New SMU AD Damon Evans was at the podium yesterday for his introductory presser. Of note: “I’ve always believed that SMU has had a brand. This brand is only going to continue to grow. This institution has that fight and that wherewithal to take it to the next level. [...] You don’t go out and get someone like (new university President) Jay Hartzell just on a whim. You have to be intentional in your approach. You don’t go out and get [SMU men’s basketball coach] Andy Enfield on a whim. It’s intentional. And when they were looking for an athletic director, I could see that intention in them. [...] I believe in the word ‘and,’ that you can be good in basketball and football and tennis and track. I don’t believe in ‘or,’ that you can have one or the other. So my goal and my drive has always been, we’re all in this. [...] I think I bring a lot of experience having been in the Big Ten and the SEC and now in the ACC, having worked at two power four conferences, I want to take that knowledge and impart that here. But believe me when I say this. I don’t have all the answers. And I know that working with them here, we will find them. [...] A lot of people will look at those changes and they’re challenges, they’re upset, they want to complain. I’m not that guy. Connecticut’s Board of Trustees gave the green light to Huskies AD David Benedict to ink all student-athlete endorsement & revenue share deals without their review. Notably, per the Hartford Business Journal, “At the end of each year, the athletic director will report to the board on the annual budget for all endorsement contracts and revenue-sharing agreements, the total amount spent on endorsement contracts and revenue-sharing agreements, and the number of students who received compensation.” (link)

Athletes.org has filed an amicus brief in the House case, pointing to the lack of health & safety standards, the “certainty” of future litigation, the misuse of contracts for student-athletes due to confusion with the terms & “because of the lack of collective bargaining, the settlement is not protected under the non-statutory labor exemption that shields professional leagues from certain antitrust claims.” AO Co-Founder Brandon Copeland: “While the settlement is a start of positive change for college athlete compensation, it is only that – a starting point. There are still many concerns that need to be addressed as we take the next step into this new era of college athletics to make it a safe and sustainable ecosystem for every party who contributes to its success – especially as universities place even more emphasis on revenue growth creating misalignment with college athletes’ holistic development. [...] In the pro ranks, athletes have tools and resources to protect them, and in the college space it should be the same. Unfortunately, the system does not protect college athletes due to the self-regulating nature currently in place. With more lawsuits currently being filed against schools, conferences, and the NCAA, we are advocating for a better way. We want to ensure a sustainable future for college athletics–one without constant litigation and with safeguards for progress in college athlete compensation.” (link)

Outgoing BYU AD Tom Holmoe reflects on his faith and experiences after 20+ years leading the Cougars. On his favorite parts of the job, one of which is the annual graduation banquet: “There is not one of those champs who hasn’t had to go through the grinder, through the crucible, before they got to the end. That’s my favorite part.” He continues: “I really like the fact that we’re going to fail in athletics. There’s no person in the world that can go through life on a perfect trajectory. There’s always bumps. And in athletics, that’s really the case. ... At BYU, with over 600 student-athletes and 200 employees, there is not a day where we are not going to have a challenge. … The older I get, the more experiences I have, to be able to share with individuals, ‘You are going to be fine. This is something that’s going to take time. You might have to heal up. You might have to be out of school for a little while, but when you come back you will be stronger. “We wouldn’t have submitted it if we didn’t think there was a legitimate chance for us to get that (waiver). I think that there’s a really good chance it could happen.” That’s Colorado AD Rick George on the potential spring football scrimmage between CU and Syracuse. He continues: “I think this is a great idea for college football. You’ve got some schools out there looking at not playing a spring game. We’re looking at playing a spring game that’s going to drive more fans in here in the spring time that get excited about your program. And maybe the networks start covering more spring games and there’s a monetary value to that that schools can recoup. Kent State has placed Football HC Kenni Burns on administrative leave. Executive Deputy AD Greg Glaus will oversee administrative responsibilities related to the football program, and OC Mark Carney will handle on-field activities, with spring football practices beginning in a few days. Though no comment from the school, the decision comes about four months after an Ohio bank sued Burns for nearly $24K plus interest, although the case was later dismissed. (link)

Playfly has released its latest FanScore report for college basketball, which indicates that “52% of college basketball viewership occurs during the regular season, yet a staggering 81% of advertising dollars are spent during the March Madness tournament. The revelation points to a substantial opportunity for brands to stretch their budgets further by crafting marketing spend investment strategies that will target avid fans throughout the regular season, in addition to March Madness. Additionally, 55% of March Madness viewers did not watch any regular-season games, reinforcing that regular-season fans are more likely to show a higher level of engagement throughout the season.” Other key insights: “Women’s college basketball viewership is up 73% compared to two seasons ago, signaling exponential growth in fan interest. Monthly viewership nearly doubles starting in January, revealing a clear seasonal spike that brands can leverage. The SEC leads all other conferences in total viewership for both men’s and women’s college basketball. Fans of women’s college basketball demonstrate especially high sponsor positivity, making them a prime target for values-based brand integrations. House plaintiffs’ attorneys Steve Berman and Jeffrey Kessler, in a brief filed on Monday, argue that objections over roster limits, Title IX and other topics “suffer fatal defects” and “are mostly a rehash” of earlier objections. They contend that “for many sports, roster limits will allow for larger rosters than average squad sizes.” The brief also points out that, outside of the Power 4 conferences, roster limits “will only apply to member institutions that opt in to the revenue-sharing model.” Kessler and Berman also emphasize that approval of the settlement hinges on whether it is fair, reasonable and adequate. It does not, as Sportico’s Michael McCann explains, “have to be ideal or great for all class members; the bar for approval is much lower. Wilken will consider whether the settlement shows overall fairness in the context of the antitrust claims the players raised in the lawsuits.” Kessler and Berman also warn that the “efficacy of class-wide antitrust lawsuits” would be imperiled if “different market effects on class members” was treated as an “irreconcilable class conflict.” They also note that the settlement contains mitigation features, including that if an athlete loses a roster spot, their scholarship is protected. The brief rejects as “absurd” the argument that the settlement should be rejected based on the restrictions of paying student-athletes, including the rev-share cap, noting that without the settlement, competition by colleges and conferences for athletes “in the form of direct payments untethered to education would be non-existent, i.e., zero.” On Title IX-based objections: “The damages in an antitrust case must be allocated and awarded in a manner that would have occurred through market forces in a but-for world where the antitrust violation did not take place.” More from McCann. Hundreds of ADs and commissioners will travel to Capitol Hill on April 9, two days after the final House settlement hearing, to participate in College Sports Day on the Hill. Yahoo’s Ross Dellenger notes there are more Senate and House hearings tentatively scheduled for April as well. (link)

The Southern Conference announces its regulatory approach to the House settlement, which includes three key components: institutional autonomy, the ability to offer extra benefits and reinforcing existing and distinctive policies. Specifically, each institution will have the freedom to opt in or out of the settlement; member institutions shall continue to adhere to the current grant-in-aid maximums for all conference sports; a student-athlete transferring between conference members is required to serve an academic year in residence prior to competing for their new institution; immediate competitive eligibility is provided for graduate transfers and student athletes who did not receive athletics aid at their previous institution; and there will continue to be universal postseason eligibility, ensuring every SoCon team will participate in conference championships. Commissioner Michael Cross: “The Council of Presidents’ action provides macro-level institutional freedom regarding the decision to offer newly permissible benefits as part of the anticipated NCAA settlement, while also establishing boundaries that preserve the SoCon’s commitment to student-athlete development within a community of institutions that share common values and want to maintain fiscal and budgetary sanity." (link); According to HERO Sports’ Sam Herder, the SoCon will announce that it has set a football scholarship cap of 63 (the current FCS max) for schools that opt into the settlement. Attendance for the first two rounds of the NCAA Women’s Basketball Tournament was 224,972, a 30% drop from last year’s record of 292,456. This year’s attendance is also slightly lower than that of 2023, when 231,677 fans came through the turnstiles. (link)

South Carolina’s women’s basketball team lost $5.6M last year, according to The State’s Jordan Kaye, who notes that “over the past three years – a span in which South Carolina has made the Final Four every season and won a pair of national titles – the Gamecocks women’s basketball team has averaged a deficit of $5.59M. [...] For her part, [Gamecocks Women’s Basketball HC Dawn] Staley understands the factors at play. For instance: Last year, as the USC women’s basketball team lost $5.6M, the men’s team had a profit of nearly $3.5M. On paper, that looks like a Grand Canyon-sized gap incapable of being tightened. But if the South Carolina women’s team earned the same money from media rights (television deals, etc.) and NCAA Tournament distributions, the revenue of the two programs would be almost identical.” Kaye goes on to point out that a budget deficit is not reflective of the overall value of the program because it “does not account for the brand awareness of 24M people watching Staley’s team win the national championship” or the economic impact of tourism dollars the team brings into the state. Columbia Mayor Daniel Rickenmann: “The women’s program has helped Columbia elevate. I think it has been unbelievably elevating for the university. Think about what it means to our loyal fans, our restaurateurs, our hoteliers.” Meanwhile, Kaye points out that despite having an arena that holds 5K fewer people, LSU outpaces South Carolina in ticket sales even though the Gamecocks lead the country in attendance. To that end, Gamecocks AD Jeremiah Donati says: “We are taking a fresh look at ticket pricing for both season and single-game tickets and creating additional corporate partnerships to increase our revenue. We want to find the balance of keeping a full basketball arena while also making sure that we’re asking and getting fair-market value for those opportunities.” (link)

Sports Illustrated’s Kevin Sweeney breaks down this year’s men’s basketball transfer portal and notes that “it’s clear there’s a lot more money in the ecosystem this spring than last. A major driver of that is the advent of revenue sharing, with most high-majors and several top mid-majors able to share $3M or more in addition to plans to use existing NIL collectives to operate above that. A high-end roster budget last year was around $5M, now that number feels closer to $7M based on recent conversations with staffs across the country. A few schools will spend even more than that.” Sweeney also reports that “somewhere between 25 and 50 players made $1M in 2024; expect that total to double in ’25. Sources tell Sports Illustrated that one top point guard has already received multiple $3M offers, and numbers between $1M and $2M pop up far more often than they did a year ago in conversation. It’s already forcing programs to reevaluate their roster-building strategies and focus longer term on roster retention.” As one high-major staffer puts it: “You can’t afford to be in battles for six-seven guys in the portal every spring.” (link)

Legal Matters…
+ Two more former Michigan female student-athletes – a former volleyball player and a former women’s soccer player – have filed a class-action lawsuit against the university, its board of regents, former Football AC Matt Weiss and Keffer Development Services. The latest complaint contends that Weiss “primarily targeted female college athletes, so he posed a greater threat” to the unnamed plaintiffs, who were both “prominent female student-athletes” for the Wolverines. “The information that Weiss acquired due to the Non-Individual Defendants’ negligence is highly confidential, personal, and distressing when exposed without authorization, causing humiliation and embarrassment.” According to The Athletic’s Austin Meek, damages are expected to top $5M and affect more than 100 other potential plaintiffs. (link); ESPN’s Dan Wetzel reports prosecutors have indicated the number of victims is approximately 3,300 athletes. Wetzel also explains how Weiss allegedly accessed the accounts: “His initial entry point, according to his indictment, was gaining heightened access to data via the Keffer Development Services, a third-party contractor that keeps the medical information for some 150,000 athletes at approximately 100 schools, including Westmont (DII). Keffer declined comment to ESPN on the situation. From there, prosecutors charge, he decrypted Keffer's code and then used open sources to gain personal information, allowing him to guess or reset individual passwords. His victims, the feds allege, were not random. He kept notes on ‘their school affiliation, athletic history, and physical characteristics’ and later, if he found photos or videos, on ‘their bodies and their sexual preferences.’” Victims are apparently not limited to the U-M campus and allegedly include student-athletes at Westmont, whose Director of Institutional Resilience, Jason Tavarez, tells Wetzel: "When I was talking to the FBI, they said that it was not just us and not just a couple of schools.” Michigan Director of Public Affairs Kay Jarvis says the university has yet to be served with the complaint and can't comment on pending litigation. Keffer also declined to comment to ESPN on the lawsuit and overall situation.” (link)
+ Former Tennessee Football HC Jeremy Pruitt has sued the NCAA in DeKalb County, Alabama, claiming that the association “conspired with Tennessee” to make him the “sacrificial lamb” for rules violations resulting in his firing and a six-year showcause, Yahoo’s Ross Dellenger reports. Pruitt is claiming $100M in lost wages. Pruitt claims in the suit that the NCAA applied rules against him in 2023 that “had been essentially abolished in 2021 by the United States Supreme Court ruling.” The suit also states Pruitt “may be the last coach in America to be punished for impermissible player benefits.” Dellenger adds: “A key point of the suit: Jeremy Pruitt claims that Tennessee was illegally paying players before he arrived and that he reported the violations to then-AD Phillip Fulmer in 2017. Fulmer told Pruitt that ‘he would handle it,’ per the complaint.” (link)
+ Nebraska has a bill to amend its NIL law that’s gone under the radar, according to Kennyhertz Perry attorney Mit Winter, who notes the bill “gives athletes the right to enter into deals with collectives & says the NCAA can’t prohibit/interfere with that right. It also says the NCAA can’t require athletes or schools to disclose 3rd party deals. Another state law that directly contradicts the House settlement.
