The American has unanimously approved a performance-based revenue-share model for men’s and women’s basketball tournament units. Under the new model, schools that earn units during the NCAA basketball tournament in a particular season receive 100% of the value of those units for one year with the remaining payments to then be shared equally among all members of the conference. SBJ’s Ben Portnoy notes the “measures passed by the AAC will take effect such that Memphis’ men’s team and South Florida’s women’s squad will receive payouts related to their respective 2025 tournament appearances in next year’s conference distribution.” (link)

ESPN’s Dan Wetzel and Pete Thamel speak with several individuals who are skeptical about the efficacy of the House settlement’s NIL enforcement mechanism. St. John’s Men’s Basketball HC Rick Pitino remarks: "I think it's a flawed system before it gets started. Totally flawed." Purdue Men’s Basketball HC Matt Painter adds: “We have zero trust.” Former (and infamous) Miami (FL) supporter Nevin Shapiro asserts that "this is not the way to regulate this. I applaud them for giving an effort, I guess, but this is not practical. There's one million ways to circumvent it." Wetzel and Thamel go on to note that not only has an NCAA system never effectively prevented cheating, an FBI probe into men’s hoops wound up flaming out. As such, they ask: “If neither the FBI nor the NCAA enforcement staff could do much, why would anyone think this new entity will? … Then there is the challenge of figuring out whether a player is being paid the proper amount for a deal. A deal that might seem too generous to, say Caitlin Clark before her junior season at Iowa, might actually turn out to be a bargain. Or as an old axiom goes: Something is worth what somebody is willing to pay for it.” On that point, (Kansas Men’s Basketball HC Bill) Self says: "I actually think in theory it's good," but "it's hard to imagine how someone can [define] fair market value because to me, the fair market value is what a company or an organization sees that individual's worth as." Purdue AD Mike Bobinski calls it the “curse of this business” that when a new rule is put in place, people don’t say that’s “‘what we'll have to do.' The first thing they say is, 'How do we get around it? How do we bend it to our purposes or our objectives?' That has to change." (link)

Johnson v. NCAA plaintiff’s attorney Paul MacDonald talks with The Athletic’s Seth Emerson about why he believes student-athletes should be designated as employees and submits that “rules set at the athletic department and coach levels seem to be trending stricter and more extensive in anticipation of revenue-sharing under the House settlement.” Employment law attorney Marc Edelman adds that on one hand, it is “pretty foolish” for coaches to implement overly strict rules” on a number of grounds, including the fact it only strengthens the argument that the individuals on the football team operate under the constraints of the coach. This is a constraint that no other students at the university would operate under. On the other hand, it’s only one more over-reaching step that’s not likely to put the college athletes over the goal line for proving control. That goal line had been met a long time ago.” Emerson notes that one argument schools will make is that “by attending any school, athletes subject themselves to personal conduct and honor codes. So the coaches putting in rules by themselves are employee-defining, according to Josh Nadreau, an employment lawyer in Massachusetts.” Nadreau, who is advising some athletic departments, including one in the ACC and another in the Big East, explains: “When I’m advising folks, I’d say focus on the level and things that you need to control to make your team successful and less on sort of other things that people who don’t have the same interest as you will use as a factor to try to put another coin on the side of scale on employment.” As far as the House settlement’s impact on student-athlete employment, Nadreau submits: “These issues are long from over. In some circles, I think there’s thought that the House settlement will be a reset point. I don’t think so.” (link)

Multiple industry sources have indicated to The Mercury News’ Jon Wilner that the “Pac-12’s likely [media] valuation range is $7M per school per year on the lowest end and $12M per school if everything breaks just right with the number of bids and the structure of the deal.” Now that the league has a “start-up mentality,” Wilner proposes four ways the league could reexamine its football scheduling strategy and thereby maximize its media value. The first is to start the season in full on Labor Day weekend. “The Sunday and Monday of Labor Day weekend are there for the taking with no NFL, but college football has been slow to occupy the space. Just two games are scheduled for Aug. 31 next season (South Carolina-Virginia Tech and Notre Dame-Miami), and there’s only one lined up for Labor Day itself (TCU-North Carolina). Projecting out to 2026 and beyond, the Pac-12 would have numerous broadcast windows available for non-conference games. Or it could take a bold approach and slot high-level conference matchups (think: Washington State-Boise State) into the open real estate.” Wilner also suggests taking better advantage of Friday nights and Thanksgiving Eve and considering Sunday evenings. On the latter: “The Hotline’s most radical idea might prove too aggressive for the Pac-12, but it’s worth considering a few kickoffs each season on Sunday at 7:30 p.m. … Avoid Sunday night at all costs if the (Kansas City) Chiefs are playing the (Dallas) Cowboys; but take your shot if the (Indianapolis) Colts are facing the (Minnesota) Vikings. Fox could promote the game during its afternoon NFL broadcast and use it to pump the Big Ten or Big 12 game scheduled for the following Friday. We know at least one subset of the football audience — the gamblers — would love having a Pac-12 game on Sunday night.” (link)

Atlantic 10 Commissioner Bernadette McGlade tells NBC Sports’ Nicole Auerbach that the distribution of women’s March Madness units “eliminates the argument that there’s no revenue generated in the sport of women’s basketball, and that has been an Achilles heel for the women’s championship and women’s basketball.” Big East Commissioner Val Ackerman adds: “There’s a symbolism that I don’t think can be lost on anybody — the fact that women’s basketball is being treated more seriously.” Ackerman also notes that it’s not an accident that this new revenue stream began right as college sports are set to enter the revenue-sharing era and asks: “How will schools balance the interests of their respective sports? How will they fundraise for sports if those dollars are not coming from generated athletics revenue? This is the backdrop. This isn’t happening in a vacuum. (The unit) could boost what would otherwise be available to women’s basketball through revenue sharing. … But any school not at the top level still has work to do in terms of figuring out a revenue pathway, fan development and how to be successful on the court as the cost of doing business goes up. That’s reality. Do I think there’s reason to be optimistic (about women’s basketball)? I think there is, but there is a need to temper it with the reality of how all sports, including women’s basketball, are going to be impacted by the new model.” (link)

Connecticut AD David Benedict weighs in on the two-site NCAA Women’s Basketball Tournament regionals, which saw the Huskies travel to Spokane last weekend: “I'd love for the people making these decisions to try to explain what the competitive equity piece is in the decision-making process. Having been a part of, fortunately, many Final Fours now, I don't know how people don't factor and take into consideration — regardless of whether it's UConn or anybody else — that these are the most important games that some of our student-athletes will ever have an opportunity to compete in. There should be some sort of competitive equity in how those teams are positioned so that they can all be at their best. I don't think the current setup allows for that. Our kids will get to sleep at 2 o'clock Eastern time. They have to get up, travel all day [to Tampa], and right away you're into all the different requirements that they have for you [at the Final Four]. And we're the last team playing. It's a disadvantage and you're traveling all the way across the country.” Benedict acknowledges that the rationale was based on attendance concerns but argues that “they weren't putting the regions in the right places, where there is support for women's basketball. … Are you making the decision based on who is giving you the best deal to come to their city, or are you looking to put it in a place where you're going to get the support you need? ... We're rarely asked for our opinion at UConn. They come to us afterward and ask what they can improve on. I'm not sure if that's just a formality or if they actually utilize the information. I would suggest it's a formality." More. (link)

Iowa is reconsidering its methods of team travel and nonconference scheduling, among other spending areas, as it prepares for revenue-sharing, according to Hawkeyes AD Beth Goetz, who explains: “We’ll take a look at how all of our teams travel. Certainly there’s some sort of standard for how some of our revenue sports move around, and that’ll continue. But I think we’re just going to try to be as resourceful as we can, and some of that has to do with how you schedule for other sports.” Deputy AD for Strategic Initiatives/COO Joe Parker adds: “Every time we put a team on the road, the most efficient way to do it is by bus. Next is commercial aircraft. And then there’s some teams that we just have to simply choose to charter. … There’s big cost-saving opportunities there if we can apply that level of discipline.” As it relates to holding concerts in Kinnick Stadium to drive revenue, Goetz notes that “for different reasons and different times, it sort of ebbs and flows. And some of that has to do with the concert market and where they’re trying to move around to. But I think any time we have a chance to look at those opportunities, we certainly will.” Overall, Parker expects the number of student-athletes to decrease by about 100, mostly due to the elimination of walk-ons. The Hawkeyes expect to add more than 20 scholarships for women’s sports. (link)

Fresno State President Saúl Jiménez-Sandoval has approved a mandatory student fee increase that will generate around $11.4M per year and add $5M or more to the athletic department budget. Starting this fall, students will pay an additional $495 per year to fund academic and student support initiatives, as well as student life initiatives including the university’s athletics programs. Jiménez-Sandoval explained the university committed to maintaining a strong athletics program while reducing reliance on institutional support; “however, the financial landscape of college athletics continues to evolve, with rising costs driven by inflation, market demands, and evolving NCAA policies. University leadership will conduct annual evaluations of financial commitments, including direct institutional support, to ensure that athletics operates efficiently while aligning with broader institutional priorities. The focus remains on building a sustainable financial model that balances institutional investment with self-generated revenue to support the success of Fresno State student-athletes and the university as a whole.” (link)

NCAA lead counsel Rakesh Kilaru and House plaintiffs’ attorney Jeffrey Kessler join Tulane Sports Law Director Gabe Feldman to discuss the House settlement. Feldman asks how the settlement will prevent future lawsuits from student-athletes or collectives who argue the collectives should be allowed to pay athletes whatever they want and notes that in professional sports such lawsuits are forestalled by the nonstatutory labor exemption via collective bargaining. Kilaru responds: “I think if you look at the revenues that are being shared, the opportunities for legitimate third-party NIL transactions, I think the hope is that we've created something that's not going to incentivize a bunch of folks to come in and say the system isn't working. I think we wanted to create a system that does work.” Kilaru also submits that “one of the features of the settlement, part of that 10-year term, part of being able to say, ‘Hey, for the next 10 years we're going to have these rules be binding on student-athletes’ is giving them the opportunity to speak up. … Every year when new students enroll, they’ll get a notice that there’s this injunction…that lays out the following terms. And they’ll have the opportunity to come in and say to the judge, ‘I know you approved that before, but it’s not working for me.’” Ultimately, though, Kilaru admits that the “only way to really end those collateral attacks is for there to be some kind of congressional legislation.” Kessler adds that to successfully argue the cap should be higher, plaintiffs would have to prove the “competitive market here would generate more than 51% [of revenues to be shared with student-athletes when scholarships, health care and other benefits are factored in]. So, that’s not going to be so easy to do.” Overall, Kessler believes the deal is reasonable enough itself to discourage most cases. Kilaru goes on to minimize the concerns about players losing roster spots or sports being cut by pointing out that of the ~390K student-athletes, only nine “came in and said I think I actually lost a roster spot as a result of this settlement.” Full podcast. The U.S. District Court of Northern California has posted the list of individuals who will be arguing at the House settlement hearing, and Venable LLP Partner Philip Sheng provides a list of what topics each of the 13 attorneys will argue. Meanwhile, Judge Claudia Wilken has issued specific instructions about who can sit where in the courtroom. Colorado AD Rick George comments on how the Buffs are positioning themselves for a post-House landscape: “I’ve been saying that this is our moment in time; we have to grasp it. It’s challenging moving forward when you have to find $20.5 million in your budget to share. It’s not like it’s sitting around. So we’ve had to be thoughtful about how we can trim expenses, how we can grow our revenue. But we need support from the greater community, from the Boulder businesses, the Denver businesses, the economic impact that we’ve had on this state the last two years with Coach Prime here is off the charts…. We need that to be returned to us by getting support from these local businesses and in our fan base and our donors; that’s just the reality.” George also explains the decision to install a new AstroTurf RootZone 3D3 surface at Folsom Field: “When Judge Wilken makes a ruling in the middle of April, we’ve got to be ready for that. And so for us to be able to host events at that stadium, to increase our revenues, again, it’s going to increase the economic impact that we have in our city and our state. And so, I mean, it’s good for everybody. It’s just a decision that we needed to make. We’re confident in our decision. We’re going to have great turf.” (link)

They’re the ones that are reminding our student-athletes that they have a content shoot after practice, or before they get on the bus, or meeting them at the training table and making sure that they feel prepared and ready to go for their campaign engagement. The people power and the boots on the ground are critical to our success.” Portnoy also notes that SIDEARM Sports has tracked traffic increases during March Madness and found that Florida, Duke, Michigan, Wisconsin and St. John’s are the most-searched men’s basketball teams among websites SIDEARM powers, respectively. The most-searched for women’s teams are Connecticut, Tennessee, Ohio State, UCLA and USC, respectively. The most-searched men’s players are, in order, Creighton’s Steven Ashworth, Florida’s Olivier Rioux, Duke’s Spencer Hubbard and Cooper Flagg, Drake’s Bennett Stirtz and Michigan’s Vladislav Goldin. Kentucky Men’s Basketball HC Mark Pope notes that while the House settlement could be approved Monday, he’s prepared for it to take 7-10 days for U.S. District Judge Claudia Wilken to issue a ruling. “There’s no definite timeline. We’re just, in terms of that shift, we’re just in a wait-and-see mode, and then there’s all the complications of actually implementing the agreement and what that’s going to look like. It’s pretty exciting, man. Every day is something new.” Wilken’s approval (or rejection) will inform Pope’s decision on whether to pursue a permanent GM for the program, and he explains: “General managers are really interesting. Designating someone exclusively in that spot is a calculated decision that comes with all kinds of complications. Right now, we’re dealing with it in-house by dividing up those responsibilities. We’ll see. Like I said, the entire landscape of college basketball and college athletics could change on [April] 7. It could potentially send us on a brand new trajectory, or nothing could happen. We could continue down the road we are. I think staff and responsibilities change like that. Those decisions will become forthcoming after we get more clarity on what the world of college athletics is going to look like.” (link)

Dollars and Cents…
+ Memphis is asking fans to cover the Shelby County sales tax rate of 9.75% on all tickets and parking “as the department positions itself to navigate the rapidly evolving landscape of intercollegiate athletics.” The Tigers made the announcement as season tickets for football and men’s and women’s basketball go on sale for next season and added: “The department will not be adding any new fees for revenue-sharing. … The adjustment to the sales tax on all tickets and parking will allow Memphis athletics to better align financially with aspirational institutions that are currently charging or will be adding sales tax to their tickets.” Men's basketball ticket pricing will be restructured for the Club and Plaza Levels for a more affordable experience. Beginning in 2025-26 the north and south sides of the Terrace Level will be reduced by 3,649 seats as the curtain system inside FedExForum “will be utilized to create a more energetic atmosphere. The overall capacity for home games will now be 14,470 with the ability to open the curtains for games as ticket sales deem necessary.” (link)

Facility Features…
+ Toledo is installing a new FieldTurf CORE 2.5 playing surface at the Glass Bowl. Rockets AD Bryan Blair says of the multimillion-dollar project: “It’s a big deal. But it’s probably a bigger deal in terms of the message it sends in terms of how we’re continuing to invest in our facilities. People say, ‘Oh, well, you just get a new playing surface.’ You really have to look deeper than that. What does that mean for injury prevention? What does that mean for on-the-field performance? What does that mean to the look and feel of the Glass Bowl? The reality is, we don’t have a true practice field for our football program. I know that’s something [Football] Coach [Jason] Candle’s talked a lot about, and I’ve increasingly talked about in terms of our upcoming facility plan. That has to be a priority going forward when you’ve got 100-plus players and then another 40 or 50 staff members, and sleds, and everything else. It’s just actually not safe to practice with the full football team in that tiny footprint because you start running into each other, pass routes go awry, and you’re bumping into other players.” Fans will also notice some changes to the on-field branding, according to the Toledo Blade’s Kyle Rowland, who notes midfield will feature Toledo’s main rocket and all-caps “Toledo” script logo. The end zones will still say “Toledo” and “Rockets.” Window World Toledo logos adorned the 25-yard lines last season, a sponsorship that could extend into 2025. If not Window World, UT expects another company to sign a deal. (link)
+ Clemson will begin selling alcoholic beverages at athletic events beginning with this weekend’s spring football game. Sales at McWhorter Stadium (softball) and Doug Kingsmore Stadium (baseball) will be piloted beginning the week of April 7. Tigers AD Graham Neff: “We have appreciated the support from several key groups to begin a safe implementation that is both fan-friendly and family-friendly. Legal Matters…
+ Stanford recently cleared Men’s Water Polo HC Brian Flacks of allegations of abusive behavior but is now looking into reports of retaliation against his accusers, according to the San Francisco Chronicle’s Ann Killion. Flacks was investigated last fall after parents complained about his treatment of student-athletes. The university’s investigation “did not substantiate the claims that were raised,” but parents have since retained representation and allege that Flacks has been trying to rid the program of people who may have cooperated with the previous investigation. Justice Law Collaborative Partner Paula Bliss: “These families are extremely concerned about the mental health of their sons and their teammates as a result of the psychological and emotional trauma they’ve experienced under Coach Brian Flacks. Their sons have faced targeted retaliation by Coach Flacks following the close of the investigation. The University has shown a complete lack of regard towards its student athletes by failing to protect them. The fact that Stanford continues to allow this coach to be poolside amidst the serious and specific allegations is appalling, but unfortunately, not surprising given the university’s recent history.” (link)
+ Colorado Governor Jared Polis (D) has signed into law House Bill 1041, which allows colleges and universities to pay their student-athletes directly. The law also carves out the athletes’ contracts as exempt from the state open records law. In a signing statement, Polis said he supported the bill’s aims and keeping Colorado collegiate athletics competitive — but he had “concerns” about the exception. “While the bill’s exception is narrowly tailored, it follows an unfortunate trend of legislative proposals that ultimately impede access to official records that are arguably within the public’s interest to view. These exceptions move transparency in the wrong direction and any other proposals that further prevent or delay public access to information will be carefully reviewed.” Senator Judy Amabile (D-Boulder), who sponsored the legislation, explains the rationale for the exemption: “They’re not being paid with public money. They’re students, and students have protections, and we wanted to preserve that.” (link)
+ Two more lawsuits have been filed against Michigan, former Football AC Matt Weiss and third-party vendor Keffer Development Services. The first suit was filed by a current U-M student who’s “been active in the athletics program there since she enrolled” and alleges Weiss unlawfully obtained her personal information and the school failed to monitor its employee.
