House case plaintiffs’ attorney Jeffrey Kessler joined SANIL Founder/Rutgers law professor Jason Belzer’s class to discuss the House settlement, and Belzer provides a recap: “Jeff believes the strongest objections to the case will come in reference to Title IX but because it's a anti-trust case, the same standard does not apply to calculating how damages are determined. All the settlement does is commit the schools to paying the damages and sharing future revenue, how the money gets paid out is not for the House case to decide. How Title IX gets applied will be litigated in the future. He also does not believe that the objection that the settlement can't happen because there should be a bargaining unit on behalf of the athletes will not succeed. The settlement allows for collective bargaining to exist in the future, but is not relevant to this case. Lastly, he does not believe that the objection around roster limits and eliminating walk-on positions will be enough to derail the settlement.” (link)

NCAA SVP of Basketball Dan Gavitt joins The Field of 68’s Jeff Goodman and Rob Dauster and reiterates that when it comes to expansion there “is no intended outcome” and “one of the potential outcomes certainly is still no expansion at all. And if there were to be a recommendation to expand, it would likely be very modest in nature.” Dauster notes Kentucky Men’s Basketball HC Mark Pope recently suggested expanding the regular season to 40 games, and Gavitt explains that would be more tractable than dramatically increasing the number of games in the NCAA Tournament, which is limited by the calendar. Gavitt goes on to remark that “I don’t think we should look at the SEC this year as an outlier and something that we're not going to experience probably on a pretty regular basis going forward. … Would the committee consider moving teams up or down a seed line to avoid teams from the same league playing early in the tournament? The simple answer is no. That would be the last resort. … We’ve done a lot of modeling just based on projections and and we think it's going to work out fine this year, but undoubtedly we're going to see more conference matchups during this year and future NCAA tournaments if you have as many as 11, 12, 13, or more teams from one league in the field.” Gavitt admits work needs to be done with the playing rules committee to curb the number of monitor reviews and also points out there are some “game administration” areas, such as subbing players in and shooting free throws in a timely manner, that can be tightened to shorten the length of games. Mountain West Commissioner Gloria Nevarez covers several topics on the Big Mountain podcast and says the state of Texas is an area of interest in expansion, “but [we’re] pretty genuine in we're taking a pause right now. I think we're going to see what our media situation is and then if there's more to be had, maybe do that after we understand what our media rights are.” With UC Davis joining the league for non-football sports, Nevarez talks about the challenges associated with bringing in an FCS school for football and explains: “One of the things we were concerned about is with all these governance changes, what if we rely on bringing an FCS School up and then the rules change or something happens that prevents or makes entry into FBS more difficult? Certainly that's been a conversation. There have been significant political headwinds within the world of FBS about what is our size? Should we be adding more schools? So we felt strongly that right now at this time, sticking with current FBS schools was where we wanted to be to ensure our future. Memphis has raised $26.168M toward its Simmons Bank Liberty Stadium renovation project, Tigers AD Ed Scott told trustees yesterday. The Tigers are tasked with raising at least $50M toward the $222M project to unlock a $50M matching pledge made by FedEx Founder Fred Smith, and Scott said he feels good about reaching the goal “because there are some other conversations that I’m not at liberty to discuss that are rather large amounts that, when those come through, it’ll really put a nice dent in that $50M mark for us. So, I feel really good about where we’re at.” According to the Daily Memphian’s Frank Bonner II, Scott’s presentation included three verbal pledges for gifts worth a combined $7.8M; however, since those gifts aren’t finalized, Scott didn’t include them in the $26M figure he cited. Scott also noted that fundraising for the $8.5M Liza Wellford Fletcher Stadium project has reached $6.97M. Additionally, Scott explained the Tigers wound up $764,620 short in football-season ticket revenue projections for FY25 and $43,200 short in football-parking revenue. The shortfall was expected due to decreased Liberty Stadium capacity prompted by the renovation. Bonner notes the “department’s total ticket and parking shortfall to date is $872,669, with spring sports still ongoing and one regular-season men’s [basketball] game remaining.” Scott on the House settlement: “All I’m saying is we’re opting in now. I don’t find it necessary to tell everybody what we’re doing, yet. As long as our coaches and staff know, that’s all I’m really concerned about at this point.” (link)

Michigan AD Warde Manuel agrees with Big Ten Commissioner Tony Petitti and SEC Commissioner Greg Sankey about making changes to the way the College Football Playoff is seeded, explaining: “I battled that with friends and people who would say, ‘Well, the number three team lost in the Playoff. The number four team lost in the Playoff.’ And I’m like, ‘No, the number four team was ranked 12th, the number three team was ranked eight.’ Now, one and two lost because they were the same, but you have these shifts. … When teams are ranked one and two, and because of the way they’re seeded, that people can come into those positions and back stronger teams up into positions where they’re playing you earlier than they normally would. So, I think it puts those teams that bounce out of the top four because other teams come in – I think it puts them at a disadvantage because you’re either playing tougher teams earlier or as the number one and two teams did this year, they’re playing a higher-ranked team earlier in the Playoff than they would have if they had just seeded them.” Manuel adds: “So, in my opinion, you add the five conference champions, and you leave them ranked where they are unless they’re outside. This year everybody would have been ranked one through 10. Arizona State would have moved from 12 to 11 and Clemson would have moved to 12. Then you set the Playoff from there.” (link)

Michigan State AD Alan Haller talks about the decision to move the Spartans’ football finale next season against Maryland to Ford Field, saying he’s confident fans welcome this: “Yeah, I did my homework. This wasn't me just sitting in my office saying let's do this. I had a focus group of a number of people. I checked with a lot of people, my staff checked with a lot of people, and there was an all go on this. There was very little negative feedback.” Haller also stands by his commitment not to drop any sports: “While I’m AD, my plan is to not drop any sports, so you can put that on record. As of March 4, Clemson had paid about $2.05M to four law firms for work on its lawsuit against the ACC, according to a Freedom of Information Act request filed by the Post & Courier’s Jon Blau, who notes the Tigers were billed for nearly 3,400 hours of legal work in the dispute. Blau also reports that “the biggest chunk has gone to the Columbia-based firm Nelson Mullins, which received about $1.54 million. Clemson's athletics fundraising arm, IPTAY, has paid about $890,000 of what was owed to Nelson Mullins. Clemson has said outside attorneys in the case will not receive state dollars.” Rather, the dispute has been funded by athletic department revenue as well as private donors. The latter included "un restricted" donations to IPTAY and gifts specifically earmarked for the effort. Whether the investment is worth it remains to be seen, but Blau notes the fee for leaving after 2030-31 has been reduced to $75M; therefore, “at this point, Clemson has parlayed a couple of million dollars in legal fees into tens and potentially hundreds of millions of dollars in future broadcast revenues.” (link)

West Virginia has unveiled a new men’s basketball season ticket model under which the per seat contribution will be combined with any other donations made to the athletic department, including contributions to the Country Roads Trust, to determine fans’ overall Mountaineer Athletic Club membership levels. Under the new model, 30% of season ticket holders will experience no increase or even a decrease in their overall season ticket cost and 50% will experience an increase of less than $250. Mountaineers AD Wren Baker: "Collegiate athletics is undergoing the most transformational period in its history. Presidents in the Mountain West are “irked” that the five schools leaving for the Pac-12 have neither given official notice of their departures nor wired the requisite $5K exit deposit, according to JohnCanzano.com’s eponymous publisher, who writes: “They’ll tell you that the ‘Mountain West Five,’ as they’re often called, not only bailed but are still clinging to their board seats, trampling the league’s conflict of interest policy by sitting in on meetings with the Pac-12. … Both conferences insist they’ve got a winning hand. Both sides will tell you they’re not afraid to go to court. Yet, we all know university presidents are risk-averse and eager to settle.” One Mountain West board member tells Canzano: “We don’t want to throw mud at the Pac-12. We just want to move forward. We feel like we’re in a good place as a conference. We should be together (in a merger). We’d be stronger together. But if we’re going separately, how about you just do you and let us do us?” Several MW sources compare the current legal dispute with the Pac-12 (and the amount of attorneys’ fees) to that which was recently settled between the ACC and Clemson and Florida State. On that score, Canzano notes former Fox Sports President Bob Thompson was the court-appointed mediator. Thompson “isn’t a judge or a lawyer. But he negotiated a pile of media rights contracts in his 25 years in the industry. The parties needed someone who knew and understood the landscape. It would have taken too long to educate a retired judge on the nuances of the media-rights world and values, so Thompson was the pick. I suspect if former Pac-12 Commissioner George Kliavkoff had the sense to hire Thompson to consult in 2022, the conference might have accepted that fateful $30 million offer from ESPN and lived on.” (link)

SBJ’s Ben Portnoy weighs in on the ACC’s settlement with Florida State and Clemson and credits Commissioner Jim Phillips with "keeping the league afloat.” Portnoy explains: “Clemson and Florida State wanted out. It wasn’t clear whether ESPN would extend its media rights agreement ahead of an early 2025 deadline. All that felt like precursors to another conference realignment fire sale (I’ll concede I wasn’t totally sure how the ACC would soldier on, either). And yet, here in March 2025, the ACC is alive and seemingly set to exist for the foreseeable future between moving toward settling the aforementioned lawsuits and ESPN extending its deal through 2036 last month. Phillips deserves ample credit for all that, even if it might seem his hand was forced.” Portnoy goes on to ask: “How does that old proverb go? Necessity is the mother of innovation? That’s all good and well, but if that forced innovation leads to building a skyscraper out of popsicle sticks, it’s probably not going to hold in a hurricane. Perhaps we look up four years from now, the current Power Four is kaput and high-major college sports look completely different than they do today. In this moment, though, Phillips has navigated the S.S. ACC tugboat through a typhoon. He deserves his flowers.” (link)

Georgia Tech AD J Batt met today with the Board of Trustees. According to the Atlanta Journal-Constitution’s Chad Bishop, “new turf is scheduled to be installed at Bobby Dodd Stadium over the summer and the Fanning Center, currently under construction, remains on track to be completed in the spring of 2026. The final steel beam is scheduled to go in during a ceremony Friday.” Bishop also reports the Yellow Jackets made a $500K net gain from the football team’s appearance in the 2024 Birmingham Bowl, adding: “Some of the department’s expenses were over budget in the second quarter for the fiscal year 2025, but there are concerted efforts, including increased ticket revenue and the renewal of the school’s contract with Adidas, to make up for those expenses.” (link)

James Madison AD Matt Roan tells the Daily News Record’s Shane Mettlen that he wants JMU to be at the top of the Sun Belt in terms of revenue-sharing. He also aims to compete with some of the most successful Group of 5 football programs such as Boise State, Tulane and Memphis. “The specific number is not yet finalized because of university processes. But we know what those benchmarks are. We want to make sure we are leading the league with respect to that. That comes from our ability to forecast what our self-generated revenues will be.” Roan goes on to assert: “I cannot be clearer, that whatever we do in the rev share space, it will not be due to student fees. It will be based on our ability to generate revenues ourselves as an athletic department, and then it will be based on our ability to realize certain operational efficiencies.” While Roan doesn’t commit to the exact rev-share distributions per sport, he suggests it could be similar to the 75%/15%/5% model many schools appear to be using for football, men’s basketball and women’s basketball, respectively, with the remainder going to other sports. Mettlen notes that “for football and basketball players, that could be as simple as playing in games where tickets are sold. For other sports, players may be asked to participate in events that help generate funds for the school. Roan: “Maybe this is a little bit unique for us, but maybe kind of developing what I would call an ambassadorship program. So, the student-athletes who do benefit from rev-share moving forward, we’d have them much more involved whether it’s actively trying to secure donations or ticket sales and picking up the phone, but even outside of athletics is having our student-athletes much more involved.” (link)

Siena “does not intend” to opt into revenue-sharing; however, the school says it will continue to evaluate the situation ahead of the June 15 deadline. Saints AD John D’Argenio: “While they have terms of the settlement, they’ve got to wait until it’s finally approved to see if there’s any change to it. There’s so many unknowns, at least in our mind right now, to make a definitive statement of what we’re going to do.” An athletic department spokesperson adds: “Several factors have informed this stance, including unclear settlement terms, the additional infrastructure required to comply with opt-in’ criteria, and the rapidly shifting landscape of college athletics. Experts who reviewed a sampling of more than a dozen NIL contracts tell ESPN’s Dan Murphy the deals bear the hallmarks of employment contracts. Illinois law professor Michael LeRoy explains the contracts "cross those red lines very clearly. It's employment on its face. There's no masking it." The documents obtained by Murphy include full MOUs and templates from the SEC and Big Ten, and he points out that many of them explicitly state student-athletes are not employees and are not being paid for playing on the team. “However, experts say, the fine print might be deemed in a court challenge to contradict those assertions.” Johnson v. NCAA plaintiffs’ attorney Michael Willemin: "They're really bending over backward to try to thread a needle that I don't think can be threaded.” Heitner Legal Founder Darren Heitner adds: "These deals are absolutely worthless to athletes. There's no reason to sign it. You're giving away rights and there's no guarantees for you in it." Athletes.org CEO Brandon Copeland points out that “there’s a reason why the NFLPA gets a chance to see any deal that involves five players or more. One, that's to protect the athletes, and two, is to make sure it's maximized and the athletes aren't being taken advantage of.” Copeland goes on to submit that legal challenges will only increase moving forward. "I think next year will be a lot more chaos than there ever has been. Eventually people are going to look at this whole system and say: Well, why don't we just do this thing like pros?" (link)

Kennyhertz Perry attorney Mit Winter advises against counting on the DOJ to change its objection to the House settlement. He explains: “In early 2021, under pressure from state NIL laws, the NCAA was scheduled to vote on revising its NIL bylaws. Before the vote happened, the DOJ swooped in with a letter explaining the NCAA’s proposed NIL bylaws had antitrust issues. In a past-is-prologue moment, the DOJ had specific concerns with the NCAA’s plan to require athletes to disclose all deals to a ‘third-party administrators’ for a fair market value analysis. Sound familiar? As the DOJ noted, AD & coach salaries aren’t subjected to this process. And which administration was the assistant attorney general who wrote the letter (Makan Delrahim) serving under? Trump. At the time of his letter, he expected the Biden administration to continue with the same antitrust approach. He was right.” Delrahim argued that any antitrust immunity “should be as narrow as possible & be conditioned on collective representation rights for athletes. … Then the 9-0 Alston decision came down and the NCAA’s various NIL restrictions and the third party administrator were abandoned in favor of the interim NIL policy. But the proposed third-party administrator and other restrictions are now back as part of the House settlement. So as you can see, the NCAA has done nothing to address the antitrust concerns raised by the DOJ in 2021 under the Trump administration. It’s still just hoping Congress passes a law that allows it to impose the restrictions/TPA without fear of antitrust law. Yes, schools will be allowed to pay athletes under the House settlement. But that doesn’t mean the NCAA should get a free pass on abiding by antitrust law.” (link)

More than anything we want to provide you with an elite championship experience that you will remember for the rest of your life and it is our intention to make sure that happens. Fanatics has partnered with Ticketmaster to create the Fanatics Ticket Marketplace, where users on the Fanatics app can buy resale tickets alongside apparel, merchandise, trading cards and collectibles. Sportico’s Eben Novy-Williams reports the deal is part of a “wider two-way partnership between Fanatics and the Live Nation unit, whereby Ticketmaster tickets list via Fanatics, and Fanatics merchandise lists via Ticketmaster.” Fanatics Chief Strategy and Growth Officer Tucker Kain: “When you look at the market position that Ticketmaster has built—we wanted to make sure we had as broad and comprehensive an offering as we could. Plus, having Ticketmaster/Live Nation as a potential partner across a number of things, like distributing our merchandise [through them], there’s an opportunity to start here and build a bigger partnership over time.” While the financial specifics remain unknown, Kain says it’s a commercial partnership that does not involve equity. Kain also tells Novy-Williams: “We didn’t think there was necessarily a need for just another ticketing company, so how does this actually add value? We’re tying it to your Fanatics ID, so we can understand what a fan does across merchandise, trading cards, betting and now ticketing. And then it’s, how can we reward that?” (link)
