NCAA lead counsel Rakesh Kilaru and House plaintiffs’ attorney Jeffrey Kessler join Tulane Sports Law Director Gabe Feldman to discuss the House settlement. Feldman asks how the settlement will prevent future lawsuits from student-athletes or collectives who argue the collectives should be allowed to pay athletes whatever they want and notes that in professional sports such lawsuits are forestalled by the nonstatutory labor exemption via collective bargaining. Kilaru responds: “I think if you look at the revenues that are being shared, the opportunities for legitimate third-party NIL transactions, I think the hope is that we've created something that's not going to incentivize a bunch of folks to come in and say the system isn't working. I think we wanted to create a system that does work.” Kilaru also submits that “one of the features of the settlement, part of that 10-year term, part of being able to say, ‘Hey, for the next 10 years we're going to have these rules be binding on student-athletes’ is giving them the opportunity to speak up. … Every year when new students enroll, they’ll get a notice that there’s this injunction…that lays out the following terms. And they’ll have the opportunity to come in and say to the judge, ‘I know you approved that before, but it’s not working for me.’” Ultimately, though, Kilaru admits that the “only way to really end those collateral attacks is for there to be some kind of congressional legislation.” Kessler adds that to successfully argue the cap should be higher, plaintiffs would have to prove the “competitive market here would generate more than 51% [of revenues to be shared with student-athletes when scholarships, health care and other benefits are factored in]. So, that’s not going to be so easy to do.” Overall, Kessler believes the deal is reasonable enough itself to discourage most cases. Kilaru goes on to minimize the concerns about players losing roster spots or sports being cut by pointing out that of the ~390K student-athletes, only nine “came in and said I think I actually lost a roster spot as a result of this settlement.” Full podcast. The U.S. District Court of Northern California has posted the list of individuals who will be arguing at the House settlement hearing, and Venable LLP Partner Philip Sheng provides a list of what topics each of the 13 attorneys will argue. Meanwhile, Judge Claudia Wilken has issued specific instructions about who can sit where in the courtroom. Conference Carolinas Commissioner Chris Colvin chats with D2 Baseball about the league’s use of KPI for conference tournament seeding, DII’s potential implementation of NPI and more. After implementing KPI as the seeding metric in Basketball, Soccer, Softball and Volleyball last year, the need for KPI in Baseball became apparent as the 13 members are playing 10 three-game conference series, enabling those who do not play a top team to gain an advantage via win-loss record. With new baseball members joining, the league schedule will grow to 11 three-game series and likely remain there to allow the “strength of our conference the ability to show itself through non-conference games.” Colvin and league ADs believe “this is the direction we need to go. We think we're going to potentially be on the front curve of this that's going to start happening with lots of conferences and happen nationally. Even if that's not the case, we believe it has served us well so far.” (link, link - KPI rankings)

Central Missouri rolls out its NIL collective, The Central Stable Collective, alongside a partnership with Opendorse, which will assist in building the collective’s infrastructure and an NIL marketplace. AD Matt Howdeshell: “For UCM to be competitive at the highest level of Division II, NIL support is required to retain and attract the best student-athletes. We have updated our giving model to reflect this need. While your direct support of our department, by joining the Cardinal & Black Fund, purchasing tickets, being a corporate partner and giving to sport-specific Excellence Funds remains critical to our growth and well-being, a strong NIL collective is also critical to providing opportunities for our student-athletes. […] All our head coaches agree that NIL opportunities through the Central Stable Collective are imperative for future success. We feel the need to adapt to the modern era of college athletics and align ourselves with the most competitive sector of NCAA Division II.” (link)

Swimming World’s Adam Denn chats with DII and DIII HCs about the impact their programs will see as a result of DI roster limits from the House settlement, with Nova Southeastern HC Ben Hewitt noting that the nature of conversations with prospective student-athletes has not changed. “We’ve been way busier than we normally are this time of year. The market has been flooded with kids reaching out in advance (of a potential lost roster spot).” Denison (DIII) HC Gregg Parini: “We need to make sure the student-athlete fits us athletically, socially, and academically. That’s always first priority. […] The financial decision definitely can make this level a more unique fit.” On the topic of competitiveness, Denn notes 11 DII records and 10 DIII records were broken at this year’s championships. Drury HC Brian Reynolds adds: “We’ve shown swimmers can improve and develop at this level and within our program. We’ve lost great programs in Division II over these last couple of years, and yet we keep getting faster. […] There’s an opportunity for some really great competitive swimming with some great programs. I’ve seen a lot of swimmers who could be really great performers at this level, if they took the option.” (link)

Fort Hays State led DII in Women’s Basketball average attendance with 2,084, followed by Northern State, Pittsburg State, Minnesota State and Drury. On the Men’s Basketball side, Washburn topped DII with an average of 2,229, followed by Fort Hays State, Minnesota State, Black Hills State and North Georgia. (link)

Rebar, structural steel, piping and ductwork are all facing price volatility due to expected tariffs from the Trump administration, according to Skanska USA Building EVP of Project Planning Steve Stouthamer. While reports indicate the Trump could roll back the ultimate scope of this action, contractors say just the threat of tariffs can have an immediate impact on material costs, according to Construction Dive’s Sebastian Obando, and Stouthamer tells him: “Steel prices have increased 15% to 25% since the beginning of January and aluminum is also up 8% to 10% from the beginning of January. The Trump administration has indicated Canadian lumber will be included in the reciprocal tariffs which are set to take effect on April 2. Lumber has already seen a significant increase, 10% to 15% in cost, in anticipation of this tariff.” Stouthamer also explains that “at present, we are not expecting a near-term impact on project timelines. If there is a considerable shift to onshoring manufacturing, supply chain schedules could be constrained, but this is not like the situation we experienced during the pandemic where the supply chains were impacted by global shutdowns. … Projects can benefit by investing additional time into the mapping of the specified materials for the project to determine their source, if those sources are impacted by tariffs and whether alternative products and sources could mitigate financial risk.” (link)
