively, with the remainder going to other sports. Mettlen notes that “for football and basketball players, that could be as simple as playing in games where tickets are sold. For other sports, players may be asked to participate in events that help generate funds for the school. Roan: “Maybe this is a little bit unique for us, but maybe kind of developing what I would call an ambassadorship program. So, the student-athletes who do benefit from rev-share moving forward, we’d have them much more involved whether it’s actively trying to secure donations or ticket sales and picking up the phone, but even outside of athletics is having our student-athletes much more involved.” (link)

Siena “does not intend” to opt into revenue-sharing; however, the school says it will continue to evaluate the situation ahead of the June 15 deadline. Saints AD John D’Argenio: “While they have terms of the settlement, they’ve got to wait until it’s finally approved to see if there’s any change to it. There’s so many unknowns, at least in our mind right now, to make a definitive statement of what we’re going to do.” An athletic department spokesperson adds: “Several factors have informed this stance, including unclear settlement terms, the additional infrastructure required to comply with opt-in’ criteria, and the rapidly shifting landscape of college athletics. Significant questions remain regarding the settlement’s implementation, Title IX compliance, and long-term sustainability.” (link); Memphis will opt into the House settlement, Tigers Senior Assoc. Experts who reviewed a sampling of more than a dozen NIL contracts tell ESPN’s Dan Murphy the deals bear the hallmarks of employment contracts. Illinois law professor Michael LeRoy explains the contracts "cross those red lines very clearly. It's employment on its face. There's no masking it." The documents obtained by Murphy include full MOUs and templates from the SEC and Big Ten, and he points out that many of them explicitly state student-athletes are not employees and are not being paid for playing on the team. “However, experts say, the fine print might be deemed in a court challenge to contradict those assertions.” Johnson v. NCAA plaintiffs’ attorney Michael Willemin: "They're really bending over backward to try to thread a needle that I don't think can be threaded.” Heitner Legal Founder Darren Heitner adds: "These deals are absolutely worthless to athletes. There's no reason to sign it. You're giving away rights and there's no guarantees for you in it." Athletes.org CEO Brandon Copeland points out that “there’s a reason why the NFLPA gets a chance to see any deal that involves five players or more. One, that's to protect the athletes, and two, is to make sure it's maximized and the athletes aren't being taken advantage of.” Copeland goes on to submit that legal challenges will only increase moving forward. "I think next year will be a lot more chaos than there ever has been. Eventually people are going to look at this whole system and say: Well, why don't we just do this thing like pros?" (link)

Kennyhertz Perry attorney Mit Winter advises against counting on the DOJ to change its objection to the House settlement. He explains: “In early 2021, under pressure from state NIL laws, the NCAA was scheduled to vote on revising its NIL bylaws. Before the vote happened, the DOJ swooped in with a letter explaining the NCAA’s proposed NIL bylaws had antitrust issues. In a past-is-prologue moment, the DOJ had specific concerns with the NCAA’s plan to require athletes to disclose all deals to a ‘third-party administrators’ for a fair market value analysis. Sound familiar? As the DOJ noted, AD & coach salaries aren’t subjected to this process. And which administration was the assistant attorney general who wrote the letter (Makan Delrahim) serving under? Trump. At the time of his letter, he expected the Biden administration to continue with the same antitrust approach. He was right.” Delrahim argued that any antitrust immunity “should be as narrow as possible & be conditioned on collective representation rights for athletes. … Then the 9-0 Alston decision came down and the NCAA’s various NIL restrictions and the third party administrator were abandoned in favor of the interim NIL policy. But the proposed third-party administrator and other restrictions are now back as part of the House settlement. So as you can see, the NCAA has done nothing to address the antitrust concerns raised by the DOJ in 2021 under the Trump administration. It’s still just hoping Congress passes a law that allows it to impose the restrictions/TPA without fear of antitrust law. Yes, schools will be allowed to pay athletes under the House settlement. But that doesn’t mean the NCAA should get a free pass on abiding by antitrust law.” (link)

Commissioner Jeff Bacon: “To our student-athletes: this decision was made for you. More than anything we want to provide you with an elite championship experience that you will remember for the rest of your life and it is our intention to make sure that happens. Fanatics has partnered with Ticketmaster to create the Fanatics Ticket Marketplace, where users on the Fanatics app can buy resale tickets alongside apparel, merchandise, trading cards and collectibles. Sportico’s Eben Novy-Williams reports the deal is part of a “wider two-way partnership between Fanatics and the Live Nation unit, whereby Ticketmaster tickets list via Fanatics, and Fanatics merchandise lists via Ticketmaster.” Fanatics Chief Strategy and Growth Officer Tucker Kain: “When you look at the market position that Ticketmaster has built—we wanted to make sure we had as broad and comprehensive an offering as we could. Plus, having Ticketmaster/Live Nation as a potential partner across a number of things, like distributing our merchandise [through them], there’s an opportunity to start here and build a bigger partnership over time.” While the financial specifics remain unknown, Kain says it’s a commercial partnership that does not involve equity. Kain also tells Novy-Williams: “We didn’t think there was necessarily a need for just another ticketing company, so how does this actually add value? We’re tying it to your Fanatics ID, so we can understand what a fan does across merchandise, trading cards, betting and now ticketing. And then it’s, how can we reward that?” (link)

U.S. District Judge Claudia Wilken has released details on the House settlement final approval hearing to be held on April 7. Due to time constraints, Wilken has limited the objectors that will be called as part of the hearing. Boise State professor Sam Ehrlich shares the list and points out Wilken has attached a note explaining that the “Court cannot order changes to the agreement. Objectors should address whether they wish the Court to reject the settlement and set the case for trial.” Ehrlich submits this is likely in response to those who have asked Wilken to push the NCAA to change roster limits. WCC Commissioner Stu Jackson joins the WCC Points in the Paint podcast with Sean Farnham and Dave Flemming and says that “in a perfect world it would have been great going into the conference tournament that we would have been assured of perhaps three bids in the NCAA Tournament. We still may get there but, again, we wouldn't even be in that position, quite frankly, without a stronger and deeper conference. And it's incumbent upon us as we look at the conference in the future that we focus on our original objective, [which is] to continue to try to build the overall strength of our existing members but, as importantly, if we add members, they need to be members that add basketball strength for both the women and the men.” Regarding the changes throughout the industry, Jackson explains he’s “comfortable in a sphere of injustice, which is what I feel conferences like ours have suffered. Over the past months, first with the process of the House settlement and the damages that conferences like ours incurred as a result of the defendants being the NCAA and the Power 5 conferences…only to be repeated once again when we're in this phase of redefining NCAA governance and implementation and what that governance would look like, we find ourselves once again in a position where we are in the dark waiting for, as I termed it, the tablets to be handed down.” Because of conference expansion, Jackson points out that several teams will make this year’s NCAA Tournament despite having conference records at or below .500. “Their resumes are going to be worthy for NCAA participation, unfortunately to the detriment of teams in mid-major conferences that perhaps have better records – and, you could argue, maybe better teams.” Full podcast. Outgoing Stanford AD Bernard Muir tells SBJ’s Ben Portnoy that “I think right now, what Stanford’s gonna try to do is figure out what does the House impact have on the department. Revenue is going to be critical. We jumped into the ACC taking a bit of a haircut, so tightening the belt from a budgetary standpoint, really focusing on where to strategically put the resources across the entire department [are crucial]. And then, like I said, revenue generation is going to be critical. And then really trying to calibrate how you invest in a 36-sport program and be able to compete on a national stage, especially in the programs that garner great exposure. … I think we’ve all had to adapt and adjust really quickly on the fly and I know my AD peers are doing that right now. We’re talking about dollars, primarily – whether we put it in our student-athletes’ pockets through [revenue] sharing, or whether we provide additional scholarships. I still think this is rooted in an educational endeavor, and there’s something to be garnered by being on a campus and spending as long as you can in one place and getting a degree.” What’s next for Muir? “People mentioned the ‘Retirement’ word. I feel a little young for that. I’m thankful that I at least have a chance to assess, and hopefully, knock on wood, my health stays good and I can jump into something else when the timing’s right.” (link)

Virginia will not support a diving program next year, according to SwimSwam Editor in Chief Braden Keith, who notes UVA, “like other ACC teams, are limited at 30 athletes on each of their men’s and women’s swimming & diving teams, and the Cavaliers don’t necessarily have to make many cuts to get under those numbers as they host a relatively lean roster as it is. Sources close to the program told SwimSwam that the Cavaliers have a lower goal than that, though. While the program is open to going up to those limits, their goal is to be closer to 24 swimmers per gender. … This move is reflective of what many Division I coaches have told SwimSwam, which is that they view the smaller rosters as an opportunity to give athletes more individual attention and manage a more nimble roster. One coach even proposed to SwimSwam a limit of 12 swimmers and a number of divers.” (link)

SBJ’s Ben Portnoy checks in with several stakeholders around the industry to hear what they have to say about the increasing number of schools hiring football GMs. Blueprint Sports CEO Rob Sine: “It’s a fad right now that is appropriate that a lot of people are focusing on because professional sports is penetrating this industry top to bottom in a lot of different areas. Professional sports have been doing roster management for a long time, so it makes sense to bring it to the college level. But you also look at the roster or the staff size at a professional sports team compared to a college, you can’t just check a box and say, ‘Hey, I’ve got a GM that I’m paying hundreds of thousands of dollars a year,’ or ‘I have a software solution.’ … How do you make it actionable? How do you go out and actually negotiate, recruit and look for the right student athletes, build the right budget to afford the players you want to pick? It all has to be linked together. So much of it right now is sitting in boxes in departments across the country, and I’m not quite sure that they know what they have or what they’re going to be getting to in the long run.” The Athlete Group Partner Jake Rosenberg: “This GM role, it’s not only a title, but it really starts absorbing a lot more of the responsibility and true autonomy in the team build. It becomes more empowered over time. And not really to head coaches' detriment, but to the head coaches' benefit in the sense that coaches are doing a lot of work that is really outside their primary skills that are skills unto themselves, and that the entire team as a whole would benefit by someone else really handling. “There are just so many new functions that were not part of the process at all in the past, and now are part of the process and are being handled by coaches. They’re really kind of taking away from a lot of the true skills and value that these coaches are able to add.” (link)

The sports industry is becoming more adept at implementing loyalty programs, according to SBJ’s Bret McCormick, who notes that “for years, the industry has asked fans to hand over their data with little to offer in return, but modern loyalty and fan engagement programs are making this exchange a better deal for fans. Sports properties are providing more exclusive content, merchandise, concessions items and experiences, and in some cases, team apps are the primary way to view a team’s game broadcasts. What were once ‘grind and earn’ points-based loyalty programs are beginning to more closely resemble memberships or subscriptions. Within sports property C-suites, the view of these programs is shifting, too, from cost centers to revenue generators that touch all areas of a modern sports enterprise.” Next League Chief Digital Officer Shripal Shah tells McCormick: “They’re starting to get a broader understanding that it’s actually the tip of the spear for everything else that they’re trying to do, like fan identification, automated fan journeys, personas, segmentation and increasing share of [digital] wallet.” McCormick goes on to highlight Minnesota’s loyalty program and explains: “Besides offering money-can’t-buy types of experiences as rewards in the Gopher Loyalty program, Minnesota athletics particularly focuses on including children-focused events in the rewards catalogue, a popular offering for grandparent fans that helps as ‘that 5-, 6-, 7-, 9-year-old starts to develop their affinity for Gopher athletics,’ said Michael Kelly, director of development and annual giving strategy.” Lots more. The Pat McAfee Show’s eponymous host says his Field Pass contract with the College Football Playoff has expired and said last week that “we don’t know if that’s ever going to happen again.” On3’s Alex Byington notes that it’s “unclear whether McAfee’s contract with the College Football Playoff will be renewed for the 2025 season or beyond, but with six months before any actual games kickoff, there’s plenty of time for discussions to pick back up.” Regarding his future with ESPN, McAfee responded to those who have speculated it may be coming to an end: “While we were [in Disney World] during our [two-week] break, with how long it was, some people were wondering – I’ve heard – in the industry, ‘Oh, Pat McAfee and the show are never coming back to ESPN.’ They thought we were gonna sail off into the sunset. Never come back. Then I popped my ass into Disney and I think, ‘Is this not enough of a mention?’ I am literally in Mickey Mouse’s town having the time of my life. We are so incredibly grateful that we get to do this. I think that was a lot of the thought while we were gone is just gratitude, perspective, appreciation, and also, it’s time to get back to work.” (link)

Dayton is cutting its workforce by 65 positions, including 45 professional faculty members whose contracts will not be renewed and 20 staffers whose positions have been eliminated. According to President Eric Spina, the cuts will amount to roughly $25M over three years, and “these changes are part of UD’s response to the broad set of challenges facing higher education that we’ve discussed in numerous working groups, town halls and Q&A sessions. But today, our focus is on our colleagues who received this difficult news and the impact on their lives.” (link)
