The DII Championships Committee is recommending changing the team sport championship access ratio from 4.25:6 to 4:6. The committee is also recommending expanding the Football Championship to 32 teams starting in 2025, citing new exceptions to the triennial budget process and the new AQ legislation that both passed at the 2025 NCAA Convention. The “mid-range estimate” for the expansion on travel and per diem is $545K. Pending this change, the DII Football Committee is proposing to modify how teams in the four super regions are bracketed, with the top four seeds to be seeded as such in their super region and the remaining teams to be unseeded and placed in any super region “if doing so reduces the number of flights in the first/second round.” The priorities for pairing teams will be as follows: 1) Unseeded teams will be placed into the bracket to maximize reduction of first-round flights. 2) Unseeded teams will be placed into the bracket in a fashion that will reduce the likelihood of second-round flights. 3) Repeating regular-season matchups in the first round of the championship should be avoided, provided that doing so does not increase the number of flights (per Priorities 1 and 2). 4) Teams shall be paired accordingly based on what their seed would have been prior to being listed as ‘unseeded.’” Of note, teams that qualify via AQ that are not in the top eight of the final ranking will be paired with a number one seed. Other recommendations include allowing football officiating crews to continue using the same number of referees as they use during the regular season and adding one Women’s Golf rules official at each regional site. House plaintiffs’ attorneys Steve Berman and Jeffrey Kessler, in a brief filed on Monday, argue that objections over roster limits, Title IX and other topics “suffer fatal defects” and “are mostly a rehash” of earlier objections. They contend that “for many sports, roster limits will allow for larger rosters than average squad sizes.” The brief also points out that, outside of the Power 4 conferences, roster limits “will only apply to member institutions that opt in to the revenue-sharing model.” Kessler and Berman also emphasize that approval of the settlement hinges on whether it is fair, reasonable and adequate. It does not, as Sportico’s Michael McCann explains, “have to be ideal or great for all class members; the bar for approval is much lower. Wilken will consider whether the settlement shows overall fairness in the context of the antitrust claims the players raised in the lawsuits.” Kessler and Berman also warn that the “efficacy of class-wide antitrust lawsuits” would be imperiled if “different market effects on class members” was treated as an “irreconcilable class conflict.” They also note that the settlement contains mitigation features, including that if an athlete loses a roster spot, their scholarship is protected. The brief rejects as “absurd” the argument that the settlement should be rejected based on the restrictions of paying student-athletes, including the rev-share cap, noting that without the settlement, competition by colleges and conferences for athletes “in the form of direct payments untethered to education would be non-existent, i.e., zero.” On Title IX-based objections: “The damages in an antitrust case must be allocated and awarded in a manner that would have occurred through market forces in a but-for world where the antitrust violation did not take place.” More from McCann.
