This isn't completely unusual, but is more evidence of college leaders’ push for Fed legislation before the presidential election season.” (link)

+ The Texas House of Representatives came up three votes shy of the 100 it needed to pass legislation legalizing sports gambling and casinos. Representative Leach (R-Plano), who authored the bill, says he is “hopeful and expectant” the House will get all 100 votes needed today. Texas voters ultimately get to decide on the legalization, assuming the proposals make it through both chambers. (link)
+ The Minnesota Senate has advanced a bill to legalize sports gambling to the Senate Rules Committee, and Senator Klein (D-53), who sponsored the bill, is optimistic about getting the state’s two horse tracks on board. “We've got to find a way to make the tracks at least not openly oppose it.” (link)
+ The Colorado Rapids have removed midfielder Max from all team activities as MLS investigates his connection with unlawful sports gambling, according to The Athletic’s Bogert, who reports that “Max is alleged to have received 60,000 Brazilian real (around $12K USD) to purposefully get a yellow card last season against LA Galaxy.” (link)

Renovations to TIAA Bank Field in Jacksonville may force the Florida-Georgia football series to be played in a different venue in the 2025 and 2026 seasons. Jacksonville Mayor Curry, who noted the Jacksonville Jaguars may also be pushed out of their home for two seasons, suggested the two teams play a home-and-home before returning in 2027. Gators AD Stricklin, however, tells The Athletic that he is under the impression the stadium would not be available for the 2026 and 2027 seasons if the renovation project moves forward. Stricklin also notes that having the Jaguars play their home games at Ben Hill Griffin Stadium would be “worth a conversation. There are a lot of Jags fans in Gainesville given the close proximity to Jacksonville.” (link)

Dave Willock, Sr., the father of Georgia football student-athlete Devin Willock, who passed away in an automobile accident earlier this year, has now filed a lawsuit against the university’s athletic association, former UGA student-athlete Carter, who was recently drafted by the Philadelphia Eagles, and others, according to The Athletic. UGA says in its response to the suit: “The attorneys who filed the complaint have refused to provide any factual basis for their claims against the athletic association, and we believe the evidence will prove them to be without merit. We intend to strongly dispute these baseless allegations in Court.” Willock is seeking $30M from the defendants in compensatory damages as well as an additional $10M in punitive damages from Carter, according to the lawsuit. The U.S. First Circuit Court of Appeals in Massachusetts overturned the fraud and conspiracy convictions of Gamal Abdelaziz, a former casino executive, and John Wilson, a private equity financier, who were convicted in connection to the Varsity Blues scandal. The three-judge panel, which upheld Wilson’s tax fraud conviction, ruled that the lower court judge wrongly instructed the jury that admissions slots constituted property, according to the New York Times’ Hartocollis, who notes the “court also found that the government had failed to prove that the two men agreed to engage in a conspiracy with other parents, who were, like them, the clients of William Singer, known as Rick, a college admissions consultant to the rich, the mastermind of the admissions scheme.” A spokeswoman for the U.S. attorney for Massachusetts says the office was “reviewing the opinion issued by the First Circuit Court of Appeals and assessing next steps.” (link)

Le Moyne (DII) announces it will join the NEC this fall. NEC Commissioner Morris: "During our membership evaluation process, it became abundantly clear there was tremendous mission alignment between the NEC and Le Moyne from an academic, athletic and community perspective. I would like to thank President Linda LeMura, Board Chair Pete DiLaura and Athletic Director Bob Beretta for their leadership through this process. Alabama AD Byrne confirms there are no baseball student-athletes believed to be involved in the gambling scandal, which he explains was not on his radar until ESPN originally broke the news. Byrne also notes the department called an all-staff meeting the following day, during which he and Football HC Saban addressed the entire Crimson Tide staff. More from AL.com’s Casagrande: “(Byrne) asked how many of the staff members and student-athletes are creating some of this challenge. I said probably five or six. That’s one half of one percent of the entire department and you have 99.5% of your student-athletes and staff who are doing a really good job. And they are. We’re proud of them. And don’t lose sight of that as you’re talking about your department and university because we’re having a really solid year in many ways. There are things we have to get better at and we’re taking that seriously but I’m also really proud of a lot of the accomplishments we’ve had and I think it’s good to talk about these things.” (link)

West Virginia Men’s Basketball HC Huggins has agreed to a million-dollar salary reduction, “significant suspension” and sensitivity training but is expected to return next season, ESPN’s Thamel reports. Huggins’ pay would be reduced from $4.2M to $3.2M. (link); WVU Gee outlines the specifics of Mountaineers Men’s Basketball HC Huggins’ return to the sideline, which include training sessions with the WVU's LGBTQ+ Center (which will also apply to all current and future coaches), meetings with the WVU Carruth Center to better understand the mental health crisis facing college students, particularly those in marginalized communities, a three-game regular season suspension, and the amendment of his current contract from a multiyear agreement to a year-by-year agreement that will begin on May 10, 2023, and end on April 30, 2024. SBJ’s Ourand: “I think ESPN, they’re not chasing after the Pac-12, but if there’s something opportunistic that presents itself, they’re going to grab it. ESPN is available. They’re talking pretty regularly to the Pac-12, and if they’re able to get a deal, that’ll work out.” Fox, Ourand adds, has expressed a similar position. The New York Post’s Marchand adds: “That’s probably not great for the Pac-12 if everyone’s just looking at it as an opportunity to make a good deal if they’re going to try to match the Big 12 and not have teams like possibly Colorado and others leave their conference.” Ourand then notes Washington State AD Chun recently remarked the league has a good deal that’s out there, “I just don’t know who that deal is with.” (link)

The plan also sets out to ensure all student-athletes achieve their full potential in academics, athletics and personal success; provide an inclusive and supportive environment that helps coaches and staff lead and develop student-athletes to reach their goals and pursue championships; and welcome, value and engage all students, coaches, staff, alumni and friends. The Big Ten is “strongly considering” removing its requirement for teams to play a Power 5 nonconference football opponent starting in 2024, Action Network’s McMurphy reports, adding that teams would be able to continue scheduling FCS teams. McMurphy also notes each Big Ten school already has scheduled a nonconference Power 5 opponent in at least three of the four seasons between 2024-27. “Unless something crazy happens,” the league is expected to maintain its nine-game league slate moving forward. (link)

The Big Ten Network halted Maryland’s Terps+ subscription streaming service, according to the Washington Post’s Giambalvo, who explains: “Despite months of planning for an idea that was hatched years ago, the Big Ten, which controls the school’s media rights, was left in the dark. And this plan, according to a letter sent from Big Ten Network President Francois McGillicuddy to Maryland Athletic Director Damon Evans, would ‘flagrantly violate’ the assignments of rights among the school, the conference and the Big Ten Network.” In a letter to Evans dated October 26, 2022, McGillicuddy cited the Big Ten Media Agreements Reference Manual, which prohibits schools from licensing ancillary programming to third parties (UMD had partnered with Sport & Story for the platform) and codifies that the BTN “owns distribution rights to all Ancillary Programming beyond distribution on the Member Institution’s official athletic website.” Lots more. Missouri State President Smart deflected some of the blame for the football team’s low APR to himself and away from former Bears Football HC Petrino, saying: “I think he came into a situation where he didn't have players that could win. I don't care how good of a coach you are, if you don't have players, you can't win. I think we could have supported him better through some of that and put some constraints on him." Missouri State currently has a multiyear APR of 927 which is below the required score of 930 to be eligible for postseason play; however, penalties have been put on hold until 2024 due to COVID and the transfer portal. More Smart: “Bobby Petrino is a hard coach to manage, he's a great coach and became a friend and I don't mean that as criticism. He's just driven to win. If we need a player, he's going to figure out how to get that player, within the rules, to win. A lot of these graduate transfer players came and played a year and left and didn't make progress on their degree and that hurts your APR numbers. We'll have less of that." (link)

Washington State Men’s Basketball HC Smith says it would cost $1M to $1.5M in NIL dollars to field a competitive Pac-12 basketball team, clarifying: “That’s a top 60 team. … It’s a ridiculous amount of money that is being thrown around.” Smith also shared with a local radio show a story about how an agent helped a secure a NIL deal and took a 20% commission, to which Smith jokingly replied: “Goodness gracious, I’d have done it for 4%.” (link)

U.S. Senators Cardin (D-MD) and Thune (R-SD) have reintroduced the Athlete Opportunity and Taxpayer Integrity Act, which would prohibit individuals and organizations from using the charitable tax deduction for specific contributions that compensate college or incoming college athletes for the use of their NIL. Cardin: “We want to ensure that the opportunities available for student athletes to benefit from their own name, image and likeness are protected. We also have an obligation to protect taxpayer funds, which means that charitable deductions should be reserved for charitable activities. Purposefully blurring the line between private expenses and charitable contributions dilutes both these efforts. Our bipartisan legislation will maintain the integrity of the NIL program, protect taxpayers and student athletes.” Thune adds: “This bipartisan legislation would prohibit these entities from inappropriately using NIL agreements to reduce their own tax obligations. I’m proud to support these common-sense guardrails that would protect athletes, strengthen NIL, and uphold the responsible stewardship of taxpayer dollars.” (link); Full bill. (link)
