NCAA lead counsel Rakesh Kilaru and House plaintiffs’ attorney Jeffrey Kessler join Tulane Sports Law Director Gabe Feldman to discuss the House settlement. Feldman asks how the settlement will prevent future lawsuits from student-athletes or collectives who argue the collectives should be allowed to pay athletes whatever they want and notes that in professional sports such lawsuits are forestalled by the nonstatutory labor exemption via collective bargaining. Kilaru responds: “I think if you look at the revenues that are being shared, the opportunities for legitimate third-party NIL transactions, I think the hope is that we've created something that's not going to incentivize a bunch of folks to come in and say the system isn't working. I think we wanted to create a system that does work.” Kilaru also submits that “one of the features of the settlement, part of that 10-year term, part of being able to say, ‘Hey, for the next 10 years we're going to have these rules be binding on student-athletes’ is giving them the opportunity to speak up. … Every year when new students enroll, they’ll get a notice that there’s this injunction…that lays out the following terms. And they’ll have the opportunity to come in and say to the judge, ‘I know you approved that before, but it’s not working for me.’” Ultimately, though, Kilaru admits that the “only way to really end those collateral attacks is for there to be some kind of congressional legislation.” Kessler adds that to successfully argue the cap should be higher, plaintiffs would have to prove the “competitive market here would generate more than 51% [of revenues to be shared with student-athletes when scholarships, health care and other benefits are factored in]. So, that’s not going to be so easy to do.” Overall, Kessler believes the deal is reasonable enough itself to discourage most cases. Kilaru goes on to minimize the concerns about players losing roster spots or sports being cut by pointing out that of the ~390K student-athletes, only nine “came in and said I think I actually lost a roster spot as a result of this settlement.” Full podcast. The U.S. District Court of Northern California has posted the list of individuals who will be arguing at the House settlement hearing, and Venable LLP Partner Philip Sheng provides a list of what topics each of the 13 attorneys will argue. Meanwhile, Judge Claudia Wilken has issued specific instructions about who can sit where in the courtroom. Notably, seating for the press will be limited and available on a first-come, first-served basis. Kennyhertz Perry attorney Mit Winter also provides a Zoom link for the hearing. (link, link)

Colorado AD Rick George comments on how the Buffs are positioning themselves for a post-House landscape: “I’ve been saying that this is our moment in time; we have to grasp it. It’s challenging moving forward when you have to find $20.5 million in your budget to share. It’s not like it’s sitting around. So we’ve had to be thoughtful about how we can trim expenses, how we can grow our revenue. But we need support from the greater community, from the Boulder businesses, the Denver businesses, the economic impact that we’ve had on this state the last two years with Coach Prime here is off the charts…. We need that to be returned to us by getting support from these local businesses and in our fan base and our donors; that’s just the reality.” George also explains the decision to install a new AstroTurf RootZone 3D3 surface at Folsom Field: “When Judge Wilken makes a ruling in the middle of April, we’ve got to be ready for that. And so for us to be able to host events at that stadium, to increase our revenues, again, it’s going to increase the economic impact that we have in our city and our state. And so, I mean, it’s good for everybody. It’s just a decision that we needed to make. We’re confident in our decision. We’re going to have great turf.” (link)

Learfield EVP for NIL Growth and Development Solly Fulp talks with SBJ’s Ben Portnoy about the companies’ efforts to help clients capitalize on March Madness and explains that “what we’re discovering is with these big moments in college athletics, we’re seeing a value in connecting brands with student athletes and having that connection to the fans and the fandom of college athletics when there’s great interest. … What we’re appreciating more and more is that these NIL business managers that are part of our sports properties teams are more valuable than ever. They’re the ones that are reminding our student-athletes that they have a content shoot after practice, or before they get on the bus, or meeting them at the training table and making sure that they feel prepared and ready to go for their campaign engagement. The people power and the boots on the ground are critical to our success.” Portnoy also notes that SIDEARM Sports has tracked traffic increases during March Madness and found that Florida, Duke, Michigan, Wisconsin and St. John’s are the most-searched men’s basketball teams among websites SIDEARM powers, respectively. The most-searched for women’s teams are Connecticut, Tennessee, Ohio State, UCLA and USC, respectively. The most-searched men’s players are, in order, Creighton’s Steven Ashworth, Florida’s Olivier Rioux, Duke’s Spencer Hubbard and Cooper Flagg, Drake’s Bennett Stirtz and Michigan’s Vladislav Goldin. On the women’s side those players are UCLA’s Lauren Betts, Iowa State’s Audi Crooks, USC’s JuJu Watkins, UConn’s Paige Bueckers, Creighton’s Mallory Brake and TCU’s Hailey Van Lith. (link)

Kentucky Men’s Basketball HC Mark Pope notes that while the House settlement could be approved Monday, he’s prepared for it to take 7-10 days for U.S. District Judge Claudia Wilken to issue a ruling. “There’s no definite timeline. We’re just, in terms of that shift, we’re just in a wait-and-see mode, and then there’s all the complications of actually implementing the agreement and what that’s going to look like. It’s pretty exciting, man. Every day is something new.” Wilken’s approval (or rejection) will inform Pope’s decision on whether to pursue a permanent GM for the program, and he explains: “General managers are really interesting. Designating someone exclusively in that spot is a calculated decision that comes with all kinds of complications. Right now, we’re dealing with it in-house by dividing up those responsibilities. We’ll see. Like I said, the entire landscape of college basketball and college athletics could change on [April] 7. It could potentially send us on a brand new trajectory, or nothing could happen. We could continue down the road we are. I think staff and responsibilities change like that. Those decisions will become forthcoming after we get more clarity on what the world of college athletics is going to look like.” (link)

Dollars and Cents…
+ Memphis is asking fans to cover the Shelby County sales tax rate of 9.75% on all tickets and parking “as the department positions itself to navigate the rapidly evolving landscape of intercollegiate athletics.” The Tigers made the announcement as season tickets for football and men’s and women’s basketball go on sale for next season and added: “The department will not be adding any new fees for revenue-sharing. … The adjustment to the sales tax on all tickets and parking will allow Memphis athletics to better align financially with aspirational institutions that are currently charging or will be adding sales tax to their tickets.” Men's basketball ticket pricing will be restructured for the Club and Plaza Levels for a more affordable experience. Beginning in 2025-26 the north and south sides of the Terrace Level will be reduced by 3,649 seats as the curtain system inside FedExForum “will be utilized to create a more energetic atmosphere. The overall capacity for home games will now be 14,470 with the ability to open the curtains for games as ticket sales deem necessary.” (link)
+ UNC Asheville has received a $250K matching challenge gift from an anonymous donor to support a new on-campus tennis facility. Bulldogs AD Janet Cone: "Bringing our tennis courts back on campus is a crucial part of enhancing the student-athlete experience and continuing to cultivate a culture of athletic success and community engagement. We hope our Bulldog alumni and friends will step up to meet this challenge." (link)

Facility Features…
+ Toledo is installing a new FieldTurf CORE 2.5 playing surface at the Glass Bowl. Rockets AD Bryan Blair says of the multimillion-dollar project: “It’s a big deal. But it’s probably a bigger deal in terms of the message it sends in terms of how we’re continuing to invest in our facilities. People say, ‘Oh, well, you just get a new playing surface.’ You really have to look deeper than that. What does that mean for injury prevention? What does that mean for on-the-field performance? What does that mean to the look and feel of the Glass Bowl? The reality is, we don’t have a true practice field for our football program. I know that’s something [Football] Coach [Jason] Candle’s talked a lot about, and I’ve increasingly talked about in terms of our upcoming facility plan. That has to be a priority going forward when you’ve got 100-plus players and then another 40 or 50 staff members, and sleds, and everything else. It’s just actually not safe to practice with the full football team in that tiny footprint because you start running into each other, pass routes go awry, and you’re bumping into other players.” Fans will also notice some changes to the on-field branding, according to the Toledo Blade’s Kyle Rowland, who notes midfield will feature Toledo’s main rocket and all-caps “Toledo” script logo. The end zones will still say “Toledo” and “Rockets.” Window World Toledo logos adorned the 25-yard lines last season, a sponsorship that could extend into 2025. If not Window World, UT expects another company to sign a deal. (link)
+ Clemson will begin selling alcoholic beverages at athletic events beginning with this weekend’s spring football game. Sales at McWhorter Stadium (softball) and Doug Kingsmore Stadium (baseball) will be piloted beginning the week of April 7. Tigers AD Graham Neff: “We have appreciated the support from several key groups to begin a safe implementation that is both fan-friendly and family-friendly. We will continue to evaluate the impacts and adapt our offerings and policies to meet the needs of our fans.” (link); The Post & Courier’s Jon Blau notes that guidelines for alcohol sales at Clemson "do not impact the existing stadium re-entry policies" so people can still come in and out of the stadium. CBS’ Richard Johnson outlines the various ideas Nebraska considered for its reformatted spring football game. In addition to an open practice, 12- to 45-minute scrimmage and skills contests, the Huskers’ list of 30 possible non-football events included an alumni flag football game, a concert, a fastest student on campus race, sorority tug-of-war, tractor pull, and an invitation to President Donald Trump among several others. Check out the full list and Football HC Matt Rhule’s favorites. (link)

Legal Matters…
+ Stanford recently cleared Men’s Water Polo HC Brian Flacks of allegations of abusive behavior but is now looking into reports of retaliation against his accusers, according to the San Francisco Chronicle’s Ann Killion. Flacks was investigated last fall after parents complained about his treatment of student-athletes. The university’s investigation “did not substantiate the claims that were raised,” but parents have since retained representation and allege that Flacks has been trying to rid the program of people who may have cooperated with the previous investigation. Justice Law Collaborative Partner Paula Bliss: “These families are extremely concerned about the mental health of their sons and their teammates as a result of the psychological and emotional trauma they’ve experienced under Coach Brian Flacks. Their sons have faced targeted retaliation by Coach Flacks following the close of the investigation. The University has shown a complete lack of regard towards its student athletes by failing to protect them. The fact that Stanford continues to allow this coach to be poolside amidst the serious and specific allegations is appalling, but unfortunately, not surprising given the university’s recent history.” (link)
+ Colorado Governor Jared Polis (D) has signed into law House Bill 1041, which allows colleges and universities to pay their student-athletes directly. The law also carves out the athletes’ contracts as exempt from the state open records law. In a signing statement, Polis said he supported the bill’s aims and keeping Colorado collegiate athletics competitive — but he had “concerns” about the exception. “While the bill’s exception is narrowly tailored, it follows an unfortunate trend of legislative proposals that ultimately impede access to official records that are arguably within the public’s interest to view. These exceptions move transparency in the wrong direction and any other proposals that further prevent or delay public access to information will be carefully reviewed.” Senator Judy Amabile (D-Boulder), who sponsored the legislation, explains the rationale for the exemption: “They’re not being paid with public money. They’re students, and students have protections, and we wanted to preserve that.” (link)
+ Two more lawsuits have been filed against Michigan, former Football AC Matt Weiss and third-party vendor Keffer Development Services. The first suit was filed by a current U-M student who’s “been active in the athletics program there since she enrolled” and alleges Weiss unlawfully obtained her personal information and the school failed to monitor its employee. The second, which was filed Friday by a former gymnast at Michigan from 2013 to 2017, claims that the plaintiff “participated in the gymnastics program while Weiss’ breach of the University and Keffer’s systems was ongoing.” (link)

UNLV AD Erick Harper gets emotional telling KSNV’s Bryan Salmond that it means a lot when people he doesn’t know come up and thank him for the job he’s done “or you get an email that says, ‘Hey, I’m really proud of and happy with what you’re doing. Don’t ever leave.’ Those are the things that make you want to come to work every day and battle. Cause I love battling.” He adds of his wife: “The love and the passion that she has to allow me to do what I do, and when she shows that, it makes me work harder because I want her to know how important it is, when she’s here supporting me, that we’re doing this as a family.” (link)

Sportico’s Michael McCann observes that “one of the great sports law misunderstandings in college sports is that the U.S. Supreme Court made NIL possible through its ruling in NCAA v. Alston (2021). The reality is that Alston had nothing to do with NIL or even compensation for playing sports. The Supreme Court held that the NCAA and its member institutions violated federal antitrust law by agreeing to limit each member’s opportunities to compensate college athletes for education-related expenses. Those expenses included costs related to study abroad programs, postgraduate scholarships, vocational school scholarships, technology fees and other costs that are connected to education. Given that a core mission of the NCAA and its members is to provide quality education to college athletes, rules that make it harder for schools to defray education costs are conceptually problematic. The antitrust hook was that colleges and conferences are competing businesses. When competitors join hands to price fix—whether it be coordinating how much to charge consumers for a product or service or how much a college can reimburse athletes for their costs of education—that’s a potential antitrust law problem.” McCann goes on to submit that it’s far from a given that SCOTUS’ Alston decision “served as a warning to the NCAA that it could not restrict athletes’ economic rights, be they about playing sports or NIL. … Even if Alston could be expansively read as lending support to college athletes using NIL, that support would only relate to antitrust scrutiny of NIL rules. If the NCAA legally challenges NIL statutes, the challenge wouldn’t occur under antitrust law. It would take place under constitutional law, specifically the Commerce Clause and the Contract Clause. The gist of that legal attack…would be to portray state NIL laws as unconstitutionally preventing the NCAA from enforcing rules nationally and as interfering with compliance of rules member schools contractually accepted.” More. Penn State Football HC James Franklin tells On3’s Andy Staples and Ari Wasserman that “I’m in a situation now where, for really the first time here at Penn State, we have the alignment that I’ve been pounding on the table for for 12 years.” Specifically, Franklin explains the Nittany Lions have invested in football in the same way that Michigan, Ohio State and Oregon have in the conference: “You’ve seen that type of commitment with some of the things we’ve been able to do.’ Staples notes that “the most glaring example is something that would have seemed sacrilegious a few years ago: taking millions of dollars to name the field at Beaver Stadium. West Shore Home, a remodeling company founded by Penn State alumnus B.J. Werzyn, is paying $50M over 15 years to name the field.” All that said, Franklin asserts: “I’m not going to allow people to not recognize the consistent level of success that we’ve had, that 99% of the programs in the country would die to have. … We’ve been one of the most consistent programs in the country and, to be honest with you, probably the most consistent Penn State’s been since joining the Big Ten.” But, Franklin adds: “I also totally recognize and own that we have to take that next step in our biggest games, in our biggest moments.” (link); Full interview. Sportico’s Daniel Libit points out Coastal Carolina, on paper at least, “has quite literally nothing to lose” by offering free concessions at football games next season. “That’s because the school has for several years reported $0 in revenue from concessions, programs, novelties and parking on its annual athletics revenue and expense disclosures to the NCAA. In 2022-23, it was one of only two FBS public universities to throw up the goose egg on this line item, according to Sportico’s college sports finances database.” Chanticleers Senior Assoc. AD/Chief Revenue and Business Intelligence Officer Matt Harman tells Libit that stems from the Chants’ concessions deal with Aramark. CCU signed a $43.4M dining services contract with the company in 2020 that runs through July 2027. The deal includes student dining as well as athletics concessions, meaning the athletics department has never directly collected revenue from game-day food sales. Libit adds: “As athletic departments nationwide look to squeeze every dollar from existing revenue streams, CCU’s arrangement with Aramark makes this one of the easiest financial sacrifices a school can make in the name of fan appreciation. That said, Harman insisted that as an auxiliary unit of the university, athletics still was mindful of its financial impact.” (link)

Sportico’s Daniel Libit takes a look at how Colorado and Syracuse went about petitioning the NCAA to play a joint spring football scrimmage and explains that on “March 19, Colorado formally requested legislative relief from the NCAA through its Requests/Self-Reports Online (R/SRO) portal. The request specifically sought an exemption from NCAA Bylaw 17, which restricts schools to intra-squad scrimmages or spring games against teams composed of ‘bona fide alumni or students.’ Colorado instead sought permission to scrimmage against another Division I program.” CU Assoc. AD for Compliance Rob Rosner wrote to the NCAA: “If this waiver is granted, our institution would be able to follow a similar pattern that has been used at the highest level of football, in which NFL teams engage in joint practice sessions during the pre-season. The waiver would intentionally provide an opportunity for our football coaching staff and sports medicine staff to limit the total repetitions for football [athletes] in live scrimmage situations.” Rosner also referenced a 2019-20 NCAA proposal that would have allowed joint preseason football engagements but was tabled because of the COVID-19 pandemic. “Our institution feels that circumstances in college athletics have drastically changed since the original proposal was put forth in 2019. This legislative relief waiver seeks to provide a meaningful opportunity to safeguard the well-being of our football student-athletes, as well as those of our opponent.” More from Libit. (link)

The women’s hoops Sweet 16 averaged 1.7M viewers, per Front Office Sports’ Colin Salao, who notes that figure is down 29% vs. 2024 but up 39% over 2023. The most-watched games were Texas vs. Tennessee (2.9M) and Notre Dame vs. TCU (2.5M) (both on ABC), followed by Connecticut vs. Oklahoma (1.9M) and Maryland vs. South Carolina (1.7M), both of which were on ESPN. According to SBJ’s Austin Karp, viewership for the NCAA Men's Basketball Tournament “is flat headed into Final Four, but that may not be a bad thing for Final 4 numbers with big teams this year. Tourney +3% vs same period 2023. Elite 8 down 10%, but 2024 had benefit of Easter Sunday window (Elite 8 was +4% from 2023). When looking at ‘windows,’ which is how CBS Sports/TNT Sports sell ads for the men's tourney, the event is averaging a combined 9.4M viewers heading into the Final Four (4 networks) When looking at a per-game average, men's tourney games are averaging 3.7M viewers.” (link)

Tariff Talk…
+ President Donald Trump says he’s settled on a plan for his latest batch of tariffs expected to take effect tomorrow but declined to reveal what he’s decided. The Wall Street Journal notes: “All eyes will be on what Trump has decided: whether to apply a universal tariff, of up to 20% on all imports, to virtually all U.S. trade partners, or levy individual tariff rates for all countries that could be subject to negotiation—the so-called reciprocal tariff approach. (link)
+ Rebar, structural steel, piping and ductwork are all facing price volatility due to expected tariffs from the Trump administration, according to Skanska USA Building EVP of Project Planning Steve Stouthamer. While reports indicate the Trump could roll back the ultimate scope of this action, contractors say just the threat of tariffs can have an immediate impact on material costs, according to Construction Dive’s Sebastian Obando, and Stouthamer tells him: “Steel prices have increased 15% to 25% since the beginning of January and aluminum is also up 8% to 10% from the beginning of January. The Trump administration has indicated Canadian lumber will be included in the reciprocal tariffs which are set to take effect on April 2. Lumber has already seen a significant increase, 10% to 15% in cost, in anticipation of this tariff.” Stouthamer also explains that “at present, we are not expecting a near-term impact on project timelines. If there is a considerable shift to onshoring manufacturing, supply chain schedules could be constrained, but this is not like the situation we experienced during the pandemic where the supply chains were impacted by global shutdowns. … Projects can benefit by investing additional time into the mapping of the specified materials for the project to determine their source, if those sources are impacted by tariffs and whether alternative products and sources could mitigate financial risk.” (link)
