Terms have been released in the NCAA’s settlement with Tennessee and other states over an injunction preventing the NCAA from enforcing rules around booster-athlete NIL negotiations. Yahoo’s Ross Dellenger: “Of note: Though the injunction will continue, it will not impact the House settlement.” Tennessee AG Jonathan Skrmetti: “We fought hard to protect the rights of Tennessee’s student-athletes and this settlement locks in the victory for them. With a multi-billion-dollar entertainment industry rising from the foundation of college sports, the kids who make it all happen should not be the only people denied an opportunity to prosper. This settlement benefits generations of student-athletes, protects Tennessee universities from NCAA retaliation, and pushes college sports toward a new equilibrium that acknowledges financial reality while preserving competitive integrity. I’m glad to see the NCAA give up on defending a world that no longer exists. I hope the association’s laudable change of position marks a transition from acting as the worst kind of HOA toward cultivating a new era of great college sports for athletes, schools, and fans. We all dream of a future when you can keep up with college sports without having to learn the Federal Rules of Civil Procedure.” (link, link); ESPN’s Dan Murphy explains the settlement means the “NCAA has agreed to permanently drop its rule prohibiting athletes from negotiating the terms of name, image and likeness payments until after they enroll in school,” and an NCAA spokesperson says: "This agreement continues the progress we have made over the last few years in allowing prospective and transferring student-athletes to seek out NIL opportunities. This judgment is fully consistent with the House settlement and underscores our support for student-athletes benefiting from their NIL and our commitment to provide increased benefits to student-athletes at every stage in their collegiate experience, creating a sustainable model for the future of college sports." USF AD Michael Kelly joins the On the Fly podcast to discuss the Bulls’ facilities strategies, including how the department is financing its $340M football stadium. The USF Financing Corporation plans to issue $200M in debt, as approved by Florida's Board of Governors in September 2023, and Kelly notes the loan will be repaid through various revenue sources, including operating revenues from the stadium and other athletics-generated income. An additional $50M is targeted through private donations. As of November 2024, USF had secured over $45M, with significant contributions like the $25M from Tampa General Hospital. Kelly emphasizes that this comprehensive funding approach ensures the project does not rely on tax dollars or state funding, reflecting the university's commitment to financial responsibility. “Our ambitions are now known and they have been spoken into existence. What I know is we have $25M in pledges raised for our indoor facility and those numbers have not happened in the 55 years of playing sports at USF. We have a plan. We have momentum." Kelly also says the Bulls will add more than 100 scholarships post-House “and then we'll be able to figure out sometime before the budget is set how much [revenue will be shared]. I don't believe we’ll be at $20M, but we're going to get as high as we possibly can. … If we can get to the limit, we'll get there as fast as we can, but regardless we'll continue to strive to be at the very top of our current conference.” Full podcast. Bloomberg’s Ira Boudway explores the viability of the Deloitte-led NIL clearinghouse as part of the House settlement, and A-Mark Partnership Strategies Founder/CEO Jim Andrews says: “I don’t see that there’s any way that it’s not messy. That’s not to say that it can’t be done or that the very smart people at Deloitte cannot come up with something that is very good.” In fact, Boudway is told by a source familiar with the implementation committee that there will be “flexibility built into the system” with “allowance for a range of compensation for similar deals. Those that don’t pass muster can be renegotiated or appealed to an independent arbitrator.” Building the clearinghouse itself is something Opendorse Founder Blake Lawrence “wouldn’t wish upon my worst enemy, because I’ve done it,” and Boudway notes: “Let’s assume, however, that Deloitte can get the job done. That’s when the problems really begin. Schools are counting on athletes to report their deals. Not all will. While the NCAA has a rule requiring disclosure, many players have decided it’s toothless and have opted to ignore it. Lawrence estimates that 80% of NIL transactions go undisclosed, a rate he expects to stay the same once the settlement is in effect. This leaves the NCAA in the familiar position of having to decide what to do when a star recruit from a low-income family shows up to school in a Lamborghini.” Ultimately, Boudway concludes: “Most pro sports leagues in the US have some version of a fair market value rule to prevent teams from using third-party deals as a way around payroll restrictions. But those rules are part of collectively bargained agreements with players, which provide an antitrust exemption, something college sports don’t have. The NCAA is betting it can corral the market using a class-action settlement instead. My March Madness pick this year is that they’re wrong.” (link)

NCAA Women’s Basketball Tournament ad sales for Disney/ESPN are up 132% YoY, according to SBJ’s Mollie Cahillane, who reports revenue “has grown nearly 300% in the first year of a new media-rights pact between ESPN and the NCAA (of which the women’s tourney is a part), with some 30-second spots climbing to nearly $1.5M for the championship game. A source close to negotiations broke down average prices for a 30-second spot in the NCAA Women’s Championship Game over the last couple years: FY23: $65,830 (9.9M viewers for LSU-Iowa across ABC/ESPN2; also the first time the game was on broadcast TV); FY24: $188,870 (a record 18.9M viewers for South Carolina-Iowa across ABC/ESPN, marking a record for a women’s title game and beating the audience for UConn-Purdue on the men’s side); FY25: $438,692.” Cahillane also notes ESPN reached 112 total advertisers for this year’s women’s tourney, jumping to 18 total categories. Disney Advertising’s VP for Revenue and Yield Management Jacqueline Dobies tells Cahillane ESPN has hit 95% in sell-out for the women’s tournament, with a few opportunities remaining in early rounds. Approximately 80% of that inventory sold out during the upfront. Dobies adds: “The unit rates we’re seeing are on par with the NBA Finals, for things like the men's college football championship game. Internally, we’ve had to change the vernacular of ‘champ game.’ The revenue and the type of demand and pricing that we’re seeing there -- parity is happening.” Additionally, Cahillane reports CBS and TNT have sold out March Madness inventory for the men’s tourney, surpassing $1B in sales. LIU is adding triathlon and women's flag football as intercollegiate sports beginning with the 2025-2026 academic year. USA Triathlon Chief Sport Development Officer Tim Yount: “Not only will they be a successful triathlon program but will do so in one of the most iconic locations in all the world. They will be providing new pathways for females to excel and contribute to the movement that triathlon is making as it starts the process with the NCAA of moving from emerging to championship sport status." Michigan regent Denise Ilitch believes it’s only a matter of time before the Wolverines start a women’s hockey program and tells the AP: “All I can say is those that are the supporters and the board and the president all want the same thing. So I think we’ll move as quickly as we can. I don’t want to put a date on it though but, boy, I’m hoping within the next few months we’re able to have at least a direction on whether it’ll be Yost or a new arena.” A recent feasibility study by Collegiate Sports Associates estimated it would cost $300M to build a new one-rink facility with an 8,000-10,000 seating capacity. CSA also priced out a new two-rink facility at $330M — with the second ice sheet providing more revenue-generating potential. (link)

The “auditions to be the next CEO of Disney are in full swing,” according to Bloomberg’s Lucas Shaw, who notes that earlier this month “Entertainment co-Chair Dana Walden appeared at a Morgan Stanley conference to tout the profitability of Disney’s streaming services. Days later, parks chief Josh D’Amaro and Walden’s co-Chair Alan Bergman appeared at South by Southwest to discuss their creative collaborations. These public appearances aren’t designed as tests. CEO Bob Iger is asking his top deputies to represent the company on his behalf and giving them a chance to own their victories after a good run.” While Shaw contends that no one knows who will be the next CEO, he reports the board is still leaning toward an internal choice and has identified four insiders: Bergman, D’Amaro, Walden and ESPN Chairman Jimmy Pitaro. … Pitaro has communicated to both friends and the board that he’s not interested in the role.” Shaw goes on to explain that “while it’s hard to imagine the board ignoring Iger’s opinions, [James] Gorman, the former CEO of Morgan Stanley, is firmly in charge of the process. He leads the board’s succession planning committee, which also includes General Motors CEO Mary Barra and Calvin McDonald, CEO of Lululemon. The committee met seven times in fiscal 2024. Which means the real pressure right now isn’t on the candidates. It’s on the board.” (link)

West Virginia Governor Patrick Morrisey and Attorney General John “JB” McCuskey announce they will investigate the NCAA men’s basketball selection committee after the West Virginia men’s basketball team was controversially denied a bid to March Madness. Sportico’s Daniel Libit: “Standing before a podium emblazoned with the phrase ‘National Corrupt Athletic Association,’ Morrisey, a first-term Republican, called WVU’s tourney exclusion a ‘miscarriage of justice and robbery at the highest level.’ He sharply criticized the selection committee’s decision to award one of its final bids to North Carolina, whose athletic director, Bubba Cunningham, chaired the selection committee. Cunningham has said he recused himself from being present in the room when any decisions involving UNC were made, but his explanation has failed to quell his chorus of critics. Morrisey, now leading that tune, dismissed Cunningham’s claims of neutrality, saying they ‘don’t pass the smell test.’” As such, Morrisey has directed McCuskey to investigate whether any “backyard deals, backroom dealings, corruption, bribes or any nefarious activities” influenced the selection process. McCuskey is “hopeful” the NCAA will work with his office to put to rest concerns that the selection process “is a completely subjective analysis,” and Morrisey later indicated it was “premature to talk about litigation” and that he also hoped the NCAA would “want to work collaboratively” with them. NCAA SVP of Basketball Dan Gavitt released a statement explaining that “after the NIT bracket was released Sunday evening, it was brought to the NIT's attention that one of the teams scheduled to participate in the tournament had also committed to a non-NCAA affiliated postseason event. In an effort to secure another participating team, the NIT prematurely extended an invitation to the South Alabama Jaguars, prior to learning that the original team chose to accept its invitation to the NIT. Regrettably, the NIT rescinded its invitation to South Alabama. We understand the emotional impact this confusion created, and we sincerely apologize to South Alabama, Head Coach Richie Riley, and all the student-athletes for the error." Riley calls this a “meaningless apology to the most meaningful group of players I’ve ever coached! What they did to us last night is inexcusable! These guys in our locker room don’t deserve this and it’s sad your idea of making it right is a copy and paste apology!” (link)

Cal and Stanford men’s basketball coaches and players say the positives outweighed the negatives in their first ACC season, and Bears AD Jim Knowlton tells The Mercury News’ Mike Barber: “Everyone loved the Pac-12. It was magnificent in so many ways. But I honestly think what we learned is that, because of the distribution challenges with the Pac-12 Network, it really was a regional brand. I think every one of our 550,000 alums are seeing that this is really helping us be a national brand.” While that expanded visibility didn’t translate into attendance this season, Cal HC Mark Madsen says there’s excitement building around next season’s home slate. “[Duke], North Carolina, Louisville, Notre Dame, USC, Vanderbilt. If there’s ever a year for season tickets at Cal, this is the year. These are going to be sellouts. It’s going to be an unbelievable environment, and we’re going to be playing high-level basketball against the top teams.” Knowlton adds: “If I’m a betting man, I’d say Haas Pavilion is going to be packed. It’s going to be sold out. We’re excited to have Duke at our house. We’re excited to have North Carolina.” Meanwhile, officials from both schools say they learned valuable lessons about the travel difficulties, and Cardinal HC Kyle Smith explains he told his players they’re “astronauts,” adding: “We’re kind of the first ones out here, journeying into space and figuring this thing out. I’m sure there will be things that we’ll take away that — practices we’ll do better.” (link)

Colorado Football HC Deion Sanders explains the direction he’d like to go with the spring game: “The Spring Game will be televised on ESPN2. … We’ve got to sell this thing out and pack this thing because the way the trend is going, you never know if this is going to be the last spring game. I don’t believe in that. I don’t really want to condone that. I would like to play in the spring. Actually, I (would) like to play against another team in the spring. That’s what I’m trying to do right now. To have a competitive (game) against your own guys kind of gets monotonous. You really can’t tell the level of your guys because, you know, it’s the same old, same way. Everybody kind of knows each other. Towards the end, I would like to style it like the pros. I would like to practice against someone for a few days, then you have the spring game and I think the public will be satisfied with that tremendously. I think it’s a tremendous idea. Five-star QB prospect Ryder Lyons tells On3’s Ari Wasserman and Andy Staples the reason so many recruits of his caliber don’t publicly talk about their NIL endeavors is because “if you do, you get labeled as someone who is chasing money. The thing is, 99% of the world, if you offered $150K more to take this job, most people are taking it. I think people don’t want to talk about it because you get bashed online. You get bashed on social media.” Wasserman subsequently observes: “Compensating high-level athletes has become normal. Talking about it hasn’t. There are multiple reasons why that could be the case. Let’s start at the obvious. College athletes taking money for their talents was illegal for decades and whenever they did it, it was under the table and deemed immoral. That was a form of cheating for all of our lives, so it’s going to take some time before fans catch up and realize this isn’t only normal, but should probably be promoted. Secondly, there is an entitlement factor. If you talk to coaches and people who cover recruiting, many will tell you kids have changed because the financial implications of their decisions have entered the space. We can argue whether that’s fair or illogical, but the truth is, things always change when a bag of money is put on the table. The difference now? That bag is taxable income. It isn’t shady. It isn’t cheating. It isn’t immoral. It’s reasonable compensation.” More. (link)

The AAC is focused on Memphis, Tampa, Birmingham and Wichita as possible host cities for next year’s men’s basketball tournament, according to Commissioner Tim Pernetti, who says Jacksonville also submitted a bid, but the league is focused on these four. Tampa, Birmingham and Wichita put in bids to host both tournaments, while Memphis’ bid was only for the men’s. Pernetti notes the league isn’t necessarily looking for a long-term deal with a specific site, and he hopes to announce a decision by this year’s Final Four. (link)

The Massachusetts Development Finance Agency has given Northeastern the go-ahead to sell $650M of municipal bonds to finance the deconstruction and construction of the new multi-purpose facility that is planned to replace Matthews Arena. The estimated construction cost for the new facility, which would include an arena for hockey and basketball games, practice courts and training facilities, is between $300M and $350M. Northeastern plans to sell $400M in bonds for the arena while the remaining $100M will be used for other capital projects on its Boston campus. (link)
