House plaintiffs’ attorneys Steve Berman and Jeffrey Kessler, in a brief filed on Monday, argue that objections over roster limits, Title IX and other topics “suffer fatal defects” and “are mostly a rehash” of earlier objections. They contend that “for many sports, roster limits will allow for larger rosters than average squad sizes.” The brief also points out that, outside of the Power 4 conferences, roster limits “will only apply to member institutions that opt in to the revenue-sharing model.” Kessler and Berman also emphasize that approval of the settlement hinges on whether it is fair, reasonable and adequate. It does not, as Sportico’s Michael McCann explains, “have to be ideal or great for all class members; the bar for approval is much lower. Wilken will consider whether the settlement shows overall fairness in the context of the antitrust claims the players raised in the lawsuits.” Kessler and Berman also warn that the “efficacy of class-wide antitrust lawsuits” would be imperiled if “different market effects on class members” was treated as an “irreconcilable class conflict.” They also note that the settlement contains mitigation features, including that if an athlete loses a roster spot, their scholarship is protected. The brief rejects as “absurd” the argument that the settlement should be rejected based on the restrictions of paying student-athletes, including the rev-share cap, noting that without the settlement, competition by colleges and conferences for athletes “in the form of direct payments untethered to education would be non-existent, i.e., zero.” On Title IX-based objections: “The damages in an antitrust case must be allocated and awarded in a manner that would have occurred through market forces in a but-for world where the antitrust violation did not take place.” More from McCann. Hundreds of ADs and commissioners will travel to Capitol Hill on April 9, two days after the final House settlement hearing, to participate in College Sports Day on the Hill. Yahoo’s Ross Dellenger notes there are more Senate and House hearings tentatively scheduled for April as well. (link)

The Southern Conference announces its regulatory approach to the House settlement, which includes three key components: institutional autonomy, the ability to offer extra benefits and reinforcing existing and distinctive policies. Specifically, each institution will have the freedom to opt in or out of the settlement; member institutions shall continue to adhere to the current grant-in-aid maximums for all conference sports; a student-athlete transferring between conference members is required to serve an academic year in residence prior to competing for their new institution; immediate competitive eligibility is provided for graduate transfers and student athletes who did not receive athletics aid at their previous institution; and there will continue to be universal postseason eligibility, ensuring every SoCon team will participate in conference championships. Commissioner Michael Cross: “The Council of Presidents’ action provides macro-level institutional freedom regarding the decision to offer newly permissible benefits as part of the anticipated NCAA settlement, while also establishing boundaries that preserve the SoCon’s commitment to student-athlete development within a community of institutions that share common values and want to maintain fiscal and budgetary sanity." (link); According to HERO Sports’ Sam Herder, the SoCon will announce that it has set a football scholarship cap of 63 (the current FCS max) for schools that opt into the settlement. Attendance for the first two rounds of the NCAA Women’s Basketball Tournament was 224,972, a 30% drop from last year’s record of 292,456. This year’s attendance is also slightly lower than that of 2023, when 231,677 fans came through the turnstiles. (link)

South Carolina’s women’s basketball team lost $5.6M last year, according to The State’s Jordan Kaye, who notes that “over the past three years – a span in which South Carolina has made the Final Four every season and won a pair of national titles – the Gamecocks women’s basketball team has averaged a deficit of $5.59M. [...] For her part, [Gamecocks Women’s Basketball HC Dawn] Staley understands the factors at play. For instance: Last year, as the USC women’s basketball team lost $5.6M, the men’s team had a profit of nearly $3.5M. On paper, that looks like a Grand Canyon-sized gap incapable of being tightened. But if the South Carolina women’s team earned the same money from media rights (television deals, etc.) and NCAA Tournament distributions, the revenue of the two programs would be almost identical.” Kaye goes on to point out that a budget deficit is not reflective of the overall value of the program because it “does not account for the brand awareness of 24M people watching Staley’s team win the national championship” or the economic impact of tourism dollars the team brings into the state. Columbia Mayor Daniel Rickenmann: “The women’s program has helped Columbia elevate. I think it has been unbelievably elevating for the university. Think about what it means to our loyal fans, our restaurateurs, our hoteliers.” Meanwhile, Kaye points out that despite having an arena that holds 5K fewer people, LSU outpaces South Carolina in ticket sales even though the Gamecocks lead the country in attendance. To that end, Gamecocks AD Jeremiah Donati says: “We are taking a fresh look at ticket pricing for both season and single-game tickets and creating additional corporate partnerships to increase our revenue. We want to find the balance of keeping a full basketball arena while also making sure that we’re asking and getting fair-market value for those opportunities.” (link)

Sports Illustrated’s Kevin Sweeney breaks down this year’s men’s basketball transfer portal and notes that “it’s clear there’s a lot more money in the ecosystem this spring than last. A major driver of that is the advent of revenue sharing, with most high-majors and several top mid-majors able to share $3M or more in addition to plans to use existing NIL collectives to operate above that. A high-end roster budget last year was around $5M, now that number feels closer to $7M based on recent conversations with staffs across the country. A few schools will spend even more than that.” Sweeney also reports that “somewhere between 25 and 50 players made $1M in 2024; expect that total to double in ’25. Sources tell Sports Illustrated that one top point guard has already received multiple $3M offers, and numbers between $1M and $2M pop up far more often than they did a year ago in conversation. It’s already forcing programs to reevaluate their roster-building strategies and focus longer term on roster retention.” As one high-major staffer puts it: “You can’t afford to be in battles for six-seven guys in the portal every spring.” (link)

Legal Matters…
+ Two more former Michigan female student-athletes – a former volleyball player and a former women’s soccer player – have filed a class-action lawsuit against the university, its board of regents, former Football AC Matt Weiss and Keffer Development Services. The latest complaint contends that Weiss “primarily targeted female college athletes, so he posed a greater threat” to the unnamed plaintiffs, who were both “prominent female student-athletes” for the Wolverines. “The information that Weiss acquired due to the Non-Individual Defendants’ negligence is highly confidential, personal, and distressing when exposed without authorization, causing humiliation and embarrassment.” According to The Athletic’s Austin Meek, damages are expected to top $5M and affect more than 100 other potential plaintiffs. (link); ESPN’s Dan Wetzel reports prosecutors have indicated the number of victims is approximately 3,300 athletes. Wetzel also explains how Weiss allegedly accessed the accounts: “His initial entry point, according to his indictment, was gaining heightened access to data via the Keffer Development Services, a third-party contractor that keeps the medical information for some 150,000 athletes at approximately 100 schools, including Westmont (DII). Keffer declined comment to ESPN on the situation. From there, prosecutors charge, he decrypted Keffer's code and then used open sources to gain personal information, allowing him to guess or reset individual passwords. His victims, the feds allege, were not random. He kept notes on ‘their school affiliation, athletic history, and physical characteristics’ and later, if he found photos or videos, on ‘their bodies and their sexual preferences.’” Victims are apparently not limited to the U-M campus and allegedly include student-athletes at Westmont, whose Director of Institutional Resilience, Jason Tavarez, tells Wetzel: "When I was talking to the FBI, they said that it was not just us and not just a couple of schools.” Michigan Director of Public Affairs Kay Jarvis says the university has yet to be served with the complaint and can't comment on pending litigation. Keffer also declined to comment to ESPN on the lawsuit and overall situation.” (link)
+ Former Tennessee Football HC Jeremy Pruitt has sued the NCAA in DeKalb County, Alabama, claiming that the association “conspired with Tennessee” to make him the “sacrificial lamb” for rules violations resulting in his firing and a six-year showcause, Yahoo’s Ross Dellenger reports. Pruitt is claiming $100M in lost wages. Pruitt claims in the suit that the NCAA applied rules against him in 2023 that “had been essentially abolished in 2021 by the United States Supreme Court ruling.” The suit also states Pruitt “may be the last coach in America to be punished for impermissible player benefits.” Dellenger adds: “A key point of the suit: Jeremy Pruitt claims that Tennessee was illegally paying players before he arrived and that he reported the violations to then-AD Phillip Fulmer in 2017. Fulmer told Pruitt that ‘he would handle it,’ per the complaint.” (link)
+ Nebraska has a bill to amend its NIL law that’s gone under the radar, according to Kennyhertz Perry attorney Mit Winter, who notes the bill “gives athletes the right to enter into deals with collectives & says the NCAA can’t prohibit/interfere with that right. It also says the NCAA can’t require athletes or schools to disclose 3rd party deals. Another state law that directly contradicts the House settlement. More from Virginia Tech AD Whit Babcock’s conversation with media members, during which he remarked: “I do believe the president and board understand that it’s a pretty chaotic and transformational time, Wild West, whatever you want to call it. I’m confident the board understands the need to help us more from a funding standpoint. I’m confident they know and understand the truth about our work here.” The Virginian-Pilot’s David Teel points out the “first step in that help came Tuesday, when the Board of Visitors raised each student’s athletics fee from $437 to $732 starting in 2025-26. The increase will net the department an additional $10.7M annually while still leaving the university in compliance with a state law that caps student fees at 20% of a power conference member’s athletics revenue.” Babcock calls that cap “punitive” for Virginia and Virginia Tech and believes the state legislature could provide some relief, as the Hokies are “dead last” among state DI universities in athletics fees. “I don’t know that I’ve done a good enough job saying this but very grateful for everything [the board has] done. But if there’s ever a chance to push in and change the way we’ve done things here, this is a natural point in time to do that, and I believe the student fees was the first step in that direction.” With viewership numbers now playing a role in the ACC’s revenue distribution, Teel points out that Tech has six games scheduled with Old Dominion from 2026-31, three of which are in Norfolk, that could be replaced. Babcock: “When we have an answer on that, we’ll let everybody know. … Everything’s being looked at on our football schedule.” (link)

Alabama AD Greg Byrne covers several topics with The Birmingham Lede’s Kevin Scarbinsky, including whether Men’s Basketball HC Nate Oats was contacted by Texas for its now-filled vacancy. Byrne says UT never reached out to him, adding that Longhorns AD Chris Del Conte “and I've been friends for 30+ years. I do think he's one of the ones in our industry that if he's going to want to talk to your coach, he's going to give you a call. He would do that for me just like I would do that to him. Obviously, that's a great thing to have where your coach is being mentioned for other jobs. That means he or she is doing a really good job where they are, and I would much rather have that…than having to have the tough conversation where is the right fit for your program long-term? … You only ever change coaches if you think it's the right thing for the long-term health of the program. That’s it, period.” Byrne believes the biggest factor in the SEC’s turnaround in men’s basketball has been a change in the “holistic approach to the way we support our kids and impact that makes. … Commissioner Slive brought in Mike Tranghese, the old commissioner of the Big East, who's a strong basketball guy, to help in it and Greg [Sankey] did too. And then I think because we had resources that not every league has had at the same level, we've been able to hire some really good coaches at our schools, and an elite coach – there aren't a lot of them walking around. So that's why you’ve seen us be aggressive with Nate and keep him. We were paying like a Final Four coach before he went to his first Final Four.” Full podcast. (link)

West Virginia AD Wren Baker interviewed Utah State Men’s Basketball HC Jerrod Calhoun for the Mountaineers’ vacancy before ultimately choosing North Texas HC Ross Hodge, according to The Dominion Post’s Justin Jackson, who writes: “The story behind Baker passing over Calhoun is one of a growing feud between Baker and a certain percentage of the major athletic donors at WVU. It is a rift, according to sources, that goes back to last December, when former football coach Neal Brown was fired and Rich Rodriguez was hired. The big money wanted Rodriguez and that big money eventually won out. The big money, this time, wanted Calhoun on WVU’s sideline. However you want to put it, planting a flag or drawing a line in the sand, that’s the stand Baker took this time around. And, according to sources, it could be a costly one for WVU in terms of financial support from certain boosters for NIL funding for the men’s hoops program.” One source tells Jackson: “What I can tell you is there are so many people who are just enraged over this. I’m not sure Wren fully understands the consequences behind this decision.” One explanation for Baker choosing to draw a hard line here involves Calhoun’s ties to former WVU HC Bob Huggins, whom Jackson characterizes as “at odds” with the athletic department since his resignation. A source tells Jackson that Calhoun “basically told them he had learned a lot under Huggins and had a great deal of respect for Huggins, but that he had no interest in having Huggins as part of his staff or as part of the program.” (link)

Penn State AD Pat Kraft has done a “magical” job of fundraising, according to Nittany Lions Football HC James Franklin, who adds: "Having relationships that we have developed with people specifically like [West Shore Home Founder/CEO] B.J. [Werzyn] and West Shore Home goes a long way. And the fact that we have alumni that believe in what our university is doing and believe in what our athletic department is doing led by Pat Kraft and then our football program, those things are important. When you have a $700M project going on at the same time that you're trying to get a roster put together with NIL, there could be some challenges of where that fundraising goes.” Franklin didn’t discuss how Penn State is planning to distribute revenue among teams but noted the challenging part is “having to make decisions and having to move forward really before you have all of the information and all of the guidelines.” (link)

Following the dismissal of Football HC Troy Taylor, Stanford is faced with the decision of hiring a permanent coach “under suboptimal circumstances” or appointing an Interim HC for the 2025 season, and The Mercury News’ Jon Wilner submits: “There are risks associated with hiring a permanent coach this spring and with using an interim coach for the season. But appointing an interim would grant [Football GM Andrew] Luck the time to assess the industry landscape following the [House] settlement, benchmark Stanford’s resources against peers in the ACC and map a path forward. The Cardinal cannot botch the hire or make a half-hearted commitment to football. The next five years are effectively an audition for Stanford before college football’s Great Restructuring begins. Whatever the outcome — whether the SEC and Big Ten expand again or a super league arises — Stanford cannot afford to get left behind. … Firing Taylor was the first step in an essential cleanup effort that will take years and require an unprecedented institutional commitment. If Stanford whiffs on the hire, the salvage operation could be delayed indefinitely — with dire long-term consequences.” (link)

Under the terms of Schatzel’s separation, she will receive $400K plus applicable earnings on account of deferred compensation within 30 days of her resignation. She will receive an additional payment of $300K to be paid in six monthly installments starting on April 15. UL Board of Trustees Chair Diane Medley on Schatzel’s departure: “We were very pleased with how things had gone with the legislature, with some of the programs that were being initiated. The Pittsburgh Post-Gazette’s Ava Dzurenda catches up with Saint Francis student-athletes and coaches following the school’s announcement that it would transition to DIII, and track & field student-athlete Trey Baney explains: “It’s hard because there isn’t just one feeling. I’m feeling a lot of heartbreak, not just for myself but for everybody else and especially for the future of Saint Francis.” Softball HC Beth Krysiak says critical communication missteps added to the frustration: “I was just as shocked as the rest of the Red Flash community. I wish we had the opportunity to tell our student-athletes first instead of them getting an email just three minutes before our meeting. That’s the toughest part.” Former Red Flash golf student-athlete J.W. Cunningham tells Dzurenda the timing of the announcement – on the heels of the men’s basketball team’s NCAA Tournament berth – made the announcement even more difficult to accept. “I was at the game last week, and it was awesome to be there, see professors, teammates and alumni. Everyone was proud to be a Red Flash, and it was great to see the school on a national stage. But after the announcement, I felt a sense of loss.” Meanwhile, women’s water polo student-athlete Megan Marlin was among those who attended a campus forum this week and says: “We went to that forum to ask questions, but none were fully answered because so much is unknown. How do you make such an extreme decision that could plummet a university when you don’t have a concrete plan? … They say this is better for the long term, but then they can’t provide anyone with potential projections for the long term. Every business student here would tell you — you don’t make a big decision like this without a five-year projection or a business plan.” More. (link)

North Carolina’s business court refused to pause an antitrust lawsuit brought by members of the 1983 NC State Men’s Basketball national championship team who accuse the NCAA of illegally using their likenesses, ruling that the organization failed to show it would suffer a “substantial injustice” without a stay. Through the first two rounds of the NCAA Men’s Basketball Tournament there have been at least 52 reviews that have lasted a total of 111 minutes and 23 seconds, according to the Wall Street Journal’s Andrew Beaton and Robert O’Connell, who add: “Considering that a college basketball game is only 40 minutes of action, that’s nearly three full games’ worth of watching officials huddle, stare at a monitor and eventually announce their decision. … In just five years, the average length of regular-season, power-conference games has increased by nearly five minutes, according to college basketball statistician Ken Pomeroy. Now, games that used to last under two hours are checking in at over 2 hours and 4 minutes.” (link)

Duke is displeased with the use of its official merchandise on HBO’s The White Lotus, and VP for Communications, Marketing, and Public Affairs Frank Tramble says the show “not only uses our brand without permission, but in our view uses it on imagery that is troubling, does not reflect our values or who we are, and simply goes too far. Suicide is the second-leading cause of death on college campuses. As imagery from the show is being shared widely across social media, we are using our brand to promote mental health awareness and remind people that help is available. … Duke appreciates artistic expression and creative storytelling, but characters prominently wearing apparel bearing Duke’s federally registered trademarks creates confusion and mistakenly suggests an endorsement or affiliation where none exists.” (link)
